\u00ebsht\u00eb i parashikuar kryesisht mbi qart\u00ebsimin e rregullave dhe procedurave t\u00eb raportimit t\u00eb institucioneve publike mbi veprimtarit\u00eb e tyre, sikurse \u00ebsht\u00eb paraqitur n\u00eb relacionin e tij dhe sipas komunikimit verbal t\u00eb b\u00ebr\u00eb me institucionin e KQZ-s\u00eb,&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>KRIIK ju nxit t\u00eb vijoni m\u00eb tej me amendimin e Vendimit nr. 9 edhe mbi aspekte t\u00eb tjera shum\u00eb t\u00eb rend\u00ebsishme t\u00eb parashikuara prej tij, t\u00eb cilat kan\u00eb rezultuar se jan\u00eb t\u00eb paplota, me mang\u00ebsi dhe q\u00eb duhen p\u00ebrmir\u00ebsuar m\u00eb tej, p\u00ebrpara dat\u00ebs 11 janar 2025<\/strong>, kur edhe nis p\u00ebriudha kat\u00ebr mujore e parashikuar nga Kodi Zgjedhor.&nbsp;<\/p>\n\n\n\n<p>KRIIK thekson dhe sjell n\u00eb v\u00ebmendjen tuaj se <strong>nj\u00eb nga element\u00ebt m\u00eb problematik\u00eb dhe kryesor\u00eb<\/strong> q\u00eb d\u00ebmtojn\u00eb integritetin e zgjedhjeve n\u00eb vend \u00ebsht\u00eb <strong>p\u00ebrdorimi i burimeve shtet\u00ebrore p\u00ebr avantazh elektoral dhe se Komisioni Qendror i Zgjedhjeve ka nj\u00eb rol par\u00ebsor<\/strong> p\u00ebr luftimin e k\u00ebtij fenomeni, sikurse edhe ODIHR ka vler\u00ebsuar.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Ndryshe nga sa \u00ebsht\u00eb relativizuar <\/strong>n\u00eb diskutimet e tryezave teknike t\u00eb zhvilluara s\u00eb fundmi dhe opinionin publik <strong>se mekanizmi i raportimit<\/strong> t\u00eb veprimtarive t\u00eb institucioneve <strong>\u00ebsht\u00eb thjesht nj\u00eb deklarim formal<\/strong> prej tyre, <strong>KRIIK<\/strong>, si nj\u00eb aktor me p\u00ebrvoj\u00eb t\u00eb gjat\u00eb dhe q\u00eb ka ndjekur nga af\u00ebr t\u00ebr\u00eb proceset elektorale dhe mekanizmin n\u00eb fjal\u00eb, <strong>thekson me forc\u00eb kund\u00ebrt\u00ebn<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Mekanizmi i raportimit nga ana e institucioneve p\u00ebr veprimtarit\u00eb publike q\u00eb parashikojn\u00eb t\u00eb realizojn\u00eb dhe roli i KQZ-s\u00eb n\u00eb mbikqyrjen dhe kontrollin e tyre <strong>\u00ebsht\u00eb instrumenti kryesor ndon\u00ebse jo i vetmi<\/strong>, n\u00eb dispozicion t\u00eb KQZ-s\u00eb n\u00eb k\u00ebt\u00eb funksion.&nbsp;<\/p>\n\n\n\n<p>KRIIK ju rikujton <strong>se Ligjv\u00ebn\u00ebsi ka ngarkuar KQZ-n\u00eb me funksione \u201clegjislative\u201d<\/strong>, ve\u00e7an\u00ebrisht \u201cKomisionin Rregullator\u201d si komision kolegjial, <strong>p\u00ebr t\u00eb adresuar plot\u00ebsisht fenomenim n\u00eb fjal\u00eb n\u00ebp\u00ebrmjet plot\u00ebsimit t\u00eb plot\u00eb t\u00eb kuadrit rregullator<\/strong>, t\u00eb nevojsh\u00ebm p\u00ebr tu zbatuar nga institucionet publike dhe aktor\u00ebt e tjer\u00eb t\u00eb p\u00ebrfshir\u00eb, sikurse edhe nga vet\u00eb administrata dhe organet drejtuese t\u00eb KQZ-s\u00eb.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00cbsht\u00eb e r\u00ebnd\u00ebsishme q\u00eb n\u00eb ushtrimin e k\u00ebsaj p\u00ebrgjegj\u00ebsie, <strong>KQZ-ja t\u00eb ec\u00eb p\u00ebrpara duke u bazuar n\u00eb kufijt\u00eb e vendosur nga Kushtetuta e Ligji dhe duke e par\u00eb k\u00ebt\u00eb t\u00eb fundit jo ngusht\u00ebsisht<\/strong>, por n\u00eb kuptimin e plot\u00eb t\u00eb tij dhe frym\u00ebs q\u00eb p\u00ebrmban t\u00ebr\u00eb Kodi Zgjedhor dhe parimet kushtetuese p\u00ebrkat\u00ebse, si edhe <strong>duke marr\u00eb ve\u00e7an\u00ebrisht n\u00eb konsiderat\u00eb p\u00ebrvoj\u00ebn dhe problematikat e hasura n\u00eb periudh\u00ebn 2021-2024 dhe ng\u00ebr\u00e7et e krijuara n\u00eb p\u00ebrmbushjen e rolit t\u00eb KQZ-s\u00eb e zbatimit t\u00eb plot\u00eb t\u00eb ligjit<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>Bazuar edhe n\u00eb paragrafin e par\u00eb t\u00eb sesioni II t\u00eb relacionit<\/strong> \u201cP\u00ebrmbledhje shpjeguese e p\u00ebrmbajtjes s\u00eb projekt-vendimit\u201d ku thuhet, nd\u00ebr t\u00eb tjera, se ky akt i sot\u00ebm ka <strong>p\u00ebr q\u00ebllim p\u00ebrmir\u00ebsimin dhe adresimin e t\u00eb gjitha shqet\u00ebsimeve t\u00eb hasuar deri m\u00eb sot<\/strong> n\u00eb zbatimin e Vendimit nr. 9, dat\u00eb 24.12.2020 t\u00eb Komisionit Rregiullator, <strong>p\u00ebrsa i p\u00ebrket nenit 92 t\u00eb Kodit Zgjedhor<\/strong>,&nbsp;&nbsp;<\/p>\n\n\n\n<p>KRIIK ju paraqet rekomandimet e tij lidhur me projekt-aktin, m\u00eb t\u00eb plot\u00ebsuar dhe argumentuara , nga rekomandimi i nisur pak dit\u00eb m\u00eb par\u00eb.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>Konkretisht:<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>I.<\/strong><strong> N\u00eb pik\u00ebn 2 t\u00eb Projekt-vendimit, lidhur me \u201cRegjistrimin e Subjekteve n\u00eb Nd\u00ebrfaqen Elektronike t\u00eb Raportimit t\u00eb Institucioneve (NRI)\u201d.<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>I.1. <\/strong>Nevojitet t\u00eb p\u00ebrcaktohet <strong>qart\u00eb diferenca midis personit p\u00ebrgjegj\u00ebs p\u00ebr raportimin<\/strong> i njohur nga Kodi i Zgjedhor, i cili \u00ebsht\u00eb personi p\u00ebrgjegj\u00ebs p\u00ebr drejtimin administrativ t\u00eb institucioneve publike, agjencive dhe nd\u00ebrmarrjeve shtet\u00ebrore, <strong>dhe personit \/ operatorit i cili \u00ebsht\u00eb p\u00ebrgjegj\u00ebs p\u00ebr kryerejen e veprimeve <\/strong>n\u00eb Nd\u00ebrfaqen Elektronike t\u00eb Raportimit t\u00eb Institucioneve (NRI).&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ky i fundit \u00ebsht\u00eb i ngarkuar\/em\u00ebruar p\u00ebr k\u00ebt\u00eb funksion nga personi personi p\u00ebrgjegj\u00ebs p\u00ebr drejtimin administrativ t\u00eb institucioneve publike.&nbsp;<\/p>\n\n\n\n<p><strong>I.2.<\/strong> KQZ duhet t\u00eb siguroj\u00eb q\u00eb <strong>n\u00eb nd\u00ebrfaqen e raportimeve t\u00eb figurojn\u00eb emrat e t\u00eb dy personave t\u00eb cituar m\u00eb sip\u00ebr<\/strong>, sikurse ka qen\u00eb e paraqitur edhe m\u00eb par\u00eb n\u00eb nd\u00ebrfaqen e raportimeve.&nbsp;<\/p>\n\n\n\n<p><strong>I.3. <\/strong>Konsiderohet me shum\u00eb r\u00ebnd\u00ebsi, q\u00eb <strong>KQZ-ja t\u00eb qart\u00ebsoj\u00eb dhe parashikoj\u00eb<\/strong>, n\u00eb p\u00ebrmbajtjen e nenit 4 q\u00eb ndryshohet, <strong>se \u00ebsht\u00eb detyrim i personit p\u00ebrgjegj\u00ebs p\u00ebr drejtimin administrativ q\u00eb t\u00eb jet\u00eb n\u00eb dijeni mbaj\u00eb p\u00ebrgjegjesi p\u00ebr \u00e7do veprim apo mosveprim t\u00eb b\u00ebr\u00eb nga personi operator i ngarkuar prej tij<\/strong>, apo p\u00ebr \u00e7do infromacion, k\u00ebrkes\u00eb apo detyrim q\u00eb i p\u00ebrcillet institucionit prej KQZ-s\u00eb, n\u00ebp\u00ebrmjet llogaris\u00eb n\u00eb NRI t\u00eb institrucionit \/ operatorit.&nbsp;<\/p>\n\n\n\n<p><strong>I.4.<\/strong> \u00cbsht\u00eb e domosdoshme <strong>t\u00eb parashikohet forma e v\u00ebnies n\u00eb dijeni t\u00eb titullarit t\u00eb institucionit prej personit p\u00ebrgjegj\u00ebs<\/strong>, duke l\u00ebn\u00eb gjurm\u00eb institucionale e informuar KQZ-n\u00eb p\u00ebr njoftimin e b\u00ebr\u00eb, n\u00eb rastin kur KQZ-ja e ndalon aktivitetin.&nbsp;<\/p>\n\n\n\n<p>Gjith\u00eb sa m\u00eb sip\u00ebr, <strong>shmang relativizimin e shkeljes s\u00eb ligjit apo moszbatimin e ndalimit t\u00eb v\u00ebn\u00eb nga KQZ-ja<\/strong>, duke \u00e7uar t\u00ebr\u00eb p\u00ebrfundimin e procesit t\u00eb hetimit administrativ dhe sanksionimit nga KAS vet\u00ebm n\u00eb v\u00ebnien parap\u00ebrgjegj\u00ebsis\u00eb t\u00eb operatorit \/ punonj\u00ebsit t\u00eb em\u00ebruar.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb q\u00eb <strong>personi p\u00ebrgjegj\u00ebs p\u00ebr raportimin apo edhe titullari i institucionit lihen jasht\u00eb p\u00ebrgjegj\u00ebsis\u00eb <\/strong>n\u00ebn mbrojtjen e mos v\u00ebnies n\u00eb dijeni, apo mos pasjes s\u00eb dijenis\u00eb, sikurse ka rezultuar n\u00eb proceset e m\u00ebparshme.&nbsp;<\/p>\n\n\n\n<p>T\u00ebr\u00eb kjo, kur dihet bot\u00ebrisht <strong>se p\u00ebrgjegj\u00ebsia direkte \u00ebsht\u00eb e titullarit t\u00eb institucionit<\/strong>, si ai politik, ashtu edhe ai nga pik\u00ebpamja e hierarkis\u00eb administrative t\u00eb institucionit.&nbsp;<\/p>\n\n\n\n<p><strong>II.<\/strong><strong> N\u00eb pik\u00ebn 3 t\u00eb Projekt-vendimit, lidhur me \u201cProcedura e raportimit n\u00eb NRI\u201d.<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>II.1.<\/strong><strong> <\/strong>Projekt-vendimi n\u00eb pik\u00ebn 1 t\u00eb nenit 5 q\u00eb ndryshohet p\u00ebrcakton se: \u201cNuk raportohen veprimtari ku institucioni publik, apo p\u00ebrfaq\u00ebsues t\u00eb tij jan\u00eb ftuar p\u00ebr t\u00eb marr\u00eb pjes\u00eb.\u201d&nbsp;<\/p>\n\n\n\n<p>KRIIK rekomandon se <strong>Institucionet duhet t\u00eb raportojn\u00eb edhe p\u00ebr evente ku titullar\u00eb apo p\u00ebrfaq\u00ebsues t\u00eb tij jan\u00eb t\u00eb ftuar si fol\u00ebs n\u00eb aktivitete t\u00eb organizuara nga subjekte t\u00eb cilat nuk kan\u00eb detyrim p\u00ebr raportim.<\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb gjykimin e KRIIK, <strong>institucionet publike do t\u00eb duhet t\u00eb ken\u00eb detyrimin p\u00ebr t\u00eb raportuar edhe veprimtari n\u00eb t\u00eb cilat titullari apo funksionar\u00eb t\u00eb lart\u00eb t\u00eb institucionit p\u00ebrkat\u00ebs jan\u00eb t\u00eb ftuar t\u00eb marrin pjes\u00eb si fol\u00ebs.<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kjo p\u00ebr s\u00eb paku dy arsye, e dyta rrjedh logjikisht pres s\u00eb par\u00ebs:&nbsp;<\/p>\n\n\n\n<p><em>S\u00eb pari,<\/em> <strong>nj\u00eb funksionar i lart\u00eb q\u00eb merr pjes\u00eb n\u00eb nj\u00eb event si fol\u00ebs do t\u00eb angazhoj\u00eb burime publike t\u00eb institucionit<\/strong> ku punon p\u00ebr t\u00eb marr\u00eb pjes\u00eb n\u00eb event, sado minimale qofshin ato.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Theksojm\u00eb se burimet publike nuk jan\u00eb vet\u00ebm materiale, por me r\u00ebnd\u00ebsi \u00ebsht\u00eb edhe <strong>Ofiqi Publik<\/strong> q\u00eb persona t\u00eb ndrysh\u00ebm g\u00ebzojn\u00eb dhe<strong> Autoriteti Shtet\u00ebror i Institucionit, q\u00eb ata p\u00ebrfaq\u00ebsojn\u00eb, t\u00eb cilin e mbartin me vete kudo ku ata ftohen t\u00eb zhvillojn\u00eb veprimtari <\/strong>si fol\u00ebs, pavar\u00ebsisht se jan\u00eb t\u00eb ftuar dhe nuk e organizojn\u00eb ata at\u00eb veprimtari.&nbsp;<\/p>\n\n\n\n<p>P\u00ebrdorimi i k\u00ebtij ofiqi publik dhe avantazheve q\u00eb ai sjell p\u00ebr t\u00eb b\u00ebr\u00eb fushat\u00eb, nd\u00ebrkoh\u00eb q\u00eb veprojn\u00eb n\u00eb rolin e tyre si zyrtar\u00eb publik\u00eb dhe jo politik\u00eb <strong>p\u00ebrb\u00ebn p\u00ebrdorim t\u00eb autoritetit shtet\u00ebror dhe ofiqit publik p\u00ebr avantazh elektoral<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p><em>S\u00eb dyti, <\/em>gjat\u00eb periudh\u00ebs zgjedhore <strong>mund t\u00eb organizohen edhe evente nga subjekte q\u00eb nuk jan\u00eb institucione publike<\/strong> dhe, si rrjedhim, nuk kan\u00eb detyrimin p\u00ebr t\u00eb raportuar (si OJF, p\u00ebrfaq\u00ebsi diplomatike, organizata nd\u00ebrkomb\u00ebtare, apo biznese private).&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nj\u00eb num\u00ebr rastesh t\u00eb tilla <strong>jan\u00eb evidentuar n\u00eb zgjedhje t\u00eb shkuara<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb rast se institucioneve u hiqet detyrimi p\u00ebr t\u00eb raportuar, lihet hapur mund\u00ebsia q\u00eb titullar\u00ebt e institucioneve apo funksionar\u00eb t\u00eb <strong>lart\u00eb t\u00eb p\u00ebrdorin t\u00eb tilla aktivitete p\u00ebr fushat\u00eb elektorale, nd\u00ebrkoh\u00eb q\u00eb jan\u00eb ftuar si ofiqar\u00eb publik\u00eb<\/strong> dhe jo si eksponent\u00eb politik\u00eb, duke p\u00ebrdorur autoritetin shtet\u00ebror p\u00ebr t\u00eb avantazhuar nj\u00eb parti politike.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Detyrimi p\u00ebr t\u00eb raportuar p\u00ebr k\u00ebto aktivitete <strong>do t\u00eb rris\u00eb nd\u00ebrgjegj\u00ebsimin, p\u00ebrgjegjshm\u00ebrin\u00eb, dhe vler\u00ebsimin e kujdessh\u00ebm nga ana e ofiqar\u00ebve publik\u00eb<\/strong> n\u00ebse do t\u00eb duhet t\u00eb marrin pjes\u00eb n\u00eb nj\u00eb event t\u00eb till\u00eb dhe n\u00ebse po n\u00eb \u00e7far\u00eb roli do t\u00eb jen\u00eb aty.&nbsp;<\/p>\n\n\n\n<p>Nga ana tjet\u00ebr, ky detyrim rrit <strong>transparenc\u00ebn<\/strong> mbi aktivitetet ku p\u00ebrdoren burime shtet\u00ebrore, <strong>shmang abuzimin<\/strong> nga p\u00ebrdorimi i q\u00ebllimsh\u00ebm i organizimit t\u00eb t\u00eb tilla veprimtarive, rrit <strong>transparenc\u00ebn p\u00ebr publikun, median dhe aktor\u00ebt v\u00ebzhgues<\/strong>, si dhe u jep mund\u00ebsin\u00eb k\u00ebtyre t\u00eb fundit,
