Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit Rregullator!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit t\u00eb Ankimimeve dhe Sanksioneve!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; T\u00eb nderuar Drejtues t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p>N\u00eb vijim t\u00eb Rekomandimit t\u00eb KRIIK, nr. 2501\/003K(e-k) prot. dat\u00eb 28.01.2025, ku u shpreh nevoja p\u00ebr unifikimin propozimeve t\u00eb trupave drejtuese t\u00eb KQZ-s\u00eb lidhur me amendimin e Vendimit nr. 9\/2020 t\u00eb Komisionit Rregullator dhe nevoja p\u00ebr m\u00eb shum\u00eb koh\u00eb e nj\u00eb konsultim sa m\u00eb t\u00eb gjer\u00eb e efektiv lidhur me t\u00eb, si dhe n\u00eb kushtet kur, dit\u00ebn e sotme dat\u00eb 30 janar 2025, \u00ebsht\u00eb njoftuar mbledhje e Komisionit Rregullator me rend dite nj\u00ebrin prej propozimeve p\u00ebr ndryshim, \u00e7ka eventualisht mund t\u00eb sjell\u00eb amendime konkrete t\u00eb k\u00ebtij akti,&nbsp;<\/p>\n\n\n\n<p>KRIIK, megjith\u00ebse n\u00eb nj\u00eb koh\u00eb shum\u00eb t\u00eb shkurt\u00ebr n\u00eb dispozicion, <strong>ju paraqet m\u00eb posht\u00eb rekomandimet e tij mbi disa nga \u00e7\u00ebshtjet kryesore<\/strong> q\u00eb gjykohet se duhet t\u00eb adresoj\u00eb amendimi i Vendimit nr. 9\/2020,&nbsp; si dhe <strong>mbi dy aktet amenduese t\u00eb d\u00ebrguara<\/strong> p\u00ebr konsultim nga KQZ-ja, aktin e propozuar nga dy an\u00ebtar\u00eb t\u00eb Komisionit Rregullator dhe at\u00eb t\u00eb paraqitur si propozim i Komisionerit Shtet\u00ebror t\u00eb Zgjedhjeve.&nbsp;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Propozime mbi tekstin aktual t\u00eb Vendimit nr. 9\/2020, i ndryshuar.<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Parimi baz\u00eb mbi t\u00eb cilin bazohen propozimet e m\u00ebposhtme \u00ebsht\u00eb <strong>rritja e efektivitetit t\u00eb mekanizmave n\u00eb dispozicion t\u00eb KQZ-s\u00eb dhe vet\u00eb parashikimeve t\u00eb b\u00ebra n\u00eb Vendim p\u00ebr t\u00eb parandaluar apo sanksionuar p\u00ebrdorimin e burimeve shtet\u00ebrore p\u00ebr avantazh elektoral.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Me k\u00ebt\u00eb synim, disa nga element\u00ebt q\u00eb, n\u00eb gjykimin ton\u00eb, lipset t\u00eb adresohen dhe q\u00eb nuk jan\u00eb t\u00eb till\u00eb as n\u00eb amendimet e propozuara dhe d\u00ebrguara p\u00ebr konsultim n\u00eb dat\u00ebn 27 janar, jan\u00eb:<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Unifikimi n\u00eb Vendim i afatit kohor<\/strong> se <strong>\u00e7far\u00eb konsiderohet periudh\u00eb zgjedhore<\/strong> n\u00eb kuptim t\u00eb zbatimit t\u00eb k\u00ebtij vendimi. P\u00ebr analogji t\u00eb ndalimeve t\u00eb vendosura n\u00eb ligj, n\u00eb gjykimin e KRIIK, periudh\u00eb zgjedhore apo \u00e7do terminologji q\u00eb p\u00ebrdoret n\u00eb Vendim p\u00ebr t\u00eb p\u00ebrshkruar perudh\u00ebn kohore t\u00eb ndalimeve duhet t\u00eb konsiderohet periudha 4 muaj para dit\u00ebs s\u00eb zgjedhjeve deri n\u00eb dit\u00ebn e zgjedhjeve, p\u00ebrjashto ato q\u00eb lidhen eksplicisht me periudh\u00ebn nj\u00eb mujore t\u00eb fushat\u00ebs zgjedhore.&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Ky sakt\u00ebsim i terminologjis\u00eb s\u00eb p\u00ebrdorur n\u00eb t\u00ebr\u00eb aktin do t\u00eb adresonte edhe problematikat e lindura gjat\u00eb hetimit apo gjykimit administrativ, nga interpretime subjektive t\u00eb ndryshme, sikurse n\u00eb vijim\u00ebsi ka ndodhur.&nbsp;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li>Nisur nga fakti q\u00eb institucionet publike vijojn\u00eb ta rrisin abuzimin lidhur me p\u00ebrdorimin e burimeve t\u00eb tyre n\u00eb funksion t\u00eb fushat\u00ebs zgjedhore, si dhe, nga ana tjet\u00ebr, thuajse kan\u00eb mbyllur kanalet e informimit p\u00ebr aktor\u00ebt jasht\u00eb institucionit, duke mos ofruar transparenc\u00eb as edhe n\u00eb rastet kur investohen organizata t\u00eb shoq\u00ebris\u00eb civile t\u00eb akredituara si v\u00ebzhguese t\u00eb zgjedhjeve,&nbsp;&nbsp; <strong>lind nevoja q\u00eb<\/strong>, lidhur me nenin 3 pika 1.1 t\u00eb Vendimit, ku thuhet \u201c<em>veprimtari t\u00eb ndaluara p\u00ebr tu promovuar\u201d jan\u00eb veprimtarit\u00eb publike sipas p\u00ebrkufizimit t\u00eb nenit 2, t\u00eb k\u00ebtij vendimi, p\u00ebr t\u00eb cilat jan\u00eb v\u00ebn\u00eb rishtazi apo posa\u00e7\u00ebrisht n\u00eb dispozicion, apo jan\u00eb transferuar fonde publike jo sipas planit buxhetor t\u00eb miratuar, n\u00eb periudh\u00ebn 4 (kat\u00ebr) mujore para dat\u00ebs s\u00eb zgjedhjeve dhe q\u00eb p\u00ebrfshijn\u00eb: (\u2026)\u201d<\/em>,&nbsp; <strong>t\u00eb b\u00ebhet transparenc\u00eb e plot\u00eb dhe t\u00eb informohet paraprakisht prej \u00e7do institucioni plani buxhetor dhe ai i investimeve dhe veprimtarive q\u00eb angazhojn\u00eb burime financiare dhe materiale p\u00ebr t\u00eb gjith\u00eb periudh\u00ebn 4-mujore<\/strong>, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb mund t\u00eb jepet mund\u00ebsia p\u00ebr informim objektiv dhe verifikim prej monitoruesve t\u00eb KQZs\u00eb, v\u00ebzhguesve, subjekteve zgjedhore, medias dhe \u00e7do qytetari t\u00eb interesuar.&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Th\u00ebn\u00eb sa m\u00eb sip\u00ebr, m\u00ebnyra se si kjo hallk\u00eb t\u00eb mund t\u00eb b\u00ebhet e kontrollueshme mbetet detyrimi ligjor, p\u00ebr efekt t\u00eb parashikimeve t\u00eb Vendimit 9\/2020, i institucioneve q\u00eb t\u00eb <strong>publikojn\u00eb n\u00eb faqen e tyre t\u00eb internetit planin e<\/strong> <strong>buxhetit si dhe planin e investimeve t\u00eb parashikuara p\u00ebrgjat\u00eb periudh\u00ebs kat\u00ebr mujore.&nbsp;<\/strong><\/p>\n\n\n\n<p>Kjo do t\u00eb mund\u00ebsoj\u00eb gjykimin nga nj\u00eb aktor i jasht\u00ebm n\u00ebse nj\u00eb investim apo veprimtari po kryhet me buxhet t\u00eb planifikuar p\u00ebrpara se t\u00eb nis\u00eb periudha kat\u00ebr-mujore e ndalimit apo fondet jan\u00eb vendosur rishtas n\u00eb dispozicion.&nbsp;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li>Vendosja <strong>n\u00eb funksionim e mekanizmit t\u00eb denoncimeve n\u00eb faqet e internetit<\/strong> <strong>t\u00eb institucioneve<\/strong>. Duke marr\u00eb shkas nga fakti se, bazuar n\u00eb monitorimin e KRIIK, n\u00eb nj\u00eb num\u00ebr t\u00eb konsideruesh\u00ebm kontaktet e drejtuesve nuk jan\u00eb t\u00eb paraqitura n\u00eb faqet e institucioneve, n\u00eb kund\u00ebrshtim me parashikimin e pik\u00ebs 1.c t\u00eb nenit 7 t\u00eb Vendimit nr. 9\/2020, gjykohet se nevojiten <strong>t\u00eb parashikohen<\/strong> <strong>masa shtr\u00ebnguese dhe sanksione konkrete p\u00ebr mosplot\u00ebsimin e k\u00ebtij detyrimi<\/strong>.&nbsp;&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>Vendimi i K\u00ebshillit t\u00eb Ministrave nr. 782, dat\u00eb 18.12.2024 \u201cP\u00ebr p\u00ebrcaktimin e rregullave t\u00eb detajuara p\u00ebr aksesimin e faqeve zyrtare t\u00eb internetit t\u00eb autoriteteve publike\u201d, p\u00ebrb\u00ebn nj\u00eb detyrim tashm\u00eb p\u00ebr pajisjen me faqe interneti t\u00eb \u00e7do institucioni q\u00eb p\u00ebrfshihet n\u00eb sfer\u00ebn e Vendimit 9\/2020.<\/p>\n\n\n\n<p>Po ashtu, p\u00ebr t\u00eb rritur efektivitetin e aktit, gjykohet <strong>se duhet detajuar parashikimi se si \u00e7do institucion duhet t\u00eb b\u00ebj\u00eb funksionale n\u00eb faqen e tij t\u00eb internetit nj\u00eb form\u00eb denoncimi t\u00eb qart\u00eb p\u00ebr abuzimet e mundshme<\/strong> t\u00eb konstatuara nga aktor\u00eb apo individ\u00eb t\u00eb ndrysh\u00ebm, n\u00eb veprimtarin\u00eb e tij apo prej punonj\u00ebsve t\u00eb institucionit.&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, n\u00eb funksion edhe t\u00eb rritjes s\u00eb besimit t\u00eb qytetar\u00ebve dhe autoritetit t\u00eb vet\u00eb institucionit,&nbsp; nevojitet q\u00eb n\u00eb faqen e internetit t\u00eb institucionit, <strong>t\u00eb paraqitet n\u00eb nd\u00ebrfaqen kryesore dhe n\u00eb nj\u00eb vend t\u00eb duksh\u00ebm kontakti i drejtuesit dhe&nbsp; mund\u00ebsia e denoncimit, e shoq\u00ebruar kjo me nj\u00eb informacion t\u00eb plot\u00eb dhe t\u00eb qart\u00eb<\/strong> mbi m\u00ebnyr\u00ebn e operimit t\u00eb k\u00ebtij mekanzmi, hapat e ndjekura nga drejtuesi i institucionit n\u00eb ndjekje t\u00eb denoncimit, si dhe m\u00ebnyrat e b\u00ebrjes publike t\u00eb konkludimit t\u00eb arritur dhe masave t\u00eb mundshme t\u00eb marra.&nbsp;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Futja e konceptit t\u00eb p\u00ebrdorimit t\u00eb \u201cAutoriteti Shtet\u00ebror\u201d p\u00ebr avantazh t\u00eb padrejt\u00eb elektoral. <\/strong>&nbsp;<\/li>\n<\/ol>\n\n\n\n<p>KRIIK ka advokuar n\u00eb vijim\u00ebsi p\u00ebr kuptimin e drejt\u00eb t\u00eb p\u00ebrdorimit t\u00eb burimeve shtet\u00ebrore p\u00ebr avantazh elektoral jo thjesht n\u00eb kuptimin financiar, material e njer\u00ebzor, por edhe n\u00eb dimensionin e kuptimit <strong>t\u00eb p\u00ebrdorimit t\u00eb \u201cautoritetit shtet\u00ebror apo autoritetit t\u00eb institucionit publik\u201d<\/strong>, i cili \u00ebsht\u00eb pjes\u00eb e pandashme e institucioneve publike, drejtuesve dhe administrat\u00ebs s\u00eb tyre dhe q\u00eb lidhet me kostumin zyrtar q\u00eb mbart me vete \u00e7do punonj\u00ebs administrate, gjat\u00eb orarit zyrtar dhe jasht\u00eb tij.&nbsp;<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb kuptim \u00ebsht\u00eb nj\u00eb rregullim i t\u00ebr\u00eb i p\u00ebrcaktuar n\u00eb:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.kryeministria.al\/wp-content\/uploads\/2021\/10\/ligj-2003-09-08-9131.pdf\">Ligjin nr.9131, dat\u00eb<\/a><a href=\"https:\/\/www.kryeministria.al\/wp-content\/uploads\/2021\/10\/ligj-2003-09-08-9131.pdf\"> <\/a><a href=\"https:\/\/www.kryeministria.al\/wp-content\/uploads\/2021\/10\/ligj-2003-09-08-9131.pdf\">8.9.2003<\/a><a href=\"https:\/\/www.kryeministria.al\/wp-content\/uploads\/2021\/10\/ligj-2003-09-08-9131.pdf\">,<\/a> \u201cP\u00ebr rregullat e etik\u00ebs n\u00eb administrat\u00ebn publike\u201d;&nbsp;&nbsp;&nbsp; N\u00ebpun\u00ebsi shtet\u00ebror q\u00eb angazhohet n\u00eb m\u00ebnyr\u00eb aktive n\u00eb fushat\u00eb, avantazhon forc\u00ebn politike p\u00ebr t\u00eb cil\u00ebn angazhohet drejtp\u00ebrdrejt. P.sh., nj\u00eb n\u00ebpun\u00ebs shtet\u00ebror i cili angazhohet n\u00eb fushat\u00eb der\u00eb m\u00eb der\u00eb p\u00ebr nj\u00eb parti politike mund <strong>t\u00eb perceptohet jo si nj\u00eb aktivist i zakonsh\u00ebm, por si p\u00ebrfaq\u00ebsues i shtetit<\/strong>.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp; Prania e tij mund t\u00eb ndikoj\u00eb zgjedh\u00ebsit, ve\u00e7an\u00ebrisht ata q\u00eb varen nga sh\u00ebrbimet publike, duke krijuar ndjesin\u00eb se <strong>mb\u00ebshtetja p\u00ebr k\u00ebt\u00eb parti \u00ebsht\u00eb e lidhur me aksesin n\u00eb k\u00ebto sh\u00ebrbime<\/strong>.&nbsp;&nbsp; P\u00ebr m\u00eb tep\u00ebr, edhe n\u00ebse nj\u00eb n\u00ebpun\u00ebs angazhohet jasht\u00eb orarit zyrtar, \u00ebsht\u00eb e v\u00ebshtir\u00eb t\u00eb ndahen plot\u00ebsisht roli i tij publik dhe ai politik, ve\u00e7an\u00ebrisht kur ka mund\u00ebsi t\u00eb p\u00ebrdor\u00eb informacionin apo infrastruktur\u00ebn shtet\u00ebrore.&nbsp;<\/p>\n\n\n\n<p>Kjo d\u00ebmton barazin\u00eb e gar\u00ebs zgjedhore, pasi <strong>partia n\u00eb pushtet p\u00ebrfiton nga mobilizimi i administrat\u00ebs<\/strong>, nd\u00ebrsa opozita nuk ka t\u00eb nj\u00ebjt\u00ebn mund\u00ebsi, duke ndikuar k\u00ebshtu negativisht n\u00eb procesin demokratik dhe lirin\u00eb e zgjedh\u00ebsve p\u00ebr t\u00eb vendosur pa ndikime t\u00eb jashtme, p\u00ebrpos efekteve t\u00eb tjera tejet negative q\u00eb lidhen me politizimin e administrat\u00ebs apo format e intimidimeve t\u00eb qytetar\u00ebve apo vet\u00eb punonj\u00ebsve t\u00eb administrat\u00ebs, etj.<\/p>\n\n\n\n<p>N\u00eb k\u00ebto kushte, \u00ebsht\u00eb e nevojshme q\u00eb <strong>Vendimi nr. 9 t\u00eb p\u00ebrcaktoj\u00eb<\/strong> jo vet\u00ebm ndalimin e n\u00ebpun\u00ebsit civil p\u00ebr t\u00eb qen\u00eb protagonist aktiv n\u00eb aktivitete elektorale, por n\u00eb m\u00ebnyr\u00eb eksplicite <strong>t\u2019i ndalohet \u00e7do punonj\u00ebsi t\u00eb institucioneve t\u00eb administrat\u00ebs publike&nbsp; angazhimi n\u00eb fushat\u00ebn der\u00eb m\u00eb der\u00eb, apo forma t\u00eb tjera angazhimi si protagonist n\u00eb aktivitetet politike elektorale me qytetar\u00ebt. <\/strong>&nbsp;<\/p>\n\n\n\n<p><strong><u>I.4.b.<\/u>&nbsp; Parashikimi i raportimit t\u00eb eventeve ku p\u00ebrfaq\u00ebsuesi i nj\u00eb institucioni publik \u00ebsht\u00eb i ftuar si fol\u00ebs.&nbsp;<\/strong><\/p>\n\n\n\n<p>N\u00eb rastet kur funksionar\u00eb t\u00eb nj\u00eb institucioni publik marrin pjes\u00eb si fol\u00ebs n\u00eb nj\u00eb event t\u00eb organizuar nga nj\u00eb subjekt tjet\u00ebr, raportimi si fol\u00ebs <strong>siguron transparenc\u00eb mbi aktivitetet e tyre publike dhe t\u00eb p\u00ebrdorimit t\u00eb \u201cautoritetit shtet\u00ebror\u201d t\u00eb institucioneve<\/strong> q\u00eb ata p\u00ebrfaq\u00ebsojn\u00eb.&nbsp;<\/p>\n\n\n\n<p>Kjo nevoj\u00eb <strong>b\u00ebhet edhe m\u00eb e r\u00ebnd\u00ebsishme kur eventet organizohen nga subjekte t\u00eb cilat nuk jan\u00eb institucione publike <\/strong>dhe nuk kan\u00eb detyrimin p\u00ebr t\u00eb raportuar n\u00eb NRI, si OJF-t\u00eb apo bizneset private.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Theksohet se p\u00ebrfaq\u00ebsuesi institucional q\u00eb flet n\u00eb nj\u00eb event t\u00eb till\u00eb shkon aty i veshur me autoritet shtet\u00ebror dhe n\u00ebse eventi ka nota elektorale, apo n\u00ebse vet\u00eb fol\u00ebsi (titullari institucional) b\u00ebn propagand\u00eb politike, qoft\u00eb edhe t\u00eb t\u00ebrthort\u00eb, \u00ebsht\u00eb duke p\u00ebrdorur autoritetin e ofiqit zyrtar q\u00eb mbart vet\u00eb si dhe \u201cautoritetin shtet\u00ebror\u201d t\u00eb institucionit publik q\u00eb p\u00ebrfaq\u00ebson p\u00ebr fushat\u00eb elektorale.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><u>I.5.<\/u><\/strong> P\u00ebr t\u00eb rritur transparenc\u00ebn e institucioneve publike n\u00eb raport me v\u00ebzhguesit e zgjedhjeve, nevojiten <strong>t\u00eb parashikohen masa shtr\u00ebnguese dhe sanksione p\u00ebr rastet kur institucionet nuk respektojn\u00eb detyrimet e p\u00ebrcaktuara n\u00eb Vendimin nr. 9 (neni 3, pika 6)<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Aktualisht, shpesh ndodh q\u00eb institucionet nuk i p\u00ebrgjigjen k\u00ebrkesave t\u00eb v\u00ebzhguesve, nuk ofrojn\u00eb informacionin e k\u00ebrkuar, ose ofrojn\u00eb vet\u00ebm nj\u00eb pjes\u00eb t\u00eb informacionit, duke penguar monitorimin efektiv t\u00eb proceseve zgjedhore.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Afatet e parashikuara n\u00eb ligjin p\u00ebr t\u00eb Drejt\u00ebn e Informimit dhe procedurat p\u00ebr ankimim n\u00eb rast t\u00eb mosp\u00ebrgjigjes k\u00ebrkojn\u00eb koh\u00eb t\u00eb gjat\u00eb, duke e sjell\u00eb q\u00eb zgjidhja t\u00eb vij\u00eb pas p\u00ebrfundimit t\u00eb procesit zgjedhor, kur d\u00ebmi tashm\u00eb \u00ebsht\u00eb kryer.&nbsp;<\/p>\n\n\n\n<p>P\u00ebr k\u00ebt\u00eb arsye, \u00ebsht\u00eb e nevojshme <strong>t\u00eb krijohet nj\u00eb mekaniz\u00ebm efektiv q\u00eb mund\u00ebson raportimin e menj\u00ebhersh\u00ebm t\u00eb rasteve t\u00eb mosbashk\u00ebpunimit apo refuzimit ndaj organizatave q\u00eb jan\u00eb t\u00eb regjistruara dhe akredituara n\u00eb KQZ si v\u00ebzhgues t\u00eb zgjedhjeve<\/strong>.&nbsp;<\/p>\n\n\n\n<p>&nbsp; vler\u00ebson se p\u00ebrdorimi i rrjeteve sociale apo platformave sociale [&#8230;] apo mjete t\u00eb tjera t\u00eb komunikimit elektronik, p\u00ebr q\u00ebllime t\u00eb propagandimit apo shprehjes publike t\u00eb bindjeve dhe preferencave politike t\u00eb n\u00ebpun\u00ebsit civil, \u00ebsht\u00eb i ndaluar, n\u00eb referenc\u00eb t\u00eb p\u00ebrcaktimit t\u00eb pik\u00ebs 1, t\u00eb nenit 37 t\u00eb ligjit 152\/2013, \u201cP\u00ebr n\u00ebpun\u00ebsin civil\u201d, i ndryshuar.\u201d&nbsp;<\/p>\n\n\n\n<p>KRIIK gjykon se <strong>kjo shtrirje dhe ky interpretim i drejt\u00eb i ligjit<\/strong>, i aprovuar dhe mb\u00ebshtetur edhe nga Kuvendi i Shqip\u00ebris\u00eb n\u00eb miratimin e raporteve vjetore t\u00eb KMSHCs\u00eb e rezolutave p\u00ebrkat\u00ebse,&nbsp; <strong>do t\u00eb duhet t\u00eb p\u00ebrfshihet n\u00eb m\u00ebnyr\u00eb t\u00eb detajuar edhe n\u00eb Vendimin nr. 9<\/strong>, specifikisht n\u00eb pik\u00ebn 5 t\u00eb nenit 6.&nbsp;<\/p>\n\n\n\n<p><strong><u>I.8.<\/u><\/strong> N\u00eb nenin 6 pika 7 t\u00eb Vendimit, ku parashikohet e drejta p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb Komisionet e nivelit t\u00eb dyt\u00eb dhe t\u00eb tret\u00eb,&nbsp; do t\u00eb duhet t\u00eb amendohet n\u00eb harmonizim me Vendimin nr. 2, dat\u00eb 17.01.2025 t\u00eb Komisionit Rregullator &#8220;P\u00ebr disa shtesa dhe ndryshime n\u00eb Vendimin nr. 05, dat\u00eb 20.11.2020, \u201cP\u00ebr miratimin e rregullores p\u00ebr organizimin dhe funksionimin e Komisionit t\u00eb Zon\u00ebs s\u00eb Administrimit Zgjedhor\u201d, i ndryshuar, duke p\u00ebrcaktuar q\u00eb p\u00ebrpos njoftimit t\u00eb merret leja p\u00ebrkat\u00ebse prej Institucionit Publik.&nbsp;<\/p>\n\n\n\n<p><strong><u>I.9.<\/u><\/strong> N\u00eb akt <strong>nevojitet t\u00eb sakt\u00ebsohet se sanksionet administrative<\/strong> propozohen nga Komisioneri Shtet\u00ebror i Zgjedhjeve dhe vendosen nga Komisioni i Ankesave dhe Sanksioneve.&nbsp;<\/p>\n\n\n\n<ol style=\"list-style-type:upper-roman\" class=\"wp-block-list\">\n<li><strong>Lidhur me projektvendimin \u201c<em>P\u00ebr disa shtesa dhe ndryshime n\u00eb vendimin nr. 9, dat\u00eb 24.12.2020, i ndryshuar, t\u00eb Komisionit Rregullator, \u201cP\u00ebr rregullat e raportimit t\u00eb veprimtarive me karakter publik t\u00eb \u00e7do institucioni publik, e me kapital shtet\u00ebror, agjencive, enteve shtet\u00ebrore, kategorit\u00eb e veprimtarive t\u00eb ndaluara, si dhe monitorimin e veprimtaris\u00eb, sjelljes dhe p\u00ebrdorimit t\u00eb burimeve njer\u00ebzore, financiare dhe logjistike t\u00eb administrat\u00ebs shtet\u00ebrore para zgjedhjeve<\/em>\u201d,&nbsp;&nbsp; projekt-akt i dy An\u00ebtar\u00ebve t\u00eb Komisionit Rregullator.<\/strong><\/li>\n<\/ol>\n\n\n\n<p>KRIIK <strong>shpreh vler\u00ebsimin e tij p\u00ebr iniciativ\u00ebn dhe propozimet<\/strong> e p\u00ebrfshira n\u00eb t\u00eb , <strong>t\u00eb cilat mb\u00ebshteten plot\u00ebsisht<\/strong>, nd\u00ebrkoh\u00eb q\u00eb, <strong>gjykohet se pika 2 dhe pika 4 n\u00eb propozim mund t\u00eb p\u00ebrmir\u00ebsohen m\u00eb tej<\/strong>. b\u00ebhen transparente sipas p\u00ebrcaktimit t\u00eb agjend\u00ebs s\u00eb ushtrimit t\u00eb tyre dhe t\u00eb raportohen sipas p\u00ebrcaktimeve n\u00eb k\u00ebt\u00eb vendim<\/em>.\u201d<\/p>\n\n\n\n<p>Duke marr\u00eb t\u00eb mir\u00ebqen\u00eb se \u00ebsht\u00eb nj\u00eb ngat\u00ebrres\u00eb dhe <strong>projekt-vendimi i referohet shkronj\u00ebs \u201cc\u201d t\u00eb nenit 2 t\u00eb Vendimit nr. 9\/2024<\/strong>, duke qen\u00eb se aty p\u00ebrfshihen \u201c<em>veprimtarit\u00eb publike<\/em>\u201d,&nbsp; n\u00eb gjykimin e KRIIK p\u00ebrkufizimi i \u201cveprimtarive publike\u201d i ndryshuar n\u00ebp\u00ebrmjet amendimin t\u00eb Vendimit nr. 9 n\u00eb muajin dhjetor 2024, <strong>ka nj\u00eb p\u00ebrkufizim m\u00eb t\u00eb qart\u00eb t\u00eb k\u00ebtij koncepti, ndaj do t\u00eb ishte e udh\u00ebs q\u00eb ai t\u00eb mos ndryshohej n\u00eb p\u00ebrmbajtje<\/strong>.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, <strong>vler\u00ebsohet me vend shtimi i togfjal\u00ebshit \u201ct\u00eb zhvilluara brenda dhe jasht\u00eb vendit\u201d<\/strong> pas fillimit t\u00eb fjalis\u00eb \u201c\u201cVeprimtari publike\u201d jan\u00eb t\u00eb gjitha veprimtarit\u00eb me karakter publik\u201d.<\/p>\n\n\n\n<p>Po ashtu <strong>n\u00eb fund t\u00eb pik\u00ebs \u201cc\u201d, t\u00eb shtohet fjalia e propozuar:<\/strong> \u201cVeprimtarit\u00eb publike p\u00ebr q\u00ebllime t\u00eb k\u00ebtij vendimi duhet t\u00eb b\u00ebhen transparente sipas p\u00ebrcaktimit t\u00eb agjend\u00ebs s\u00eb ushtrimit t\u00eb tyre dhe t\u00eb raportohen sipas p\u00ebrcaktimeve n\u00eb k\u00ebt\u00eb vendim.\u201d<\/p>\n\n\n\n<p><strong><u>II.2.<\/u><\/strong> N\u00eb projekt-vendimin e propozuar n\u00eb pik\u00ebn 4 citohet se: \u201cN\u00eb nenin 3 \u201cVeprimtari t\u00eb Ndaluara\u201d, pika 1.1 riformulohet si m\u00eb posht\u00eb: <strong>&nbsp;<\/strong><\/p>\n\n\n\n<p><em>\u201cVeprimtari t\u00eb ndaluara p\u00ebr t\u2019u promovuar brenda dhe jasht\u00eb vendit\u201d jan\u00eb veprimtarit\u00eb publike t\u00eb zhvilluara brenda dhe jasht\u00eb vendit sipas p\u00ebrkufizimit t\u00eb nenit 2 t\u00eb k\u00ebtij vendimi, p\u00ebr t\u00eb cilat jan\u00eb v\u00ebn\u00eb rishtazi apo posa\u00e7\u00ebrisht n\u00eb dispozicion, apo jan\u00eb transferuar fonde publike jo sipas planit buxhetor t\u00eb miratuar, n\u00eb periudh\u00ebn 4 (kat\u00ebr) mujore para dat\u00ebs s\u00eb zgjedhjeve dhe q\u00eb p\u00ebrfshijn\u00eb\u201d por pa u kufizuar n\u00eb: p\u00ebrdorimin e fondeve publike p\u00ebr mb\u00ebshtetje t\u00eb subjekteve zgjedhore, v\u00ebnien n\u00eb dispozicion t\u00eb burimeve shtet\u00ebrore t\u00eb natyr\u00ebs materiale dhe njer\u00ebzore p\u00ebr q\u00ebllime elektorale.\u201d<\/em>\u201d<\/p>\n\n\n\n<p>P\u00ebrcaktimi i b\u00ebr\u00eb n\u00eb n\u00ebnpik\u00ebn 1.1, t\u00eb pik\u00ebs 1 t\u00eb nenit 3 t\u00eb Vendimit nr. 9\/2020 ka nj\u00eb kategori specifikimesh, t\u00eb cilat <strong>gjykohet se jan\u00eb t\u00eb nevojshme q\u00eb t\u00eb mos hiqen, por t\u00eb pasurohen m\u00eb tej me element\u00eb t\u00eb tjer\u00eb<\/strong>.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kjo edhe p\u00ebr shkak t\u00eb interpretimit subjektiv n\u00eb t\u00eb kuptuar t\u00eb parashikimeve t\u00eb Vendimit nr. 9 mbi llojin e veprimtarive, duke \u00e7uar rrjedhimisht n\u00eb bllokimin e mekanizmit parandalues q\u00eb synon Vendimi, sikurse ka ndodhur n\u00eb praktik\u00eb n\u00eb proceset e m\u00ebparshme zgjedhore.&nbsp;<\/p>\n\n\n\n<p>N\u00eb kushtet kur \u00e7do parashikim i shtuar mund eventualisht t\u00eb mos jet\u00eb shterues, <strong>do t\u00eb ishte e udh\u00ebs q\u00eb lloji i veprimtarive t\u00eb shtohej <\/strong>me detajime t\u00eb m\u00ebtejshme, apo, s\u00eb paku, <strong>t\u00eb lihet e hapur mund\u00ebsia e p\u00ebrfshirjes edhe t\u00eb llojeve t\u00eb tjera t\u00eb
