mbi zgjedhjet"},"content":{"rendered":"\n<p><strong>D E K L A R A\nT \u00cb<\/strong><\/p>\n\n\n\n<p>Marr\u00ebveshjet politike t\u00eb 14 Janarit dhe 5 Qershorit 2020\nmes aktor\u00ebve politik\u00eb<a href=\"#_edn1\">[i]<\/a>\np\u00ebrfaq\u00ebsues t\u00eb vullnetit popullor t\u00eb mandatuar nga procesi zgjedhor parlamentar\ni vitit 2017, n\u00eb kontekstin e gjendur, mor\u00ebn p\u00ebrg\u00ebzimin dhe mb\u00ebshtetjen e\naktor\u00ebve t\u00eb brendsh\u00ebm dhe partner\u00ebve t\u00eb huaj, ndon\u00ebse n\u00eb vetvete ishin\nmanifesim i nj\u00eb sjellje extra-institucionale, jo transparente, jo\ngjith\u00ebp\u00ebrfshir\u00ebse dhe q\u00eb nuk siguronte nj\u00eb adresim t\u00eb plot\u00eb t\u00eb problematikave\nt\u00eb duhura. <\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb, t\u00ebr\u00eb dimensionet e nj\u00eb procesi reformues t\u00eb nj\u00eb realiteti\ndemokratik dhe institucional, u b\u00ebn\u00eb nul n\u00eb funksion t\u00eb nj\u00eb q\u00ebllimi madhor q\u00eb\nishte ai i <strong>pranimit t\u00eb procesit zgjedhor t\u00eb ardhsh\u00ebm nga t\u00eb gjith\u00eb pal\u00ebt, si\ndhe ai i rikthimit t\u00eb jet\u00ebs parlamentare n\u00eb normalitetin demokratik<\/strong>. <\/p>\n\n\n\n<p>Pa u miratuar ende\namendimet e Kodit Zgjedhor sipas Marr\u00ebveshjes s\u00eb 5 Qershorit 2020 t\u00eb K\u00ebshillit\nPolitik, rrjedha legjislative, n\u00ebn drejtimin e mazhoranc\u00ebs socialiste, mori nj\u00eb\nkurs t\u00eb dyt\u00eb amendues t\u00eb papritur dhe n\u00eb shkelje t\u00eb ligjit, sikurse KRIIK e ka\nshprehur m\u00eb par\u00eb n\u00eb Dokumentin<a href=\"#_edn2\">[ii]<\/a>\ne publikuar m\u00eb dat\u00eb 17 Korrik 2020.<\/p>\n\n\n\n<p>Mazhoranca socialiste\ndhe opozita parlamentare nd\u00ebrmor\u00ebn n\u00eb Kuvendin e Shqip\u00ebris\u00eb nj\u00eb amendim\nkushtetues mbi \u00e7\u00ebshtjet zgjedhore, n\u00eb kund\u00ebrshtim me vullnetin e shprehur n\u00eb\nmarr\u00ebveshjen e 5 qershorit dhe pa siguruar dakord\u00ebsin\u00eb e opozit\u00ebs\njasht\u00ebparlamentare. <\/p>\n\n\n\n<p>Ndryshimi kushtetues\ni miratuar n\u00eb dat\u00ebn 30 korrik 2020<a href=\"#_edn3\">[iii]<\/a>\nu ndoq m\u00eb pas nga nj\u00eb tjet\u00ebr paket\u00eb amenduese e Kodit Zgjedhor, s\u00ebrish pa\ndakord\u00ebsin\u00eb e opozit\u00ebs jasht\u00ebparlamentare. <\/p>\n\n\n\n<p>Paketa amenduese, e cila n\u00eb thelb ishte e ndryshme dhe tejkaloi frym\u00ebn e\npropaganduar prej mazhoranc\u00ebs socialiste gjat\u00eb nd\u00ebrmarrjes s\u00eb nj\u00ebanshme t\u00eb\nndryshimeve kushtetuese, u miratua m\u00eb dat\u00ebn 5 tetor 2020 n\u00eb Kuvendin e\nShqip\u00ebris\u00eb<a href=\"#_edn4\">[iv]<\/a>.\n<\/p>\n\n\n\n<p>Ky amendim i dyt\u00eb i Kodit Zgjedhor, me Dekret t\u00eb Presidentit t\u00eb Republik\u00ebs\nt\u00eb dat\u00ebs 23 tetor 2020, iu kthye p\u00ebr rishqyrtim Kuvendit t\u00eb Shqip\u00ebris\u00eb me nj\u00eb\narsyetim t\u00eb gjat\u00eb<a href=\"#_edn5\">[v]<\/a> ku\nnd\u00ebr t\u00eb tjera i k\u00ebrkohet mazhoranc\u00ebs q\u00eb \u201ct\u00eb reflektoj\u00eb duke rishikuar q\u00ebndrimin\ne saj mbi k\u00ebto rregulla t\u00eb reja, dhe t\u00eb siguroj\u00eb opinionin final nga Komisioni\ni Venecias, duke thirrur nj\u00ebkoh\u00ebsisht dialogun gjith\u00ebp\u00ebrfshir\u00ebs p\u00ebrmes K\u00ebshllit\nPolitik\u201d. <\/p>\n\n\n\n<p>Sikurse b\u00ebhet me dije\nPresidenti i Republik\u00ebs i \u00ebsht\u00eb drejtuar m\u00eb dat\u00ebn 21 tetor 2020 Komisionit t\u00eb\nVenecias<a href=\"#_edn6\">[vi]<\/a>\nt\u00eb K\u00ebshillit t\u00eb Europ\u00ebs p\u00ebr nj\u00eb opinion urgjent mbi ndryshimin e nj\u00ebnash\u00ebm dhe\nt\u00eb p\u00ebrshpejtuar t\u00eb Kushtetut\u00ebs dhe t\u00eb Kodit Zgjedhor.<\/p>\n\n\n\n<p><strong>Koalicioni p\u00ebr\nReforma, Integrim dhe Institucione t\u00eb Konsoliduara (KRIIK)<\/strong> n\u00eb vijueshm\u00ebri i ka b\u00ebr\u00eb thirrje aktor\u00ebve kryesor\u00eb politik\u00eb q\u00eb t\u00eb shfaqin\ndomosdoshm\u00ebrisht maturi n\u00eb nd\u00ebrmarrjen e reform\u00ebs s\u00eb kuadrit ligjor\nzgjedhor.&nbsp; <\/p>\n\n\n\n<p>Ndon\u00ebse ka shprehur dhe ka rezerva t\u00eb shumta p\u00ebr procesin reformues t\u00eb\nkuadrit ligjor zgjedhor t\u00eb nd\u00ebrmarr\u00eb, me synimin p\u00ebr arritjen e ri-stabilizimit\nt\u00eb jet\u00ebs parlamentare n\u00eb vend, KRIIK ka nxitur fort aktor\u00ebt politik\u00eb <strong>p\u00ebr\ndialog gjith\u00ebp\u00ebrfshir\u00ebs n\u00eb gjetjen e dakord\u00ebsis\u00eb s\u00eb nevojshme q\u00eb do t\u2019i\nparaprinte nj\u00eb procesi zgjedhor t\u00eb pranuar nga garuesit<\/strong>.<\/p>\n\n\n\n<p>KRIIK shpreh\nshqet\u00ebsimin e tij se tashm\u00eb t\u00eb gjendur n\u00eb periudh\u00eb zgjedhore, n\u00eb situat\u00eb t\u00eb\nr\u00ebnduar t\u00eb sh\u00ebndetit publik dhe me nj\u00eb Komision Qendror Zgjedhjesh t\u00eb\nsapokonstituuar, ndryshimet legjislative p\u00ebr \u00e7\u00ebshtje thelb\u00ebsore zgjedhore <strong>pa\ndakord\u00ebsi politike jan\u00eb fatale p\u00ebr ecurin\u00eb normale demokratike e politike n\u00eb\nvend<\/strong>.<\/p>\n\n\n\n<p>KRIIK shfryt\u00ebzon\nrastin e kthimit t\u00eb k\u00ebsaj pakete amenduese n\u00eb Kuvend p\u00ebr t\u2019i b\u00ebr\u00eb <strong>thirrje\naktor\u00ebve politik\u00eb q\u00eb t\u00eb dialogojn\u00eb dhe gjejn\u00eb sa m\u00eb shpejt dakord\u00ebsin\u00eb p\u00ebr\np\u00ebrmbylljen e procesit reformues<\/strong>. Madje, kjo dakord\u00ebsi \u00ebsht\u00eb e nevojshme t\u00eb\nvijoj\u00eb n\u00eb ndjekjen dhe n\u00eb asistimin e KQZ-s\u00eb t\u00eb sapokonstituuar p\u00ebr t\u00eb\np\u00ebrballuar sfidat jo t\u00eb vogla t\u00eb cilat i jan\u00eb ngarkuar nga legjislatori. Termat\nkohor\u00eb dhe konteksti i emergjenc\u00ebs s\u00eb sh\u00ebndetit publik, p\u00ebrpos t\u00eb tjerash, po\nr\u00ebndojn\u00eb gjithmon\u00eb e m\u00eb shum\u00eb n\u00eb mbar\u00ebvajtjen e p\u00ebrgatitjes s\u00eb procesit\nzgjedhor t\u00eb 25 prillit 2021.<\/p>\n\n\n\n<p>Mungesa e Gjykat\u00ebs\nKushtetuese si nj\u00eb mekaniz\u00ebm thelb\u00ebsor garantues p\u00ebr respektimin e lirive e t\u00eb\ndrejtave t\u00eb qytetar\u00ebve, si dhe t\u00eb garancive t\u00eb tjera kushtetuese,&nbsp; dikton akoma m\u00eb shum\u00eb mosnd\u00ebrmarrjen e nj\u00eb <strong>procesi\namendues t\u00eb Kodit Zgjedhor pa dakord\u00ebsi politike<\/strong>. Nj\u00eb proces i till\u00eb m\u00eb\nshum\u00eb se sa ka lidhje me fatin e zgjedhjeve pasuese, <strong>\u00ebsht\u00eb kritik n\u00eb\npasurimin e precedent\u00ebve t\u00eb rreziksh\u00ebm p\u00ebr t\u00eb ardhmen demokratike t\u00eb vendit<\/strong>.\n<\/p>\n\n\n\n<p>Mazhorancat\npasardh\u00ebse mund t\u00eb p\u00ebrvijojn\u00eb p\u00ebrs\u00ebritjen e k\u00ebtij precedenti duke legjitimuar\nnd\u00ebrmarrjen e reformave zgjedhore ngusht\u00ebsisht t\u00eb nj\u00ebanshme e rrjedhimisht\nantidemokratike. Ve\u00e7an\u00ebrisht n\u00eb realitete parademokratike nj\u00eb sjellje e till\u00eb\np\u00ebrb\u00ebn nj\u00eb tjet\u00ebr hap pas n\u00eb tradit\u00ebn shtetformuese, duke zhb\u00ebr\u00eb tashm\u00eb edhe\nstandardin e m\u00ebparsh\u00ebm t\u00eb marr\u00ebveshjeve t\u00eb mbyllura bipartizane me qasje t\u00eb\nngushta interesash.<\/p>\n\n\n\n<p>Aktor\u00ebt politik\u00eb,\nve\u00e7an\u00ebrisht <strong>Partia Socialiste si forc\u00eb qeveris\u00ebse dhe me pushtet t\u00eb\npakufizuar, duhet t\u00eb marr\u00eb p\u00ebrgjegj\u00ebsi t\u00eb plot\u00eb p\u00ebr t\u00eb ardhmen demokratike t\u00eb\nvendit duke siguruar t\u00ebr\u00eb garancit\u00eb e nevojshme p\u00ebr t\u00eb gjith\u00eb aktor\u00ebt <\/strong>q\u00eb\nduan t\u00eb marrin pjes\u00eb n\u00eb zgjedhje. <\/p>\n\n\n\n<p>Praktika gati 30\nvje\u00e7are e vuajtjes nga mospranimi i rezultatit zgjedhor nga pal\u00ebt pjes\u00ebmarr\u00ebse\nn\u00eb zgjedhje, duhet t\u00eb marr\u00eb fund. <\/p>\n\n\n\n<p><strong>Pjekuria dhe\nlargpam\u00ebsia e klas\u00ebs politike shqiptare<\/strong>, n\u00eb justifikim dhe p\u00ebrmbushje t\u00eb angazhimeve demokratike q\u00eb ka marr\u00eb\nShqip\u00ebria, si vend an\u00ebtar i NATO-s, kandidat p\u00ebr n\u00eb Bashkimin Europian dhe,\naktualisht, si kryesuese e Organizat\u00ebs p\u00ebr Siguri dhe Bashk\u00ebpunim n\u00eb Europ\u00eb\n(OSBE<strong>), duhet t\u00eb siguroj\u00eb sa m\u00eb par\u00eb zgjidhjen e k\u00ebtij ng\u00ebr\u00e7i t\u00eb panevojsh\u00ebm\npolitik n\u00ebp\u00ebrmjet nj\u00eb tryeze t\u00eb vazhdueshme dialogu<\/strong> p\u00ebr t\u00eb mir\u00ebn e vendit\ndhe popullit shqiptar, duke pranuar zbatimin paekuivok t\u00eb aspiratave\nkushtetuese dhe jet\u00ebsimin e sjelljes s\u00eb plot\u00eb ligjore e institucionale, e cila,\nn\u00eb munges\u00eb t\u00eb garantit vendor kushtetues, <strong>pranon verdiktin e aktor\u00ebve t\u00eb\ntret\u00eb nd\u00ebrkomb\u00ebtar\u00eb me potenc\u00eb, ekspertiz\u00eb dhe p\u00ebrvoj\u00eb sikurse \u00ebsht\u00eb Komisioni\ni Venecias<\/strong>.<\/p>\n\n\n\n<p>KRIIK shpreh\nkeqardhje q\u00eb ky mekaniz\u00ebm nuk u investua m\u00eb par\u00eb nga aktor\u00ebt respektiv\u00eb,\nsikurse KRIIK b\u00ebri thirrje q\u00eb n\u00eb muajin korrik n\u00eb nisje t\u00eb p\u00ebrplasjeve politike\np\u00ebr ndryshimet e nj\u00ebanshme kushtetuese.&nbsp;\nMegjithat\u00eb, edhe tani n\u00eb afatet kohore t\u00eb ngushta p\u00ebrkundrejt\np\u00ebrgatitjes s\u00eb zgjedhjeve t\u00eb ardhshme, konsideron se periudha kohore deri n\u00eb\nmarrjen&nbsp; urgjente t\u00eb Opinionit dhe\ntematika e cuar per interpretim, nuk sjellin ndonj\u00eb komplikim serioz, t\u00eb\ndrejt\u00ebp\u00ebrdrejt\u00eb dhe me pasoja t\u00eb parikuperueshme n\u00eb ecurin\u00eb p\u00ebrgatitore t\u00eb\nprocesit zgjedhor t\u00eb nisur. T\u00ebr\u00eb kjo, p\u00ebrball\u00eb kontekstit aktual dhe shmangies\ns\u00eb nj\u00eb situate akoma m\u00eb shum\u00eb problematike q\u00eb mund t\u00eb p\u00ebrvijohet gjat\u00eb apo pas\nzgjedhjeve t\u00eb ardhshme.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb kuad\u00ebr,\nnevojitet s\u00eb pari q\u00eb <strong>Mazhoranca Socialiste t\u00eb t\u00ebrhiqet dhe t\u00eb pezulloj\u00eb\nmenj\u00ebher\u00eb shqyrtimin sot n\u00eb parlament<a href=\"#_edn7\"><strong>[vii]<\/strong><\/a>\nt\u00eb dekretit t\u00eb Presidentit, duke treguar lidership, p\u00ebrgjegj\u00ebsi dhe largpam\u00ebsi\npolitike<\/strong>, sikurse ka treguar edhe m\u00eb par\u00eb lidhur me \u00e7\u00ebshtje t\u00eb cilat jan\u00eb\nmarr\u00eb n\u00eb shqyrtim prej Komisionit t\u00eb Venecias.<\/p>\n\n\n\n<p>Nga ana tjet\u00ebr, n\u00eb\nopinionin e KRIIK, <strong>aktor\u00ebt politik\u00eb mund dhe duhet t\u2019i japin jet\u00eb menj\u00ebher\u00eb\ntryez\u00ebs s\u00eb dialogut politik p\u00ebr dakord\u00ebsimin e q\u00ebndrimeve<\/strong> konform\npraktikave dhe standardeve m\u00eb t\u00eb mira nd\u00ebrkomb\u00ebtare, pa pritur momentin e publikimit\nzyrtar t\u00eb Opinionit prej Komisionit t\u00eb Venecias. <\/p>\n\n\n\n<p>N\u00eb p\u00ebrfundim, sillet\nn\u00eb v\u00ebmendje t\u00eb aktor\u00ebve politik\u00eb se ndryshimet e Kodit Zgjedhor t\u00eb 5 tetorit,\nn\u00eb gjykimin e KRIIK, <strong>prekin n\u00eb thelb reflektimin e drejt\u00ebp\u00ebrdrejt\u00eb t\u00eb vot\u00ebs\ns\u00eb qytetarit n\u00eb mandatin p\u00ebrfaq\u00ebsues t\u00eb votuar<\/strong>, duke shkuar k\u00ebshtu n\u00eb\nkund\u00ebrshtim me praktikat e mira t\u00eb caktuara nga Komisioni i Venecias. <\/p>\n\n\n\n<p>Pa hyr\u00eb n\u00eb nj\u00eb\nanaliz\u00eb t\u00eb plot\u00eb t\u00eb gjith\u00eb ndryshimeve t\u00eb b\u00ebra, KRIIK sjell n\u00eb v\u00ebmendje\nshqet\u00ebsimin madhor t\u00eb b\u00ebr\u00eb t\u00eb ditur q\u00eb n\u00eb krye t\u00eb her\u00ebs <strong>p\u00ebr pamund\u00ebsin\u00eb e\nhapjes s\u00eb sistemit politik prej establishmentit aktual<\/strong>.&nbsp; <\/p>\n\n\n\n<p>Ndryshimet ligjore t\u00eb\nkryera, megjith\u00ebse t\u00eb frym\u00ebzuara n\u00ebn aspirat\u00ebn p\u00ebr rritjen e mund\u00ebsis\u00eb s\u00eb\nqytetar\u00ebve p\u00ebr t\u00eb zgjedhur vet\u00eb kandidat\u00ebt e preferuar, rezultuan n\u00eb nj\u00eb liri t\u00eb\nkufizuar p\u00ebr t\u00eb zgjedhur ve\u00e7 nga \u201cshportat\u201d elektorale t\u00eb kandidat\u00ebve t\u00eb\nparacaktuar nga lidershipi partiak, <strong>duke pamund\u00ebsuar zgjedhjen e garuesve t\u00eb\nrinj apo t\u00eb alternativave t\u00eb reja politike p\u00ebrtej forcave t\u00eb establishmentit<\/strong>.<\/p>\n\n\n\n<p>Ve\u00e7an\u00ebrisht alarmante\nn\u00eb k\u00ebt\u00eb drejtim \u00ebsht\u00eb <strong>pamund\u00ebsia e garimit t\u00eb kandidat\u00ebve t\u00eb pavarur q\u00eb mund\nt\u00eb vijn\u00eb nga shoq\u00ebria civile dhe q\u00eb mb\u00ebshteten nga zgjedh\u00ebsit<\/strong>, ndaj t\u00eb\ncil\u00ebve n\u00eb nj\u00eb qasje jo parimore dhe jo kushtetuese iu k\u00ebrkohet q\u00eb pavar\u00ebsisht\nrezultatit n\u00eb zon\u00ebn zgjedhore ku ata kandidojn\u00eb, q\u00eb t\u00eb mund t\u00eb p\u00ebrllogaritjen\nn\u00eb marrjen ose jo t\u00eb mandatit, iu duhet t\u00eb kalojn\u00eb pragun prej 1% t\u00eb votave n\u00eb\nrang vendi. <\/p>\n\n\n\n<p>Gjithashtu, theksohet se <strong>mekanizimi i kontrollit dhe transparenc\u00ebs\nfinanciare nuk \u00ebsht\u00eb i projektuar p\u00ebr situat\u00ebn e parashikuar<\/strong> nga ndryshimet\ne fundit duke shtuar akoma edhe m\u00eb problematikat e mbartuara deri sotmi.\nFormula e propozuar e kandidimit pritet t\u00eb nxis\u00eb akoma m\u00eb shum\u00eb garimin\nnd\u00ebrmjet dhe brenda vet\u00eb partive politike, p\u00ebr rrjedhoj\u00eb duke rritur dhe\nveprimtarin\u00eb financiare zgjedhore, e cila <strong>me ndryshimet e b\u00ebra mbetet\nt\u00ebr\u00ebsisht jan\u00eb kontrollit dhe transparenc\u00ebs, qoft\u00eb edhe minimaliste t\u00eb siguruar\nm\u00eb par\u00eb<\/strong>.<\/p>\n\n\n\n<p><strong><em>Tiran\u00eb,&nbsp;
