Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit Rregullator!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp;&nbsp;T\u00eb nderuar Drejtues t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p>N\u00eb kuad\u00ebr t\u00eb bashk\u00ebpunimit me ju lidhur me konsultimin paraprak t\u00eb projekt-akteve, p\u00ebr t\u00eb cilin gjejm\u00eb rastin<strong> t\u2019ju fal\u00ebnderojm\u00eb s\u00ebrish<\/strong>, lidhur me <em>projekvendimin \u201cP\u00ebr miratimin e rregullave p\u00ebr procedurat e votimit nga jasht\u00eb vendit<\/em>\u201d,<br><strong>KRIIK ju paraqet m\u00eb posht\u00eb q\u00ebndrimin e vet lidhur me k\u00ebt\u00eb Projektvendim<\/strong>.<\/p>\n\n\n\n<p><em><u>N\u00eb parantez\u00eb,<\/u><\/em>&nbsp;KRIIK ju ri-sjell n\u00eb v\u00ebmendje&nbsp;<strong>\u00e7\u00ebshtjen e vlefshm\u00ebris\u00eb ose jo t\u00eb dokumentit t\u00eb identifikimit<\/strong>&nbsp;t\u00eb shtetasve q\u00eb jetojn\u00eb jasht\u00eb dhe kufizimin e mundsh\u00ebm t\u00eb shprehjes s\u00eb t\u00eb drejt\u00ebs s\u00eb tyre t\u00eb vot\u00ebs, lidhur me k\u00ebt\u00eb element formal.<\/p>\n\n\n\n<p>Nisur nga praktika e ndjekur n\u00eb zgjedhjet e m\u00ebparshme dhe diskutimet e shumta mbi vlefshm\u00ebrin\u00eb e dokumentit t\u00eb zgjedh\u00ebsit,&nbsp; KRIIK gjykon dhe nxit&nbsp;<strong>KQZ-n\u00eb q\u00eb, n\u00eb respekt dhe zbatim t\u00eb p\u00ebrcaktimeve t\u00eb b\u00ebra n\u00eb Kodin Zgjedhor,&nbsp; t\u00eb b\u00ebj\u00eb p\u00ebrpjekjet e duhura<\/strong>, n\u00eb bashk\u00ebpunim edhe me partit\u00eb politike parlamentare si dhe Ministrin\u00eb e Brendshme e at\u00eb t\u00eb Jashtme,&nbsp;<strong>p\u00ebr t\u00eb udh\u00ebzuar p\u00ebrshpejtimin e procedurave t\u00eb pajisjes me dokumente identifikimi t\u00eb shtetasve q\u00eb jetojn\u00eb jasht\u00eb<\/strong>, p\u00ebr efekt t\u00eb pjes\u00ebmarrjes s\u00eb tyre n\u00eb zgjedhje.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Po ashtu, nxitet&nbsp;<strong>KQZ-ja q\u00eb t\u00eb nd\u00ebrveproj\u00eb me Ministrin\u00eb e Brendshme dhe me K\u00ebshillin e Ministrave<\/strong>&nbsp;lidhur me faktin se, n\u00ebse do t\u00eb gjykohet q\u00eb t\u00eb shtyhet afati i vlefshm\u00ebris\u00eb s\u00eb dokumenteve t\u00eb identifikimit, akti ligjor p\u00ebrkat\u00ebs t\u00eb miratohet s\u00eb paku 3 muaj p\u00ebrpara dat\u00ebs s\u00eb zgjedhjeve. Kjo&nbsp;<strong>do t\u00eb siguronte zbatimin e parimit t\u00eb barazis\u00eb<\/strong>, pra t\u00eb kushteve t\u00eb barabarta n\u00eb k\u00ebt\u00eb aspekt, p\u00ebr t\u00eb gjith\u00eb shtetasit me dokumente identifikimi jo t\u00eb vlefshme dit\u00ebn e zgjedhjeve, pavar\u00ebsisht n\u00ebse ata do t\u00eb votojn\u00eb brenda apo me post\u00eb nga jasht\u00eb vendit.<\/p>\n\n\n\n<p>Lidhur me p\u00ebrmbajtjen e projekt-vendimit,&nbsp;<strong>rekomandohet si m\u00eb posht\u00eb vijon<\/strong>:<\/p>\n\n\n\n<p><strong><u>I.<\/u><\/strong>&nbsp;N\u00eb Kreun II, Pika 1 e projekt-vendimit parashikohet se:&nbsp;<em>\u201cT\u00eb drejt\u00ebn e vot\u00ebs nga jasht\u00eb vendit e ka \u00e7do shtetas shqiptar me t\u00eb drejt\u00eb vote, emri i t\u00eb cilit gjendet n\u00eb list\u00ebn p\u00ebrfundimtare t\u00eb zgjedh\u00ebsve nga jasht\u00eb dhe q\u00eb n\u00eb PER ka ngarkuar nj\u00eb dokument identifikimi t\u00eb vlefsh\u00ebm p\u00ebrpara miratimit t\u00eb k\u00ebsaj liste.\u201d<\/em><\/p>\n\n\n\n<p>KRIIK rekomandon se nevojitet t\u00eb qart\u00ebsohet e shkruhet eksplicisht q\u00eb n\u00eb PER duhet t\u00eb ngarkohet nj\u00eb&nbsp;<strong>dokument i vlefsh\u00ebm identifikimi n\u00eb dit\u00ebn e zgjedhjeve<\/strong>, sikurse Kodi Zgjedhor p\u00ebrcakton p\u00ebr k\u00ebdo zgjedh\u00ebs q\u00eb voton.<\/p>\n\n\n\n<p><strong><u>II.<\/u><\/strong>&nbsp;N\u00eb Kreun II, Pika 2 e projekt-vendimit parashikohet se:&nbsp;<em>\u201cFleta e votimit nga jasht\u00eb vendit \u00ebsht\u00eb p\u00ebr \u00e7do zon\u00eb zgjedhore, e nj\u00ebjt\u00eb me flet\u00ebn e votimit q\u00eb p\u00ebrdoret brenda territorit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, por me nj\u00eb element t\u00eb ve\u00e7ant\u00eb dallues\u201d<\/em><\/p>\n\n\n\n<p>KRIIK rekomandon se nevojitet t\u00eb shtohet edhe p\u00ebrcaktimi se&nbsp;<strong>fleta e votimit duhet t\u00eb mos p\u00ebrmbaj\u00eb asnj\u00eb kod elektronik t\u00eb lexuesh\u00ebm,&nbsp;<\/strong>pra as \u201cbarkod\u201d dhe as \u201cqrkod\u201d.<\/p>\n\n\n\n<p>Kjo&nbsp;<strong>n\u00eb funksion t\u00eb siguris\u00eb p\u00ebr mos-identifikimin n\u00eb asnj\u00eb rast t\u00eb vot\u00ebs<\/strong>, gj\u00eb e cila mund t\u00eb ndodh\u00eb n\u00ebse lidhet barkodi i flet\u00ebs s\u00eb votimit me emrin e zgjedh\u00ebsit t\u00eb cilit i d\u00ebrgohet fleta dhe me administrimin e num\u00ebrimin e saj m\u00eb pas, proces ky i monitoruar e regjistruar me kamera me rezolucion t\u00eb lart\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; KQZ-ja duhet&nbsp;<strong>t\u00eb jap\u00eb garanci t\u00eb plot\u00eb dhe mbaj\u00eb barr\u00ebn e prov\u00ebs q\u00eb procesi i fsheht\u00ebsis\u00eb s\u00eb vot\u00ebs nuk mund t\u00eb c\u00ebnohet n\u00eb asnj\u00eb rrethan\u00eb<\/strong>, pavar\u00ebsisht administrimit t\u00eb t\u00ebr\u00eb procesit nga administrata e KQZ-s\u00eb dhe garancive deklarative apo etike q\u00eb mund t\u00eb jepen n\u00eb k\u00ebt\u00eb drejtim.<\/p>\n\n\n\n<p>N\u00ebse p\u00ebr efekt t\u00eb prodhimit t\u00eb flet\u00ebve e num\u00ebrimit t\u00eb tyre paraqitet e nevojshme t\u00eb vendoset nj\u00eb kod num\u00ebrtues, \u00e7do kod elektronik apo num\u00ebrimi t\u00eb vendoset n\u00eb kundraflet\u00ebn e flet\u00ebs apo bllokut t\u00eb flet\u00ebve t\u00eb votimit, por n\u00eb asnj\u00eb rast t\u00eb mos ekzistoj\u00eb mund\u00ebsia e lidhjes, direkt apo indirekt, e \u00e7far\u00ebdo kodi apo num\u00ebrtimi t\u00eb p\u00ebrdorur me flet\u00ebn e votimit.<\/p>\n\n\n\n<p><strong><u>III.<\/u><\/strong>&nbsp;N\u00eb Kreun III.2, pika 3 e projekt-vendimit parashikohet se:&nbsp;<em>\u201cD\u00ebrgimi i dokumentacionit zgjedhor b\u00ebhet n\u00ebp\u00ebrmjet nj\u00eb sh\u00ebrbimi postar q\u00eb mund\u00ebson gjurmimin e d\u00ebrges\u00ebs.\u201d<\/em><\/p>\n\n\n\n<p>KRIIK rekomandon se nevojitet t\u00eb p\u00ebrcaktohet eksplicisht se d\u00ebrgimi i dokumentacionit zgjedhor t\u00eb b\u00ebhet&nbsp;<strong><u>detyrimisht<\/u><\/strong>&nbsp;n\u00ebp\u00ebrmjet nj\u00eb sh\u00ebrbimi&nbsp;<strong><u>t\u00eb shpejt\u00eb<\/u><\/strong>&nbsp;postar q\u00eb mund\u00ebson gjurmimin e d\u00ebrges\u00ebs.<\/p>\n\n\n\n<p>KRIIK gjykon se n\u00eb kushtet e koh\u00ebs s\u00eb konsiderueshme q\u00eb k\u00ebrkon d\u00ebrgesa me post\u00eb, shqet\u00ebsim ky i ngritur edhe nga vet\u00eb KQZ-ja, kjo e fundit&nbsp;<strong>duhet t\u00eb mos harxhoj\u00eb m\u00eb shum\u00eb se 2-3 dit\u00eb p\u00ebr t\u00eb d\u00ebrguar<\/strong>&nbsp;dokumentacionin zgjedhor tek zgjedh\u00ebsit jasht\u00eb vendit, duke i l\u00ebn\u00eb sa m\u00eb shum\u00eb koh\u00eb n\u00eb dispozicion atyre p\u00ebr d\u00ebrgimin me post\u00eb t\u00eb vot\u00ebs s\u00eb tyre.<\/p>\n\n\n\n<p>Duke qen\u00eb se kosto financiare e d\u00ebrgimit t\u00eb vot\u00ebs n\u00eb KQZ do t\u00eb mbulohet nga vet\u00eb zgjedh\u00ebsit, \u00ebsht\u00eb e natyrshme q\u00eb ata t\u00eb zgjedhin kompani postare t\u00eb ndryshme, t\u00eb shpejta ose jo. N\u00eb rastin e dyt\u00eb paraqitet detyrimisht nevoja q\u00eb zgjedh\u00ebsve tu lihet sa m\u00eb shum\u00eb koh\u00eb n\u00eb dispozicion n\u00eb m\u00ebnyr\u00eb q\u00eb ata t\u00eb mund ta d\u00ebrgojn\u00eb vot\u00ebn e tyre n\u00eb KQZ edhe me post\u00eb t\u00eb thjesht\u00eb.<\/p>\n\n\n\n<p>KRIIK gjykon se vendimi i ligjv\u00ebn\u00ebsit p\u00ebr t\u2019i mbuluar shteti kostot e d\u00ebrgimit t\u00eb dokumentacionit zgjedhor dhe diskrecioni q\u00eb KQZ-ja i ka dh\u00ebn\u00eb vetes p\u00ebr suksesin e k\u00ebtij procesi madhor, duhet ta nxis\u00eb at\u00eb p\u00ebr&nbsp;<strong>t\u00eb k\u00ebrkuar fondin e nevojsh\u00ebm financiar p\u00ebr t\u00eb p\u00ebrballuar sh\u00ebrbimin e shpejt\u00eb postar<\/strong>.<\/p>\n\n\n\n<p><strong><u>IV.<\/u><\/strong>&nbsp;Lidhur me pik\u00ebn 4 t\u00eb Kreut III.2 (<em>\u201cKomisioni Qendror i Zgjedhjeve fillimisht b\u00ebn p\u00ebrpjekje t\u00eb p\u00ebrzgjedh\u00eb ofrues nd\u00ebrkomb\u00ebtar\u00eb t\u00eb sh\u00ebrbimit postar me jasht\u00eb vendit, t\u00eb cil\u00ebt kan\u00eb eksperienc\u00eb dhe reputacion t\u00eb mir\u00eb n\u00eb sh\u00ebrbimin e post\u00ebs s\u00eb shpejt\u00eb. Zgjedhja e k\u00ebtij operatori realizohet n\u00ebp\u00ebrmjet procedurave m\u00eb afatshkurtra q\u00eb mund\u00ebson legjislacioni p\u00ebr prokurimin publik\u201d<\/em>),&nbsp;&nbsp; gjykohet se duhet t\u00eb shtohet n\u00eb vijim apo n\u00eb nj\u00eb pik\u00eb t\u00eb ve\u00e7ant\u00eb se&nbsp;<strong>KQZ-ja shpall thirrjen dhe kontakton paraprakisht me operator\u00ebt e post\u00ebs s\u00eb shpejt\u00eb<\/strong>, t\u00eb cil\u00ebt ftohen t\u00eb shprehin interesin paraprakisht dhe ofert\u00ebn financiare me fasha t\u00eb numrit t\u00eb d\u00ebrgesave dhe sipas vendeve t\u00eb ndryshme.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;Gjithashtu k\u00ebto kompani deklarojn\u00eb paraprakisht p\u00ebrmbushjen e \u00e7do parametri tjet\u00ebr t\u00eb k\u00ebrkuar prej KQZ-s\u00eb lidhur me zbatimin e k\u00ebtij procesi, s\u00eb bashku me garancit\u00eb p\u00ebrkat\u00ebse q\u00eb ato ofrojn\u00eb.<\/p>\n\n\n\n<p>Ky p\u00ebrcaktim shtes\u00eb do t\u00eb mund t\u2019i jap\u00eb mund\u00ebsi KQZ-s\u00eb t\u00eb njoh\u00eb paraprakisht terrenin dhe ofertat e kompanive n\u00eb treg, p\u00ebrfshir\u00eb p\u00ebrmbushjen e t\u00ebr\u00eb parametrave t\u00eb tjer\u00eb t\u00eb k\u00ebrkuara, duke fituar koh\u00eb e thjeshtuar m\u00eb pas edhe procesin e vendimmarrjes n\u00eb p\u00ebrzgjedhjen e kompanis\u00eb me t\u00eb cil\u00ebt do t\u00eb lidh\u00eb kontrat\u00eb.<\/p>\n\n\n\n<p>Gjithashtu, gjykohet se \u00ebsht\u00eb e nevojshme q\u00eb t\u00eb p\u00ebrcaktohet n\u00eb k\u00ebt\u00eb akt, n\u00eb k\u00ebt\u00eb kre apo n\u00eb nj\u00eb tjet\u00ebr,<strong>&nbsp; se aktmarr\u00ebveshjet apo kontratat e lidhura midis KQZ-s\u00eb dhe kompanis\u00eb\/ve p\u00ebrkat\u00ebse duhet t\u00eb p\u00ebrmbajn\u00eb t\u00eb detajuara edhe p\u00ebrgjegj\u00ebsit\u00eb e nevojshme administrative e ato penale<\/strong>&nbsp;n\u00eb rast t\u00eb c\u00ebnimit t\u00eb garancive dhe shkeljes s\u00eb akteve rregullatore t\u00eb miratuara nga KQZ-ja.<\/p>\n\n\n\n<p><strong><u>V.<\/u><\/strong>&nbsp;N\u00eb Kreun III.3, pika 2 e projekt-vendimit parashikohet se:&nbsp;<em>\u201cPasi plot\u00ebson flet\u00ebn e votimit, zgjedh\u00ebsi e vendos at\u00eb n\u00eb zarfin e flet\u00ebs s\u00eb votimit t\u00eb d\u00ebrguar nga KQZ. N\u00eb zarfin e flet\u00ebs s\u00eb votimit vendoset\/futet vet\u00ebm fleta e votimit dhe asnj\u00eb dokument tjet\u00ebr.\u201d<\/em><\/p>\n\n\n\n<p>KRIIK rekomandon se n\u00eb k\u00ebt\u00eb pik\u00eb nevojitet t\u00eb shtohet&nbsp;<strong>nj\u00eb fjali lidhur me karakteristikat e zarfit ku do t\u00eb vendoset fleta e votimit<\/strong>.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Sugjerohet q\u00eb t\u00eb p\u00ebrcaktohet se&nbsp;<strong>zarfi duhet t\u00eb jet\u00eb i p\u00ebrb\u00ebr\u00eb nga nj\u00eb let\u00ebr e trash\u00eb, me ngjyr\u00eb t\u00eb ve\u00e7ant\u00eb dhe i pa tejduksh\u00ebm<\/strong>, duke siguruar n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb mosleximin me asnj\u00eb lloj forme apo mjeti t\u00eb p\u00ebrdorur t\u00eb flet\u00ebs t\u00eb votimit q\u00eb do t\u00eb p\u00ebrmbaj\u00eb n\u00eb brend\u00ebsi.<\/p>\n\n\n\n<p><strong><u>VI.<\/u><\/strong>&nbsp;N\u00eb Kreun III.3, pika 4 e projekt-vendimit parashikohet se:&nbsp;<em>\u201cZarfi i flet\u00ebs s\u00eb votimit, i cili p\u00ebrmban vet\u00ebm flet\u00ebn e votimit, vendoset n\u00eb nj\u00eb zarf tjet\u00ebr t\u00eb siguruar nga vet\u00eb zgjedh\u00ebsi, i cili ka dimensione t\u00eb rekomanduara nga KQZ. Mbi k\u00ebt\u00eb zarf zgjedh\u00ebsi duhet t\u00eb vendos\u00eb\/ngjis\u00eb Kodin Unik t\u00eb regjistrimit t\u00eb tij n\u00eb PER, t\u00eb cilin ai e printon nga kjo platform\u00eb. Kodi Unik i zgjedh\u00ebsit gjenerohet automatikisht nga PER dhe p\u00ebrmban em\u00ebr, mbiem\u00ebr t\u00eb zgjedh\u00ebsit, shtetin ku ka k\u00ebrkuar t\u2019i d\u00ebrgohet fleta e votimit, si dhe qarkun ku ka regjistrin e gjendjes civile n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb. Kodi Unik i zgjedh\u00ebsit \u00ebsht\u00eb gjithashtu i pasqyruar n\u00eb form\u00ebn e nj\u00eb Barcode, ose QR Code.\u201d<\/em><\/p>\n\n\n\n<p>Pra thuhet se zarfi i flet\u00ebs s\u00eb votimit, i cili p\u00ebrmban vet\u00ebm flet\u00ebn e votimit, vendoset n\u00eb nj\u00eb zarf tjet\u00ebr t\u00eb siguruar nga vet\u00eb zgjedh\u00ebsi, i cili ka dimensione t\u00eb rekomanduara nga KQZ.<\/p>\n\n\n\n<p>KRIIK rekomandon q\u00eb, p\u00ebr t\u00eb leht\u00ebsuar procesin, ngarkes\u00ebn e shtetasit, por edhe shmangien e keqkuptimeve t\u00eb mundshme,&nbsp;<strong>zarfi i dyt\u00eb,&nbsp;<\/strong>n\u00eb t\u00eb cilin futet zarfi i par\u00eb q\u00eb p\u00ebrmban flet\u00ebn e votimit, duhet&nbsp;<strong>t\u00eb merret p\u00ebrsip\u00ebr e t\u00eb d\u00ebrgohet nga KQZ-ja s\u00eb bashku me dokumentacionin zgjedhor<\/strong>.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp; Sugjerohet gjithashtu q\u00eb k<strong>y zarf i dyt\u00eb t\u00eb jet\u00eb duksh\u00ebm m\u00eb i madh se zarfi i par\u00eb ku futet fleta e votimit, si dhe t\u00eb ket\u00eb nj\u00eb ngjyr\u00eb t\u00eb ndryshme nga ai<\/strong>.<\/p>\n\n\n\n<p>M\u00eb pas t\u00eb mund t\u00eb udh\u00ebzohet zgjedh\u00ebsi p\u00ebr procedurat n\u00eb vijim n\u00ebp\u00ebrmjet referimit t\u00eb ngjyr\u00ebs dhe madh\u00ebsis\u00eb s\u00eb zarfit.<\/p>\n\n\n\n<p><strong><u>VII.<\/u><\/strong>&nbsp;N\u00eb Kreun III.3, pas pik\u00ebs 6 (<em>\u201cD\u00ebrgimi i dokumentacionit zgjedhor nga zgjedh\u00ebsi p\u00ebr n\u00eb KQZ, rekomandohet t\u00eb b\u00ebhet n\u00ebp\u00ebrmjet nj\u00eb sh\u00ebrbimi postar i cili mund\u00ebson gjurmimin e d\u00ebrges\u00ebs.
