Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp; T\u00eb nderuar An\u00ebtar\u00eb t\u00eb Komisionit Rregullator!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp; T\u00eb nderuar Koleg\u00eb t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p>Koalicioni p\u00ebr Reforma, Integrim dhe Institucione t\u00eb Konsoliduara (KRIIK) ka ndjekur n\u00eb vijim\u00ebsi gjith\u00eb procesin e vendimmarrjes administrative n\u00eb KQZ, duke u p\u00ebrpjekur t\u00eb jap\u00eb kontributin e vet n\u00ebp\u00ebrmjet rekomandimeve apo sugjerimeve konkrete p\u00ebrgjat\u00eb procesit t\u00eb konsultimit paraprak t\u00eb projekt-akteve t\u00eb d\u00ebrguara nga ju, apo edhe p\u00ebr projektakteve t\u00eb tjera p\u00ebr t\u00eb cilat vler\u00ebsohet se nevojiten t\u2019iu b\u00ebhen p\u00ebrmir\u00ebsime t\u00eb m\u00ebtejshme.<\/p>\n\n\n\n<p>Duke vler\u00ebsuar maksimalisht gatishm\u00ebrin\u00eb dhe fleksibilitetin e treguar nga ju n\u00eb k\u00ebt\u00eb proces, KRIIK gjen <strong>rastin t\u2019ju shpreh edhe nj\u00ebher\u00eb fal\u00ebnderimet e tij p\u00ebr t\u00ebr\u00eb k\u00ebt\u00eb bashk\u00ebpunim t\u00eb frytsh\u00ebm t\u00eb arritur<\/strong> deri m\u00eb tani, dhe<\/p>\n\n\n\n<p><strong>ju paraqet opinionin e tij<\/strong> lidhur me projekt-vendimin \u201cP\u00ebr miratimin e disa afateve procedurale q\u00eb lidhen me zgjedhjet e pjesshme p\u00ebr Kryetar n\u00eb Bashkin\u00eb Kuk\u00ebs, q\u00eb do t\u00eb zhvillohen m\u00eb dat\u00eb 24 shtator 2023\u201d.<\/p>\n\n\n\n<p>Konkretisht:<\/p>\n\n\n\n<p><strong><u>I.<\/u><\/strong> Konsiderohet e nevojshme q\u00eb <strong>pas pik\u00ebs 3 t\u00eb projektvendimit t\u00eb shtohet nj\u00eb pik\u00eb e cila t\u00eb sakt\u00ebsoj\u00eb se kur fillon monitorimi i fushat\u00ebs zgjedhore prej Autoritetit t\u00eb Mediave Audiovizive, sipas parashikimeve t\u00eb kuadrit ligjor.<\/strong><\/p>\n\n\n\n<p>B\u00ebhet me dije se n\u00eb Zgjedhjet e p\u00ebrs\u00ebritura t\u00eb 23 Korrikut 2023 p\u00ebr Kryetarin e Bashkis\u00eb Rrogozhin\u00eb, nga Autoriteti i Mediave Audiovizive (AMA) nuk u zhvillua asnj\u00eb monitorim i transmetimit t\u00eb fushat\u00ebs zgjedhore prej Ofruesve t\u00eb Sh\u00ebrbimeve Mediatike Audio\/audiovizive (OSHMA).<\/p>\n\n\n\n<p>Ky monitorim mungoi t\u00ebr\u00ebsisht qoft\u00eb gjat\u00eb fushat\u00ebs zgjedhore, qoft\u00eb edhe gjat\u00eb heshtjes zgjedhore, sikurse ligji parashikon, nd\u00ebrkoh\u00eb q\u00eb u faktua edhe pasqyrim i fushat\u00ebs zgjedhore n\u00ebp\u00ebrmjet transmetimeve t\u00eb OSHMA-ve, edhe thyerje e heshtjes zgjedhore prej tyre. (p\u00ebr m\u00eb shum\u00eb shih <a href=\"https:\/\/kriik.al\/home\/2023\/07\/25\/deklarata-e-gjetjeve-dhe-konkluzioneve-paraprake\/\">Deklarat\u00ebn Paraprake t\u00eb Zgjedhjeve t\u00eb P\u00ebrs\u00ebritura<\/a> t\u00eb 23 korrikut 2023 n\u00eb Rrogozhin\u00eb, si dhe <a href=\"https:\/\/kriik.al\/home\/2023\/07\/22\/denoncim-nr-12-lidhur-me-thyerjen-e-heshtjes-zgjedhore-nepermjet-trasmetimit-te-aktiviteteve-elektorale-te-partise-socialiste-ne-bashkine-rrogozhine\/\">Denoncimin nr. 12 \u201cLidhur me thyerjen e heshtjes zgjedhore<\/a> n\u00ebp\u00ebrmjet transmetimit t\u00eb aktiviteteve elektorale t\u00eb Partis\u00eb Socialiste n\u00eb Bashkin\u00eb Rrogozhin\u00eb\u201d t\u00eb KRIIK)<\/p>\n\n\n\n<p>Nga komunikimi i KRIIK me AMA-n p\u00ebr informacion lidhur me p\u00ebrmbushjen e detyrimit ligjor t\u00eb monitorimit t\u00eb fushat\u00ebs zgjedhore, prej tyre u dha p\u00ebrgjigjja dhe argumentimi i m\u00ebposht\u00ebm:<\/p>\n\n\n\n<p>\u201c<em>AMA, p\u00ebr procesin e monitorimit t\u00eb fushatave zgjedhore, bazohet n\u00eb \u201cKodin Zgjedhor\u201d t\u00eb Republik\u00ebs, si dhe \u201cMetodologjin\u00eb e monitorimit t\u00eb medias audio dhe audiovizive\u201d, i ndryshuar, miratuar nga KQZ, me vendim nr. 2, dt. 30.01.2021.&nbsp;<\/em><\/p>\n\n\n\n<p><em>N\u00eb rastin e zgjedhjeve t\u00eb p\u00ebrs\u00ebritura t\u00eb 23.07.2023 n\u00eb Rrogozhin\u00eb, p\u00ebr t\u00eb cilat ju jeni interesuar n\u00eb k\u00ebrkes\u00ebn p\u00ebr informacion, AMA ka pasur n\u00eb monitorim n\u00eb m\u00ebnyr\u00eb t\u00eb pand\u00ebrprer\u00eb, gjat\u00eb dy jav\u00ebve t\u00eb zhvillimit t\u00eb fushat\u00ebs zgjedhore, rubrik\u00ebn p\u00ebr veprimtarit\u00eb publike \u201cNdaluar nga KQZ\u201d, pjes\u00eb e faqes zyrtare virtuale t\u00eb k\u00ebtij institucioni (kqz.gov.al).<\/em><\/p>\n\n\n\n<p><em>P\u00ebrmbajtja e k\u00ebsaj rubrike \u00ebsht\u00eb pik\u00ebnisja p\u00ebr monitorim dhe shqyrtim t\u00eb m\u00ebtejsh\u00ebm p\u00ebr \u00e7do rast t\u00eb identifikuar nga KQZ dhe t\u00eb shoq\u00ebruar me vendimin p\u00ebrkat\u00ebs q\u00eb me shkres\u00eb zyrtare p\u00ebrcillet edhe n\u00eb AMA.&nbsp;&nbsp;<\/em><\/p>\n\n\n\n<p><em>P\u00ebr fushat\u00ebn e zgjedhjeve t\u00eb p\u00ebrs\u00ebritura n\u00eb Rrogozhin\u00eb nuk ka pasur asnj\u00eb njoftim nga KQZ, po ashtu dhe asnj\u00eb vendim t\u00eb p\u00ebrcjell\u00eb me shkres\u00eb n\u00eb AMA, p\u00ebr veprimtari publike \u201cNdaluar nga KQZ\u201d<\/em>.\u201d<\/p>\n\n\n\n<p>KRIIK ju sjell n\u00eb v\u00ebmendje se, pavar\u00ebsisht vakumit ligjor ekzistues lidhur me zgjedhjet e pjesshme, institucionet p\u00ebrkat\u00ebse t\u00eb tilla si KQZ-ja nevojitet t\u00eb angazhohen maksimalisht p\u00ebr t\u00eb marr\u00eb vendime t\u00eb plota e nxjerr\u00eb udh\u00ebzimet e nevojshme t\u00eb cilat duhet t\u00eb qart\u00ebsojn\u00eb pik\u00ebpyetjet dhe mund\u00ebsuar nj\u00eb proces zgjedhor pa problematika, ku nj\u00eb prej tyre \u00ebsht\u00eb nevoja p\u00ebr specifikimin n\u00eb Vendimin e Komisionit Rregullator<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> edhe t\u00eb detyrimit t\u00eb AMAs p\u00ebr t\u00eb monitoruar mbulimin mediatik t\u00eb fushat\u00ebs, sikurse parashikohet shprehimisht n\u00eb Kodin Zgjedhor.<\/p>\n\n\n\n<p>Kodi Zgjedhor<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a> dhe Metodologjia e Miratuar nga Komisioni Rregullator p\u00ebr monitorimin e medias audio-vizive<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a> k\u00ebrkojn\u00eb q\u00eb AMA t\u00eb monitoroj\u00eb mbulimin e fushat\u00ebs nga mediat dhe t\u2019i d\u00ebrgoj\u00eb raporte ditore KQZ-s\u00eb, t\u00eb cilat duhet t\u00eb publikohen n\u00eb faqen e k\u00ebsaj t\u00eb fundit<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a>.<\/p>\n\n\n\n<p>Monitorimi i OSHMA-ve p\u00ebr veprimtarit\u00eb me karakter publik t\u00eb institucioneve publike t\u00eb p\u00ebrcaktuara n\u00eb pik\u00ebn 1, t\u00eb k\u00ebtij vendimi, nga data 26.8.2023, nga ora 08:00-00:00 ose sipas rastit deri n\u00eb p\u00ebrfundimin e programit, sikurse parashikohet n\u00eb pik\u00ebn nr. 2 t\u00eb projekt-vendimit, \u00ebsht\u00eb edhe n\u00eb funksion t\u00eb llogaritjes s\u00eb koh\u00ebs s\u00eb fushat\u00ebs zgjedhore t\u00eb transmetuar, p\u00ebrgjat\u00eb periudh\u00ebs s\u00eb fushat\u00ebs zgjedhore, kur veprimtaria ndjek q\u00ebllime elektorale. (shih parashikimet n\u00eb nenin 81 pika 1 dhe nenin 84 pika 1 e 2 t\u00eb Kodit Zgjedhor).<\/p>\n\n\n\n<p>M\u00eb konkretisht, Kodi Zgjedhor ngarkon AMA-n q\u00eb t\u00eb konsideroj\u00eb si koh\u00eb transmetimi fushate n\u00eb edicionet informative t\u00eb OSHMA-ve (apo edhe t\u00eb koh\u00ebs n\u00eb dispozicion p\u00ebr RTSH-n\u00eb), p\u00ebr subjektin zgjedhor, at\u00ebher\u00eb kur konstaton se: <em>\u201cTransmetimi i veprimtarive t\u00eb institucioneve publike, qendrore ose vendore, llogaritet n\u00eb koh\u00ebn e transmetimit t\u00eb subjektit zgjedhor, t\u00eb cilit i p\u00ebrket titullari i institucionit, n\u00ebse veprimtaria ndjek q\u00ebllime elektorale. Veprimtaria ndjek q\u00ebllime elektorale kur ajo synon promovimin e arritjeve institucionale, t\u00eb investimeve, inaugurimeve ose ecurin\u00eb n\u00eb nd\u00ebrtimin e pun\u00ebve publike ose kur promovon aspekte specifike t\u00eb programit elektoral t\u00eb subjektit zgjedhor.\u201d<\/em>.<\/p>\n\n\n\n<p>P\u00ebrpos p\u00ebrfshirjes n\u00eb projektvendim t\u00eb gjith\u00eb sa m\u00eb sip\u00ebr, <strong>KRIIK nxit Komisionerin dhe Administrat\u00ebn e KQZ-s\u00eb q\u00eb t\u00eb hartoj\u00eb, d\u00ebrgoj\u00eb e b\u00ebj\u00eb publike<\/strong> <strong><u>KUJTESA<\/u><\/strong> lidhur me detyrimet ligjore q\u00eb kan\u00eb t\u00ebr\u00eb operator\u00ebt apo institucionet e ngarkuara me detyra lidhur me k\u00ebt\u00eb procves t\u00eb pjessh\u00ebm zgjedhor.<\/p>\n\n\n\n<p>Ve\u00e7an\u00ebrisht <strong>ky informimi duhet t\u2019u shkoj\u00eb t\u00ebr\u00eb OSHMA-ve p\u00ebr t\u00eb shmangur ekspozimin e tyre ndaj shkeljeve ligjore<\/strong>, pasi penalitetet e parashikuara p\u00ebr ta jan\u00eb t\u00eb konsiderushme, madje p\u00ebr disa prej tyre edhe t\u00eb pap\u00ebrballueshme.<\/p>\n\n\n\n<p>Nevojitet q\u00eb <strong>KQZ-ja t\u00eb angazhohet maksimalisht paraprakisht<\/strong>, si dhe t\u00eb shmang\u00eb m\u00eb pas me \u00e7do kusht relativizimin, injorimin apo shkeljen e ligjit duke mosvepruar apo mosp\u00ebrmbushur n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb detyrimet ligjore t\u00eb parashikuara, duke mbajtur n\u00eb k\u00ebmb\u00eb e jet\u00ebsuar m\u00eb tej fenomenin aq problematik t\u00eb pand\u00ebshkueshm\u00ebris\u00eb ndaj moszbatimit t\u00eb ligjit.<\/p>\n\n\n\n<p><strong><u>II.<\/u><\/strong>&nbsp; Nevojitet q\u00eb <strong>KQZ-ja t\u00eb disiplinoj\u00eb sjelljen e t\u00ebr\u00eb operatar\u00ebve t\u00eb p\u00ebrfshir\u00eb lidhur me respektimin e afateve dhe procedurave t\u00eb paraqitjes, miratimit dhe publikimit t\u00eb vendimeve lidhur me akreditimin e t\u00eb gjith\u00eb v\u00ebzhguesve vendas, e ve\u00e7an\u00ebrisht atyre t\u00eb akredituara prej subjekteve zgjedhore<\/strong>.<\/p>\n\n\n\n<p><strong>Parashikimi i b\u00ebr\u00eb n\u00eb pikat 12 dhe 13 t\u00eb projekt-vendimit konsiderohet prej KRIIK problematik dhe nj\u00eb hap pas me standardin e v\u00ebn\u00eb prej KQZ-s\u00eb<\/strong> qoft\u00eb n\u00eb rastin e Zgjedhjeve t\u00eb Pjesshme Vendore t\u00eb 6 marsit 2022 <em>(vendimi nr. 2 dt. 22.01.2022 i KRR)<\/em>, qoft\u00eb t\u00eb Zgjedhjeve t\u00eb P\u00ebrs\u00ebritura t\u00eb 23 korrikut 2023 n\u00eb Rrogozhin\u00eb <em>(vendimi nr. 25 dt. 06.07.2023 i KRR)<\/em>.<\/p>\n\n\n\n<p>Afati i parashikuar p\u00ebr paraqitjen e k\u00ebrkesave m\u00eb dat\u00eb 22 shtator, 2 dit\u00eb p\u00ebrpara zgjedhjeve, dhe mungesa e afatit detyrues brenda t\u00eb cilit KQZ-ja apo KZAZ-ja duhet t\u00eb marrin vendim, <strong>c\u00ebnon t\u00eb drejt\u00ebn p\u00ebr t\u00eb v\u00ebzhguar, mund\u00ebsine e ankimimit n\u00eb rast refuzimi, si dhe heq \u00e7do mund\u00ebsi p\u00ebr transparenc\u00eb ndaj aktor\u00ebve q\u00eb akreditojn\u00eb v\u00ebzhgues dhe ndaj individ\u00ebve t\u00eb angazhuar si t\u00eb till\u00eb<\/strong>.<\/p>\n\n\n\n<p>&nbsp;&nbsp; \u00c7do konsiderat\u00eb apo shqyrtim i m\u00ebvonsh\u00ebm, pas dit\u00ebs s\u00eb zgjedhjeve, i t\u00ebr\u00eb llojeve t\u00eb problematikave q\u00eb mund t\u00eb konstatohen, jan\u00eb pa asnj\u00eb dobi, nd\u00ebrkoh\u00eb q\u00eb vet\u00eb procesi zgjedhor mund t\u00eb vuaj\u00eb seriozisht prej tyre.<\/p>\n\n\n\n<p>Ju risjellim k\u00ebtu konstatimin e KRIIK n\u00eb monitorimin e b\u00ebr\u00eb t\u00eb zgjedhjeve t\u00eb p\u00ebrs\u00ebrituara t\u00eb 23 korrikut 2023 n\u00eb Rrogozhin\u00eb, pik\u00ebrisht lidhur me problematik\u00ebn madhore q\u00eb p\u00ebrb\u00ebjn\u00eb dhe p\u00ebrmbajn\u00eb n\u00eb vetvete v\u00ebzhguesit politik\u00eb t\u00eb akredituar, ku u faktua se:<\/p>\n\n\n\n<p>\u201cDeri n\u00eb dit\u00ebn e zgjedhjeve, KZAZ-ja nuk ishte marr\u00eb asnj\u00eb vendim formal p\u00ebr akreditimin e v\u00ebzhguesve nga partit\u00eb politike. Sipas an\u00ebtar\u00ebve t\u00eb KZAZ-s\u00eb, deri n\u00eb dat\u00ebn 18 korrik, q\u00eb ishte edhe afati i fundit p\u00ebr paraqitjen e k\u00ebrkesave p\u00ebr v\u00ebzhgues nga ana e subjekteve zgjedhore, nuk kishte patur asnj\u00eb k\u00ebrkes\u00eb t\u00eb till\u00eb.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, n\u00eb dit\u00ebn e zgjedhjeve, v\u00ebzhguesit e KRIIK evidentuan nj\u00eb num\u00ebr t\u00eb konsideruesh\u00ebm v\u00ebzhguesish politik\u00eb t\u00eb pajisur me dokument akreditimi p\u00ebr t\u00eb v\u00ebzhguar, pavar\u00ebsisht se p\u00ebr k\u00ebt\u00eb akreditim nuk ishte marr\u00eb m\u00eb par\u00eb nj\u00eb vendim formal nga ana e KZAZ-s\u00eb deri n\u00eb at\u00eb moment. Emrat n\u00eb k\u00ebto dokumente akreditimi ishin t\u00eb plot\u00ebsuara me shkrim dore.
