{"id":619,"date":"2020-12-14T20:10:57","date_gmt":"2020-12-14T19:10:57","guid":{"rendered":"https:\/\/kriik.al\/home\/?p=619"},"modified":"2020-12-28T19:22:57","modified_gmt":"2020-12-28T18:22:57","slug":"opinion-mbi-projekt-udhezimin-per-percaktimin-e-rregullave-per-depozitimin-e-verifikimin-e-dokumentacionit-te-kandidimit-afatet-per-publikimin-e-listave-te-kandidateve-dhe-miratimin-e-modele","status":"publish","type":"post","link":"https:\/\/kriik.al\/home\/2020\/12\/14\/opinion-mbi-projekt-udhezimin-per-percaktimin-e-rregullave-per-depozitimin-e-verifikimin-e-dokumentacionit-te-kandidimit-afatet-per-publikimin-e-listave-te-kandidateve-dhe-miratimin-e-modele\/","title":{"rendered":"OPINION Mbi Projekt-udh\u00ebzimin \u201cP\u00ebr p\u00ebrcaktimin e rregullave p\u00ebr depozitimin e verifikimin e dokumentacionit t\u00eb kandidimit, afatet p\u00ebr publikimin e listave t\u00eb kandidat\u00ebve dhe miratimin e modeleve t\u00eb kandidimit\u201d"},"content":{"rendered":"\n<p>Koalicioni p\u00ebr Reforma Integrim dhe Institucione t\u00eb\nKonsoliduara (KRIIK Albania) p\u00ebrcjell\nopinionin e tij mbi projekt-udh\u00ebzimin <em>\u201cP\u00ebr p\u00ebrcaktimin e rregullave p\u00ebr\ndepozitimin e verifikimin e dokumentacionit t\u00eb kandidimit, afatet p\u00ebr\npublikimin e listave t\u00eb kandidat\u00ebve dhe miratimin e modeleve t\u00eb kandidimit\u201d <\/em>duke\nsjell\u00eb n\u00eb v\u00ebmendje n\u00eb rradh\u00eb t\u00eb par\u00eb se partit\u00eb politike jan\u00eb subjekte juridike\nt\u00eb cilat manifestojn\u00eb \u201cbashkime vullnetare t\u00eb shtetasve mbi baz\u00ebn e ideve, t\u00eb\nbindjeve e t\u00eb pik\u00ebpamjeve ose t\u00eb interesave t\u00eb p\u00ebrbashk\u00ebt politik\u00eb, t\u00eb cil\u00ebt\nsynojn\u00eb t\u00eb ndikojn\u00eb n\u00eb jet\u00ebn e vendit n\u00ebp\u00ebrmjet pjes\u00ebmarrjes n\u00eb zgjedhjet dhe\np\u00ebrfaq\u00ebsimit t\u00eb popullit n\u00eb organet e zgjedhura t\u00eb pushtetit<a href=\"#_ftn1\">[1]<\/a>\u201d. <\/p>\n\n\n\n<p>Si t\u00eb\ntilla, ato synojn\u00eb t\u00eb marrin dhe ushtrojn\u00eb n\u00ebp\u00ebrmjet p\u00ebrfaq\u00ebsuesve t\u00eb vet\u00eb p\u00ebrgjegj\u00ebsi\npublike, duke ndikuar n\u00eb form\u00ebsimin e vullnetit politik t\u00eb popullit n\u00eb t\u00eb\ngjitha fushat e jet\u00ebs publike<a href=\"#_ftn2\">[2]<\/a>, duke ndikuar\ndrejt\u00ebp\u00ebrs\u00ebdrejt\u00eb n\u00eb cil\u00ebsin\u00eb e mir\u00ebfunksionimit t\u00eb sistemit demokratik,\nshtetit ligjor e t\u00eb s\u00eb drejt\u00ebs. <\/p>\n\n\n\n<p>Funksionimi\ndhe organizimi i partive politike n\u00eb p\u00ebrputhje me parimet demokratike p\u00ebrb\u00ebn nj\u00eb\ndetyrim kushtetues, nd\u00ebrkoh\u00eb q\u00eb mbetet thelb\u00ebsore sjellja e tyre n\u00eb p\u00ebrputhje t\u00eb\nplot\u00eb me detyrimet ligjore t\u00eb parashikuara prej legjislacionit n\u00eb fuqi.\nDetyrime q\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e tyre jan\u00eb minimaliste n\u00eb krahasim me detyrimet me t\u00eb\ncilat p\u00ebrballen t\u00eb gjitha subjektet juridike apo edhe organizatat e tjera\npolitike ose jo n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb.<\/p>\n\n\n\n<p>Eksperienca\njo pozitive e deritanishme n\u00eb k\u00ebt\u00eb drejtim, e konsideruar prej KRIIK si nj\u00eb\nsjellje q\u00eb nxit apo edhe p\u00ebrb\u00ebn burimin e paligjshm\u00ebris\u00eb e pand\u00ebshkueshm\u00ebris\u00eb,\ngjykohet se duhet t\u00eb merret me shum\u00eb seriozitet n\u00eb konsiderat\u00eb nga KQZ-ja.<\/p>\n\n\n\n<p>N\u00eb\nkoherenc\u00eb me vullnetin e shprehur dhe n\u00ebn aspirat\u00ebn e marr\u00ebveshjes s\u00eb 5\nqershorit, KQZ-ja nevojitet t\u00eb adresoj\u00eb k\u00ebt\u00eb problematik\u00eb brenda hap\u00ebsirave q\u00eb\nlejon ligji si nj\u00eb reflektim i zgjeruar i detyrimeve ligjore t\u00eb parashikuara\ndhe i p\u00ebrvoj\u00ebs s\u00eb m\u00ebparshme problematike t\u00eb evidentuar.<\/p>\n\n\n\n<p>Duke\ntheksuar nevoj\u00ebn p\u00ebr transparenc\u00eb maksimale dhe informacion t\u00eb plot\u00eb ndaj\nvotuesit e publikut t\u00eb gjer\u00eb p\u00ebr t\u00eb gjith\u00eb subjektet dhe kandidat\u00ebt garues n\u00eb\nprocesin zgjedhor, sugjerimet e m\u00ebposhtme t\u00eb KRIIK jan\u00eb strukturuar n\u00eb tre\npjes\u00eb, n\u00eb logjik\u00ebn e tre kategorive t\u00eb subjekteve zgjedhore: <\/p>\n\n\n\n<p>&#8211; regjistrimi i kandidat\u00ebve;&nbsp; <\/p>\n\n\n\n<p>&#8211; kandidat\u00ebt e pavarur &nbsp;<em>dhe <\/em><\/p>\n\n\n\n<p>&#8211; partit\u00eb ose koalicionet.<\/p>\n\n\n\n<p><strong>N\u00eb nj\u00eb konsiderat\u00eb t\u00eb p\u00ebrgjithshme<\/strong> mbi\nt\u00ebr\u00eb procedurat e regjistrimit t\u00eb subjekteve zgjedhore, KRIIK parashtron\nnevoj\u00ebn e <strong>shoq\u00ebrimit t\u00eb t\u00eb gjith\u00eb dokumentacionit shkresor edhe me versionin\nelektronik t\u00eb tyre<\/strong>, pra n\u00eb formatin <em>word<\/em>, <em>excel<\/em> ose <em>pdf<\/em>\ndhe jo n\u00eb formatin <em>image<\/em>. <\/p>\n\n\n\n<p>K\u00ebto\nformate sugjerohen si m\u00eb t\u00eb p\u00ebrshtatshme p\u00ebr t\u2019u p\u00ebrdorur, duke ofruar leht\u00ebsi\nn\u00eb pun\u00ebn e administrat\u00ebs s\u00eb KQZ-s\u00eb, por nga ana tjet\u00ebr ofrojn\u00eb edhe mund\u00ebsin\u00eb e\np\u00ebrpunimit leht\u00ebsisht t\u00eb t\u00eb dh\u00ebnave q\u00eb ato p\u00ebrmbajn\u00eb. <\/p>\n\n\n\n<p>Gjithashtu,\nlidhur me dokumentacionin tip t\u00eb propozuar nga KQZ-ja p\u00ebr t\u2019u plot\u00ebsuar, sugjerohet\nq\u00eb <strong>t\u00eb vendoset si kriter i domosdosh\u00ebm plot\u00ebsimi i tyre me kompjuter<\/strong>,\nduke shmangur gabimet apo pasakt\u00ebsit\u00eb q\u00eb mund t\u00eb vijn\u00eb edhe n\u00eb rastet kur ato\njan\u00eb plot\u00ebsuar me g\u00ebrma dore kapitale.<\/p>\n\n\n\n<p>Gjykohet\nse <strong>depozitimi i versionit elektronik dhe plot\u00ebsimi n\u00eb version elektronik i\ndokumentacionit t\u00eb k\u00ebrkuar<\/strong>, ndihmon n\u00eb pun\u00ebn e administrat\u00ebs, si n\u00eb sakt\u00ebsi\ndhe n\u00eb leht\u00ebsim t\u00eb p\u00ebrpunimit t\u00eb t\u00eb dh\u00ebnave. Gjithashtu, ndihmon edhe n\u00eb pun\u00ebn\ne organizatave monitoruese, medias apo mund t\u00eb p\u00ebrdoret leht\u00ebsisht p\u00ebr q\u00ebllime\nt\u00eb tjera k\u00ebrkimore apo dokumentuese. <\/p>\n\n\n\n<p>N\u00eb\ngjykimin e KRIIK, k\u00ebto dy kritere nuk p\u00ebrb\u00ebjn\u00eb nj\u00eb barr\u00eb penguese ose jo-proporcionale\nq\u00eb mund t\u00eb c\u00ebnoj\u00eb t\u00eb drejt\u00ebn p\u00ebr t\u2019u kandiduar t\u00eb subjekteve apo kandidat\u00ebve.<\/p>\n\n\n\n<p>N\u00eb\nt\u00eb dyja nga rastet, sugjerohet q\u00eb KQZ-ja t\u2019a refuzoj\u00eb dhe t\u00eb k\u00ebrkoj\u00eb plot\u00ebsimin\ne dokumentacionit kur nuk respektohet k\u00ebrkesa formale. &nbsp;<\/p>\n\n\n\n<p>N\u00eb\nk\u00ebt\u00eb vazhd\u00eb, n\u00ebse subjektet apo kandidat\u00ebt nuk arrijn\u00eb t\u00eb depozitojn\u00eb\ndokumentacionin n\u00eb formatin elektronik, pas dy her\u00ebve kthim p\u00ebr plot\u00ebsim\ndokumentacioni, <strong>sugjerohet t\u00eb nd\u00ebrmerret penaliteti i refuzimit t\u00eb\nregjistrimit<\/strong>.<\/p>\n\n\n\n<p><strong>a. Regjistrimi i kandidat\u00ebve<\/strong><\/p>\n\n\n\n<p>P\u00ebrsa\ni p\u00ebrket dokumentacionit p\u00ebr kandidat\u00ebt e listave shum\u00ebem\u00ebrore t\u00eb partive\npolitike, n\u00eb p\u00ebrputhje me Kodin Zgjedhor, udh\u00ebzimi paraqet nj\u00eb t\u00ebr\u00ebsi\ndokumentacioni<a href=\"#_ftn3\">[3]<\/a>.\n<\/p>\n\n\n\n<p>KRIIK\nshpreh nj\u00eb sugjerim n\u00eb lidhje me projekt-udh\u00ebzimin p\u00ebrsa i p\u00ebrket Modelit Nr.\n7, pra modelit t\u00eb jet\u00ebshkrimit t\u00eb kandidatit. <\/p>\n\n\n\n<p><strong>Sugjerohet nj\u00eb format m\u00eb i detajuar i jet\u00ebshkrimit t\u00eb kandidat\u00ebve<\/strong>, i cili t\u00eb ofroj\u00eb nj\u00eb informacion m\u00eb t\u00eb plot\u00eb dhe t\u00eb\ndetajuar mbi kandidatin.<\/p>\n\n\n\n<p>Formati\naktual mbart 5 element\u00eb mbi gjeneralitetet e kandidat\u00ebve dhe 4 element\u00eb mbi\njet\u00ebshkrimin. <\/p>\n\n\n\n<p>Ky\nformat n\u00eb vetvete dhe p\u00ebrvoja e evidentuar, u l\u00eb mund\u00ebsi kandidat\u00ebve t\u00eb\nshmangen nga detyrimi p\u00ebr t\u00eb ofruar transparenc\u00eb t\u00eb plot\u00eb mbi edukimin,\nformimin, angazhimin dhe t\u00eb shkuar\u00ebn e tyre. <\/p>\n\n\n\n<p>P\u00ebr\nk\u00ebt\u00eb arsye organizata sugjeron q\u00eb n\u00eb Modelin e jet\u00ebshkrimit t\u00eb shtohen n\u00eb m\u00ebnyr\u00eb\nt\u00eb detajuar disa element\u00eb t\u00eb domosdosh\u00ebm p\u00ebr t\u2019u informuar mbi profilin e\nkandidatit dhe q\u00eb duhet t\u00eb vihen n\u00eb format p\u00ebr tu plot\u00ebsuar n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb\nimponojn\u00eb plot\u00ebsimin e tyre prej kandidat\u00ebve, si m\u00eb posht\u00eb vijon:<\/p>\n\n\n\n<p><em>i. Aktivitete, angazhime, kontribute apo eksperienca t\u00eb\ntjera (p\u00ebr t\u2019u plot\u00ebsuar sipas d\u00ebshir\u00ebs s\u00eb kandidatit)<\/em><\/p>\n\n\n\n<p>Me\nndryshimet e fundit ligjore, kandidat\u00ebt q\u00eb planifikojn\u00eb t\u00eb pranojn\u00eb dhurime t\u00eb\nfondeve jopublike mbi vler\u00ebn 50,000 Lek\u00eb p\u00ebr fushat\u00ebn e tyre zgjedhore, do t\u00eb duhet\nt\u00eb hapin llogari t\u00eb posa\u00e7me bankare p\u00ebr pranimin e tyre. <\/p>\n\n\n\n<p>P\u00ebr\nshkak se kjo rrethan\u00eb v\u00ebrtet mund t\u00eb jet\u00eb eventuale, nisur edhe nga ndryshimi\nligjor mbi listat e hapura \u00e7ka nxit konkurrimin edhe midis kandidat\u00ebve t\u00eb t\u00eb nj\u00ebjtit\nsubjekt zgjedhor, p\u00ebr logjik\u00eb mir\u00eb administrimi do t\u00eb duhet q\u00eb llogaria bankare\nt\u00eb jet\u00eb e hapur paraprakisht. <\/p>\n\n\n\n<p>Nxitet\nKQZ-ja q\u00eb <strong>n\u00eb momentin e regjistrimit s\u00eb bashku me dokumentat e regjistrimit\nt\u00eb kandidat\u00ebve t\u00eb shtoj\u00eb dhe p\u00ebrfshij\u00eb edhe deklarimin prej kandidatit<a href=\"#_ftn4\"><strong>[4]<\/strong><\/a>\nt\u00eb llogaris\u00eb s\u00eb posa\u00e7me bankare<\/strong> q\u00eb do t\u00eb p\u00ebrdoret p\u00ebr pranimin e dhurimeve\nt\u00eb mundshme t\u00eb fondeve jopublike p\u00ebr fushat\u00ebn e tij elektorale. &nbsp;<\/p>\n\n\n\n<p>N\u00eb\nrast t\u00eb kund\u00ebrt, mungesa e llogaris\u00eb mund t\u00eb penalizoj\u00eb vet\u00eb kandidatin p\u00ebrgjat\u00eb\nfushat\u00ebs, nd\u00ebrkoh\u00eb q\u00eb mund t\u00eb krijoj\u00eb hap\u00ebsira p\u00ebr shkeljen e rregullimit\nligjor mbi financimin e fushat\u00ebs. <\/p>\n\n\n\n<p>Ky\nsugjerim p\u00ebrforcohet akoma m\u00eb shum\u00eb nga eksperienca aspak pozitive e publikimit\nt\u00eb llogarive prej subjekteve zgjedhore n\u00eb proceset zgjedhore t\u00eb m\u00ebparshme.<\/p>\n\n\n\n<p><strong>b. Kandidat\u00ebt e pavarur<\/strong><\/p>\n\n\n\n<p>Kodi\nZgjedhor shprehet se verifikimi i n\u00ebnshkrimeve p\u00ebr zgjedhjet p\u00ebr Kuvendin\nkryhet nga administrata e KQZ-s\u00eb\/KZAZ-s\u00eb<a href=\"#_ftn5\">[5]<\/a>. &nbsp;Nj\u00eb tag\u00ebr q\u00eb \u00ebsht\u00eb i paqart\u00eb procedurialisht,\nduke qen\u00eb se institucioni nuk mbart ekspertiz\u00eb t\u00eb ve\u00e7ant\u00eb n\u00eb k\u00ebt\u00eb drejtim, dhe\np\u00ebr t\u00eb cilin n\u00eb vijim\u00ebsi misionet e OSBE-ODIHR dhe t\u00eb tjer\u00eb e kan\u00eb ngritur si\nproblematik\u00eb.<\/p>\n\n\n\n<p>Nga\nana tjet\u00ebr, sjellim n\u00eb v\u00ebmendje se Kodi Zgjedhor nuk e kufizon t\u00eb drejt\u00ebn e\nn\u00ebnshkrimit mb\u00ebshtet\u00ebs p\u00ebr nj\u00eb apo m\u00eb shum\u00eb kandidat\u00eb.<\/p>\n\n\n\n<p>KRIIK\nsugjeron q\u00eb udh\u00ebzimi q\u00eb do t\u00eb miratohet n\u00eb vazhdim nga KQZ-ja p\u00ebr procedur\u00ebn e\nverifikimit t\u00eb n\u00ebnshkrimeve, <strong>t\u00eb parashikoj\u00eb dhe rregulloj\u00eb pun\u00ebn e\nadministrat\u00ebs s\u00eb institucionit<\/strong> <strong>vet\u00ebm p\u00ebr verifikimin formal t\u00eb\ndokumentacionit p\u00ebr n\u00ebnshkrimet mb\u00ebshtet\u00ebse<\/strong>.<\/p>\n\n\n\n<p>K\u00ebsisoj\nadministrata e KQZ-s\u00eb t\u00eb verifikoj\u00eb n\u00ebse ka mang\u00ebsi dokumentesh apo gabime\nmateriale n\u00eb informacionin e p\u00ebrcjell\u00eb.<\/p>\n\n\n\n<p>Nd\u00ebrsa\np\u00ebrsa i p\u00ebrket <strong>origjinalitetit t\u00eb firmave dhe plot\u00ebsis\u00eb s\u00eb vullnetit<\/strong> t\u00eb\ndh\u00ebn\u00eb nga qytetar\u00ebt, <strong>sugjerohet q\u00eb KQZ-ja t\u00eb shtoj\u00eb dhe miratoj\u00eb nj\u00eb Deklarat\u00eb\np\u00ebrgjegj\u00ebsie <\/strong>p\u00ebr qytetar\u00ebt dhe grupet nism\u00ebtare. <\/p>\n\n\n\n<p>K\u00ebto\ndeklarata t\u00eb p\u00ebrcaktojn\u00eb se cili do jet\u00eb individi p\u00ebrgjegj\u00ebs penalisht n\u00eb\nrastet e pretendimeve p\u00ebr n\u00ebnshkrime t\u00eb rreme.<\/p>\n\n\n\n<p>N\u00eb\nfrym\u00ebn e k\u00ebtyre rekomandimeve, sugjerohet q\u00eb <strong>listat e qytetar\u00ebve mb\u00ebshtet\u00ebs\nt\u00eb depozitohen n\u00eb format elektronik t\u00eb formatit <em>excel<\/em>, si dhe t\u00eb jen\u00eb\npublike<\/strong> n\u00eb faqen e internetit t\u00eb KQZ-s\u00eb. <\/p>\n\n\n\n<p>N\u00eb\nk\u00ebt\u00eb m\u00ebnyr\u00eb, p\u00ebr rastet kur qytetar\u00ebt do t\u00eb ken\u00eb pretendime p\u00ebr origjinalitetin\ne firmave apo rezerva p\u00ebr mb\u00ebshtetjen e dh\u00ebn\u00eb p\u00ebr kandidaturat t\u00eb mund t\u00eb\nparaqesin ankimime. <\/p>\n\n\n\n<p>M\u00eb\npas le t\u00eb jet\u00eb puna investiguese e Prokuris\u00eb q\u00eb t\u00eb konkludoj\u00eb p\u00ebr rrethanat.<\/p>\n\n\n\n<p>P\u00ebrsa\ni p\u00ebrket publicitetit t\u00eb personave q\u00eb japin n\u00ebshkrimet mb\u00ebshtet\u00ebse, KRIIK i\nnjeh rezervat q\u00eb mund t\u00eb mbartt\u00eb ky sugjerim n\u00eb raport me privat\u00ebsin\u00eb. <\/p>\n\n\n\n<p>Megjithat\u00eb\nn\u00eb analiz\u00ebn e tij, KRIIK argumenton k\u00ebt\u00eb sugjerim me faktin q\u00eb legjislatori nuk\nka vendosur kufizim ndaj qytetar\u00ebve p\u00ebr numrin e kandidat\u00ebve q\u00eb mund t\u00eb\nmb\u00ebshtesin, nd\u00ebrkoh\u00eb q\u00eb nga ana tjet\u00ebr mund\u00ebsia p\u00ebr verifikimin e n\u00ebnshkrimeve\n\u00ebsht\u00eb vet\u00ebm e qytetar\u00ebve. <\/p>\n\n\n\n<p>P\u00ebrball\u00eb\nk\u00ebtyre dy rrethanave, pa publikimin e emrave t\u00eb individ\u00ebve mb\u00ebshtet\u00ebs mekanizmi\n\u00ebsht\u00eb t\u00ebr\u00ebsisht i c\u00ebnuesh\u00ebm duke mos qen\u00eb transparent. <\/p>\n\n\n\n<p>P\u00ebrvoja\ne ka provuar k\u00ebt\u00eb rrethan\u00eb dhe sesi diskrecionaliteti i KQZ-s\u00eb ua ka\npamund\u00ebsuar regjistrimin disa kandidat\u00ebve n\u00eb proceset e m\u00ebparshme zgjedhore. <\/p>\n\n\n\n<p>Lidhur\nme firmat mb\u00ebshtet\u00ebse n\u00eb t\u00ebr\u00ebsi dhe ve\u00e7an\u00ebrisht ato n\u00eb mb\u00ebshtetje t\u00eb kandidat\u00ebve\nt\u00eb pavarur, KRIIK sugjeron q\u00eb <strong>projekt-udh\u00ebzimi t\u00eb parashikoj\u00eb specifikimin e\ndh\u00ebnies s\u00eb n\u00ebnshkrimeve mb\u00ebshtet\u00ebse edhe prej personave me pamund\u00ebsi n\u00eb shikim\napo me aft\u00ebsi ndryshe<\/strong>. <\/p>\n\n\n\n<p>N\u00eb\nrastin kur n\u00ebnshkrimi prej k\u00ebtyre personave \u00ebsht\u00eb i pamundur t\u00eb hidhet vet\u00eb, at\u00ebher\u00eb\n\u00ebsht\u00eb me r\u00ebnd\u00ebsi q\u00eb vullneti i tyre t\u00eb mos kufizohet n\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb, por t\u00eb\nparashikohet q\u00eb n\u00eb list\u00ebn e n\u00ebnshkrimeve, n\u00eb em\u00ebr t\u00eb tyre t\u00eb firmosin persona t\u00eb\ntret\u00eb, bashk\u00ebshoq\u00ebruar kjo me nj\u00eb deklarat\u00eb ku t\u00eb specifikohet vullneti i\ndeleguar n\u00eb prezenc\u00eb t\u00eb personit me aft\u00ebsi ndryshe.<\/p>\n\n\n\n<p><strong>c. Partit\u00eb ose koalicionet<\/strong><\/p>\n\n\n\n<p>P\u00ebrsa\ni p\u00ebrket regjistrimit t\u00eb partive ose koalicioneve, KRIIK nxit nj\u00eb perspektiv\u00eb\nn\u00eb projekt-udh\u00ebzimin n\u00eb fjal\u00eb. Kufizimet dhe k\u00ebrkesat q\u00eb vendos Kodi Zgjedhor\njan\u00eb n\u00eb rrafshin e procesit zgjedhor. <\/p>\n\n\n\n<p>Megjithat\u00eb,\nsikurse u soll n\u00eb v\u00ebmendje edhe n\u00eb hyrje t\u00eb k\u00ebtij Opinioni, partit\u00eb politike\nmbartin detyrime ligjore p\u00ebrtej procesit zgjedhor, ku p\u00ebr disa prej tyre, psh.\nn\u00eb aspektin financiar, KQZ-ja \u00ebsht\u00eb e ngarkuar p\u00ebr kontroll. <\/p>\n\n\n\n<p>N\u00eb\nk\u00ebt\u00eb perspektiv\u00eb, nxitet q\u00eb <strong>regjistrimi i partive politike si subjekte\nzgjedhore t\u00eb mbaj\u00eb parasysh dhe detyrimet e tjera ligjore t\u00eb partive politike<\/strong>.\n<\/p>\n\n\n\n<p>N\u00ebse\nnj\u00eb parti politike nuk ka respektuar detyrimin kushtetues e ligjor t\u00eb\nfunksionimit t\u00eb saj n\u00eb m\u00ebnyr\u00eb demokratike, duke zgjedhur n\u00eb m\u00ebnyr\u00eb periodike\norganet drejtuese, sipas organizimit dhe periodicitetit t\u00eb p\u00ebrcaktuar n\u00eb\nstatutin e vet, at\u00ebher\u00eb ajo parti nuk mbart legjitimitet si subjekt zgjedhor. <\/p>\n\n\n\n<p>Nga\nana tjet\u00ebr si subjekt juridik, p\u00ebr m\u00eb tep\u00ebr si nj\u00eb subjekt i predispozuar p\u00ebr t\u00eb\nkryer veprimtari dhe transaksione financiare, partia politike mbart detyrimin t\u00eb\nregjistrohet n\u00eb organin tatimor dhe t\u00eb pajiset me NIPT, numri i t\u00eb cilit duhet\nt\u00eb p\u00ebrdoret n\u00eb faturat tatimore t\u00eb blerjeve apo shitjeve sipas rregullimeve t\u00eb\nlegjislacionit tatimor.<\/p>\n\n\n\n<p>N\u00eb referim\nt\u00eb detyrimeve ligjore t\u00eb p\u00ebrmendura m\u00eb lart, p\u00ebr t\u00eb siguruar ligjzbatimin edhe\nprej partive politike, e rrjedhimisht edhe legjitimitetin e tyre p\u00ebr t\u2019u b\u00ebr\u00eb\npjes\u00eb e gar\u00ebs zgjedhore p\u00ebr t\u00eb marr\u00eb p\u00ebrsip\u00ebr p\u00ebrgjegj\u00ebsi publike apo vullnet p\u00ebrfaq\u00ebsues\npopullor,&nbsp; <strong>\u00ebsht\u00eb e nevojshme q\u00eb\npartit\u00eb politike<\/strong> n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb regjistrohen si subjekte zgjedhor\u00eb <strong>t\u00eb\ndepozitojn\u00eb edhe dokumentacionin shtes\u00eb si vijon<\/strong>, p\u00ebrpos atyre t\u00eb\nparashikuara n\u00eb projekt-udh\u00ebzim:<\/p>\n\n\n\n<p>i. V\u00ebrtetimin nga Gjykata e Rrethit Tiran\u00eb p\u00ebr Asamblen\u00eb e\nP\u00ebrgjithshme t\u00eb fundit t\u00eb kryer prej partis\u00eb politike;<\/p>\n\n\n\n<p>ii. Deklarimin nga partia politike mbi pasjen ose jo t\u00eb\ndeyrimeve financiare ndaj institucioneve publike ose privat\u00ebve.<\/p>\n\n\n\n<p>Ky\ndokumentacion shtes\u00eb i sugjeruar nuk vjen vet\u00ebm duke u bazuar n\u00eb ligjshm\u00ebrin\u00eb n\u00eb\nt\u00eb cil\u00ebn partit\u00eb politike gjenden. <\/p>\n\n\n\n<p>K\u00ebto\nsugjerime mb\u00ebshteten n\u00eb p\u00ebrvoj\u00ebn monitoruese shum\u00eb vje\u00e7are t\u00eb KRIIK, ku gjetjet\nm\u00eb t\u00eb fundit jan\u00eb trajtuar n\u00eb Raportin p\u00ebr zgjedhjet e vitit 2019-t\u00eb<a href=\"#_ftn7\">[7]<\/a>, por edhe n\u00eb\npun\u00ebn k\u00ebrkimore n\u00eb Regjistrin e Partive Politike. <\/p>\n\n\n\n<p>P\u00ebrmendet\nk\u00ebtu si fenomen ekzistenca e partive politike t\u00eb cilat <strong>nuk kan\u00eb p\u00ebrmbushur prej\nshum\u00eb vitesh detyrimin statutor p\u00ebr mbledhje dhe vendimmarrje<\/strong> t\u00eb Asambles\u00eb\ns\u00eb P\u00ebrgjithshme t\u00eb tyre<a href=\"#_ftn8\">[8]<\/a>. <\/p>\n\n\n\n<p>Gjithashtu,\nlegjitimiteti i p\u00ebrfaq\u00ebsuesit ligjor t\u00eb partis\u00eb politike dhe kryerja e\nveprimeve dhe transaksioneve bankare mbi baz\u00ebn e dokumentacioneve q\u00eb ndodhen\nbrenda afatit t\u00eb vlefshm\u00ebris\u00eb s\u00eb tyre, jan\u00eb kritere q\u00eb p\u00ebrcakton edhe Ligji <em>\u201cP\u00ebr\nparandalimin e pastrimit t\u00eb parave dhe financimit t\u00eb terrorizmit\u201d<\/em> si dhe\nRregullorja e Bank\u00ebs s\u00eb Shqip\u00ebris\u00eb <em>\u201cP\u00ebr parandalimin e pastrimit t\u00eb parave\ndhe financimit t\u00eb terrorizmit\u201d<a href=\"#_ftn9\"><strong>[9]<\/strong><\/a><\/em>.<\/p>\n\n\n\n<p>P\u00ebrsa\ni p\u00ebrket k\u00ebrkes\u00ebs p\u00ebr depozitimin e kopjes s\u00eb NIPT-it, b\u00ebhet me dije se gjat\u00eb\nzgjedhjeve t\u00eb kaluara jan\u00eb evidentuar parti ku llogarit\u00eb bankare nuk jan\u00eb hapur\nme NIPT-in p\u00ebrkat\u00ebs dhe n\u00eb em\u00ebr t\u00eb partis\u00eb politike, si dhe veprimtaria\nfinanciare (blerjet) nuk jan\u00eb b\u00ebr\u00eb duke sh\u00ebnuar n\u00eb fatur\u00eb numrin e NIPT t\u00eb\npartis\u00eb respektive politike<a href=\"#_ftn10\">[10]<\/a>. Apo edhe raste\nkur jan\u00eb evidentuar parti politike q\u00eb nuk kan\u00eb patur fare NIPT<a href=\"#_ftn11\">[11]<\/a>.<\/p>\n\n\n\n<p>N\u00eb\nfund b\u00ebhet me dije se nj\u00eb p\u00ebrfitim tjet\u00ebr i r\u00ebnd\u00ebsish\u00ebm nd\u00ebrsa respektohen\nqartazi formalitetet ligjore, &nbsp;\u00ebsht\u00eb\nkontrolli dhe frenimi i partive politike \u201cfiktive\u201d. &nbsp;K\u00ebto parti politike jo vet\u00ebm q\u00eb jan\u00eb nj\u00eb barr\u00eb\nq\u00eb r\u00ebndojn\u00eb s\u00eb tep\u00ebrmi n\u00eb mekanizmin e kontrollit financiar, por mund t\u00eb p\u00ebrb\u00ebjn\u00eb\nnj\u00eb k\u00ebrc\u00ebnim edhe ndaj zbatimit t\u00eb sistemeve t\u00eb teknologjis\u00eb n\u00eb proceset\nzgjedhore.
