Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp; T\u00eb nderuar Koleg\u00eb t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p>Duke ju fal\u00ebnderuar p\u00ebr t\u00ebr\u00eb bashk\u00ebpunimin n\u00eb vazhdim\u00ebsi, n\u00eb p\u00ebrgjigje t\u00eb ftes\u00ebs p\u00ebr konsultim t\u00eb d\u00ebrguar nga ju me post\u00eb elektronike n\u00eb dat\u00ebn 6 shtator 2024, KRIIK ju paraqet shkurtimisht q\u00ebndrimin e tij lidhur me \u201cDraft Raportin mbi gjetjet nga auditimi i fondeve t\u00eb p\u00ebrfituara dhe shpenzuara nga partit\u00eb politike pjes\u00ebmarr\u00ebse n\u00eb zgjedhjet p\u00ebr organet e qeverisjes vendore, t\u00eb dat\u00ebs 14 maj 2023\u201d.<\/p>\n\n\n\n<p>Dokumenti n\u00eb vijim \u00ebsht\u00eb i ndar\u00eb n\u00eb dy pjes\u00eb.<\/p>\n\n\n\n<p>N\u00eb pjes\u00ebn e par\u00eb paraqiten komente t\u00eb p\u00ebrgjithshme lidhur me Raportin e p\u00ebrgatitur prej jush, por edhe mbi procesin n\u00eb t\u00ebr\u00ebsi t\u00eb mbik\u00ebqyrjes s\u00eb financave p\u00ebr Zgjedhjet Vendore t\u00eb 14 majit 2023.&nbsp;<\/p>\n\n\n\n<p>Opinioni i paraqitur bazohet sa n\u00eb draft-raportin e d\u00ebrguar, aq edhe n\u00eb informacionin q\u00eb KRIIK posedon n\u00eb lidhje me procesin e zhvilluar, n\u00eb vijim t\u00eb ndjekjes dhe monitorimit t\u00eb pand\u00ebrprer\u00eb t\u00eb procesit zgjedhor, p\u00ebrfshir\u00eb aktivitetin e KQZ-s\u00eb, komunikimin e dendur me t\u00eb n\u00eb form\u00ebn shkresore e verbale, p\u00ebrgjat\u00eb gjith\u00eb procesit q\u00eb i parapriu Dit\u00ebs s\u00eb Zgjedhjeve t\u00eb 14 majit, si dhe pas tij.<\/p>\n\n\n\n<p>N\u00eb pjes\u00ebn e dyt\u00eb paraqiten komente m\u00eb specifike n\u00eb lidhje me gjetjet e paraqitura n\u00eb Draft-Raportin e p\u00ebrcjell\u00eb p\u00ebr konsultim dhe kryq\u00ebzimit t\u00eb tyre me ato t\u00eb KRIIK.<\/p>\n\n\n\n<p>Ky kryq\u00ebzim u krye me sa ishte e mundur, pasi formati dhe m\u00ebnyrat se si jan\u00eb paraqitur t\u00eb dh\u00ebnat n\u00eb Draft-Raportin e p\u00ebrcjell\u00eb, jo domosdoshm\u00ebrisht p\u00ebrputhen me metodologjin\u00eb e konkludimit n\u00eb gjetje dhe t\u00eb paraqitjes s\u00eb tyre prej KRIIK.<\/p>\n\n\n\n<p>N\u00eb vijim t\u00eb aktiviteti t\u00eb tij t\u00eb pand\u00ebrprer\u00eb n\u00eb monitorimin e proceseve zgjedhore dhe zhvillimeve t\u00eb tjera q\u00eb e afektojn\u00eb at\u00eb, KRIIK ka p\u00ebrgatitur Raportin P\u00ebrfundimtar mbi Transparenc\u00ebn dhe Kontrollin e financimit t\u00eb fushat\u00ebs p\u00ebr Zgjedhjet e Organeve t\u00eb Qeverisjes Vendore t\u00eb 14 majit 2023. &nbsp;<\/p>\n\n\n\n<p>Raporti P\u00ebrfundimtar pason Raportin Paraprak <a href=\"https:\/\/kriik.al\/home\/2023\/07\/31\/raport-paraprak-financim-zgjedhje14maj23\/\">\u201cMbi transparenc\u00ebn dhe kontrollin mbi financimin e fushat\u00ebs p\u00ebr Zgjedhjet p\u00ebr Organet e Qeverisjes Vendore t\u00eb 14 majit 2023\u201d,<\/a> t\u00eb publikuar n\u00eb korrik t\u00eb vitit 2023, i cili ju \u00ebsht\u00eb d\u00ebrguar edhe juve.<\/p>\n\n\n\n<p>Theksojm\u00eb se Raporti P\u00ebrfundimtar nuk \u00ebsht\u00eb publikuar ende p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb raporteve t\u00eb vet\u00ebdeklarimit t\u00eb kandidat\u00ebve p\u00ebr an\u00ebtar\u00eb t\u00eb k\u00ebshillave bashkiake, vet\u00ebm nj\u00eb pjes\u00eb e t\u00eb cilave na jan\u00eb vendosur n\u00eb dispozicion t\u00eb skanuara, pavar\u00ebsisht k\u00ebrkesave t\u00eb vazhdueshme zyrtare dhe verbale t\u00eb KRIIK. Theksohet se ato ende nuk figurojn\u00eb as t\u00eb publikuara n\u00eb faqen e internetit t\u00eb KQZ-s\u00eb. &nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Pamund\u00ebsia p\u00ebr t\u00eb verifikuar t\u00eb gjitha raportet e kandidat\u00ebve pengon p\u00ebrfundimin dhe publikimin e Raportit P\u00ebrfundimtar pasi, n\u00eb munges\u00eb t\u00eb k\u00ebtyre raporteve, procesi i duhur i verifikimit dhe i kryq\u00ebzimit t\u00eb t\u00eb dh\u00ebnave, p\u00ebr rrjedhoj\u00eb, edhe gjetjet finale t\u00eb KRIIK nuk mund t\u00eb jen\u00eb t\u00eb plota.<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast, me synimin p\u00ebr t\u00eb ndihmuar sado pak KQZ-n\u00eb n\u00eb misionin e vet madhor p\u00ebr t\u00eb kontrolluar n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb financimin e zgjedhjeve, si edhe p\u00ebr t\u2019i dh\u00ebn\u00eb fund procesit t\u00eb pand\u00ebshkueshm\u00ebris\u00eb s\u00eb subjekteve zgjedhore lidhur me shkeljet ligjore t\u00eb kryera prej tyre, n\u00eb shoq\u00ebrim t\u00eb k\u00ebtij Dokumenti mund t\u00eb gjeni edhe Draftin e Raportit P\u00ebrfundimtar t\u00eb KRIIK mbi financimin e Zgjedhjeve 2023, bazuar n\u00eb t\u00eb dh\u00ebnat q\u00eb KRIIK disponon dhe atyre q\u00eb KQZ ka publikuar.<\/p>\n\n\n\n<p><strong>I. Komente t\u00eb p\u00ebrgjithshme n\u00eb lidhje me Draft-Raportin dhe procesin e &nbsp;mbik\u00ebqyrjes s\u00eb financimit p\u00ebr Zgjedhjet Vendore 2023<\/strong><\/p>\n\n\n\n<p><em>I.1. Mbi metodologjin\u00eb dhe struktur\u00ebn e Raportit<\/em><strong><\/strong><\/p>\n\n\n\n<p>KRIIK v\u00ebren se Draft-Raporti ka nj\u00eb p\u00ebrmir\u00ebsim n\u00eb ezaurimin e p\u00ebrshkrimit t\u00eb problematikave t\u00eb evidentuara, duke p\u00ebrfshir\u00eb edhe shoq\u00ebrimin e tyre me kuadrin ligjor p\u00ebrkat\u00ebs. &nbsp;&nbsp;Megjithat\u00eb, gjykohet se metodologjia e ndjekur nga administrata n\u00eb hartimin e raportit ka ende vend p\u00ebr p\u00ebrmir\u00ebsim.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat e p\u00ebrfshira n\u00eb raport nevojitet t\u00eb ken\u00eb kronologji logjike dhe sistematike, t\u00eb bazuar n\u00eb skanimin e \u00e7do problematike t\u00eb evidentuar dhe duke ezauruar secil\u00ebn problematik\u00eb n\u00eb nj\u00eb seksion m\u00eb vete t\u00eb raportit, p\u00ebr t\u00eb konkluduar m\u00eb pas n\u00eb shkeljet potenciale ligjore, si dhe sanksionimet p\u00ebrkat\u00ebse t\u00eb propozuara.<\/p>\n\n\n\n<p>Shqyrtimi, n\u00eb gjykimin e KRIIK, mund t\u00eb filloj\u00eb me elementet m\u00eb bazike q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me dor\u00ebzimin ose jo t\u00eb raportit financiar, me respektimin ose jo t\u00eb formatit, etj., e m\u00eb pas t\u00eb shtrihet n\u00eb problematikat e tjera q\u00eb lidhen me p\u00ebrmbajtjen e raporteve t\u00eb vet\u00ebdeklarimit, si dhe kryq\u00ebzimin e t\u00eb dh\u00ebnave t\u00eb deklaruara me ato t\u00eb evidentuara n\u00eb raportet e monitorueseve dhe t\u00eb audit\u00ebve ligjor\u00eb.<\/p>\n\n\n\n<p><em>I.2. Mungesa e nj\u00eb draft-vendimi t\u00eb KQZ-s\u00eb n\u00eb lidhje me gjetjet e evidentuara n\u00eb Raportin e p\u00ebrgatitur, si pjes\u00eb integrale e tij por edhe e procesit t\u00eb konsultimit<\/em><\/p>\n\n\n\n<p>Sjellim n\u00eb v\u00ebmendjen tuaj se p\u00ebrcjellja p\u00ebr konsultim vet\u00ebm e Draft-Raportit, pa e shoq\u00ebruar at\u00eb me nj\u00eb projekt-vendim n\u00eb lidhje me masat e propozuara, t\u00eb integruar n\u00eb Draft-Raport, n\u00eb gjykimin e KRIIK, nuk ndihmon n\u00eb realizimin e nj\u00eb procesi t\u00ebr\u00ebsisht transparent dhe t\u00eb q\u00ebndruesh\u00ebm p\u00ebrsa i p\u00ebrket qasjes s\u00eb paekuivok n\u00eb zbatim t\u00eb ligjit.<\/p>\n\n\n\n<p>Shqyrtimi n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb i shkeljeve t\u00eb konstatuara, duke nisur nga ato m\u00eb minoret, \u00ebsht\u00eb m\u00eb se i domosdosh\u00ebm, madje duke patur parasysh e marr\u00eb n\u00eb konsiderat\u00eb gjithashtu edhe problematikat e proceseve t\u00eb m\u00ebparshme zgjedhore, si dhe qasjen e KQZ-s\u00eb t\u00eb b\u00ebr\u00eb ndaj tyre.<\/p>\n\n\n\n<p><em>I.3. Mungesa e detajeve n\u00eb lidhje me procesin dhe v\u00ebshtir\u00ebsit\u00eb e hasura nga KQZ<\/em><\/p>\n\n\n\n<p>Nj\u00eb munges\u00eb e Draft-Raportit, n\u00eb opinionin e KRIIK, \u00ebsht\u00eb mosparaqitja n\u00eb t\u00eb e p\u00ebrshkrimit dhe analiz\u00ebs s\u00eb v\u00ebshtir\u00ebsive me t\u00eb cilat puna e KQZ-s\u00eb \u00ebsht\u00eb hasur gjat\u00eb implementimit t\u00eb mekanizmave p\u00ebr monitorimin e financimit t\u00eb subjekteve zgjedhore p\u00ebr Zgjedhjet e vitit 2023, duke e fokusuar Raportin vet\u00ebm tek gjetjet<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; N\u00eb gjykimin e KRIIK analiza e v\u00ebshtir\u00ebsive dhe problematikave n\u00eb Raport \u00ebsht\u00eb me shum\u00eb vler\u00eb, p\u00ebr s\u00eb paku dy arsye:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>S\u00eb pari, i sh\u00ebrben p\u00ebrmir\u00ebsimit t\u00eb mekanizmit n\u00eb vijim, nd\u00ebrkoh\u00eb q\u00eb mungesa e nj\u00eb analize t\u00eb till\u00eb, duke shmangur evidentimin e problematikave, sjell si pasoj\u00eb mbajtjen e status quo-s\u00eb dhe mbartjen e k\u00ebtyre problematikave n\u00eb vazhdim\u00ebsi. Mungesa e informacionit t\u00eb plot\u00eb mbi raportimin nga kandidat\u00ebt p\u00ebr kryetar\u00eb bashkie<\/em><\/p>\n\n\n\n<p>Sipas ligjit, \u00e7do kandidat apo parti politike pjes\u00ebmarr\u00ebse n\u00eb zgjedhje, duhet t\u00eb deklaroj\u00eb me p\u00ebrgjegjshm\u00ebri t\u00eb lart\u00eb \u00e7do lloj aktiviteti e transaksioni financiar t\u00eb kryer n\u00eb funksion t\u00eb fushat\u00ebs, duke plot\u00ebsuar me p\u00ebrgjegj\u00ebsi e n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb formatet e raportimit t\u00eb p\u00ebrcaktuara nga ligji.<\/p>\n\n\n\n<p>Lidhur me raportet e vet\u00ebdeklarimit t\u00eb dor\u00ebzuara nga kandidat\u00ebt p\u00ebr kryetar bashkie, nga monitorimi n\u00eb faqen e internetit t\u00eb KQZ-s\u00eb, rezulton se nga totali prej 144 kandidat\u00ebsh, vet\u00ebm 123 prej tyre kan\u00eb dor\u00ebzuar raport vet\u00ebdeklarimi, nd\u00ebrsa 18 prej tyre nuk e kan\u00eb b\u00ebr\u00eb nj\u00eb gj\u00eb t\u00eb till\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Kandidat\u00ebt p\u00ebr kryetar t\u00eb bashkis\u00eb, ashtu sikurse partit\u00eb politike, duhet t\u00eb raportonin n\u00ebp\u00ebrmjet Platform\u00ebs Elektronike t\u00eb Raportimit Financiar (PERF).<\/p>\n\n\n\n<p>Ky detyrim u respektua nga kandidat\u00ebt t\u00eb cil\u00ebt raportuan, por mbetet problematik fakti q\u00eb shfaqja e raporteve n\u00eb faqen e internetit nuk \u00ebsht\u00eb me emrin e kandidatit por vet\u00ebm duke vendosur si referim subjektin politik propozues t\u00eb tij.<\/p>\n\n\n\n<p>Gjithashtu, raportet e publikuara n\u00eb faqe nuk p\u00ebrmbajn\u00eb informacione lidhur me dat\u00ebn e publikimit t\u00eb tyre, ose mbi rastet eventuale t\u00eb ndryshimit t\u00eb m\u00ebvonsh\u00ebm t\u00eb ndonj\u00eb elementi apo plot\u00ebsimit t\u00eb m\u00ebpassh\u00ebm, pas afatit ligjor t\u00eb p\u00ebrcaktuar, t\u00eb b\u00ebr\u00eb n\u00eb p\u00ebrmbajtjen e tyre.<\/p>\n\n\n\n<p>K\u00ebto elemente, \u00ebsht\u00eb e nevojshme t\u00eb mbahen n\u00eb v\u00ebmendje nga KQZ-ja, n\u00eb funksion t\u00eb zbatimit t\u00eb detyrimit p\u00ebr transparenc\u00eb ndaj zbatimit t\u00eb afateve ligjore n\u00eb plot\u00ebsimin dhe dor\u00ebzimin e k\u00ebtyre raporteve.<\/p>\n\n\n\n<p><em>I.5. D\u00ebshtimi p\u00ebr t\u00eb hedhur raportet e kandidat\u00ebve t\u00eb listave shum\u00ebem\u00ebrore p\u00ebr k\u00ebshillat bashkiak\u00eb n\u00eb PERF<\/em><\/p>\n\n\n\n<p>Mbetet mjaft problematike, mos hedhja n\u00eb format elektronik i raporteve t\u00eb kandidat\u00ebve p\u00ebr an\u00ebtar\u00eb t\u00eb k\u00ebshillave bashkiak\u00eb n\u00ebp\u00ebrmjet Platform\u00ebs Elektronike t\u00eb Raportimit Financiar (PERF). &nbsp;Nd\u00ebrkoh\u00eb q\u00eb e ka vler\u00ebsuar pozitivisht iniciativ\u00ebn p\u00ebr raportimin n\u00eb m\u00ebnyr\u00eb elektronike nga ana e subjekteve zgjedhore, KRIIK ka v\u00ebn\u00eb n\u00eb vijim\u00ebsi n\u00eb dukje disa mang\u00ebsi n\u00eb implementim.<\/p>\n\n\n\n<p>Pasi u njoh me p\u00ebrmbajtjen e Projekt-Vendimit \u201c<em>P\u00ebr raportimin financiar n\u00eb platform\u00ebn elektronike t\u00eb raportimit financiar (PERF) nga subjektet zgjedhore p\u00ebr zgjedhjet e organeve t\u00eb qeverisjes vendore t\u00eb dat\u00ebs 14 Maj 2023\u201d, KRIIK <\/em>n\u00ebp\u00ebrmjet komunikimit t\u00eb vazhduesh\u00ebm me KQZ, si shkresor<a href=\"#_ftn2\" id=\"_ftnref2\"><sup>[2]<\/sup><\/a> ashtu edhe verbal, propozoi q\u00eb detyrimin p\u00ebr raportimin n\u00eb k\u00ebt\u00eb platform\u00eb ta mbartin edhe kandidat\u00ebt p\u00ebr an\u00ebtar\u00eb t\u00eb K\u00ebshillave Bashkiak\u00eb, por KQZ-ja nuk e b\u00ebri k\u00ebt\u00eb element pjes\u00eb t\u00eb akteve n\u00ebnligjore p\u00ebrkat\u00ebse, duke deklaruar n\u00eb m\u00ebnyr\u00eb t\u00eb pakuptimt\u00eb se do ta merrte vet\u00eb institucioni<a href=\"#_ftn3\" id=\"_ftnref3\"><sup>[3]<\/sup><\/a> barr\u00ebn e hedhjes s\u00eb t\u00eb dh\u00ebnave t\u00eb k\u00ebtyre raporteve n\u00eb PERF.<\/p>\n\n\n\n<p>KRIIK shprehu n\u00ebp\u00ebrmjet t\u00eb gjitha kanaleve t\u00eb komunikimit, publik ose jo, se kjo zgjidhje nuk i sh\u00ebrbente q\u00ebllimit t\u00eb leht\u00ebsimit t\u00eb kontrollit dhe verifikimit p\u00ebr KQZ-n\u00eb, p\u00ebrkundrazi e v\u00ebshtir\u00ebsonte m\u00eb shum\u00eb pun\u00ebn e administrat\u00ebs s\u00eb KQZ-s\u00eb n\u00eb k\u00ebt\u00eb drejtim, duke e mbingarkuar at\u00eb dhe ulur efi\u00e7enc\u00ebn e mekanizmit kontrollues dhe ligjzbatimit n\u00eb t\u00ebr\u00ebsi.<\/p>\n\n\n\n<p>N\u00eb realitet, hedhja e raporteve t\u00eb kandidat\u00ebve p\u00ebr k\u00ebshillat bashkiak\u00eb n\u00eb Platform\u00ebn Elektronike t\u00eb Raportimit Financiar nga administrata e KQZ-s\u00eb nuk u realizua, por raportet u kontrolluan fizikisht, madje nj\u00eb pjes\u00eb e konsiderueshme e tyre nuk u publikuan fare n\u00eb faqen e internetit t\u00eb KQZ-s\u00eb.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb situat\u00eb dhe duke mbatjur n\u00eb konsiderat\u00eb se PERF nuk \u00ebsht\u00eb m\u00eb n\u00eb funksion, n\u00eb pritje p\u00ebr t\u2019u p\u00ebrmir\u00ebsuar, KRIIK nxit KQZ-n\u00eb q\u00eb, n\u00eb funksion t\u00eb transparenc\u00ebs, minimalisht t\u00eb publikoj\u00eb raportet e kandidat\u00ebve t\u00eb listave shum\u00ebem\u00ebrore p\u00ebr k\u00ebshillat bashkiak\u00eb n\u00eb faqen e vet t\u00eb internetit, qoft\u00eb edhe n\u00eb form\u00eb t\u00eb skanuar.<\/p>\n\n\n\n<p><em>I.6. P\u00ebrfshirja n\u00eb Raportin e KQZ-s\u00eb e List\u00ebs Em\u00ebrore t\u00eb Kandidat\u00ebve t\u00eb cil\u00ebt nuk kan\u00eb dor\u00ebzuar raport vet\u00ebdeklarimi<\/em><\/p>\n\n\n\n<p>Kandidimi n\u00eb nj\u00eb proces zgjedhor, n\u00ebp\u00ebrmjet t\u00eb cilit aspirohet marrja e Mandatit t\u00eb Kryetarit t\u00eb Bashkis\u00eb apo An\u00ebtarit t\u00eb K\u00ebshillit Bashkiak, \u00ebsht\u00eb nj\u00eb p\u00ebrgjegj\u00ebsi madhore p\u00ebr t\u00eb cil\u00ebn, p\u00ebrpos t\u00eb tjerave, duhet t\u00eb respektohet \u00e7do detyrim ligjor, nj\u00eb nd\u00ebr t\u00eb cil\u00ebt mbetet raportimi me p\u00ebrgjegjshm\u00ebri i t\u00eb ardhurave dhe shpenzimeve t\u00eb kryera n\u00eb funksion t\u00eb fushat\u00ebs elektorale.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; \u00c7do kandidat \u00ebsht\u00eb nj\u00eb em\u00ebr publik dhe p\u00ebrmbushja e k\u00ebtij detyrimi prej tyre duhet t\u00eb jet\u00eb t\u00ebr\u00ebsisht transparente dhe nj\u00ebkoh\u00ebsisht duhet b\u00ebr\u00eb publike nga KQZ-ja, sikurse ligji parashikon.<\/p>\n\n\n\n<p>Ndaj gjykohet se \u00ebsht\u00eb me shum\u00eb vler\u00eb, n\u00eb funksion t\u00eb transparenc\u00ebs dhe llogaridh\u00ebnies ndaj publikut, q\u00eb Lista Em\u00ebrore e Kandidat\u00ebve t\u00eb cil\u00ebt garuan n\u00eb zgjedhjet e 14 majit 2023, si dhe p\u00ebrmbushja ose jo prej tyre e detyrimit t\u00eb dor\u00ebzimit t\u00eb raporteve financiare p\u00ebr fushatat respektive zgjedhore, t\u00eb p\u00ebrfshihen n\u00eb Draft-Raportin e hartuar nga KQZ-ja.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat lidhur me p\u00ebrmbushjen e k\u00ebtij detyrimi ligjor nuk duhet t\u00eb jen\u00eb vet\u00ebm numerike, duke i vendosur thjesht si numra individ\u00ebsh dhe vet\u00ebm n\u00eb p\u00ebrgjegj\u00ebsin\u00eb e partis\u00eb politike p\u00ebrkat\u00ebse, por ato duhet t\u00eb jen\u00eb s\u00eb pari individuale dhe specifike duke vendosur n\u00eb \u00e7do rast emrin p\u00ebrkat\u00ebs t\u00eb \u00e7do kandidati, p\u00ebrkrah shkeljes s\u00eb b\u00ebr\u00eb prej tij.<\/p>\n\n\n\n<p>Gjithashtu, lidhur m\u00eb k\u00ebt\u00eb shkelje ligjore t\u00eb evidentuar, KRIIK nxit KQZ-n\u00eb t\u00eb b\u00ebj\u00eb adresimin e duhur ligjor dhe sanksionimin p\u00ebrkat\u00ebs t\u00eb parashikuar, duke mos p\u00ebrs\u00ebritur praktik\u00ebn e m\u00ebparshme t\u00eb kanalizimit t\u00eb k\u00ebsaj shkeljeje si mosrespektim i formatit t\u00eb raportimit, por si mosdor\u00ebzim i tij, sikurse \u00ebsht\u00eb n\u00eb t\u00eb v\u00ebrtet\u00eb.<\/p>\n\n\n\n<p><em>I.7. Komunikimi i KQZ-s\u00eb me subjektet zgjedhore<\/em><\/p>\n\n\n\n<p>Ligji e p\u00ebrcakton qart\u00eb faktin q\u00eb n\u00ebse partia politike ka ezauruar \u00e7do rrug\u00eb k\u00ebrkesash dhe komunikimi me kandidatin lidhur me p\u00ebrmbushjen e detyrimit t\u00eb dor\u00ebzimit t\u00eb raportit financiar, p\u00ebrgjegj\u00ebsia p\u00ebr mosdor\u00ebzimin e raportit i kalon vet\u00eb kandidatit dhe jo partis\u00eb q\u00eb e ka propozuar at\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp; &nbsp;&nbsp;N\u00eb k\u00ebt\u00eb kuad\u00ebr, nevojitet nj\u00eb komunikim i administrat\u00ebs s\u00eb KQZ-s\u00eb me partit\u00eb politike lidhur me mosp\u00ebrmbushjen e detyrimit t\u00eb dor\u00ebzimit t\u00eb raportit financiar prej kandidat\u00ebve t\u00eb tyre e hapave t\u00eb tjer\u00eb t\u00eb nd\u00ebrmarr\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb p\u00ebrcaktohet sakt\u00ebsisht, sikurse ligji parashikon, se kush duhet t\u00eb sanksionohet lidhur me k\u00ebt\u00eb shkelje.<\/p>\n\n\n\n<p>N\u00eb rast se nga ana e KQZ-s\u00eb \u00ebsht\u00eb kryer nj\u00eb proces i till\u00eb, do t\u00eb duhet q\u00eb ecuria e tij, p\u00ebrfshi hapat e nd\u00ebrmarr\u00eb nga KQZ-ja dhe p\u00ebrgjigjet e dh\u00ebna prej subjekteve zgjedhore t\u00eb jen\u00eb t\u00eb detajuara dhe p\u00ebrfshira n\u00eb Draft-Raportin e p\u00ebrgatitur.<\/p>\n\n\n\n<p><em>I.8. Mos evidentimi n\u00eb Draft-Raport i mosplot\u00ebsimit nga ana e subjekteve zgjedhore t\u00eb detyrimit ligjor p\u00ebr t\u00eb dor\u00ebzuar bilancin e aseteve dhe detyrimeve<\/em><\/p>\n\n\n\n<p>Neni 92\/3 g\u00ebrma \u201c\u00e7\u201d e Kodit Zgjedhor parashikon qart\u00eb detyrimin e subjekteve zgjedhore p\u00ebr t\u00eb dor\u00ebzuar n\u00eb KQZ, si pjes\u00eb t\u00eb Raportimit Financiar, edhe Bilancin e Aseteve dhe Detyrimeve p\u00ebr periudh\u00ebn nga dekretimi i dat\u00ebs s\u00eb zgjedhjeve deri n\u00eb dat\u00ebn e zgjedhjeve.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; P\u00ebrmbushja e k\u00ebtyre detyrimeve ligjore si dhe nj\u00eb raportim i sakt\u00eb e konform standardeve t\u00eb kontabilitetit, b\u00ebn t\u00eb mundur t\u00eb sigurohet nj\u00eb panoram\u00eb m\u00eb e qart\u00eb mbi aktivitetin financiar t\u00eb subjektit zgjedhor, duke siguruar transparenc\u00eb m\u00eb t\u00eb plot\u00eb dhe b\u00ebr\u00eb funksional mekanizmin e kontrollit n\u00ebp\u00ebrmjet verifikimeve t\u00eb KQZ-s\u00eb dhe auditimit prej audit\u00ebve ligjor\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Gjithashtu, \u00ebsht\u00eb m\u00ebse e nevojshme, sikurse ligji parashikon, q\u00eb bilanci i aseteve dhe detyrimeve t\u00eb jet\u00eb objekt i pun\u00ebs s\u00eb audit\u00ebve ligjor\u00eb, p\u00ebr t\u00eb patur nj\u00eb panoram\u00eb t\u00eb plot\u00eb t\u00eb gjendjes dhe pasqyrave financiare t\u00eb subjekteve zgjedhore n\u00eb fillim dhe n\u00eb fund t\u00eb periudh\u00ebs s\u00eb raportimit, \u00e7ka n\u00eb fakt, p\u00ebr shkak t\u00eb mosdor\u00ebzimit t\u00eb k\u00ebtyre bilanceve, nuk \u00ebsht\u00eb b\u00ebr\u00eb dot e mundur.<\/p>\n\n\n\n<p>Rezulton se asnj\u00eb parti politike nuk dor\u00ebzoi n\u00eb KQZ Bilancin e Aseteve dhe Detyrimeve sikurse ligji p\u00ebrcakton, duke vijuar praktik\u00ebn e anashkalimit dhe mosrespektimit ndaj norm\u00ebs detyruese t\u00eb Kodit Zgjedhor, nd\u00ebrkoh\u00eb q\u00eb ky fakt nuk p\u00ebrmendet fare n\u00eb Draft-Raportin e KQZ-s\u00eb.<\/p>\n\n\n\n<p>\u00cbsht\u00eb e paqart\u00eb dhe e pajustifikueshme shmangia e evidentimit t\u00eb nj\u00eb detyrimi t\u00eb qart\u00eb ligjor nga ana e partive politike n\u00eb Draft-Raportin e p\u00ebrgatitur.<\/p>\n\n\n\n<p><em>I.9. Plot\u00ebsimi i raporteve t\u00eb vet\u00ebdeklarimit nga ana e subjekteve zgjedhore n\u00eb m\u00ebnyr\u00eb neglizhente<\/em><\/p>\n\n\n\n<p>Gjat\u00eb analiz\u00ebs s\u00eb raporteve t\u00eb vet\u00ebdeklarimit t\u00eb subjekteve zgjedhore, KRIIK ka v\u00ebn\u00eb re raste t\u00eb plot\u00ebsimit t\u00eb raporteve me neglizhenc\u00eb, \u00e7ka pengon jo thjesht b\u00ebrjen e transparenc\u00ebs mbi to, por edhe mund t\u00eb konsiderohen si orvatje p\u00ebr t\u00eb fshehur realitetin e veprimtaris\u00eb s\u00eb kryer apo mbuluar shkeljet ligjore t\u00eb b\u00ebra<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a>.<\/p>\n\n\n\n<p>N\u00ebse kjo neglizhenc\u00eb \u00ebsht\u00eb e q\u00ebllimshme ose jo nuk mund t\u00eb gjykohet, por, n\u00eb \u00e7do rast, KRIIK gjykon se KQZ-ja do t\u00eb duhet t\u2019i kishte evidentuar k\u00ebto neglizhenca dhe kthyer raportin p\u00ebr plot\u00ebsim\/korrigjim tek subjektet zgjedhore.<\/p>\n\n\n\n<p>N\u00eb munges\u00eb t\u00eb k\u00ebsaj, m\u00eb s\u00eb paku, gjykohet se n\u00eb Raportin e KQZ-s\u00eb, ky element do t\u00eb duhet t\u00eb evidentohet dhe t\u00eb vendosen sanksionet p\u00ebrkat\u00ebse, sipas rastit.<\/p>\n\n\n\n<p><em>I.10. Mos evidentimi i shpenzimeve p\u00ebr reklama politike n\u00eb mediat sociale<\/em><\/p>\n\n\n\n<p>Jo vet\u00ebm n\u00eb Shqip\u00ebri, por n\u00eb t\u00eb gjith\u00eb bot\u00ebn, tanim\u00eb nj\u00eb pjes\u00eb e konsiderueshme e fushatave politike kryhen online, p\u00ebrfshi n\u00eb mediat sociale, qoft\u00eb n\u00ebp\u00ebrmjet postimeve q\u00eb synojn\u00eb t\u00eb arrijn\u00eb zgjedh\u00ebsit n\u00eb m\u00ebnyr\u00eb organike, qoft\u00eb n\u00ebp\u00ebrmjet reklam\u00ebs s\u00eb paguar politike n\u00eb k\u00ebto media.<\/p>\n\n\n\n<p>Monitorimi i shpenzimeve p\u00ebr reklam\u00eb politike n\u00eb mediat sociale duhet t\u00eb jet\u00eb n\u00eb fokus t\u00eb v\u00ebmendjes s\u00eb Komisionit Qendror t\u00eb Zgjedhjeve, p\u00ebr vet\u00eb impaktin madhor q\u00eb k\u00ebto reklama kan\u00eb n\u00eb opinionin publik, duke qen\u00eb se jan\u00eb sot nj\u00eb nga m\u00ebnyrat m\u00eb efektive p\u00ebr t\u00eb arritur zgjedh\u00ebsit potencial\u00eb, por edhe p\u00ebr t\u00eb publikuar reklama t\u00eb personalizuara dhe targetuara specifikisht p\u00ebr demografi t\u00eb ndryshme zgjedh\u00ebsish. &nbsp;&nbsp;R\u00ebnd\u00ebsia e monitorimit t\u00eb reklam\u00ebs politike n\u00eb mediat sociale ishte ve\u00e7an\u00ebrisht e dukshme n\u00eb Zgjedhjet p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb vitit 2021, gjat\u00eb t\u00eb cilave jo vet\u00ebm subjektet zgjedhore, por edhe pal\u00eb t\u00eb treta (t\u00eb cilat qartas ishin t\u00eb koordinuara nga subjektet zgjedhore) shpenzuan shuma t\u00eb konsiderueshme parash.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Nd\u00ebrkoh\u00eb q\u00eb jo n\u00eb \u00e7do rast \u00ebsht\u00eb e mundur t\u00eb b\u00ebhet transparenc\u00eb e plot\u00eb mbi shpenzimet p\u00ebr reklama politike n\u00eb internet, pasi disa kompani (t\u00eb tilla si X apo Google) nuk mund\u00ebsojn\u00eb transparenc\u00ebn p\u00ebr k\u00ebto shpenzime, rrjetet sociale m\u00eb t\u00eb p\u00ebrdorura aktualisht n\u00eb vend dhe q\u00eb kan\u00eb impaktin m\u00eb t\u00eb lart\u00eb potencial tek zgjedh\u00ebsit (Facebook dhe Instagram) kan\u00eb krijuar mekanizma q\u00eb mund\u00ebsojn\u00eb nj\u00eb transparenc\u00eb, edhe pse jo totale, n\u00eb lidhje me reklamat politike n\u00eb Shqip\u00ebri prej marsit t\u00eb viti 2021, <a href=\"https:\/\/www.facebook.com\/ads\/library\/\">Librarin\u00eb e Reklamave Politike<\/a>.<\/p>\n\n\n\n<p>KRIIK gjykon se KQZ duhet t\u00eb p\u00ebrdor\u00eb k\u00ebt\u00eb baz\u00eb t\u00eb dh\u00ebnash p\u00ebr t\u00eb evidentuar dhe verifikuar n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur shpenzimet s\u00eb paku n\u00eb k\u00ebto rrjete sociale t\u00eb partive politike apo kandidat\u00ebve. Nd\u00ebrkoh\u00eb q\u00eb edhe nga analiza e raporteve t\u00eb b\u00ebra prej monitoruesve t\u00eb KQZ-s\u00eb, rezulton se ata kan\u00eb d\u00ebshtuar t\u00eb p\u00ebrmbushin detyr\u00ebn e tyre n\u00eb p\u00ebrputhje me Udh\u00ebzimin e KSHZ-s\u00eb, duke qen\u00eb se nuk kan\u00eb raportuar fare n\u00eb lidhje me k\u00ebt\u00eb element.<\/p>\n\n\n\n<p>N\u00eb \u00e7do rast, n\u00eb Raportin Paraprak t\u00eb KRIIK <a href=\"https:\/\/kriik.al\/home\/2023\/07\/31\/raport-paraprak-financim-zgjedhje14maj23\/\">\u201cMbi transparenc\u00ebn dhe kontrollin mbi financimin e fushat\u00ebs p\u00ebr Zgjedhjet p\u00ebr Organet e Qeverisjes Vendore t\u00eb 14 majit 2023\u201d<\/a>, t\u00eb publikuar n\u00eb korrik 2023, ka t\u00eb dh\u00ebna n\u00eb lidhje me shpenzimet n\u00eb media sociale dhe k\u00ebto gjetje i jan\u00eb komunikuar KQZ-s\u00eb. &nbsp;P\u00ebr m\u00eb tep\u00ebr, n\u00eb Raportin q\u00eb po ju d\u00ebrgojm\u00eb bashk\u00eblidhur mund t\u00eb gjeni edhe kryq\u00ebzimin e k\u00ebtyre t\u00eb dh\u00ebnave me raportimin e subjekteve zgjedhore.<\/p>\n\n\n\n<p>Gjykohet se KQZ-ja duhet t\u00eb marr\u00eb n\u00eb konsiderat\u00eb k\u00ebto gjetje dhe t\u00eb verifikoj\u00eb n\u00ebse deklarimi i shpenzimeve nga subjektet zgjedhore p\u00ebrputhet me t\u00eb dh\u00ebnat e analizuara dhe evidentuara nga KRIIK, t\u00eb cilat bazohen n\u00eb nj\u00eb baz\u00eb t\u00eb dh\u00ebnash publike t\u00eb vendosur n\u00eb dispozicion nga kompania Meta q\u00eb ka p\u00ebrfituar t\u00eb ardhurat p\u00ebr k\u00ebto reklama, pra jan\u00eb zyrtare dhe t\u00eb besueshme.<\/p>\n\n\n\n<p><em>I.11. Nevoja p\u00ebr sqarim e sakt\u00ebsim t\u00eb metodologjis\u00eb s\u00eb p\u00ebrdorur p\u00ebr kostot e shpenzuara p\u00ebr reklam\u00eb politike n\u00eb media<\/em><\/p>\n\n\n\n<p>N\u00eb p\u00ebrmbajtje t\u00eb gjith\u00eb Drasft-Raportit t\u00eb d\u00ebrguar, reklama politike n\u00eb media z\u00eb nj\u00eb vend t\u00eb konsideruesh\u00ebm, por t\u00eb ndar\u00eb n\u00eb disa seksione, duke p\u00ebrs\u00ebritur shpesh t\u00eb nj\u00ebjtat t\u00eb dh\u00ebna por t\u00eb ndara n\u00eb m\u00ebnyra t\u00eb ndryshme.<\/p>\n\n\n\n<p>Kjo e b\u00ebn t\u00eb pakuptueshme p\u00ebr publikun informacion real t\u00eb raportuar dhe t\u00eb p\u00ebrllogaritur si t\u00eb shpenzuar nga subjektet zgjedhore.<\/p>\n\n\n\n<p>E gjith\u00eb m\u00ebnyra e pasqyrimit t\u00eb gjetjeve lidhur me k\u00ebt\u00eb \u00e7\u00ebshtje, n\u00eb opinionin e KRIIK, do t\u00eb duhet t\u00eb rishikohet, duke sqaruar m\u00eb par\u00eb metodologjin\u00eb e p\u00ebrdorur nga KQZ-ja p\u00ebr t\u00eb kryer p\u00ebrllogaritjet e saj, e m\u00eb pas t\u00eb b\u00ebhet pasqyrimi i t\u00eb dh\u00ebnave n\u00eb form\u00eb sa m\u00eb t\u00eb qart\u00eb dhe leht\u00ebsisht t\u00eb kuptueshme p\u00ebr publikun.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Gjithashtu, sugjerohet q\u00eb n\u00eb raporte t\u00eb tilla me t\u00eb dh\u00ebna t\u00eb karakterit financiar nevojitet t\u00eb b\u00ebhet pasqyrimi i tyre n\u00eb forma tabelare, \u00e7ka ndihmon m\u00eb shum\u00eb b\u00ebrjen e transparenc\u00ebs s\u00eb plot\u00eb, si dhe kuptimin apo p\u00ebrpunimin e t\u00eb dh\u00ebnave n\u00eb fjal\u00eb.<\/p>\n\n\n\n<p><em>I.12. Mosp\u00ebrfshirja e shpenzimeve t\u00eb reklamave t\u00eb b\u00ebra n\u00eb mediat online<\/em><\/p>\n\n\n\n<p>P\u00ebrgjat\u00eb fushat\u00ebs zgjedhore, subjektet zgjedhore kan\u00eb paguar jo vet\u00ebm p\u00ebr reklama n\u00eb mediat tradicionale por edhe n\u00eb portalet e tyre online, p\u00ebrfshir\u00eb gjithashtu mediat e tjera online apo si\u00e7 njihen ndryshe portale, si edhe n\u00eb m\u00ebnyra t\u00eb tjera promovuese.<\/p>\n\n\n\n<p>Ngelet shqet\u00ebsues fakti q\u00eb kjo kategori mediash, nuk njihen nga ligji si t\u00eb tilla, dhe p\u00ebr rrjedhim ato nuk mbartin detyrimin ligjor t\u00eb depozitojn\u00eb dhe b\u00ebjn\u00eb publike n\u00eb KQZ tarifat q\u00eb aplikojn\u00eb p\u00ebr reklama, p\u00ebrpos se mbeten jasht\u00eb \u00e7do monitorimi nga institucionet.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; P\u00ebrjashtim n\u00eb k\u00ebt\u00eb rast b\u00ebjn\u00eb mediat audiovizive q\u00eb kan\u00eb edhe faqe interneti, t\u00eb cilat duhet t\u00eb publikojn\u00eb tarifat p\u00ebr k\u00ebto lloj reklamash, por ligji nuk i detyron n\u00eb m\u00ebnyr\u00eb eksplicite p\u00ebr t\u00eb depozituar edhe tarifat e faqes s\u00eb internetit. Konstatohet se disa media i kan\u00eb depozituar tarifat edhe p\u00ebr reklama n\u00eb faqet e tyre t\u00eb internetit.<\/p>\n\n\n\n<p>Nga monitorimi jo sistematik i KRIIK<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a> rezulton se s\u00eb paku 30 faqe interneti<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a> kan\u00eb publikuar gjat\u00eb fushat\u00ebs reklam\u00eb politike p\u00ebr subjektet zgjedhore.<\/p>\n\n\n\n<p>Nga k\u00ebqyrja e raporteve t\u00eb vet\u00ebdeklarimit rezulton se vet\u00ebm tre subjekte, dy parti politike<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a> dhe nj\u00eb kandidat<a href=\"#_ftn10\" id=\"_ftnref10\">[10]<\/a> kan\u00eb deklaruar shpenzime p\u00ebr media online, n\u00eb shum\u00ebn 741.760 lek\u00eb.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; K\u00ebto shpenzime nuk mund t\u00eb p\u00ebrllogariten apo p\u00ebrqasen n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur, p\u00ebr shkak t\u00eb munges\u00ebs s\u00eb \u00e7mimit s\u00eb reklamimit n\u00eb mediat online, si dhe t\u00eb koh\u00ebzgjatjes q\u00eb k\u00ebto reklama kan\u00eb qen\u00eb prezente online.<\/p>\n\n\n\n<p>KRIIK i sugjeroi KQZ-s\u00eb nj\u00eb qasje proaktive duke marr\u00eb list\u00ebn e \u00e7mimeve dhe kontratat e lidhura nd\u00ebrmjet tyre dhe subjekteve zgjedhore, n\u00ebse ka t\u00eb tilla.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; N\u00eb rastin e mediave audiovizive q\u00eb kan\u00eb patur reklama t\u00eb paguara qoft\u00eb n\u00eb transmetim, qoft\u00eb n\u00eb faqet e internetit, do t\u00eb duhej q\u00eb KQZ-ja t\u00eb evidentonte shpenzimet p\u00ebr secil\u00ebn kategori m\u00eb vete, sipas kontratave t\u00eb lidhura mes medias dhe subjekteve zgjedhore.<\/p>\n\n\n\n<p>N\u00eb Draft-Raportin e paraqitur ky komponent nuk p\u00ebrmendet.<\/p>\n\n\n\n<p>N\u00eb dijenin\u00eb e KRIIK, Komisioni Qendror i Zgjedhjeve nuk ka patur asnj\u00eb komunikim me portalet apo faqet web t\u00eb cilat p\u00ebrgjat\u00eb fushat\u00ebs elektorale vendos\u00ebn reklama t\u00eb subjekteve t\u00eb ndryshme zgjedhore, nd\u00ebrkoh\u00eb q\u00eb asnj\u00eb institucion p\u00ebrgjegj\u00ebs nuk kryen monitorim t\u00eb tyre.<\/p>\n\n\n\n<p>N\u00eb gjykimin e KRIIK kjo \u00ebsht\u00eb mang\u00ebsi n\u00eb procesin e kontrollit dhe verifikimit q\u00eb kryhet nga KQZ dhe \u00ebsht\u00eb nj\u00eb hallk\u00eb q\u00eb do t\u00eb duhet t\u00eb kryhet prej k\u00ebtij institucioni.&nbsp;<\/p>\n\n\n\n<p><strong>II. Majlinda Bufi, si dhe Euro Balkan News n\u00eb vler\u00ebn 174 400 lek\u00eb.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Partia Demokratike e Shqip\u00ebris\u00eb p\u00ebrpos mediave t\u00eb p\u00ebrfshira ka deklaruar shpenzime reklamash politike edhe n\u00eb News 24 n\u00eb shum\u00ebn 2 120 000 lek\u00eb.<\/li>\n<\/ul>\n\n\n\n<p>Pagesa e p\u00ebrfshir\u00eb n\u00eb raportin e administrat\u00ebs s\u00eb KQZ p\u00ebr Top Channel n\u00eb vler\u00ebn 200.000 lek\u00eb, nga monitorimi i KRIIK nuk rezulton t\u00eb jet\u00eb deklaruar nga Partia Demokratike n\u00eb raportin e saj t\u00eb vet\u00ebdeklarimit.<\/p>\n\n\n\n<p>Gjithashtu, specifikimi i b\u00ebr\u00eb nga administrata n\u00eb pik\u00ebn IV. \u2018Televizioni Ardit Baxhaku PF n\u00eb vler\u00ebn 200 000 lek\u00eb\u2019, nuk \u00ebsht\u00eb shpenzim q\u00eb duhet t\u00eb futet n\u00eb kategorin\u00eb e pagesave p\u00ebr reklam\u00eb, duke qen\u00eb se: <em>s\u00eb pari<\/em> nuk kemi t\u00eb b\u00ebjm\u00eb me media dhe <em>s\u00eb dyti<\/em> p\u00ebrshkrimi konkret n\u00eb raportin e subjektit Partia Demokratike \u00ebsht\u00eb \u201cPagese per sh\u00ebrbim video\u201d.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Partia e Liris\u00eb, p\u00ebrpos shpenzimeve t\u00eb deklaruara por t\u00eb pa paguara p\u00ebr Syri TV, sikurse specifikuar n\u00eb raportin e administrat\u00ebs s\u00eb KQZ, ka disa kandidat\u00eb t\u00eb cil\u00ebt sipas monitorimit t\u00eb KRIIK, kan\u00eb deklaruar shpenzime p\u00ebr reklam\u00eb politike n\u00eb media.<\/li>\n<\/ul>\n\n\n\n<p>Konkretisht, kandidati Belind K\u00eblli\u00e7i i cili ka deklaruar pagesa p\u00ebr News 24 n\u00eb shum\u00ebn 940 771 lek\u00eb, Syri TV n\u00eb shum\u00ebn 1 848 902 lek\u00eb, Radio Gjirokastra n\u00eb shum\u00ebn 3 180 lek\u00eb, Radio Alpo n\u00eb shum\u00ebn 5 000 lek\u00eb dhe Panorama Online n\u00eb shum\u00ebn 222 000 lek\u00eb.<\/p>\n\n\n\n<p>Duke qen\u00eb se monitorimi i AMA-s e vendos koh\u00ebn e reklam\u00ebs s\u00eb kandidat\u00ebve n\u00eb subjektin politik q\u00eb ata p\u00ebrfaq\u00ebsojn\u00eb, p\u00ebrllogaritja duhet b\u00ebr\u00eb duke marr\u00eb n\u00eb konsiderat\u00eb edhe deklarimet e kandidat\u00ebve, pra jo vet\u00ebm ato t\u00eb partis\u00eb propozuese.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Partia Agrare Ambjentaliste,\u00a0 p\u00ebrpos pages\u00ebs p\u00ebr News 24 t\u00eb p\u00ebrfshir\u00eb n\u00eb raportin e hartuar nga administrata e KQZ, sipas monitorimit t\u00eb KRIIK n\u00eb raportin e vet\u00ebdeklarimit ka deklaruar nj\u00eb pages\u00eb ende t\u00eb pa kryer n\u00eb momentin e vet\u00ebdeklarimit, por gjithsesi detyrim i faturuar, p\u00ebr TV Ora News n\u00eb shum\u00ebn 1 585 834 lek\u00eb.<\/li>\n<\/ul>\n\n\n\n<p><strong><em><u>II.4. Lidhur me pik\u00ebn 5<\/u><\/em><\/strong> <strong><em><u>t\u00eb Draft-Raportit<\/u><\/em><\/strong>, e cila lidhet me dor\u00ebzimin e raporteve t\u00eb vet\u00ebdeklarimit prej subjekteve zgjedhore.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat e p\u00ebrfshira n\u00eb raportin e hartuar nga administrata e KQZ p\u00ebrputhen me t\u00eb dh\u00ebnat e monitorimit t\u00eb KRIIK.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb sipas ligjit, p\u00ebrpos raportit t\u00eb vet\u00ebdeklarimit, partit\u00eb politike duhet t\u00eb depozitojn\u00eb n\u00eb KQZ edhe Bilancin e Aseteve dhe Detyrimeve t\u00eb tyre p\u00ebr periudh\u00ebn nga dekretimi i dat\u00ebs s\u00eb zgjedhjeve deri n\u00eb dat\u00ebn e zgjedhjeve, pra nga data 24 tetor 2022 deri n\u00eb dat\u00ebn 14 maj 2023.<\/p>\n\n\n\n<p>Asnj\u00eb raport i till\u00eb nuk rezulton t\u00eb jet\u00eb dor\u00ebzuar nga partit\u00eb politike, element i cili duhet t\u00eb marr\u00eb v\u00ebmendjen e KQZ-s\u00eb.<\/p>\n\n\n\n<p><strong><em><u>II.7. Lidhur me pik\u00ebn 7 t\u00eb Draft-Raportit:<\/u><\/em><\/strong> \u201cAuditimi p\u00ebr subjektet zgjedhore t\u00eb cilat dor\u00ebzuan raport financiar p\u00ebr fushat\u00ebn zgjedhore 2023 dhe gjetjet p\u00ebrkat\u00ebse\u201d.<\/p>\n\n\n\n<p>Nga t\u00eb dh\u00ebnat e raporteve t\u00eb auditues\u00ebve ligjor\u00eb, si edhe nga monitorimi i KRIIK, rezultojn\u00eb pikat sikurse jan\u00eb p\u00ebrmendur n\u00eb raportin e hartuar nga administrata, me p\u00ebrjashtim t\u00eb rastit t\u00eb Partis\u00eb Socialdemokrate dhe Partis\u00eb Demokratike.&nbsp;<\/p>\n\n\n\n<p>Sipas raportit t\u00eb KQZ \u201cP\u00ebr Partin\u00eb Socialdemokrate audituesi \u00ebsht\u00eb shprehur me opinion me rezerv\u00eb shoq\u00ebruese duke konstatuar se dokumentet justifikuese nuk jan\u00eb fatura t\u00eb rregullta fiskale, &#8230;\u201d.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb nga monitorimi i KRIIK rezulton se auditi ka refuzuar t\u00eb jap\u00eb opinion ose ka dh\u00ebn\u00eb opinion refuzues p\u00ebr k\u00ebt\u00eb parti, duke u shprehur: \u201cB. P\u00cbRFUNDIMI o Refuzimi p\u00ebr ta certifikuar\/refuzimi p\u00ebr t\u00eb dh\u00ebn\u00eb opinion. Baza p\u00ebr opinionin Refuzim p\u00ebr ta certifikuar: \u2022 Dokumentet justifikuese nuk jan\u00eb fatura t\u00eb rregullta fiskale, pra nuk jan\u00eb dokumente t\u00eb njohura ligj\u00ebrisht p\u00ebr 13 raste. \u2022 N\u00eb fatur\u00eb nuk \u00ebsht\u00eb evidentuar si bler\u00ebs subjekti PSD p\u00ebr 32 raste. \u2022 Blerjet nuk kan\u00eb lidhje me shpenzimet e fushat\u00ebs por jan\u00eb Aktive Afatgjata Materiale t\u00eb cilat duhet t\u00eb paraqiten n\u00eb Pasqyrat Financiare t\u00eb vitit ushtrimor 2023 p\u00ebr 5 raste. \u2022 Subjekti nuk ka hapur llogari t\u00eb posa\u00e7me p\u00ebr fushat\u00ebn zgjedhore.<\/p>\n\n\n\n<p>Sa i p\u00ebrket Partis\u00eb Demokratike, n\u00eb pikat e p\u00ebrmbledhura n\u00eb raportin e KQZ-s\u00eb mungon shkelja e evidentuar nga audituesi e cila lidhet me mos hapjen e nj\u00eb llogarie t\u00eb posa\u00e7me bankare.<\/p>\n\n\n\n<p><strong><em><u>II.8. Lidhur me pik\u00ebn 9 t\u00eb Draft-Raportit:<\/u><\/em><\/strong> \u201cRezultatet e shqyrtimit t\u00eb shpenzimeve p\u00ebr fondet e p\u00ebrfituara nga buxheti i shtetit p\u00ebr partit\u00eb politike pjes\u00ebmarr\u00ebse n\u00eb zgjedhje\u201d.<\/p>\n\n\n\n<p>N\u00eb raportin e hartuar nga administrata e KQZ-s\u00eb paraqiten dy subjekte t\u00eb cilat duhet t\u00eb kthejn\u00eb fondin e p\u00ebrfituar nga buxheti i shtetit n\u00eb funksion t\u00eb fushat\u00ebs elektorale, pasi nuk e kan\u00eb shpenzuar at\u00eb p\u00ebr q\u00ebllimin e p\u00ebrcaktuar nga ligji q\u00eb \u00ebsht\u00eb fushata elektorale.<\/p>\n\n\n\n<p>Nga monitorimi i KRIIK, lidhur me k\u00ebt\u00eb pik\u00eb v\u00ebrehen tre problematika.<\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp; S\u00eb pari<\/em>, n\u00eb list\u00ebn e partive t\u00eb cituara mungon Partia Aleanca Arbnore Komb\u00ebtare, e cila ka p\u00ebrfituar si fond paradh\u00ebnie shum\u00ebn 532 820 lek\u00eb, por nuk ka dor\u00ebzuar asnj\u00eb raport vet\u00ebdeklarimi n\u00eb KQZ.<\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp; S\u00eb dyti<\/em>, Partia Aleanca Demokristiane e Shqip\u00ebris\u00eb, e cila sipas raportit t\u00eb hartuar nga administrate e KQZ-s\u00eb<strong>, <\/strong>ka p\u00ebrfituar fonde paradh\u00ebnie n\u00eb vler\u00ebn 448 974 lek\u00eb, shum\u00eb t\u00eb cil\u00ebn duhet ta kthej\u00eb pasi raporti, i cili \u00ebsht\u00eb jasht\u00eb formatit, si dhe i dor\u00ebzuar n\u00eb hardcopy n\u00eb KQZ ka 0 shpenzime.<\/p>\n\n\n\n<p>Nga monitorimi KRIIK rezulton se kjo parti, n\u00eb p\u00ebrmbajtjen e raportit t\u00eb saj, deklaron n\u00eb m\u00ebnyr\u00eb eksplicite se k\u00ebt\u00eb fond nuk e ka t\u00ebrhequr.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp; Gjithashtu kjo parti deklaron se kandidat\u00ebt kan\u00eb kryer fushat\u00eb me shpenzime personale, por n\u00eb raport deklaron 0 t\u00eb ardhura dhe shpenzime.<\/p>\n\n\n\n<p>Verifikimi lidhur me k\u00ebt\u00eb parti, gjykohet se duhet t\u00eb shkoj\u00eb p\u00ebrtej kthimit t\u00eb fondit q\u00eb nuk e ka t\u00ebrhequr.<\/p>\n\n\n\n<p><em>&nbsp;&nbsp;&nbsp;&nbsp; S\u00eb treti<\/em>, Kodi Zgjedhor parashikon se shpenzim p\u00ebr fushat\u00eb zgjedhore konsiderohet \u00e7do shpenzim q\u00eb b\u00ebhet p\u00ebr q\u00ebllime t\u00eb fushat\u00ebs.<\/p>\n\n\n\n<p>Nuk \u00ebsht\u00eb asesi n\u00eb frym\u00ebn dhe g\u00ebrm\u00ebn e ligjit<a href=\"#_ftn11\" id=\"_ftnref11\">[11]<\/a> q\u00eb mb\u00ebshtetja financiare e dh\u00ebn\u00eb ndaj partive politike nga buxheti i shtetit p\u00ebr zhvillimin e fushat\u00ebs elektorale, t\u00eb p\u00ebrdoret p\u00ebr shpenzime t\u00eb cilat nuk kan\u00eb q\u00ebllim informimin e qytetar\u00ebve mbi platform\u00ebn elektorale t\u00eb partis\u00eb apo kandidat\u00ebve t\u00eb saj.<\/p>\n\n\n\n<p>Nga monitorimi i b\u00ebr\u00eb nga KRIIK, evidentohen raste problematike t\u00eb shpenzimeve t\u00eb deklaruara t\u00eb cilat nuk p\u00ebrb\u00ebjn\u00eb fushat\u00eb elektorale, si: fushata e mbjelljes s\u00eb pem\u00ebve nga ana e Partis\u00eb Socialiste, e cila i kushtoi k\u00ebtij subjekti 19 883 016 lek\u00eb, si dhe deklarimi nga Partia Aleanca Arbnore Komb\u00ebtare, sipas auditit, t\u00eb pages\u00ebs s\u00eb nj\u00eb detyrimi ndaj buxhetit t\u00eb shtetit p\u00ebr sekuestrim, zhd\u00ebmtim, n\u00eb shum\u00ebn 441.688 lek\u00eb.<\/p>\n\n\n\n<p>Duke mbajtur n\u00eb v\u00ebmendje se Kodi Zgjedhor p\u00ebrcakton se \u201cShpenzime t\u00eb fushat\u00ebs zgjedhore\u201d jan\u00eb shpenzimet e b\u00ebra nga ose n\u00eb em\u00ebr t\u00eb nj\u00eb subjekti zgjedhor, p\u00ebrfshir\u00eb kandidat\u00ebt dhe\/ose deg\u00ebt e tij, ose t\u00eb nj\u00eb kandidati t\u00eb pavarur, t\u00eb cilat kryhen p\u00ebr t\u00eb promovuar fushat\u00ebn e vet ose p\u00ebr t\u00eb d\u00ebmtuar fushat\u00ebn e nj\u00eb subjekti tjet\u00ebr&#8230;\u201d, k\u00ebto shpenzime kur kryhen jasht\u00eb q\u00ebllimit t\u00eb p\u00ebrcaktuar nga ligji konsiderohen t\u00eb paligjshme, n\u00eb rastin m\u00eb t\u00eb mir\u00eb, dhe si korrupsion elektoral n\u00eb rastin m\u00eb t\u00eb keq.<\/p>\n\n\n\n<p>N\u00eb rastin e fushat\u00ebs s\u00eb mbjelljes s\u00eb pem\u00ebve prej Partis\u00eb Socialiste, fondet e shpenzuara jan\u00eb p\u00ebrdorur p\u00ebr t\u00eb mira materiale, pavar\u00ebsisht se jan\u00eb t\u00eb mira publike.<\/p>\n\n\n\n<p>Lidhur me dy rastet e m\u00ebsip\u00ebrme, k\u00ebto shpenzime nuk jan\u00eb b\u00ebr\u00eb p\u00ebr fushat\u00eb elektorale, ndaj ato duhet t\u00eb kthehen.<\/p>\n\n\n\n<p><strong><em><u>II.9. Lidhur me pik\u00ebn 10 t\u00eb Draft-Raportit:<\/u><\/em><\/strong> \u201cShqyrtimi nga Komisioni Qendror i Zgjedhjeve t\u00eb raporteve financiare t\u00eb dor\u00ebzuara nga vet\u00eb subjektet zgjedhore, nga monitoruesit, dhe ekspert\u00ebt kontab\u00ebl t\u00eb licensuar (auditues ligjor)\u201d.<\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat e paraqitura n\u00eb k\u00ebt\u00eb pik\u00eb t\u00eb raportit, konsistojn\u00eb n\u00eb numrin e zyrave zgjedhore t\u00eb konstatuara nga monitoruesit dhe ato t\u00eb deklaruara p\u00ebr tre subjekte zgjedhore, si dhe t\u00eb dh\u00ebna p\u00ebr kostot e deklaruara dhe kostot e p\u00ebrllogaritura t\u00eb shpenzuara nga ana e KQZ-s\u00eb lidhur me reklam\u00ebn politike n\u00eb media, p\u00ebr 9 parti politike.<\/p>\n\n\n\n<p>KRIIK ka monitoruar n\u00eb vijim\u00ebsi t\u00eb dyja k\u00ebto element\u00eb, p\u00ebr \u00e7do subjekt zgjedhor.<\/p>\n\n\n\n<p>Metodologjia e p\u00ebrdorur dhe t\u00eb gjitha t\u00eb dh\u00ebnat numerike, si dhe p\u00ebrllogaritjet e mosp\u00ebrputhjeve p\u00ebrkat\u00ebse, t\u00eb paraqitura n\u00eb form\u00eb tabelore, jan\u00eb t\u00eb p\u00ebrfshira n\u00eb Shtojc\u00ebn nr. 2 \u201cReklama politike n\u00eb media\u201d dhe Shtojc\u00ebn nr. 4 \u201cZyrat zgjedhore\u201d, t\u00eb cilat ndodhen bashk\u00eblidhur raportit t\u00eb v\u00ebzhgimit t\u00eb KRIIK. &nbsp;<\/p>\n\n\n\n<p><strong><em><u>II.10. Lidhur me reklam\u00ebn politike n\u00eb media.<\/u><\/em><\/strong><\/p>\n\n\n\n<p>Duke qen\u00eb se tarifat shpesh jan\u00eb me vler\u00eb mesatare dhe disa media nuk i kan\u00eb deklaruar fare tarifat, shuma e p\u00ebrllogaritur si diferenc\u00eb \u00ebsht\u00eb ilustruese por nuk \u00ebsht\u00eb vler\u00eb absolute, element q\u00eb vlen edhe p\u00ebr p\u00ebrllogaritjet e kryera nga administrata e KQZ.<\/p>\n\n\n\n<p>N\u00eb k\u00ebto kushte vendosja e mosp\u00ebrputhjes\/ve q\u00eb mund t\u00eb dalin n\u00eb vler\u00eb pagesash, nuk gjykohet t\u00eb jet\u00eb e nevojshme n\u00eb k\u00ebt\u00eb pik\u00eb t\u00eb raportit.
