Komisioner!<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit Rregullator!<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit t\u00eb Ankimimeve dhe Sanksioneve!<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>T\u00eb nderuar Drejtues t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb kuad\u00ebr t\u00eb bashk\u00ebpunimit me ju lidhur me konsultimin paraprak t\u00eb projekt-akteve, p\u00ebr t\u00eb cilin gjejm\u00eb rastin t\u2019ju fal\u00ebnderojm\u00eb s\u00ebrish, n\u00eb p\u00ebrgjigje t\u00eb mesazhit tuaj elektronik, d\u00ebrguar n\u00eb dat\u00eb 13 dhjetor 2024 lidhur me modulin e ri t\u00eb raportimeve t\u00eb institucioneve publike qendrore dhe vendore, si dhe agjencit\u00eb dhe\/ose nd\u00ebrmarrjet shtet\u00ebrore q\u00eb kan\u00eb detyrimin t\u00eb raportojn\u00eb t\u00eb gjitha veprimtarit\u00eb q\u00eb planifikojn\u00eb t\u00eb zhvillojn\u00eb n\u00eb periudh\u00ebn 4 muaj para dat\u00ebs s\u00eb zgjedhjeve,&nbsp;<\/p>\n\n\n\n<p>KRIIK Ju paraqet konsideratat dhe sugjerimet e veta sa m\u00eb posht\u00eb:&nbsp;<\/p>\n\n\n\n<p>N\u00eb nisje, gjejm\u00eb rastin t\u00eb risjellim n\u00eb v\u00ebmendje se KRIIK n\u00eb vijim\u00ebsi <strong>ndjek nga af\u00ebr dhe n\u00eb t\u00ebr\u00ebsi p\u00ebrdorimin e burimeve shtet\u00ebrore dhe ofiqit publik p\u00ebr avantazh elektoral, t\u00eb cilin e konsiderojm\u00eb si nj\u00eb nga element\u00ebt m\u00eb problematik\u00eb q\u00eb d\u00ebmtojn\u00eb integritetin e zgjedhjeve n\u00eb vend<\/strong>, adresimi i t\u00eb cilit \u00ebsht\u00eb pjes\u00eb e rekomandimit t\u00eb par\u00eb par\u00ebsor t\u00eb Raportit Final t\u00eb MNZV-s\u00eb s\u00eb ODIHR p\u00ebr Zgjedhjet Lokale t\u00eb 14 Majit 2023.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Nj\u00eb rol par\u00ebsor p\u00ebr luftimin e k\u00ebtij fenomeni, n\u00eb gjykimin e KRIIK merr Komisioni Qendror i Zgjedhjeve dhe nd\u00ebrfaqja e raportimeve<\/strong> \u00ebsht\u00eb instrumenti kryesor ndon\u00ebse jo i vetmi, n\u00eb dispozicion t\u00eb KQZ-s\u00eb n\u00eb k\u00ebt\u00eb funksion.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Sugjerimet e m\u00ebposhtme t\u00eb KRIIK jan\u00eb t\u00eb bazuara, kryesisht, n\u00eb problematikat q\u00eb jan\u00eb v\u00ebzhguar n\u00eb zgjedhjet e kryera n\u00eb vend q\u00eb nga momenti kur nd\u00ebrfaqja ka nisur fillimisht t\u00eb p\u00ebrdoret (2021), p\u00ebrfshi gjith\u00eb zgjedhjet q\u00eb jan\u00eb mbajtur nga ai moment, qofshin k\u00ebto t\u00eb p\u00ebrgjithshme, t\u00eb pjesshme apo t\u00eb p\u00ebrs\u00ebritura.&nbsp;&nbsp; Gjithashtu, disa sugjerime jan\u00eb hartuar nisur nga opinione\/problematika t\u00eb raportuara nga disa institucioneve publike q\u00eb KRIIK ka takuar gjat\u00eb k\u00ebsaj periudhe, takime t\u00eb realizuara, nd\u00ebr t\u00eb tjera, edhe p\u00ebr t\u00eb evidentuar problematik\u00ebn e p\u00ebrdorimit t\u00eb burimeve shtet\u00ebrore dhe ofiqit publik p\u00ebr avantazh elektoral dhe minimizimin e k\u00ebtij fenomeni n\u00eb zgjedhjet e ardhshme.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>S\u00eb pari,<\/em><\/strong> KRIIK thekson se, n\u00eb vijim\u00ebsi t\u00eb q\u00ebndrimit&nbsp; t\u00eb tij prej 2021 n\u00eb lidhje me k\u00ebt\u00eb \u00e7\u00ebshtje, <strong>gjykohet se mjafton q\u00eb veprimtaria institucionale t\u00eb jet\u00eb publikuar diku (n\u00eb faqe zyrtare, media, apo rrjete sociale t\u00eb institucionit) q\u00eb t\u00eb konsiderohet publike dhe t\u00eb jet\u00eb i detyruar raportimi nga institucioni organizator<\/strong>.&nbsp;&nbsp; Pra mediatizimi i veprimtaris\u00eb, duhet t\u00eb shtrihet p\u00ebrtej vet\u00ebm transmetimit n\u00eb mediat tradicionale. Kujtohet se pika 1 e nenit 92 t\u00eb Kodit Zgjedhor p\u00ebrcakton se \u201c[f]ormojn\u00eb veprimtari publike t\u00eb gjitha veprimtarit\u00eb q\u00eb jan\u00eb t\u00eb hapura p\u00ebr pjes\u00ebmarrjen e publikut apo t\u00eb medias, <strong>si dhe ato q\u00eb kan\u00eb n\u00eb agjend\u00eb informimin, n\u00eb periudh\u00ebn kat\u00ebr muaj para dat\u00ebs s\u00eb zgjedhjeve deri dit\u00ebn e zgjedhjeve, e publikut rreth tyre<\/strong>.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb praktik\u00eb, <strong>publikimi n\u00eb rrjetet dhe mediat sociale p\u00ebrb\u00ebn mediatizim t\u00eb veprimtaris\u00eb n\u00eb kuptim t\u00eb nj\u00eb informimi t\u00eb publikut, shpesh me impakt potencial edhe m\u00eb t\u00eb lart\u00eb sesa publikimi i saj n\u00eb mediat tradicionale<\/strong>. T\u00eb gjith\u00eb institucionet dhe titullar\u00ebt e tyre kan\u00eb sot n\u00eb zot\u00ebrim faqe zyrtare n\u00eb rrjetet sociale t\u00eb cilat i p\u00ebrdorin p\u00ebr mediatizim t\u00eb veprimtaris\u00eb s\u00eb p\u00ebrditshme t\u00eb tyre.&nbsp; Rrjedhimisht, planifikimi (paraprakisht) dhe publikimi (live apo pas realizimit) i nj\u00eb veprimtarie n\u00eb faqet zyrtare t\u00eb institucioneve dhe t\u00eb drejtuesve t\u00eb tyre, \u00ebsht\u00eb m\u00ebse i mjaftuesh\u00ebm p\u00ebr ta kategorizuar aktivitetin si \u201cveprimtari publike e cila duhet raportuar\u201d.&nbsp;<\/p>\n\n\n\n<p>Si rrjedhim, gjykohet se <strong>Komisioni Qendror i Zgjedhjeve do t\u00eb duhet t\u00eb nis\u00eb nj\u00eb shqyrtim administrativ dhe aplikoj\u00eb sanksione <\/strong>n\u00eb rast se evidenton apo i denoncohen raste t\u00eb veprimtarive institucionale t\u00eb publikuara n\u00eb mediat sociale, <strong>nd\u00ebrkoh\u00eb q\u00eb nuk jan\u00eb raportuar n\u00eb nd\u00ebrfaqe, pavar\u00ebsisht n\u00ebse aty ka patur media tradicionale apo publik n\u00eb prezenc\u00eb ose jo<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>S\u00eb dyti,<\/em><\/strong> n\u00eb m\u00ebnyr\u00eb q\u00eb funksionimi i nd\u00ebrfaqes t\u00eb institucionalizohet, KRIIK <strong>gjykon se duhet ripar\u00eb dhe amenduar Vendimi nr. 9, dat\u00eb 24.12.2020<\/strong> \u201cP\u00ebr rregullat p\u00ebr raportimin e veprimtarive me karakter publik t\u00eb institucioneve publike, agjencive dhe\/ose nd\u00ebrmarrjeve shtet\u00ebrore, kategorit\u00eb e veprimtarive t\u00eb ndaluara, si dhe monitorimin e veprimtaris\u00eb, sjelljes dhe p\u00ebrdorimit t\u00eb burimeve njer\u00ebzore, financiare dhe logjistike t\u00eb administrat\u00ebs shtet\u00ebrore para zgjedhjeve\u201d i Komisionit Rregullator. Elementet e nd\u00ebrfaqes, n\u00eb gjykimin e KRIIK, do t\u00eb duhet t\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb Vendim.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast p\u00ebr shkak t\u00eb koh\u00ebs s\u00eb kufizuar deri n\u00eb dat\u00ebn 11 janar 2025, kur nd\u00ebrfaqja do t\u00eb duhet t\u00eb jet\u00eb n\u00eb funksionim, KRIIK gjykon se do t\u00eb ishte e udh\u00ebs q\u00eb ajo t\u00eb nd\u00ebrtohet dhe t\u00eb nis\u00eb funksionimin, pavar\u00ebsisht amendimit apo jo nd\u00ebrkoh\u00eb t\u00eb Vendimit nr. 9. N\u00eb rast se gjat\u00eb amendimit t\u00eb k\u00ebtij Vendimi gjykohet se do t\u00eb duhet q\u00eb t\u00eb ket\u00eb ndryshime, ato mund t\u00eb kryhen n\u00eb vijim.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>S\u00eb fundi,<\/em><\/strong> rikujtohet se raportimi i aktiviteteve publike nga institucionet n\u00eb periudh\u00ebn 4 muaj para dit\u00ebs s\u00eb zgjedhjeve, pavar\u00ebsisht p\u00ebrmir\u00ebsimeve t\u00eb v\u00ebrejtura nga nisja e p\u00ebrdorimit t\u00eb saj, n\u00eb vitin 2021, <strong>vijon t\u00eb vuaj\u00eb nga mang\u00ebsi, q\u00eb konsistojn\u00eb kryesisht n\u00eb mosrespektimin e afatit t\u00eb raportimit, paplot\u00ebsin\u00eb e raportimit apo raportimin me t\u00eb dh\u00ebna t\u00eb p\u00ebrgjithshme dhe evazive, t\u00eb cilat nuk japin mund\u00ebsin\u00eb e nj\u00eb kontrolli t\u00eb sakt\u00eb nga KQZ<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb m\u00ebnyr\u00eb q\u00eb ky mekaniz\u00ebm t\u00eb jet\u00eb funksional n\u00eb t\u00ebr\u00ebsin\u00eb e tij dhe t\u00eb p\u00ebrmbush\u00eb frym\u00ebn e ligjit, KRIIK rekomandon q\u00eb <strong>KQZ-ja t\u00eb ket\u00eb detyrimin t\u00eb aprovoj\u00eb nj\u00eb aktivitet, si n\u00eb p\u00ebrputhje me ligjin, p\u00ebrpara se institucioni t\u00eb mund\u00eb ta kryej\u00eb at\u00eb<\/strong>. Duke e ndryshuar logjik\u00ebn e aprovimit pra, nga nj\u00eb aprovim pasiv i KQZ-s\u00eb n\u00eb momentin kur nuk jepen komente, si\u00e7 \u00ebsht\u00eb aktualisht, n\u00eb detyrimin p\u00ebr aprovim aktiv <strong>do t\u00eb rritet angazhimi i administrat\u00ebs s\u00eb KQZ s\u00eb me raportimin, duke qen\u00eb t\u00eb detyruar t\u00eb vler\u00ebsojn\u00eb me v\u00ebmendje \u00e7do aktivitet t\u00eb raportuar<\/strong> dhe ndaluar automatikisht t\u00eb gjith\u00eb aktivitetet q\u00eb raportohen p\u00ebrtej afatit ligjor dhe ato q\u00eb nuk p\u00ebrmbajn\u00eb detaje t\u00eb mjaftueshme.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb vijim gjeni disa sugjerime m\u00eb teknike. T\u00eb gjitha sugjerimet teknike m\u00eb posht\u00eb gjykohet se i sh\u00ebrbejn\u00eb kuptimit m\u00eb t\u00eb mir\u00eb t\u00eb aktivitetit si dhe plot\u00ebsimit t\u00eb informacionit q\u00eb p\u00ebrcillet sipas nenit 4 pika 3 t\u00eb vendimit nr. 9 dat\u00eb 24.12.2020 t\u00eb Komisionit Rregullator.&nbsp;&nbsp;<\/p>\n\n\n\n<p><em>Konkretisht:<\/em>&nbsp;<\/p>\n\n\n\n<p><strong>I. Rekomandime t\u00eb KRIIK, nisur nga eksperienca e funksionimit t\u00eb platform\u00ebs gjat\u00eb zgjedhjeve t\u00eb shkuara:<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>1.<\/strong> N\u00eb zgjedhjet e vitit 2023 nd\u00ebrfaqja e raportimit u ndryshua duke e b\u00ebr\u00eb \u00e7do fush\u00eb \u00ebsht\u00eb t\u00eb detyrueshme p\u00ebr t\u2019u plot\u00ebsuar.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Pavar\u00ebsisht k\u00ebsaj, KRIIK ka v\u00ebrejtur se plot\u00ebsimi i fushave ka qen\u00eb shpesh tejet evaziv nga p\u00ebrdoruesit dhe vet\u00ebm me fjal\u00eb t\u00eb p\u00ebrgjithshme duke mos mund\u00ebsuar kuptimin e asaj se \u00e7far\u00eb konkretisht p\u00ebrcillej dhe t\u00eb q\u00ebllimit t\u00eb saj.&nbsp;<\/p>\n\n\n\n<p>N\u00eb k\u00ebto kushte, p\u00ebr t\u00eb evituar k\u00ebto raste, por edhe \u00e7do mund\u00ebsi padijenie nga ana n\u00ebpun\u00ebsit t\u00eb caktuar p\u00ebr hedhjen e informacionit n\u00eb sistem, sugjerohet q\u00eb n\u00eb \u00e7do fush\u00eb <strong>t\u00eb paraqiten n\u00eb m\u00ebnyr\u00eb sa m\u00eb koncize sqarime dhe udh\u00ebzime se \u00e7far\u00eb informacioni konkretisht pritet prej p\u00ebrdoruesit q\u00eb t\u00eb plot\u00ebsoj\u00eb aty<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>E nj\u00ebjta gj\u00eb <strong>duhet t\u00eb aplikohet edhe n\u00eb formatet e raportimit t\u00eb hartuara p\u00ebr tu p\u00ebrdorur n\u00eb rastet e informimit me email apo me post\u00eb (n\u00eb rastet kur institucionet kan\u00eb v\u00ebshtir\u00ebsi p\u00ebr t\u00eb aksesuar nd\u00ebrfaqen, fenomen q\u00eb ka ndodhur n\u00eb zgjedhjet e m\u00ebparshme).<\/strong>&nbsp;<\/p>\n\n\n\n<p>Gjykohet se kjo do t\u00eb leht\u00ebsoj\u00eb dhe ndihmoj\u00eb p\u00ebr pasjen e nj\u00eb informacioni konkret e t\u00eb pasuruar, e rrjedhimisht edhe m\u00eb t\u00eb vlefsh\u00ebm p\u00ebr KQZ-n\u00eb n\u00eb gjykimin e saj mbi aktivitetin n\u00eb fjal\u00eb.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb rast se t\u00eb dh\u00ebnat e raportuara nuk mund\u00ebsojn\u00eb nj\u00eb panoram\u00eb t\u00eb qart\u00eb t\u00eb aktivitetit, n\u00eb t\u00eb gjith\u00eb element\u00ebt e vet, KQZ-ja ta ndaloj\u00eb zhvillimin e tij deri sa t\u00eb dh\u00ebnat t\u00eb plot\u00ebsohen n\u00eb m\u00ebnyr\u00ebn e duhur.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>2.<\/strong> P\u00ebrpos ndihmes\u00ebs dhe udh\u00ebzimeve p\u00ebr m\u00ebnyr\u00ebn se si duhet t\u00eb plot\u00ebsohet gjith\u00eb raportimi nga institucioni, vler\u00ebsohet <strong>si shum\u00eb e r\u00ebnd\u00ebsishme q\u00eb ky plot\u00ebsim t\u00eb b\u00ebhet me sakt\u00ebsi dhe p\u00ebrgjegjshm\u00ebri t\u00eb lart\u00eb. <\/strong>Kjo, jo vet\u00ebm p\u00ebr shkak t\u00eb r\u00ebnd\u00ebsis\u00eb q\u00eb ka raportimi si detyrim ligjor n\u00eb raport me procesin zgjedhor, por edhe se nj\u00eb pasakt\u00ebsi n\u00eb informacionin e p\u00ebrcjell\u00eb mund t\u00eb \u00e7oj\u00eb n\u00eb masa penalizuese, q\u00eb mund t\u00eb nd\u00ebrmerren edhe ndaj personit p\u00ebrgjegj\u00ebs t\u00eb caktuar nga institucioni n\u00eb fjal\u00eb p\u00ebr p\u00ebrdorimin e nd\u00ebrfaqes.&nbsp;<\/p>\n\n\n\n<p>Ndaj n\u00eb raport me k\u00ebt\u00eb sugjerohet q\u00eb pjes\u00eb e formatit t\u00eb raportimit <strong>t\u00eb jet\u00eb edhe nj\u00eb pik\u00eb shtes\u00eb, <\/strong>n\u00ebp\u00ebrmjet s\u00eb cil\u00ebs t\u2019i b\u00ebhet me dije personit q\u00eb e plot\u00ebson formatin e raportimit dhe ia nis at\u00eb KQZ-s\u00eb, <strong>se ai mban p\u00ebrgjegj\u00ebsi sipas ligjit p\u00ebr sakt\u00ebsin\u00eb e informacionit t\u00eb p\u00ebrcjell\u00eb apo n\u00eb rast t\u00eb plot\u00ebsimit n\u00eb m\u00ebnyr\u00eb jo korrekte<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>3.<\/strong> Pika 4 e nenit 4 t\u00eb Vendimit nr. 9 dat\u00eb 24.12.2020 t\u00eb Komisionit Rregullator p\u00ebrcakton individ\u00ebt p\u00ebrgjegj\u00ebs n\u00eb \u00e7do institucion, t\u00eb ngarkuar p\u00ebr kryerjen e raportimit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00cbsht\u00eb m\u00ebse e natyrshme q\u00eb, p\u00ebr arsye t\u00eb ndryshme, gjat\u00eb periudh\u00ebs 4 mujore t\u00eb raportimit t\u00eb ndodh\u00eb q\u00eb informacioni t\u00eb plot\u00ebsohet e p\u00ebrcillet edhe nga ndonj\u00eb punonj\u00ebs tjet\u00ebr i institucionit, pavar\u00ebsisht n\u00ebse ai \u00ebsht\u00eb i deleguar apo z\u00ebvend\u00ebsues i p\u00ebrkohsh\u00ebm i personit p\u00ebrgjegj\u00ebs t\u00eb p\u00ebrcaktuar.&nbsp;&nbsp;<\/p>\n\n\n\n<p>P\u00ebr shkak t\u00eb p\u00ebrgjegj\u00ebsis\u00eb q\u00eb mbart personi i caktuar nga institucioni, por edhe t\u00eb mosrelativizimit apo b\u00ebrjes praktikisht t\u00eb pamundur t\u00eb mekanizimit sanksionues, n\u00ebse do t\u00eb paraqitet nevoja, <strong>sugjerohet q\u00eb pjes\u00eb e formatit t\u00eb raportimit<\/strong> t\u00eb b\u00ebhet edhe opsioni <strong>i plot\u00ebsimit t\u00eb emrit t\u00eb punonj\u00ebsit q\u00eb kryen raportimin, n\u00eb rastin kur ai \u00ebsht\u00eb i ndrysh\u00ebm nga individi p\u00ebrgjegj\u00ebs i p\u00ebrcaktuar nga institucioni, emri i t\u00eb cilit i \u00ebsht\u00eb p\u00ebrcjell\u00eb zyrtarisht KQZ-s\u00eb.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>4.<\/strong> Sistemi t\u00eb mund\u00ebsoj\u00eb identifikimin e institucionit raportues n\u00eb s\u00eb paku tre kategori: \u201cOrganizator\u201d, \u201cBashk\u00eborganizator\u201d dhe \u201cPjes\u00ebmarr\u00ebs\/Fol\u00ebs\u201d.
