Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; <\/strong><strong>T\u00eb nderuar Drejtues t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><strong><\/strong><\/p>\n\n\n\n<p>N\u00eb vijim t\u00eb bashk\u00ebpunimit t\u00eb vazhduesh\u00ebm me Institucionin e KQZ-s\u00eb, <strong>KRIIK vler\u00ebson iniciativ\u00ebn p\u00ebr ndryshimet e propozuara n\u00eb Vendimin Nr. 11 dat\u00eb 25.03.2021, duke theksuar se ky ndryshim \u00ebsht\u00eb i domosdosh\u00ebm p\u00ebr t\u00eb siguruar nj\u00eb proces zgjedhor m\u00eb t\u00eb rregullt dhe transparent.<\/strong><\/p>\n\n\n\n<p><strong>Ndryshimet e propozuara n\u00eb projekt-akt, jan\u00eb n\u00eb linj\u00eb me <\/strong><a href=\"https:\/\/kriik.al\/home\/2025\/02\/20\/rekomandime-per-plotesimin-e-kuadrit-rregullator-per-garantimin-e-fshehtesise-se-votes-dhe-te-nje-mjedisi-te-lire-nga-intimidimi-te-qete-dhe-te-sigurt-per-zgjedhesit-gjate-dites-s\/\"><strong>Rekomandimet<\/strong><\/a><strong> <\/strong>q\u00eb KRIIK i ka d\u00ebrguar Komisionit Qendror t\u00eb Zgjedhjeve m\u00eb dat\u00ebn 20 shkurt 2025, ku theksohet nevoja p\u00ebr p\u00ebrmir\u00ebsimin e kuadrit rregullator p\u00ebr t\u00eb garantuar fsheht\u00ebsin\u00eb e vot\u00ebs dhe nj\u00eb mjedis t\u00eb lir\u00eb nga intimidimi gjat\u00eb dit\u00ebs s\u00eb zgjedhjeve, duke nd\u00ebrmarr\u00eb masa q\u00eb detyrojn\u00eb Komisionet e Qendrave t\u00eb Votimit t\u00eb monitorojn\u00eb rregullisht mjedisin p\u00ebrreth p\u00ebr pranin\u00eb e personave t\u00eb paautorizuar dhe t\u00eb raportojn\u00eb tek Komisionet Zonale t\u00eb Administrimit Zgjedhor (KZAZ) mbi situat\u00ebn duke e patur n\u00eb kontroll vazhdimisht at\u00eb.<\/p>\n\n\n\n<p>Pas njohjes me projekt-aktin dhe rekomandimeve t\u00eb ofruara ndaj administrat\u00ebs s\u00eb Komisionit Qendror t\u00eb Zgjedhjeve n\u00eb m\u00ebnyr\u00eb verbale,<\/p>\n\n\n\n<p>KRIIK paraqet n\u00eb vijim k\u00ebto rekomandime edhe me shkrim, me synimin q\u00eb amendimet e Vendimit nr. 11, dat\u00eb 25.03.2021, t\u00eb Komisionit Rregullator \u201cP\u00ebr m\u00ebnyr\u00ebn e ngritjes, organizimit, funksionimit t\u00eb Komisionit t\u00eb Qendr\u00ebs s\u00eb Votimit dhe zhvillimit t\u00eb zgjedhjeve n\u00eb Qendr\u00ebn e Votimit, t\u00eb ndryshuar\u201d t\u00eb jen\u00eb m\u00eb t\u00eb plota dhe akti t\u00eb jet\u00eb m\u00eb efektiv n\u00eb zbatim.<\/p>\n\n\n\n<p><strong><u>I. Rekomandime p\u00ebr sakt\u00ebsimin e amendimeve t\u00eb propozuara:<\/u><\/strong><\/p>\n\n\n\n<p><strong><u>Pika I.1.<\/u><\/strong><\/p>\n\n\n\n<p>KRIIK sugjeron q\u00eb dy fjalit\u00eb e fundit t\u00eb pik\u00ebs 5 q\u00eb shtohet t\u00eb formulohen m\u00eb qart\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb sakt\u00ebsohet m\u00ebnyra e p\u00ebrzgjedhjes s\u00eb koordinator\u00ebve t\u00eb siguris\u00eb.<\/p>\n\n\n\n<p>Nj\u00eb formulim alternativ do t\u00eb ishte:<\/p>\n\n\n\n<p><em>\u201cSi rregull, koordinator sigurie caktohet an\u00ebtari me detyr\u00ebn e mbajtjes s\u00eb radh\u00ebs dhe\/ose nj\u00eb an\u00ebtar tjet\u00ebr. N\u00eb asnj\u00eb rast nuk mund t\u00eb caktohen si koordinator\u00eb sigurie kryetari, sekretari apo an\u00ebtari i KQV-s\u00eb q\u00eb timbron zgjedh\u00ebsit. N\u00eb ndarjen e detyrave, KQV-ja nuk i ngarkon k\u00ebta an\u00ebtar\u00eb me detyra t\u00eb tjera thelb\u00ebsore, t\u00eb cilat mund t\u00eb pengojn\u00eb procesin e votimit.\u201d<\/em><\/p>\n\n\n\n<p>Ndryshimi i propozuar n\u00eb fjalin\u00eb e par\u00eb lejon mund\u00ebsin\u00eb q\u00eb t\u00eb dy koordinator\u00ebt e siguris\u00eb, n\u00eb nd\u00ebrtesat ku ka m\u00eb tep\u00ebr se nj\u00eb qend\u00ebr votimi t\u00eb jen\u00eb personat e ngarkuar p\u00ebr mbajtjen e radh\u00ebs, pasi duke p\u00ebrdorur vet\u00ebm lidh\u00ebsen \u201cdhe\u201d, mund t\u00eb kuptohet sikur koordinatori i dyt\u00eb t\u00eb jet\u00eb patjet\u00ebr nj\u00eb nga an\u00ebtar\u00ebt e KQV-s\u00eb me detyra t\u00eb tjera. Nd\u00ebrkoh\u00eb q\u00eb do t\u00eb ishte e preferueshme q\u00eb n\u00eb t\u00eb gjitha rastet, me sa t\u00eb jet\u00eb e mundur, k\u00ebta t\u00eb jen\u00eb personat e ngarkuar p\u00ebr t\u00eb mbajtur radh\u00ebn.<\/p>\n\n\n\n<p><strong><u>Pika I.2.<\/u><\/strong>.<\/p>\n\n\n\n<p>KRIIK e <strong>vler\u00ebson si nj\u00eb hap pozitiv p\u00ebrfshirjen e detyrimit t\u00eb komisioner\u00ebve p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb trajnim<\/strong>, duke qen\u00eb se mospjes\u00ebmarrja ka qen\u00eb nj\u00eb problematik\u00eb e p\u00ebrs\u00ebritur.<\/p>\n\n\n\n<p>\u00cbsht\u00eb e nevojshme q\u00eb <strong>KQZ t\u00eb ushtroj\u00eb presion t\u00eb qart\u00eb dhe konstant ndaj Partive Politike dhe an\u00ebtar\u00ebve t\u00eb KQV-ve<\/strong> t\u00eb propozuar prej tyre, p\u00ebr t\u00eb mar\u00eb pjes\u00eb n\u00eb trajnime, duke u k\u00ebrkuar KZAZ-ve t\u00eb zbatojn\u00eb me p\u00ebrpikm\u00ebri nenin 39, pika 1 g\u00ebrma \u201c\u00e7\u201d t\u00eb Kodit Zgjedhor:&nbsp;&nbsp; <em>\u201cAn\u00ebtari dhe sekretari i KQV-s\u00eb shkarkohen nga detyra me vendim t\u00eb KZAZ-s\u00eb kur: \u00e7) nuk marrin pjes\u00eb n\u00eb trajnimet ose nuk kalojn\u00eb testimet e organizuara nga KQZ-ja.\u201d<\/em><\/p>\n\n\n\n<p>Po ashtu \u00ebsht\u00eb e nevojshme q\u00eb KQZ t\u00eb marr\u00eb menj\u00ebher\u00eb kopje t\u00eb vendimeve t\u00eb KZAZ-ve p\u00ebr ngritjen e KQV-ve sipas afateve q\u00eb parashikon Kodi Zgjedhor (<em>jo m\u00eb von\u00eb se 20 dit\u00eb para dat\u00ebs s\u00eb zgjedhjeve<\/em>), <strong>duke mos lejuar fiktivitetin e k\u00ebtyre vendimeve<\/strong>, apo marrjen e tyre vet\u00ebm disa dit\u00eb para dit\u00ebs s\u00eb zgjedhjeve zgjedhjeve.<\/p>\n\n\n\n<p>Komisioni Qendror i Zgjedhjeve duhet tua b\u00ebj\u00eb t\u00eb qart\u00eb partive politike, propozuese t\u00eb an\u00ebtar\u00ebve t\u00eb komisioneve zgjedhore, se shkelja e ligjit p\u00ebrsa i p\u00ebrket problematik\u00ebs s\u00eb m\u00ebsip\u00ebrme, qoft\u00eb nga ana e tyre, qoft\u00eb nga ana e an\u00ebtar\u00ebve t\u00eb propozuar prej tyre, <strong>nuk do t\u00eb tolerohet<\/strong>.<\/p>\n\n\n\n<p>KRIIK <strong>nxit KQZ-n\u00eb t\u00eb lexoj\u00eb k\u00ebt\u00eb sjellje t\u00eb tyre si nj\u00eb sjellje t\u00eb q\u00ebllimshme q\u00eb shkon n\u00eb favor t\u00eb d\u00ebshirave dhe interesave t\u00eb tyre<\/strong>, ndaj si e till\u00eb, shkeljet e dispozitave t\u00eb ligjit dhe mosmarrja e masave t\u00eb menj\u00ebhershme p\u00ebr nd\u00ebrprerjen e shkeljes, t\u00eb konsiderohen si kund\u00ebrvajtje administrative e kryer prej subjekteve zgjedhore sipas parashikimeve t\u00eb nenit 172 pika 1 dhe 2 e Kodit Zgjedhor.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb kuad\u00ebr, KRIIK sugjeron m\u00eb posht\u00eb p\u00ebrmir\u00ebsime t\u00eb m\u00ebtejshme t\u00eb projekt-aktit p\u00ebr t\u00eb garantuar nj\u00eb trajnim m\u00eb efektiv dhe angazhues. Konkretisht:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Detyrimin e KQZ-s\u00eb p\u00ebr organizimin e trajnimeve shtes\u00eb.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>KQZ-ja duhet t\u00eb parashikoj\u00eb seanca trajnimi shtes\u00eb, t\u00eb cilat t\u00eb zhvillohen qoft\u00eb edhe nj\u00eb dit\u00eb para zgjedhjeve, p\u00ebr t\u00eb trajnuar ata komisioner\u00eb q\u00eb p\u00ebr \u00e7far\u00ebdo arsyeje nuk kan\u00eb mundur t\u00eb marrin pjes\u00eb n\u00eb trajnimin e par\u00eb, apo jan\u00eb z\u00ebvend\u00ebsuar n\u00eb momentet e fundit.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Futjen e trajnimeve online.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>N\u00ebse KQZ-ja ka mund\u00ebsi teknike, trajnimet mund t\u00eb zhvillohen edhe online, duke ofruar fleksibilitet p\u00ebr komisioner\u00ebt q\u00eb ndodhen larg ose kan\u00eb v\u00ebshtir\u00ebsi p\u00ebr pjes\u00ebmarrjen fizike n\u00eb trajnime.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Parashikimin e sanksioneve financiare p\u00ebr partit\u00eb politike.<\/strong><\/li>\n<\/ul>\n\n\n\n<p>KRIIK sugjeron q\u00eb n\u00eb projekt-akt t\u00eb p\u00ebrfshihet vendosja e sanksioneve administrative, sipas nenit 172, p\u00ebr partit\u00eb politike n\u00ebse komisioner\u00ebt e em\u00ebruar prej tyre nuk marrin pjes\u00eb n\u00eb trajnim. &nbsp;&nbsp;Penaliteti financiar mund t\u00eb p\u00ebrdoret p\u00ebr t\u00eb mbuluar shpenzimet e trajnimeve shtes\u00eb p\u00ebr komisioner\u00ebt q\u00eb nuk jan\u00eb trajnuar m\u00eb par\u00eb ose q\u00eb jan\u00eb z\u00ebvend\u00ebsuar n\u00eb momentin e fundit.<\/p>\n\n\n\n<p>Me nd\u00ebrmarrjen e k\u00ebtyre hapave shtes\u00eb, t\u00eb cil\u00ebt sigurojn\u00eb q\u00eb t\u00eb gjith\u00eb komisioner\u00ebve t\u2019iu jepet m\u00eb shum\u00eb se nj\u00eb mund\u00ebsi q\u00eb t\u00eb trajnohen duke eliminuar mund\u00ebsin\u00eb p\u00ebr justifikime apo pamund\u00ebsi objektive, &nbsp;&nbsp;<strong>do t\u00eb justifikohet plot\u00ebsisht sanksionimi i komisioner\u00ebve t\u00eb pa trajnuar me mosdh\u00ebnien e pages\u00ebs<\/strong>.<\/p>\n\n\n\n<p><strong><u>Pika I.3.<\/u><\/strong><\/p>\n\n\n\n<p>KRIIK v\u00ebren se <strong>formulimi i pik\u00ebs 3 q\u00eb shtohet nuk \u00ebsht\u00eb mjaftuesh\u00ebm i detajuar<\/strong> dhe nuk p\u00ebrcakton qart\u00eb se cilat veprime jan\u00eb t\u00eb ndaluara p\u00ebr v\u00ebzhguesit.<\/p>\n\n\n\n<p>Gjithashtu, <strong>nuk specifikohen sanksionet q\u00eb parashikohen n\u00eb rast t\u00eb shkeljes<\/strong> s\u00eb rregullave nga ana e tyre.<\/p>\n\n\n\n<p><strong>Nj\u00eb formulim alternativ dhe m\u00eb gjith\u00ebp\u00ebrfshir\u00ebs, n\u00eb gjykimin e KRIIK do t\u00eb ishte:<\/strong><\/p>\n\n\n\n<p>\u201cV\u00ebzhguesit e akredituar kan\u00eb p\u00ebrgjegj\u00ebsin\u00eb t\u00eb monitorojn\u00eb procesin e votimit n\u00eb m\u00ebnyr\u00eb t\u00eb paanshme dhe pa nd\u00ebrhyr\u00eb n\u00eb asnj\u00eb aspekt t\u00eb tij. Ata nuk kan\u00eb t\u00eb drejt\u00eb t\u00eb nd\u00ebrveprojn\u00eb drejtp\u00ebrdrejt me zgjedh\u00ebsit apo t\u00eb marrin informacion mbi t\u00eb dh\u00ebnat personale, p\u00ebrkat\u00ebsin\u00eb apo preferencat e tyre zgjedhore. Komisioni i Qendr\u00ebs s\u00eb Votimit (KQV) nuk lejohet t\u2019i jap\u00eb asnj\u00eb personi t\u00eb tret\u00eb t\u00eb dh\u00ebna q\u00eb mund t\u00eb identifikojn\u00eb zgjedh\u00ebsit q\u00eb paraqiten p\u00ebr t\u00eb votuar apo t\u00eb atyre q\u00eb nuk jan\u00eb paraqitur ende, p\u00ebrfshir\u00eb thirrjen me z\u00eb t\u00eb lart\u00eb t\u00eb emrit\/numrit zgjedhor apo t\u00eb t\u00eb dh\u00ebnave t\u00eb tjera identifikuese n\u00eb momentin q\u00eb zgjedh\u00ebsi paraqitet n\u00eb QV.<\/p>\n\n\n\n<p>V\u00ebzhguesit nuk mund t\u00eb nd\u00ebrmarrin asnj\u00eb veprim q\u00eb mund t\u00eb ndikoj\u00eb, t\u00eb frenoj\u00eb apo t\u00eb nd\u00ebrpres\u00eb lirin\u00eb dhe fsheht\u00ebsin\u00eb e procesit t\u00eb votimit. N\u00eb baz\u00eb t\u00eb k\u00ebtij informacioni, KQV-ja mund t\u00eb vendos\u00eb pezullimin e p\u00ebrkohsh\u00ebm t\u00eb votimit dhe njofton Policin\u00eb p\u00ebr veprimet e m\u00ebtejshme\u201d.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Parashikimet n\u00eb t\u00eb tre pikat, n\u00eb gjykimin e KRIIK, krijon konfuzion mbi radh\u00ebn e veprimeve q\u00eb duhet t\u00eb ndiqen nga Koordinator\u00ebt e Siguris\u00eb dhe se kush e ka kompetenc\u00ebn p\u00ebr t\u00eb njoftuar policin\u00eb, nd\u00ebrkoh\u00eb q\u00eb llojet e ve\u00e7anta t\u00eb problematikave nuk p\u00ebrcaktohen qart\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Gjithashtu, paraqitet paqart\u00ebsi p\u00ebrpara Policis\u00eb s\u00eb Shtetit se n\u00ebse ajo duhet t\u00eb marr\u00eb nj\u00eb konfirmim zyrtar nga KZAZ-ja apo KQV-ja, p\u00ebrpara se t\u00eb nd\u00ebrhyj\u00eb.<\/p>\n\n\n\n<p>P\u00ebr gjith\u00eb sa m\u00eb sip\u00ebr, KRIIK <strong>propozon q\u00eb t\u00eb detajohen kompetencat e Koordinator\u00ebve t\u00eb Siguris\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb qart\u00eb n\u00eb raport me personat e paautorizuar, &nbsp;&nbsp;t\u00eb sakt\u00ebsohet metodologjia e raportimit dhe e njoftimit t\u00eb KQV-s\u00eb, KZAZ-s\u00eb, si dhe e Policis\u00eb s\u00eb Shtetit<\/strong>.<\/p>\n\n\n\n<p>N\u00ebse gjykohet se n\u00eb raste t\u00eb ndryshme, protokolli i veprimeve t\u00eb Koordinator\u00ebve t\u00eb Siguris\u00eb duhet t\u00eb jet\u00eb i ndrysh\u00ebm, nevojitet t\u00eb p\u00ebrkufizohen qart\u00eb situatat e ndryshme dhe veprimet konkrete q\u00eb duhet t\u00eb kryejn\u00eb Koordinator\u00ebt e Siguris\u00eb, KQZ-ja, KZAZ-ja dhe Policia n\u00eb secilin rast.<\/p>\n\n\n\n<p>Megjithat\u00eb, duke qen\u00eb se ky mekaniz\u00ebm po vendoset n\u00eb funksion p\u00ebr her\u00eb t\u00eb par\u00eb, <strong>KRIIK<\/strong> <strong>propozon nj\u00eb qasje m\u00eb fleksib\u00ebl<\/strong>.<\/p>\n\n\n\n<p>Konkretisht, <strong>sugjerohet q\u00eb Koordinator\u00ebt e Siguris\u00eb t\u00eb ken\u00eb p\u00ebr detyr\u00eb:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>T\u00eb njoftojn\u00eb personat e paautorizuar<\/strong> se jan\u00eb duke kryer nj\u00eb shkelje dhe t\u00eb k\u00ebrkojn\u00eb q\u00eb ata t\u00eb largohen.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>N\u00eb rast refuzimi, <strong>t\u00eb njoftojn\u00eb paralelisht KQV-n\u00eb\/t\u00eb, Sekretarin e KZAZ-s\u00eb, KQZ-n\u00eb dhe Policin\u00eb e Shtetit p\u00ebr problematik\u00ebn <\/strong>dhe t\u00eb k\u00ebrkojn\u00eb nd\u00ebrhyrjen e Policis\u00eb s\u00eb Shtetit, duke iu d\u00ebrguar foton e dokumentit me t\u00eb cilin dokumentohet shkelja, provat e mundshme, si dhe k\u00ebrkesen p\u00ebr nevoj\u00ebn e nd\u00ebrhyrjes s\u00eb Policis\u00eb s\u00eb Shtetit dhe t\u00eb njoftimit paralelisht t\u00eb KQV-s\u00eb e KZAZ-s\u00eb p\u00ebrkat\u00ebse, si dhe t\u00eb KQZ-s\u00eb.<\/li>\n<\/ul>\n\n\n\n<p><strong><u>II.
