Komisioner!<\/strong>\u00a0<\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; <\/strong><strong>T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit Rregullator!<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>&nbsp;&nbsp;&nbsp; <\/strong><strong>T\u00eb nderuar Drejtues t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong>&nbsp;<\/p>\n\n\n\n<p>&nbsp;N\u00eb kuad\u00ebr t\u00eb bashk\u00ebpunimit me ju lidhur me konsultimin paraprak t\u00eb projekt-akteve, p\u00ebr t\u00eb cilin gjejm\u00eb rastin t\u2019ju fal\u00ebnderojm\u00eb s\u00ebrish, lidhur me <em>projektvendimin \u201c<\/em><em>Mbi rregullat p\u00ebr num\u00ebrimin dhe vler\u00ebsimin e votave nga jasht\u00eb dhe p\u00ebrfshirjen e tyre n\u00eb rezultatin e zgjedhjeve<\/em>\u201d, referuar edhe p\u00ebrgjigjeve t\u00eb marra p\u00ebr \u00e7\u00ebshtjet e ngritura n\u00eb takimin konsultues online t\u00eb dat\u00ebs 14 n\u00ebntor 2024 ku KRIIK gjithashtu paraqiti sugjerimet e tij,&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>KRIIK ju paraqet, p\u00ebrpos se verbalisht n\u00eb takim, edhe me shkrim m\u00eb posht\u00eb q\u00ebndrimin dhe rekomandimet e veta lidhur me k\u00ebt\u00eb Projektvendim<\/strong>.&nbsp;<\/p>\n\n\n\n<p><em>M\u00eb s\u00eb pari,<\/em> duke qen\u00eb se tanim\u00eb afatet ligjore t\u00eb vendosura nga Kodi Zgjedhor jan\u00eb tejkaluar, KRIIK <strong>nxit Komisionerin p\u00ebr propozimin dhe m\u00eb pas Komisionin Rregullator p\u00ebr miratimin sa m\u00eb t\u00eb shpejt\u00eb t\u00eb tij.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, na lejoni t\u00eb v\u00ebm\u00eb n\u00eb dukje se nj\u00eb aspekt tejet pozitiv i administrimit t\u00eb vot\u00ebs nga jasht\u00eb vendit nga administrata e KQZ-s\u00eb \u00ebsht\u00eb se n\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb krijohet mund\u00ebsia <strong>t\u00eb testohet p\u00ebr her\u00eb t\u00eb par\u00eb n\u00eb Shqip\u00ebri administrimi jo-politik i zgjedhjeve<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Ndaj, KRIIK beson dhe ju nxit, ju si KQZ, q\u00eb <strong>ky akt t\u00eb jet\u00eb sa m\u00eb i mir\u00ebmenduar dhe rregulluar n\u00eb t\u00eb gjith\u00eb element\u00ebt e mundsh\u00ebm, n\u00eb m\u00ebnyr\u00eb q\u00eb ky test i par\u00eb t\u00eb sh\u00ebrbej\u00eb si model pozitiv p\u00ebr aspirat\u00ebn <\/strong>e nd\u00ebrtimit t\u00eb nj\u00eb administrate zgjedhore profesioniste dhe t\u00eb pavarur politikisht n\u00eb t\u00eb ardhmen<strong>.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p><strong><em>1. N\u00eb lidhje me fuqin\u00eb vendimmarr\u00ebse t\u00eb GNVJ-ve<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p>Problematika kryesore q\u00eb KRIIK v\u00ebren n\u00eb lidhje me projektaktin \u00ebsht\u00eb <strong>mungesa e qart\u00ebsis\u00eb mbi autoritetin vendimmarr\u00ebs n\u00eb t\u00eb gjith\u00eb procesin e num\u00ebrimit t\u00eb votave nga jasht\u00eb apo, akoma m\u00eb problematike, veshja e GNVJ-ve me kompetenca vendimmarr\u00ebse.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Si shembull sillet pika III.4.2 e projektaktit ku p\u00ebrcaktohet se n\u00eb rast t\u00eb mosp\u00ebrputhjeve mes kodeve t\u00eb vulave t\u00eb siguris\u00eb, me t\u00eb cilat \u00ebsht\u00eb mbyllur kutia, dhe kodeve t\u00eb sh\u00ebnuara n\u00eb procesverbal, vendimin e merr GNVJ.&nbsp;&nbsp;<\/p>\n\n\n\n<p>KRIIK e gjen <strong>t\u00eb pap\u00ebrshtatshme k\u00ebt\u00eb zgjidhje pasi, n\u00eb gjykimin e tij, GNVJ nuk mund t\u00eb ket\u00eb legjitimitetin e duhur <\/strong>lidhur me t\u00eb tilla vendimmarrje q\u00eb mund t\u00eb afektojn\u00eb direkt rezultatin zgjedhor. P\u00ebr m\u00eb tep\u00ebr q\u00eb, sikurse do t\u00eb p\u00ebrmendet edhe n\u00eb vijim, b\u00ebhet fjal\u00eb p\u00ebr grupe t\u00eb p\u00ebrb\u00ebra nga n\u00ebpun\u00ebs t\u00eb p\u00ebrkohsh\u00ebm t\u00eb administrat\u00ebs s\u00eb KQZ-s\u00eb.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ky problem v\u00ebrehet edhe n\u00eb rastin e vendimmarrjes n\u00eb lidhje me votat e kontestuara (pikat III.4.9 dhe III.4.10).&nbsp;&nbsp;<\/p>\n\n\n\n<p>P\u00ebr analogji, n\u00eb rastin e num\u00ebrimit t\u00eb flet\u00ebve t\u00eb votimit brenda vendit vendimet n\u00eb lidhje me mosp\u00ebrputhjet e kodeve t\u00eb vulave t\u00eb siguris\u00eb apo flet\u00ebt e kontestuara, apo edhe t\u00eb tjera vendime t\u00eb r\u00ebnd\u00ebsishme, merren nga KZAZ-ja dhe jo nga grupet e num\u00ebrimit t\u00eb votave. Grupet e num\u00ebrimit t\u00eb votave, n\u00eb frym\u00ebn dhe germ\u00ebn e Kodit Zgjedhor, kryejn\u00eb thjesht detyra klerikale t\u00eb num\u00ebrimit t\u00eb votave, plot\u00ebsimit t\u00eb dokumentacionit, apo pasqyrimit aritmetik t\u00eb rezultateve t\u00eb num\u00ebrimit, dhe nuk kan\u00eb fuqi vendimmarr\u00ebse, nd\u00ebrkoh\u00eb q\u00eb GNVJ-t\u00eb kan\u00eb fuqi q\u00eb shkon p\u00ebrtej k\u00ebtyre detyrave, \u00e7ka p\u00ebrb\u00ebn kontradikt\u00eb.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb q\u00eb n\u00eb takimin e zhvilluar online n\u00eb dat\u00eb 14 n\u00ebntor, pjes\u00ebrisht Komisionieri iu p\u00ebrgjigj k\u00ebsaj pik\u00ebpyetjeje, duke u shprehur se GNVJ-t\u00eb jan\u00eb n\u00eb fakt nj\u00eb trup\u00eb e cila nuk ka analogji me administrat\u00ebn zgjedhore t\u00eb zakonshme dhe se vet\u00ebm emri \u00ebsht\u00eb i ngjash\u00ebm me GNV-t\u00eb, dhe pavar\u00ebsisht se ligjv\u00ebn\u00ebsit kan\u00eb ngarkuar KQZ-n\u00eb p\u00ebr t\u00eb rregulluar votimin nga jasht\u00eb n\u00eb t\u00eb gjith\u00eb element\u00ebt e vet dhe brenda diskrecionit t\u00eb vet, s\u00ebrish KRIIK gjykon se <strong>p\u00ebr t\u00eb ruajtur koherenc\u00ebn e kuadrit ligjor do t\u00eb ishte e udh\u00ebs q\u00eb, p\u00ebr sa t\u00eb jet\u00eb e mundur, t\u00eb ruhet analogjia mes administrimit zgjedhor t\u00eb votave brenda dhe jasht\u00eb vendit, si n\u00eb form\u00eb e ve\u00e7an\u00ebrisht n\u00eb p\u00ebrmbajtje.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>P\u00ebr sa m\u00eb sip\u00ebr, n\u00eb gjykimin e KRIIK, <strong>GNVJ-t\u00eb duhet t\u00eb jen\u00eb vet\u00ebm nj\u00eb trup\u00eb q\u00eb kryen detyra klerikale, t\u00eb ngjashme me ato t\u00eb GNV-ve dhe t\u00eb ken\u00eb t\u00eb nj\u00ebjtat kompetenca.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, n\u00eb rast t\u00eb mosp\u00ebrputhjes mes kodeve t\u00eb vulave t\u00eb siguris\u00eb dhe procesverbalit, n\u00eb rastin e flet\u00ebve t\u00eb kontestuara apo t\u00eb t\u00eb tjera rasteve q\u00eb k\u00ebrkojn\u00eb vendimmarrje, <strong>duhet q\u00eb n\u00eb akt t\u00eb parashikohet nj\u00eb autoritet tjet\u00ebr i cili t\u00eb ket\u00eb t\u00eb drejt\u00eb vendimmarrjeje mbi k\u00ebto raste<\/strong>, si dhe t\u00eb mbik\u00ebqyr\u00eb e drejtoj\u00eb pun\u00ebn e GNVJ-ve (n\u00eb modelin e KZAZ-ve).&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ky autoritet n\u00eb zbatim t\u00eb parashikimeve ligjore duhet <strong>t\u00eb vij\u00eb po nga administrata e KQZ-s\u00eb, por, <\/strong>sipas KRIIK, ai duhet <strong>t\u00eb jet\u00eb i p\u00ebrb\u00ebr\u00eb nga n\u00ebpun\u00ebs t\u00eb p\u00ebrhersh\u00ebm t\u00eb administrat\u00ebs s\u00eb KQZ-s\u00eb, t\u00eb cil\u00ebt duhet t\u00eb jen\u00eb t\u00eb lidhur drejp\u00ebrdrejt me Komisionerin dhe t\u00eb mandatuar\/em\u00ebruar prej tij. <\/strong><em>(P\u00ebr efekt t\u00eb referimit m\u00eb pas n\u00eb k\u00ebt\u00eb dokument, k\u00ebt\u00eb trup\u00eb po e quajm\u00eb <\/em><strong><em>KZAZJ<\/em><\/strong><em>)<\/em>&nbsp;<\/p>\n\n\n\n<p><strong>N\u00eb rast se propozimi i m\u00ebsip\u00ebrm nuk do t\u00eb merret n\u00eb konsiderat\u00eb<\/strong> nga Komisioni Qendror i Zgjedhjeve dhe do t\u00eb gjykohet se vendimmarrja do t\u00eb duhet t\u00eb mbetet tek GNVJ-t\u00eb (si\u00e7 parashikohet n\u00eb projektaktin aktual), at\u00ebher\u00eb KRIIK sjell n\u00eb v\u00ebmendje se <strong>do t\u00eb duhet t\u00eb citohet qart\u00eb n\u00eb akt n\u00ebse vendimet e GNVJ-s\u00eb merren me shumic\u00eb apo n\u00eb unanimitet,<\/strong> pasi kjo nuk duket t\u00eb jet\u00eb e cituar n\u00eb asnj\u00eb pik\u00eb t\u00eb aktit.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>2. N\u00eb lidhje me an\u00ebtar\u00ebsin\u00eb e GNVJ-ve<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p>Kodi Zgjedhor parashikon n\u00eb nenin 25\/1 pika 4 \u201c&#8230; <em>Procesi i num\u00ebrimit t\u00eb tyre fillon n\u00eb t\u00eb nj\u00ebjtin moment q\u00eb fillon num\u00ebrimi i kutis\u00eb s\u00eb par\u00eb me flet\u00eb votimi t\u00eb zon\u00ebs zgjedhore p\u00ebrkat\u00ebse, <\/em><strong><em>si dhe vler\u00ebsimi i tyre kryhet nga administrata e KQZ-s\u00eb<\/em><\/strong><em> dhe tabelohen n\u00eb tabel\u00ebn e rezultateve t\u00eb zon\u00ebs zgjedhore p\u00ebrkat\u00ebse<\/em>. (&#8230;)\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb projektaktin e p\u00ebrcjell\u00eb p\u00ebr miratim, pika II.3. p\u00ebrcakton se <em>\u201cProcesi i num\u00ebrimit dhe i vler\u00ebsimit t\u00eb votave nga jasht\u00eb si dhe i tabulimit t\u00eb rezultateve kryhet nga personeli i caktuar nga Komisioni Qendror i Zgjedhjeve\u201d<\/em>, nd\u00ebrsa pika II.5. p\u00ebrcakton se <em>\u201c[&#8230;] Vler\u00ebsimi i tyre kryhet nga administrata e Komisionit Qendror t\u00eb Zgjedhjeve\u201d.&nbsp;&nbsp;<\/em>&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; K\u00ebto formulime jan\u00eb jo-plot\u00ebsisht t\u00eb qarta dhe l\u00ebn\u00eb hap\u00ebsir\u00eb p\u00ebr interpretim n\u00ebse num\u00ebrimi dhe vler\u00ebsimi do t\u00eb kryhen nga administrata e KQZ-s\u00eb apo KQZ-ja do t\u00eb p\u00ebrcaktoj\u00eb\/angazhoj\u00eb personel shtes\u00eb p\u00ebr k\u00ebt\u00eb proces.&nbsp;&nbsp;<\/p>\n\n\n\n<p>KRIIK rekomandon q\u00eb <strong>formulimi i projektaktit t\u2019i q\u00ebndroj\u00eb besnik gjuh\u00ebs s\u00eb p\u00ebrdorur nga Kodi Zgjedhor n\u00eb t\u00eb gjitha pikat, duke b\u00ebr\u00eb t\u00eb qart\u00eb se \u00ebsht\u00eb administrata e KQZ-s\u00eb q\u00eb do t\u00eb kryej\u00eb num\u00ebrimin dhe vler\u00ebsimin e votave nga jasht\u00eb.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb vijim t\u00eb sa m\u00eb sip\u00ebr, n\u00eb zbatim t\u00eb parashikimit t\u00eb Kodit Zgjedhor si dhe konfirmimit t\u00eb b\u00ebr\u00eb nga Komisioneri p\u00ebrgjat\u00eb takimit konsultues,&nbsp; <strong>duhet t\u00eb p\u00ebrcaktohet qart\u00eb n\u00eb projekt-akt se administrat\u00eb e KQZ-s\u00eb, n\u00eb funksion t\u00eb k\u00ebtij procesi, do t\u00eb konsiderohet trupa e p\u00ebrkohshme e administrat\u00ebs s\u00eb institucionit.&nbsp;&nbsp; <\/strong>Apo edhe se mund t\u00eb p\u00ebrfshihen si pjes\u00eb e k\u00ebsaj administrate, n\u00eb rast se do t\u00eb konsiderohet e nevojshme, <strong>edhe punonj\u00ebs t\u00eb p\u00ebrhersh\u00ebm t\u00eb KQZ-s\u00eb<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Theksohet se lidhur me k\u00ebta punonj\u00ebs, <strong>\u00ebsht\u00eb e domosdoshme t\u00eb sigurohet me shum\u00eb kujdes nj\u00eb trajnim i plot\u00eb si dhe testimi i tyre paraprakisht<\/strong>. Angazhimi i tyre t\u00eb mund t\u00eb b\u00ebhet <strong>vet\u00ebm pas p\u00ebrfundimit me sukses t\u00eb testimit<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ndjekja e gjith\u00eb sa m\u00eb sip\u00ebr prej n\u00ebpun\u00ebsve t\u00eb p\u00ebrkohsh\u00ebm, <strong>duhet t\u00eb p\u00ebrcaktohet si detyrim n\u00eb akt dhe n\u00eb kontrat\u00ebn e pun\u00ebs s\u00eb n\u00ebnshkruar <\/strong>p\u00ebr angazhimin e tyre me koh\u00eb t\u00eb pjesshme si personel i Komisionit Qendror t\u00eb Zgjedhjeve.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, <strong>nevojitet q\u00eb n\u00eb akt dhe n\u00eb kontratat e pun\u00ebs me k\u00ebta individ\u00eb t\u00eb p\u00ebrfshihen edhe t\u00eb gjitha p\u00ebrgjegj\u00ebsit\u00eb q\u00eb do t\u00eb mbahen n\u00eb rast shkeljeje t\u00eb kuadrit ligjor<\/strong>. Gjykohet se masat apo sanksionet e aplikuara nevojiten t\u00eb jen\u00eb minimalisht t\u00eb nj\u00ebjta me num\u00ebruesit e grupeve t\u00eb num\u00ebrimit t\u00eb votave brenda vendit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, p\u00ebr sa Kodi Zgjedhor p\u00ebcakton, edhe <strong>kutit\u00eb e votimit nga jasht\u00eb do t\u00eb duhet t\u2019i n\u00ebnshtrohen Procesit t\u00eb Auditimit Paszgjedhor<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Lidhur me k\u00ebt\u00eb nevojitet q\u00eb <strong>KQZ-ja t\u00eb parashikoj\u00eb amendimet e nevojshme n\u00eb aktet n\u00ebnligjore p\u00ebrkat\u00ebse s\u00eb bashku me masat administrative<\/strong> q\u00eb do t\u00eb nd\u00ebrmerren n\u00eb rast shkeljeje, e q\u00eb minimalisht nevojiten t\u00eb parashikojn\u00eb t\u00eb nj\u00ebjtat pasoja si ndaj num\u00ebruesve t\u00eb GNV-ve brenda vendit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Po ashtu, rekomandohet q\u00eb informacioni mbi procesin e auditimit post-zgjedhor dhe pasojat e dala prej tij, <strong>t\u00eb b\u00ebhen pjes\u00eb e sesioneve informuese gjat\u00eb trajnimeve si dhe e kontratave q\u00eb do t\u00eb lidhen<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>T\u00ebr\u00eb kjo gjykohet edhe <strong>si nj\u00eb mjet nxit\u00ebs p\u00ebr t\u00eb kryer detyr\u00ebn e num\u00ebruesit me korrekt\u00ebsi,<\/strong> duke siguruar se nuk do t\u00eb ket\u00eb asnj\u00eb tolerim apo anashkalim n\u00eb rast se do t\u00eb tregohen t\u00eb pakujdessh\u00ebm (n\u00eb rastin m\u00eb t\u00eb mir\u00eb) gjat\u00eb ushtrimit t\u00eb detyr\u00ebs s\u00eb tyre, megjith\u00ebse jan\u00eb pjes\u00eb e administrat\u00ebs s\u00eb KQZ-s\u00eb.&nbsp;<\/p>\n\n\n\n<p><strong><em>3. N\u00eb lidhje me transportin e materialeve zgjedhore dhe flet\u00ebve t\u00eb votimit nga jasht\u00eb nga KQZ-ja n\u00eb VNVJ<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb parantez\u00eb, rikujtojm\u00eb se Kodi Zgjedhor n\u00eb nenin 25\/1 pika 1 parashikon se \u201c<em>Flet\u00ebt e votimit t\u00eb d\u00ebrguara nga zgjedh\u00ebsit jasht\u00eb territorit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb dhe t\u00eb administruara num\u00ebrohen n\u00eb ambientet e KQZ-s\u00eb<\/em>\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Ky p\u00ebrcaktim ligjor detyron num\u00ebrimin n\u00eb KQZ, e p\u00ebr rrjedhim sjell nevoj\u00ebn e riformulimit apo sakt\u00ebsimit t\u00eb pik\u00ebs II.2. dhe III.1. t\u00eb projekt-aktit, sipas t\u00eb cilave duket se VNVJ-ja do t\u00eb vendoset n\u00eb nj\u00eb mjedis jasht\u00eb KQZ-s\u00eb, duke b\u00ebr\u00eb t\u00eb nevojsh\u00ebm shpjegimin e marrjes me qera t\u00eb nj\u00eb ambienti prej KQZ-s\u00eb, i cili plot\u00ebson maksimalisht kriteret e nevojshme n\u00eb p\u00ebrmbushje t\u00eb t\u00ebr\u00eb k\u00ebrkesave t\u00eb parashikuara n\u00eb aktet e KQZ-s\u00eb dhe Kodit Zgjedhor.&nbsp;<\/p>\n\n\n\n<p>Referuar konfirmimit t\u00eb b\u00ebr\u00eb gjat\u00eb mbledhjes konsultuese, sipas t\u00eb cilit<strong> KQZ-ja do t\u00eb kontraktoj\u00eb nj\u00eb ambient jasht\u00eb godin\u00ebs ku ushtron aktivitetin e vet<\/strong>, n\u00eb funksion t\u00eb mbledhjes dhe num\u00ebrimit t\u00eb votave q\u00eb vijn\u00eb nga shtetasit t\u00eb cil\u00ebt jetojn\u00eb jasht\u00eb, KRIIK gjykon se <strong>n\u00eb projekt-akt duhet t\u00eb p\u00ebrfshihet parashikimi p\u00ebr transportin e kutive t\u00eb votimit dhe materialeve zgjedhore<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Ky parashikim duhet t\u00eb sakt\u00ebsoj\u00eb t\u00ebr\u00eb detajet e nevojshme qoft\u00eb p\u00ebr transportin nga KQZ-ja drejt sall\u00ebs ku do t\u00eb kryhet num\u00ebrimi apo nga kompania postare direkt n\u00eb k\u00ebt\u00eb ambient q\u00eb n\u00eb fillim t\u00eb procesit, si edhe d\u00ebrgimin e tyre m\u00eb pas n\u00eb ambientet ku materialet do t\u00eb ruhen n\u00eb vijim.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Th\u00ebn\u00eb sa m\u00eb sip\u00ebr, KQZ-ja nevojitet gjithashtu t\u00eb ket\u00eb n\u00eb konsiderat\u00eb faktin q\u00eb procesi i votimit nga jasht\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e tij <strong>duhet t\u00eb p\u00ebrmbaj\u00eb s\u00eb paku t\u00eb nj\u00ebjtat hallka sikurse ai brenda vendit si dhe p\u00ebrmbajtjen e akteve t\u00eb miratuara tanim\u00eb<\/strong> nga KQZ-ja.&nbsp;<\/p>\n\n\n\n<p><strong><em>4. N\u00eb lidhje me \u201can\u00ebtar\u00ebt v\u00ebzhgues\u201d t\u00eb GNVJ-ve<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p>Pika III.2.7. e projekt-aktit p\u00ebrcakton vendosjen e dy an\u00ebtar\u00ebve v\u00ebzhgues t\u00eb propozuar nga dy partit\u00eb kryesore politike p\u00ebr secil\u00ebn GNVJ, pa t\u00eb drejt\u00eb vote.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Gjykohet se ky parashikim \u00ebsht\u00eb shum\u00eb pozitiv pasi rrit besimin e partive politike n\u00eb proces dhe minimizon mund\u00ebsit\u00eb p\u00ebr hedhjen e dyshimeve mbi integritetin e administrimit t\u00eb votave nga jasht\u00eb.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp; Megjithat\u00eb, duke qen\u00eb se kjo \u00ebsht\u00eb nj\u00eb kategori e re p\u00ebrsa i takon kuadrit ligjor aktual p\u00ebr zgjedhjet, del<strong> e nevojshme q\u00eb n\u00eb akt t\u00eb p\u00ebrcaktohet procedura e propozimit, em\u00ebrimit, si dhe e shkarkimit t\u00eb tyre.<\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, n\u00eb frym\u00ebn e rritjes s\u00eb besimit n\u00eb proces dhe t\u00eb problematikave t\u00eb v\u00ebrejtura m\u00eb par\u00eb t\u00eb ndodhura edhe me dakord\u00ebsin\u00eb e an\u00ebtar\u00ebve t\u00eb dy partive m\u00eb t\u00eb m\u00ebdha politike, n\u00eb gjykimin e KRIIK nevojitet <strong>t\u00eb konsiderohet rritja e numrit t\u00eb an\u00ebtar\u00ebve v\u00ebzhgues, s\u00eb paku, edhe tek partit\u00eb politike<\/strong> <strong>q\u00eb kan\u00eb t\u00eb drejt\u00eb t\u00eb propozojn\u00eb an\u00ebtar\u00eb n\u00eb KZAZ apo GNV n\u00eb votimin brenda vendit<\/strong>.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>5. N\u00eb lidhje me t\u00eb drejt\u00ebn e kontestimit t\u00eb vler\u00ebsimit t\u00eb flet\u00ebve t\u00eb votimit<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p>Pika III.4.9. e projektaktit parashikon se \u201c<em>N\u00ebse ndonj\u00eb prej an\u00ebtar\u00ebve t\u00eb GNVJ ka kontestime n\u00eb lidhje me vler\u00ebsimin e flet\u00ebs s\u00eb votimit<\/em>, <em>ky kontestim sh\u00ebnohet n\u00eb Procesverbalin e Num\u00ebrimit t\u00eb Votave nga Jasht\u00eb t\u00eb Zon\u00ebs Zgjedhore. N\u00eb pjes\u00ebn mbrapa t\u00eb flet\u00ebs s\u00eb votimit, nga faqja q\u00eb nuk jan\u00eb emrat e subjekteve zgjedhor\u00eb, sekretari sh\u00ebnon fjal\u00ebn \u201cE kontestuar<\/em>\u201d.\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>\u00cbsht\u00eb e paqart\u00eb n\u00ebse an\u00ebtar\u00ebt v\u00ebzhgues mund t\u00eb kontestojn\u00eb ose jo vler\u00ebsimin e flet\u00ebve t\u00eb votimit, nj\u00ebsoj si an\u00ebtar\u00ebt e tjer\u00eb t\u00eb GNVJ-s\u00eb.&nbsp;<\/p>\n\n\n\n<p>Duke qen\u00eb se kjo kategori v\u00ebzhguesish an\u00ebtar\u00eb nuk \u00ebsht\u00eb e p\u00ebrcaktuar n\u00eb Kodin Zgjedhor, kjo e drejt\u00eb, apo mungesa e saj, nuk mund t\u00eb deduktohen as nga as nga kuadri ligjor par\u00ebsor, pra <strong>\u00ebsht\u00eb e nevojshme q\u00eb t\u00eb p\u00ebrcaktohet qart\u00eb n\u00eb k\u00ebt\u00eb akt e drejta ose jo e an\u00ebtar\u00ebve v\u00ebzhgues p\u00ebr t\u00eb kontestuar vler\u00ebsimin e flet\u00ebve t\u00eb votimit.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Kodi Zgjedhor u njeh t\u00eb drejt\u00ebn e kontestimit ndaj vler\u00ebsimit t\u00eb num\u00ebruesit t\u00eb par\u00eb edhe v\u00ebzhguesve t\u00eb subjekteve zgjedhore, nd\u00ebrkoh\u00eb q\u00eb projekt-akti nuk e p\u00ebrmend kontestimin nga ana e v\u00ebzhguesve t\u00eb subjekteve zgjedhore, <strong>\u00e7\u2019ka mund t\u00eb krijoj\u00eb konfuzion<\/strong> (neni 118, pika 2 e Kodit Zgjedhor: \u201c<em>N\u00ebse ndonj\u00eb an\u00ebtar i grupit t\u00eb num\u00ebrimit ose ndonj\u00eb prej v\u00ebzhguesve t\u00eb subjekteve zgjedhore s\u2019\u00ebsht\u00eb dakord me vler\u00ebsimin e num\u00ebruesit t\u00eb par\u00eb, ky i fundit e vendos flet\u00ebn e votimit t\u00eb kund\u00ebrshtuar n\u00eb nj\u00eb vend t\u00eb ve\u00e7ant\u00eb p\u00ebr flet\u00ebt e votimit t\u00eb kontestuara dhe vijon me flet\u00ebn tjet\u00ebr t\u00eb votimit.\u201d<\/em>).&nbsp;<\/p>\n\n\n\n<p>Duke qen\u00eb se nj\u00eb e drejt\u00eb e njohur nga Kodi Zgjedhor nuk mund t\u00eb anashkalohet me nj\u00eb akt t\u00eb KQZ-s\u00eb, logjiksh\u00ebm <strong>e drejta p\u00ebr t\u00eb kontestuar nj\u00eb flet\u00eb votimi do t\u00eb duhet t\u2019u njihet edhe v\u00ebzhguesve t\u00eb subjekteve zgjedhore<\/strong>.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; N\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb evitohen ng\u00ebr\u00e7e apo interpretime gjat\u00eb num\u00ebrimit, <strong>KRIIK gjykon se duhet t\u00eb p\u00ebrcaktohet qart\u00eb n\u00eb akt dh\u00ebnia e s\u00eb drejt\u00ebs v\u00ebzhguesve t\u00eb subjekteve zgjedhore p\u00ebr t\u00eb kontestuar vler\u00ebsimin e nj\u00eb flete votimi, si dhe parashikimi i procedurave n\u00eb vijim.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, duke patur n\u00eb konsiderat\u00eb se n\u00eb rastet e votave t\u00eb kontestuara n\u00eb procesin e num\u00ebrimit brenda vendit \u00ebsht\u00eb KZAZ-ja q\u00eb vendos n\u00ebse jan\u00eb t\u00eb vlefshme apo t\u00eb pavlefshme,&nbsp; n\u00eb k\u00ebt\u00eb rast \u00ebsht\u00eb e nevojshme <strong>t\u00eb p\u00ebrcaktohet se trupa q\u00eb duhet t\u00eb vendos\u00eb n\u00ebse vota e kontestuar nga an\u00ebtar\u00ebt apo v\u00ebzhguesit \u00ebsht\u00eb e vlefshme ose jo, t\u00eb jet\u00eb trupa nga administrata q\u00eb mbik\u00ebqyr dhe drejton pun\u00ebn e GNVJ-ve<\/strong> (apo KZAZJ, sipas propozimit t\u00eb b\u00ebr\u00eb n\u00eb pik\u00ebn 1 t\u00eb k\u00ebtij Dokumenti).&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>6. N\u00eb lidhje me modalitetin e njoftimit p\u00ebr nisjen e num\u00ebrimit t\u00eb votave brenda vendit<\/em><\/strong>&nbsp;&nbsp;<\/p>\n\n\n\n<p>Pika III.3.1. e projekt-aktit parashikon se njoftimi i KQZ-s\u00eb nga sekretar\u00ebt e KZAZ-ve kryhet n\u00ebp\u00ebrmjet post\u00ebs elektronike, ose n\u00ebp\u00ebrmjet mesazhit n\u00eb aplikacionin KQZ, apo aplikacione t\u00eb tjera.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb gjykimin e KRIIK <strong>projektakti duhet t\u00eb p\u00ebrcaktoj\u00eb n\u00eb m\u00ebnyr\u00eb shteruese metodat q\u00eb mund t\u00eb p\u00ebrdoren p\u00ebr p\u00ebrcjelljen e njoftimit, si dhe personin p\u00ebrgjegj\u00ebs p\u00ebr marrjen dhe p\u00ebrcjelljen e k\u00ebtij njoftimi tek GNVJ-ja<\/strong> p\u00ebrkat\u00ebse.&nbsp;<\/p>\n\n\n\n<p><strong>N\u00ebse<\/strong> sipas propozimit n\u00eb pik\u00ebn nr. 1 t\u00eb k\u00ebtij dokumenti do t\u00eb gjykohet e arsyeshme t\u00eb <strong>vendoset nj\u00eb trup\u00eb vendimmarr\u00ebse dhe menaxhuese e k\u00ebtij procesi (KZAZJ<\/strong>-ja<strong>), at\u00ebher\u00eb njoftimi mund t\u00eb kryhet direkt aty<\/strong> duke p\u00ebrcaktuar kontaktin e kryetarit apo sekretarit t\u00eb k\u00ebsaj trupe.&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; N\u00ebse propozimi i b\u00ebr\u00eb n\u00eb pik\u00ebn nr. 1 nuk do t\u00eb merret n\u00eb konsiderat\u00eb, at\u00ebher\u00eb duhet t\u00eb parashikohet n\u00eb akt <strong>pozicioni n\u00eb administrat\u00ebn e KQZ-s\u00eb i personit q\u00eb do t\u00eb jet\u00eb p\u00ebrgjegj\u00ebs p\u00ebr k\u00ebt\u00eb proces, ose m\u00ebnyr\u00ebn e p\u00ebrcaktimit t\u00eb tij,<\/strong> p.sh me urdh\u00ebr t\u00eb Komisionerit.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Shkarko Rekomandimin ne pdf I nderuar z.
