T\u00eb treja k\u00ebto tipologji hap\u00ebsirash publike jan\u00eb hap\u00ebsira me pages\u00eb. P\u00ebrcaktimi definitiv se hap\u00ebsirat reklamuese p\u00ebrfshijn\u00eb vet\u00ebm \u201cbillboardet, city lightet dhe ekranet digjitale reklamuese t\u00eb vendosura n\u00eb hap\u00ebsira publike\u201d (neni 6, pika 1 e projektvendimit), dhe kufizon mund\u00ebsin\u00eb q\u00eb bashkit\u00eb t\u00eb p\u00ebrcaktojn\u00eb hap\u00ebsira publike t\u00eb tjera ku subjektet zgjedhore t\u00eb mund t\u00eb vendosin postera pa patur nevoj\u00eb t\u00eb paguajn\u00eb. Nj\u00eb qasje e till\u00eb do t\u00eb diskriminonte partit\u00eb politike me burime t\u00eb kufizuara t\u00eb cilat mund t\u00eb mos ken\u00eb mund\u00ebsi t\u00eb blejn\u00eb hap\u00ebsira publike me pages\u00eb dhe do t\u00eb krijoj\u00eb pabarazi n\u00eb gar\u00eb, duke favorizuar partit\u00eb me m\u00eb shum\u00eb burime financiare.<\/p>\n\n\n\n<p>P\u00ebr m\u00eb tep\u00ebr, ky p\u00ebrcaktim \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Kodin Zgjedhor, i cili n\u00eb nenin 2 \u201cP\u00ebrkufizime\u201d, pika 31 p\u00ebrcakton se \u201c<em>Materiale propaganduese statike\u201d jan\u00eb materialet q\u00eb i sh\u00ebrbejn\u00eb subjektit zgjedhor p\u00ebr promovimin e fushat\u00ebs zgjedhore dhe q\u00eb jan\u00eb vendosur ose afishuar n\u00eb vende ose hap\u00ebsira publike me akses publik, si shtyllat e ndri\u00e7imit t\u00eb rrug\u00ebve, fasadat e nd\u00ebrtesave, sheshet, pjes\u00ebt ballore t\u00eb dyqaneve ose nd\u00ebrtesave, p\u00ebrgjat\u00eb rrug\u00ebve t\u00eb qyteteve, rrug\u00ebve nd\u00ebrqytet\u00ebse etj<\/em>.\u201d<\/p>\n\n\n\n<p>N\u00eb asnj\u00eb pik\u00eb t\u00eb Projektvendimit nuk p\u00ebrmendet detyrimi i Policis\u00eb s\u00eb Shtetit dhe Policis\u00eb Bashkiake p\u00ebr t\u00eb hequr \u201c&#8230;\u00e7do material propagandues t\u00eb subjekteve zgjedhore n\u00eb vendet jasht\u00eb p\u00ebrcaktimeve t\u00eb b\u00ebra n\u00eb pikat 1 dhe 2 t\u00eb [nenit 79 t\u00eb Kodit Zgjedhor\u201d. P\u00ebrmendja n\u00eb m\u00ebnyr\u00eb eksplicite e k\u00ebtij detyrimi \u00ebsht\u00eb e domosdoshme p\u00ebr t\u00eb shmangur munges\u00ebn e p\u00ebrmbushjes s\u00eb detyrimeve ligjore nga k\u00ebto institucione, situat\u00eb e cila u v\u00ebrejt gjat\u00eb Zgjedhjeve Lokale t\u00eb vitit 2023. P\u00ebr m\u00eb tep\u00ebr t\u00eb p\u00ebrcaktohet n\u00eb vendim afati kohor maksimal 24 deri n\u00eb 48 or\u00eb, gjat\u00eb t\u00eb cilit Policia duhet t\u00eb p\u00ebrmbush\u00eb detyrimin ligjor p\u00ebr heqjen e materialeve propagandistike t\u00eb vendosura n\u00eb kund\u00ebrshtim me ligjin.<\/p>\n\n\n\n<p>P\u00ebrpos sa m\u00eb sip\u00ebr, KRIIK gjykon se KQZ-ja nevojitet&nbsp;<strong>t\u00eb nd\u00ebrveproj\u00eb menj\u00ebher\u00eb me strukturat e Policis\u00eb s\u00eb&nbsp;Shtetit dhe t\u00eb Policive Bashkiake respektive,&nbsp;<\/strong>sipas parashikimeve t\u00eb ligjit, p\u00ebr protokollin e bashk\u00ebpunimit n\u00eb nj\u00eb koh\u00eb sa m\u00eb t\u00eb shpejt\u00eb, n\u00eb rastet e konstatimit t\u00eb posterave dhe billboard-eve q\u00eb nuk jan\u00eb konform ligjit.<\/p>\n\n\n\n<p>Disa rekomandime m\u00eb teknike i gjeni n\u00eb vijim:<\/p>\n\n\n\n<p><strong><em><u>N\u00eb lidhje me Nenin 2<\/u><\/em>&nbsp;&#8211; Caktimi i hap\u00ebsirave t\u00eb lejuara p\u00ebr reklama<\/strong><\/p>\n\n\n\n<p><strong>Pika 1:<\/strong>&nbsp;\u201cBashkit\u00eb, jo m\u00eb von\u00eb se 35 dit\u00eb para dat\u00ebs s\u00eb zgjedhjeve, hartojn\u00eb nj\u00eb list\u00eb t\u00eb hap\u00ebsirave t\u00eb lejuara p\u00ebr reklamat zgjedhore dhe menj\u00ebher\u00eb e publikojn\u00eb at\u00eb n\u00eb faqet zyrtare p\u00ebrkat\u00ebse si dhe njoftojn\u00eb subjektet zgjedhore dhe Komisionin Qendror t\u00eb Zgjedhjeve.\u201d<\/p>\n\n\n\n<p><strong>Rekomandime:<\/strong><\/p>\n\n\n\n<p>1. T\u00eb p\u00ebrcaktohet qart\u00eb se bashkit\u00eb duhet ta publikojn\u00eb vendimin menj\u00ebher\u00eb pasi t\u00eb merret dhe n\u00eb nj\u00eb vend t\u00eb duksh\u00ebm n\u00eb faqen e vet ueb.<\/p>\n\n\n\n<p>2. Nevojitet t\u00eb specifikohet rregullimi i hap\u00ebsirave reklamuese n\u00eb rrug\u00ebt nacionale. T\u00eb p\u00ebrcaktohet qart\u00eb n\u00eb projektvendim se billboard-et duhet t\u00eb vendosen vet\u00ebm n\u00eb hap\u00ebsira q\u00eb jan\u00eb n\u00ebn p\u00ebrgjegj\u00ebsin\u00eb e bashkive, p\u00ebr t\u00eb shmangur keqkuptimet q\u00eb mund t\u00eb lindin nga perceptimi se reklamat e vendosura n\u00eb krah t\u00eb rrug\u00ebve nacionale jan\u00eb n\u00eb territorin q\u00eb i p\u00ebrket rrug\u00ebs dhe, si rrjedhoj\u00eb, nuk u n\u00ebnshtrohen rregullave t\u00eb bashkis\u00eb p\u00ebrkat\u00ebse.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; N\u00eb k\u00ebt\u00eb frym\u00eb, merr r\u00ebnd\u00ebsi s\u00ebrish citimi i qart\u00eb n\u00eb Vendim se reklamat e vendosura n\u00eb hap\u00ebsira t\u00eb tjera, jasht\u00eb atyre t\u00eb p\u00ebrcaktuara n\u00eb vendimin e Kryetarit t\u00eb Bashkis\u00eb apo 5 metra nga zyrat zgjedhore hiqen nga Policia e Shteti apo ajo Bashkiake.<\/p>\n\n\n\n<p>3. Nevojitet t\u00eb p\u00ebrcaktohet nj\u00eb limit i qart\u00eb mbi hap\u00ebsirat e lejuara p\u00ebr reklama, n\u00eb p\u00ebrputhje me frym\u00ebn e ligjit, i cili synon t\u00eb shmang\u00eb vendosjen e pakontrolluar t\u00eb reklamave politike n\u00eb t\u00eb gjith\u00eb qytetin. Kryetar\u00ebt e bashkive nuk duhet t\u00eb ken\u00eb mund\u00ebsi t\u00eb formulojn\u00eb vendime t\u00eb p\u00ebrgjithshme, pa p\u00ebrcaktuar specifikisht adresat p\u00ebrkat\u00ebse, sikurse ka ndodhur n\u00eb disa raste n\u00eb zgjedhjet lokale t\u00eb vitit 2023.<\/p>\n\n\n\n<p><strong><em><u>N\u00eb lidhje me Nenin 3<\/u><\/em>&nbsp;&#8211; Metoda e ndarjes s\u00eb hap\u00ebsirave reklamuese<\/strong><\/p>\n\n\n\n<p><strong>Pika 1:<\/strong>&nbsp;\u201cHap\u00ebsirat reklamuese p\u00ebrfshijn\u00eb billboardet, city lightet dhe ekranet digjitale reklamuese t\u00eb vendosura n\u00eb hap\u00ebsira publike.\u201d<\/p>\n\n\n\n<p><strong>Rekomandime:<\/strong><\/p>\n\n\n\n<p>P\u00ebrpos rekomandimit n\u00eb hyrje t\u00eb dokumentit, n\u00eb lidhje me pabarazin\u00eb q\u00eb ky formulim krijon p\u00ebr partit\u00eb me pak burime financiare,<\/p>\n\n\n\n<p>1. Do t\u00eb ishte e udh\u00ebs q\u00eb t\u00eb p\u00ebrkufizohen termat \u201cbillboard\u201d, \u201ccity light\u201d dhe \u201cekrane digjital\u201d, p\u00ebr t\u00eb shmangur \u00e7do keqkuptim eventual.<\/p>\n\n\n\n<p>2. Nuk \u00ebsht\u00eb e qart\u00eb n\u00ebse vendimi shtrihet edhe n\u00eb hap\u00ebsirat private. Duhet t\u00eb p\u00ebrcaktohet qart\u00eb n\u00ebse ndalimi zbatohet p\u00ebr distanca deri n\u00eb 5 metra nga zyra zgjedhore, edhe kur reklama vendoset n\u00eb pron\u00eb private.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Edhe n\u00eb k\u00ebt\u00eb pik\u00eb, merr rend\u00ebsi s\u00ebrish citimi i qart\u00eb n\u00eb Vendim se reklamat e vendosura n\u00eb hap\u00ebsira t\u00eb tjera, jasht\u00eb atyre t\u00eb p\u00ebrcaktuara n\u00eb vendimin e Kryetarit t\u00eb Bashkis\u00eb apo 5 metra nga zyrat zgjedhore, hiqen nga Policia e Shteti apo ajo Bashkiake.<\/p>\n\n\n\n<p><strong>Pika 3:<\/strong>&nbsp;\u201cSubjektet zgjedhore nuk mund t\u00eb afishojn\u00eb materiale propagandistike n\u00eb billboarde apo city lights t\u00eb nj\u00ebpasnj\u00ebshme n\u00eb zonat e p\u00ebrcaktuara p\u00ebr afishim.\u201d<\/p>\n\n\n\n<p><strong>Rekomandim:<\/strong><\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb formulim duhet t\u00eb qart\u00ebsohet fjala \u201ce nj\u00ebpasnj\u00ebshme\u201d. Nevojitet q\u00eb t\u00eb sqarohet q\u00eb termi t\u00eb nj\u00ebpasnj\u00ebshme i referohet t\u00eb dyja an\u00ebve t\u00eb rrug\u00ebs, n\u00eb m\u00ebnyr\u00eb q\u00eb mos t\u00eb lihet vend p\u00ebr keqkuptim apo keqinterpretim t\u00eb fjal\u00ebs. Duhet t\u00eb p\u00ebrcaktohet detyrimi p\u00ebr publikimin e tarifave ose dor\u00ebzimin e tyre n\u00eb bashki dhe publikimin e tyre n\u00eb faqen e internetit t\u00eb bashkis\u00eb, si dhe, n\u00eb KQZ dhe publikimin e tyre n\u00eb faqen e internetit t\u00eb KQZ-s\u00eb. Nevojitet t\u00eb sakt\u00ebsohet formulimi.<\/p>\n\n\n\n<p><strong><em><u>N\u00eb lidhje me Nenin 6<\/u><\/em>&nbsp;&#8211; Sanksionet p\u00ebr shkeljet<\/strong><\/p>\n\n\n\n<p><strong>Rekomandim:<\/strong><\/p>\n\n\n\n<p>T\u00eb shtohet nj\u00eb pik\u00eb n\u00eb lidhje me sanksionet p\u00ebr bashkit\u00eb n\u00eb rast se nuk publikojn\u00eb vendimin n\u00eb faqen e tyre zyrtare menj\u00ebher\u00eb, Policin\u00eb e Shtetit apo Policin\u00eb Bashkiake n\u00eb rastet e mos p\u00ebrmbushjes s\u00eb detyrimit p\u00ebr heqjen e materialeve propagandistike t\u00eb vendosura n\u00eb kund\u00ebrshtim me ligjin.<\/p>\n\n\n\n<p><strong>Pika 1:<\/strong>&nbsp;\u201cN\u00eb rast t\u00eb shp\u00ebrndarjes s\u00eb pabarabart\u00eb t\u00eb hap\u00ebsirave, Bashkit\u00eb urdh\u00ebroj\u00eb rishp\u00ebrndarjen e hap\u00ebsirave ose ndalimin e reklamave t\u00eb vendosura n\u00eb m\u00ebnyr\u00eb t\u00eb padrejt\u00eb.\u201d<\/p>\n\n\n\n<p><strong>Rekomandime:<\/strong><\/p>\n\n\n\n<p>1. Duke marr\u00eb n\u00eb konsiderat\u00eb se fushata zgjedhore zgjat vet\u00ebm 30 dit\u00eb, duhet t\u00eb p\u00ebrcaktohet nj\u00eb afat maksimal 24 deri n\u00eb 48 or\u00eb, brenda t\u00eb cilit bashkit\u00eb duhet t\u00eb rishp\u00ebrndajn\u00eb hap\u00ebsirat reklamuese n\u00eb rast t\u00eb shkeljeve. Kjo do t\u00eb evitonte q\u00eb bashki t\u00eb caktuara t\u00eb shtyjn\u00eb vendimmarrjen, duke krijuar nj\u00eb situat\u00eb pabarazie p\u00ebr nj\u00eb pjes\u00eb t\u00eb konsiderueshme t\u00eb fushat\u00ebs zgjedhore<\/p>\n\n\n\n<p>2.
