KONKLUZIONE PARAPRAKE DHE REKOMANDIME Q\u00cb NEVOJITEN T\u00cb ADRESOHEN SA M\u00cb PAR\u00cb<\/a><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">Burimet financiare jan\u00eb thelb\u00ebsore q\u00eb kandidat\u00ebt dhe subjektet zgjedhore t\u00eb mund t\u00eb paraqesin programet e tyre tek zgjedh\u00ebsit, si dhe t\u00eb komunikojn\u00eb me ta, duke mund\u00ebsuar q\u00eb k\u00ebta t\u00eb fundit t\u00eb b\u00ebjn\u00eb nj\u00eb zgjedhje t\u00eb informuar dit\u00ebn e zgjedhjeve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Por, ana tjet\u00ebr e medaljes \u00ebsht\u00eb se parat\u00eb mund t\u00eb ken\u00eb nj\u00eb efekt negativ n\u00eb politik\u00ebb\u00ebrje pasi donator\u00ebt mund t\u00eb blejn\u00eb influenc\u00ebn politike t\u00eb vendimmarr\u00ebsve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kjo \u00ebsht\u00eb ve\u00e7an\u00ebrisht shqet\u00ebsuese n\u00ebse burimet financiare vijn\u00eb nga burime t\u00eb paligjshme, p\u00ebrfshi korrupsionin apo aktivitetin kriminal. Financimi i fushatave zgjedhore apo veprimtaris\u00eb politike nga para q\u00eb vijn\u00eb nga burime t\u00eb paligjshme mund t\u00eb shtremb\u00ebroj\u00eb vullnetin e zgjedh\u00ebsve, duke eliminuar konkurrenc\u00ebn dhe gar\u00ebn e barabart\u00eb n\u00eb zgjedhje, nd\u00ebrkoh\u00eb q\u00eb hap rrug\u00ebn p\u00ebr influenc\u00eb korruptive t\u00eb financuesve mbi politikan\u00ebt, t\u00eb cil\u00ebt m\u00eb tej kan\u00eb nevoj\u00eb p\u00ebr financuesit pasi u duhen m\u00eb tep\u00ebr para p\u00ebr t\u00eb mbajtur pushtetin, n\u00eb nj\u00eb rreth vicioz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb minimizohet ndikimi korruptiv q\u00eb financimi mund t\u00eb ket\u00eb mbi vendimmarr\u00ebsit dhe politikat publike, \u00ebsht\u00eb e domosdoshme q\u00eb t\u00eb rritet transparenca dhe llogaridh\u00ebnia e partive politike n\u00eb lidhje me burimet e tyre financiare dhe m\u00ebnyrat e shpenzimit t\u00eb fondeve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ky parim, thelb\u00ebsor p\u00ebr nj\u00eb demokraci funksionale, \u00ebsht\u00eb i sanksionuar edhe n\u00eb Kushtetut\u00ebn e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> si dhe n\u00eb legjislacionin zgjedhor<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>dhe kuadri ligjor ka ngarkuar Komisionin Qendror t\u00eb Zgjedhjeve p\u00ebr zbatimin e tij n\u00eb praktik\u00eb<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Akoma m\u00eb tep\u00ebr merr r\u00ebnd\u00ebsi zbatimi pa ekuivok normave ligjore q\u00eb mish\u00ebrojn\u00eb parimet e transparenc\u00ebs dhe llogaridh\u00ebnies n\u00eb vende me institucione t\u00eb dob\u00ebta, nivel t\u00eb lart\u00eb t\u00eb korrupsionit, dhe ku pastrimi i parave \u00ebsht\u00eb nj\u00eb problem madhor. &nbsp;Si\u00e7 evidentohet n\u00eb Raportin Vjetor 2021 p\u00ebr Shqip\u00ebrin\u00eb t\u00eb Komitetit t\u00eb Ekspert\u00ebve mbi Vler\u00ebsimin e Masave Kund\u00ebr Pastrimit t\u00eb Parave dhe Financimit t\u00eb Terrorizmit (MONEYVAL)<a href=\"#_ftn4\" id=\"_ftnref4\">[4]<\/a>, Shqip\u00ebria vijon t\u00eb b\u00ebj\u00eb pjes\u00eb n\u00eb k\u00ebt\u00eb grup shtetesh. Rezoluta e Parlamentit Europian, miratuar n\u00eb 11 korrik 2023 thekson nevoj\u00ebn p\u00ebr transparenc\u00eb n\u00eb financimin e partive politike dhe fushatave zgjedhore si nj\u00eb nga pikat m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb reform\u00ebs zgjedhore<a href=\"#_ftn5\" id=\"_ftnref5\">[5]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Transparenca dhe mbik\u00ebqyrja efektive e financave politike n\u00eb Shqip\u00ebri vazhdimisht ka vuajtur nga mang\u00ebsi t\u00eb theksuara t\u00eb cilat e kan\u00eb pamund\u00ebsuar llogaridh\u00ebnien e partive politike dhe subjekteve zgjedhore ndaj publikut. Nj\u00eb pjes\u00eb e k\u00ebtyre mang\u00ebsive dhe problematikave e kan\u00eb zanafill\u00ebn n\u00eb nj\u00eb kuad\u00ebr ligjor jo plot\u00ebsisht adekuat, dhe nj\u00eb pjes\u00eb n\u00eb implementimin e pjessh\u00ebm apo totalisht t\u00eb munguar t\u00eb normave ligjore ekzistuese.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Duke konsideruar sa m\u00eb sip\u00ebr, financimi i subjekteve zgjedhore dhe partive politike, si nj\u00eb nga element\u00ebt m\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm q\u00eb afekton integritetin e zgjedhjeve, ka qen\u00eb dhe \u00ebsht\u00eb n\u00eb fokus t\u00eb aktivitetit t\u00eb KRIIK n\u00eb m\u00ebnyr\u00eb t\u00eb vazhdueshme. KRIIK e ndjek n\u00eb vijim\u00ebsi financimin politik n\u00eb Shqip\u00ebri, p\u00ebrfshi financimin e subjekteve zgjedhore dhe at\u00eb vjetor t\u00eb partive politike, p\u00ebrgjat\u00eb viteve jo elektorale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebr Zgjedhjet p\u00ebr Organet e Qeverisjes Vendore t\u00eb 14 majit 2023, KRIIK ka ndjekur nga af\u00ebr disa prej element\u00ebve t\u00eb shpenzimeve t\u00eb kryera nga subjektet zgjedhore apo pal\u00eb t\u00eb treta gjat\u00eb periudh\u00ebs para dit\u00ebs s\u00eb zgjedhjeve, dhe do t\u00eb p\u00ebrdor\u00eb t\u00eb dh\u00ebnat e grumbulluara gjat\u00eb k\u00ebsaj periudhe p\u00ebr t\u00eb kontrolluar raportimin e financimit t\u00eb fushat\u00ebs p\u00ebr sa u p\u00ebrket k\u00ebtyre element\u00ebve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjithashtu, p\u00ebrgjat\u00eb gjith\u00eb periudh\u00ebs parazgjedhore, KRIIK ka v\u00ebzhguar aktivitetin e KQZ-s\u00eb n\u00eb lidhje me financimin e zgjedhjeve, e cila ka konsistuar deri n\u00eb k\u00ebt\u00eb moment n\u00eb ngritjen e infrastruktur\u00ebs dhe p\u00ebrgatitjen\/amendimin e akteve n\u00ebnligjore t\u00eb nevojshme, si dhe n\u00eb monitorimin e fushat\u00ebs nga ana e monitoruesve t\u00eb kontraktuar, t\u00eb dh\u00ebnat e mbledhura nga t\u00eb cil\u00ebt duhet t\u00eb p\u00ebrdoren n\u00eb vazhdim p\u00ebr t\u00eb kontrolluar v\u00ebrtet\u00ebsin\u00eb e vet\u00ebdeklarimit nga subjektet zgjedhore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KRIIK ka kontribuar n\u00eb forcimin e mekanizmit t\u00eb verifikimit dhe kontrollit t\u00eb financimit t\u00eb fushat\u00ebs zgjedhore, n\u00ebp\u00ebrmjet nj\u00eb numri rekomandimesh p\u00ebr KQZ si me shkrim<a href=\"#_ftn6\" id=\"_ftnref6\">[6]<\/a>, ashtu edhe verbalisht gjat\u00eb takimeve t\u00eb shumta me p\u00ebrfaq\u00ebsues t\u00eb institucionit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nd\u00ebrkoh\u00eb q\u00eb pritet certifikimi i rezultatit p\u00ebrfundimtar t\u00eb zgjedhjeve nga Komisioni Rregullator n\u00eb fillim t\u00eb muajit gusht<a href=\"#_ftn7\" id=\"_ftnref7\">[7]<\/a>, procesi do t\u00eb hyj\u00eb n\u00eb nj\u00eb tjet\u00ebr faz\u00eb, shpesh jasht\u00eb v\u00ebmendjes s\u00eb mediave, publikut dhe v\u00ebzhguesve nd\u00ebrkomb\u00ebtar\u00eb, por po aq thelb\u00ebsore p\u00ebr integritetin e procesit zgjedhor. &nbsp;\u00cbsht\u00eb procesi i vet\u00ebdeklarimit nga ana e subjekteve zgjedhore t\u00eb financave t\u00eb fushat\u00ebs zgjedhore t\u00eb kryer, i verifikimit dhe kontrollit t\u00eb tyre nga KQZ-ja dhe auditimit m\u00eb pas prej audituesit ligjor\u00eb, duke konkluduar n\u00eb fund n\u00eb nj\u00eb vendimmarrje finale prej KQZ-s\u00eb, n\u00ebp\u00ebrmjet s\u00eb cil\u00ebs merren masa dhe sanksionohet \u00e7do shkelje e ligjit, pavar\u00ebsisht se kush aktor e ka kryer at\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebt\u00eb kuptim, ky proces \u00ebsht\u00eb thelb\u00ebsor, jo vet\u00ebm n\u00eb raport me sanksionimin n\u00eb em\u00ebr t\u00eb barazis\u00eb elektorale p\u00ebrpara zbatimit t\u00eb ligjit, por edhe n\u00eb krijimin e klim\u00ebs s\u00eb ligjzbatimit paekuivok dhe t\u00eb dh\u00ebnies fund t\u00eb pand\u00ebrshkuesh\u00ebmris\u00eb s\u00eb shkeljeve t\u00eb kryera prej apo n\u00eb favor t\u00eb politik\u00ebs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kjo qasje nuk \u00ebsht\u00eb as m\u00eb shum\u00eb dhe as m\u00eb pak, ve\u00e7se p\u00ebrmbushje e detyrimeve q\u00eb k\u00ebrkon Kushtetuta e vendit prej Institucioneve t\u00eb pavarura, n\u00eb k\u00ebt\u00eb rast t\u00eb KQZ-s\u00eb, n\u00eb nd\u00ebrtimin e shtetit ligjor e t\u00eb s\u00eb drejt\u00ebs, e cila n\u00eb kontekstin e sot\u00ebm, merr nj\u00eb vler\u00eb akoma m\u00eb t\u00eb r\u00ebnd\u00ebsishme duke ndihmuar edhe proceset e tjera reformuese n\u00eb vend, si\u00e7 \u00ebsht\u00eb efikasiteti i reform\u00ebs n\u00eb drejt\u00ebsi n\u00eb aplikimin e ligjit n\u00eb barazi t\u00eb plot\u00eb ndaj t\u00eb gjith\u00eb shtetasve, pavar\u00ebsisht pozicioneve, funksioneve, lidhjeve apo pushtetit q\u00eb mund t\u00eb zot\u00ebrojn\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Me synimin q\u00eb procesi i transparenc\u00ebs dhe kontrollit t\u00eb financave t\u00eb jet\u00eb brenda shinave t\u00eb shtratit kushtetues dhe ligjor vendas dhe n\u00eb p\u00ebrputhje me standardet nd\u00ebrkomb\u00ebtare p\u00ebr zgjedhje demokratike, si dhe q\u00eb qytetar\u00ebve shqiptar\u00eb t\u2019u ofrohet transparenc\u00eb e plot\u00eb mbi financimin e zgjedhjeve, KRIIK n\u00ebp\u00ebrmjet k\u00ebtij Raporti Paraprak <em>nxit Komisionin Qendror t\u00eb Zgjedhjeve, subjektet zgjedhore, si dhe institucionet apo aktor\u00ebt e tjer\u00eb t\u00eb p\u00ebrfshir\u00eb q\u00eb t\u00eb nd\u00ebrmarrin t\u00eb gjith\u00eb hapat e nevojsh\u00ebm q\u00eb ky proces t\u00eb kryhet me gjith\u00eb seriozitetin dhe r\u00ebnd\u00ebsin\u00eb thelb\u00ebsore q\u00eb duhet t\u00eb mbart\u00eb.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pavar\u00ebsisht p\u00ebrpjekjeve t\u00eb KQZ-s\u00eb p\u00ebr t\u00eb rritur transparenc\u00ebn financiare t\u00eb fushat\u00ebs pas zgjedhjeve parlamentare t\u00eb vitit 2021, t\u00eb cilat meriton t\u00eb vler\u00ebsohen pozitivisht, KRIIK gjykon se hapat e nd\u00ebrmarr\u00eb n\u00eb at\u00eb moment ishin t\u00eb pamjaftuesh\u00ebm dhe se <em>KQZ do t\u00eb duhet t\u00eb respektoj\u00eb tashm\u00eb kuadrin ligjor kat\u00ebrcip\u00ebrisht dhe t\u00eb b\u00ebj\u00eb transparenc\u00eb t\u00eb plot\u00eb n\u00eb lidhje me fushat\u00ebn p\u00ebr Zgjedhjet p\u00ebr Qeverisjen Vendore t\u00eb 14 majit 2023, p\u00ebrfshir\u00eb fushat\u00ebn p\u00ebr Zgjedhjet e P\u00ebrs\u00ebritura p\u00ebr Kryetar t\u00eb Bashkis\u00eb Rrogozhin\u00eb m\u00eb dat\u00eb 23 korrik 2023.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mungesa e nj\u00eb transparence t\u00eb plot\u00eb p\u00ebr k\u00ebto zgjedhje, n\u00eb gjykimin e KRIIK, mund t\u00eb vij\u00eb vet\u00ebm prej munges\u00ebs s\u00eb nj\u00eb vullneti t\u00eb q\u00ebllimsh\u00ebm.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Asnj\u00eb arsye objektive nuk mund t\u00eb p\u00ebrligj\u00eb mos-transparenc\u00ebn dhe llogaridh\u00ebnien e munguar edhe p\u00ebr k\u00ebto zgjedhje, ndaj KRIIK:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>S\u00eb pari,<\/em> i rikujton KQZ-s\u00eb, si institucioni i ngarkuar nga ligji p\u00ebr mbik\u00ebqyrjen e financimit politik se fryma e ligjit, e mish\u00ebruar n\u00eb pik\u00ebn 3 t\u00eb nenit 9 t\u00eb Kushtetut\u00ebs \u00ebsht\u00eb transparenca e plot\u00eb n\u00eb lidhje me financimin politik dhe se germa e ligjit nuk mundet n\u00eb asnj\u00eb rast t\u00eb p\u00ebrdoret p\u00ebr t\u00eb evituar p\u00ebrmbushjen e aspiratave kushtetuese dhe parimeve t\u00eb transparenc\u00ebs dhe llogaridh\u00ebnies, mbi t\u00eb cilat nj\u00eb shoq\u00ebri demokratike, e drejt\u00eb dhe ku mbizot\u00ebron shteti ligjor duhet t\u00eb ngrihet.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebt\u00eb frym\u00eb, KRIIK i b\u00ebn thirrje Komisionit Qendror t\u00eb Zgjedhjeve, ve\u00e7an\u00ebrisht Komisionit Rregullator dhe administrat\u00ebs s\u00eb KQZ-s\u00eb, q\u00eb t\u00eb marrin n\u00eb shqyrtim rekomandimet e d\u00ebrguara nga KRIIK p\u00ebrgjat\u00eb periudh\u00ebs parazgjedhore, duke nisur nga shtatori i vitit t\u00eb shkuar (2022), p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar kuadrin rregullator p\u00ebr financimin e zgjedhjeve dhe, ve\u00e7an\u00ebrisht, implementimin e tij n\u00eb praktik\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Barra kryesore p\u00ebr implementimin e kuadrit ligjor ekzistues, i cili, pavar\u00ebsisht mungesave, \u00ebsht\u00eb n\u00eb p\u00ebrgjith\u00ebsi i mjaftuesh\u00ebm p\u00ebr t\u00eb mund\u00ebsuar transparenc\u00ebn e financimit zgjedhor, bie mbi administrat\u00ebn e KQZ-s\u00eb, e cila ka detyr\u00ebn t\u00eb kontrolloj\u00eb t\u00eb dh\u00ebnat e vet\u00ebdeklaruara nga subjektet zgjedhore, kryq\u00ebzoj\u00eb ato me t\u00eb dh\u00ebnat nga monitoruesit e fushat\u00ebs apo indicie t\u00eb tjera, p\u00ebrfshi denoncimet nga organizata t\u00eb shoq\u00ebris\u00eb civile gjat\u00eb periudh\u00ebs parazgjedhore, dhe evidentoj\u00eb problematikat q\u00eb mund t\u00eb ekzistojn\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebrgjegjshm\u00ebria, profesionalizmi dhe vullneti p\u00ebr t\u00eb zbatuar ligjin nga administrata pa kompromis dhe ekuivok mbeten thelb\u00ebsore n\u00eb garantimin e transparenc\u00ebs s\u00eb financave t\u00eb p\u00ebrdoruara nga politika p\u00ebr fushat\u00eb zgjedhore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>S\u00eb dyti,<\/em> u b\u00ebn thirrje subjekteve zgjedhore q\u00eb t\u00eb raportojn\u00eb t\u00eb gjitha shpenzimet e kryera me seriozitet dhe p\u00ebrgjegjshm\u00ebri, qofshin ato edhe m\u00eb minimalet. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KRIIK u kujton subjekteve zgjedhore se transparenca ndaj publikut n\u00eb lidhje me politik, i cili k\u00ebrkon t\u00eb vot\u00ebbesohet p\u00ebr t\u00eb qeverisur e marr\u00eb p\u00ebrgjegj\u00ebsi publike p\u00ebrsip\u00ebr.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Transparenca dhe llogaridh\u00ebnia e qeveris\u00ebsve apo atyre q\u00eb aspirojn\u00eb t\u00eb qeverisin ndaj qytetar\u00ebve \u00ebsht\u00eb nj\u00eb nga element\u00ebt thelb\u00ebsor\u00eb q\u00eb dallon nj\u00eb shoq\u00ebri demokratike nga nj\u00eb regjim autokratik apo diktatorial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>S\u00eb treti<\/em>, u b\u00ebn thirrje audit\u00ebve ligjor\u00eb, q\u00eb do t\u00eb kontraktohen nga KQZ-ja p\u00ebr t\u00eb audituar financat e fushat\u00ebs, &nbsp;t\u00eb kryejn\u00eb detyr\u00ebn e vet duke zbatuar kat\u00ebrcip\u00ebrisht dhe deri n\u00eb fund kuadrin ligjor, duke mos pranuar n\u00eb asnj\u00eb rast asnj\u00eb burim financiar, shpenzim apo raportim q\u00eb shkon kund\u00ebr kuadrit ligjor shqiptar.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\"><a id=\"_Toc141704599\">II. GJETJE PARAPRAKE<\/a><\/h1>\n\n\n\n<h2 class=\"wp-block-heading\"><a id=\"_Toc141704600\">II.1. Kuadri ligjor dyt\u00ebsor mbi transparenc\u00ebn dhe kontrollin ndaj financimit t\u00eb Zgjedhjeve<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Komisioni Qendror i Zgjedhjeve miratoi disa akte n\u00ebnligjore p\u00ebr rregullimin e financimit t\u00eb fushat\u00ebs zgjedhore 2023. Risi \u00ebsht\u00eb raportimi financiar nga partit\u00eb politike dhe kandidat\u00ebt p\u00ebr kryetar bashkie n\u00ebp\u00ebrmjet Platform\u00ebs Elektronike t\u00eb Raportimit Financiar (PERF), t\u00eb administruar nga KQZ. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nj\u00eb tjet\u00ebr risi ishte rritja e numrit t\u00eb monitoruesve t\u00eb kontraktuar nga KQZ p\u00ebr t\u00eb monitoruar fushat\u00ebn zgjedhore, me dyfish n\u00eb krahasim me zgjedhjet e vitit 2021.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nd\u00ebrkoh\u00eb q\u00eb e ka vler\u00ebsuar pozitivisht iniciativ\u00ebn p\u00ebr raportimin n\u00eb m\u00ebnyr\u00eb elektronike nga ana e subjekteve zgjedhore, KRIIK ka v\u00ebn\u00eb n\u00eb dukje disa mang\u00ebsi, p\u00ebrfshi vones\u00ebn n\u00eb aplikimin e saj, duke i miratuar aktet e nevojshme n\u00ebnligjore, sikurse n\u00eb zgjedhjet e 2021<a href=\"#_ftn8\" id=\"_ftnref8\">[8]<\/a>, me shum\u00eb vones\u00eb, vet\u00ebm nj\u00eb jav\u00eb p\u00ebrpara dit\u00ebs s\u00eb zgjedhjeve<a href=\"#_ftn9\" id=\"_ftnref9\">[9]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nuk \u00ebsht\u00eb e kuptueshme arsyeja e vones\u00ebs n\u00eb hartimin dhe miratimin e akteve n\u00ebnligjore p\u00ebrkat\u00ebse, duke qen\u00eb se PERF ka qen\u00eb gati n\u00eb muajin shkurt 2023, madje financier\u00ebt e partive u trajnuan p\u00ebr p\u00ebrdorimin e saj.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjith\u00ebsesi, shprehet konsiderata se pavar\u00ebsisht vones\u00ebs, kjo e fundit nuk duhet t\u00eb p\u00ebrdoret n\u00eb asnj\u00eb rast si arsye p\u00ebr t\u00eb krijuar probleme eventuale n\u00eb implementimin e mekanizmit apo relativizuar zbatimin e tij.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Arsyetimi i p\u00ebrdorur nga administrata e KQZ-s\u00eb, n\u00eb procesin ankimor t\u00eb lidhur me aplikimin e votimit dhe num\u00ebrimit elektronik n\u00eb bashkit\u00eb Kam\u00ebz dhe Elbasan, ku nuk u aplikua konfirmimi i flet\u00ebs s\u00eb printuar t\u00eb votimit sikurse parashikon vendimi i Komisionit Rregullator, me arsyetimin se nuk kishte koh\u00eb t\u00eb mjaftueshme, nuk duhet n\u00eb asnj\u00eb rast t\u00eb p\u00ebrdoret si arsye edhe n\u00eb procesin e kontrollit t\u00eb financave t\u00eb subjekteve zgjedhore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>N\u00ebse nj\u00eb ndryshim apo p\u00ebrmir\u00ebsim i akteve n\u00ebnligjore gjykohet i nevojsh\u00ebm nga administrata e KQZ-s\u00eb, e cila e ka tashm\u00eb t\u00eb gjith\u00eb informacionin se \u00e7far\u00eb procesi i verifikimit dhe kontrollit do t\u00eb p\u00ebrfshij\u00eb praktikisht, at\u00ebher\u00eb ky ndryshim do t\u00eb duhet t\u00eb reflektohet urgjentisht n\u00eb kuadrin ligjor rregullator.<\/em> Vet\u00ebm nj\u00eb qasje e till\u00eb do t\u00eb mund\u00ebsoj\u00eb m\u00eb pas q\u00eb \u00e7do hap dhe detaj i p\u00ebrfshir\u00eb, t\u00eb p\u00ebrmbush\u00eb zbatimin pa asnj\u00eb ekuivok t\u00eb ligjit nga pal\u00ebt n\u00eb proces.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pasi u njoh me p\u00ebrmbajtjen e aktit, n\u00ebp\u00ebrmjet komunikimit t\u00eb vazhduesh\u00ebm me KQZ, si shkresor<a href=\"#_ftn10\" id=\"_ftnref10\">[10]<\/a> ashtu edhe verbal, KRIIK ka k\u00ebrkuar q\u00eb detyrimin p\u00ebr raportimin n\u00eb k\u00ebt\u00eb platform\u00eb ta mbartin edhe kandidat\u00ebt p\u00ebr an\u00ebtar\u00eb t\u00eb K\u00ebshillave Bashkiake, por KQZ-ja nuk e b\u00ebri pjes\u00eb t\u00eb akteve n\u00ebnligjore p\u00ebrkat\u00ebse, duke deklaruar se do ta marr\u00eb vet\u00eb institucioni<a href=\"#_ftn11\" id=\"_ftnref11\">[11]<\/a> barr\u00ebn e hedhjes s\u00eb t\u00eb dh\u00ebnave t\u00eb k\u00ebtyre raporteve n\u00eb PERF.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb gjykimin e KRIIK, kjo nuk i sh\u00ebrben q\u00ebllimit t\u00eb leht\u00ebsimit t\u00eb kontrollit dhe verifikimit p\u00ebr KQZ-n\u00eb, p\u00ebrkundrazi v\u00ebshtir\u00ebson m\u00eb shum\u00eb pun\u00ebn e administrat\u00ebs n\u00eb k\u00ebt\u00eb drejtim, duke ulur efi\u00e7enc\u00ebn e mekanizmit. Nga ana tjet\u00ebr, kjo m\u00ebnyr\u00eb zgjidhjeje krijon mund\u00ebsin\u00eb e rezultimit t\u00eb gabimeve njer\u00ebzore nga ana e administrat\u00ebs s\u00eb KQZ-s\u00eb n\u00eb hedhjen e t\u00eb dh\u00ebnave dhe, si rrjedhim, do t\u00eb v\u00ebshtir\u00ebsoj\u00eb procesin e verifikimit, kontrollit apo edhe sanksionimit t\u00eb shkeljeve potenciale.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lidhur me Vendimin<a href=\"#_ftn12\" id=\"_ftnref12\">[12]<\/a> e Komisionit Rregullator, i cili miratoi rregullat p\u00ebr raportimin financiar t\u00eb subjekteve zgjedhore, rekomandimet<a href=\"#_ftn13\" id=\"_ftnref13\">[13]<\/a> e KRIIK nuk u mor\u00ebn n\u00eb konsiderat\u00eb p\u00ebr shkak t\u00eb koh\u00ebs s\u00eb pa mjaftueshme, sipas tyre, por u artikulua publikisht se do t\u00eb shihen n\u00eb vijim p\u00ebr t\u2019u p\u00ebrfshir\u00eb me pas n\u00eb vendim se \u00e7far\u00eb do t\u00eb gjykohet e nevojshme<a href=\"#_ftn14\" id=\"_ftnref14\">[14]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mos p\u00ebrfshirja n\u00eb aktin rregullator e rekomandimeve t\u00eb paraqitura, n\u00eb gjykimin e KRIIK, mund t\u00eb l\u00ebr\u00eb s\u00ebrish vend p\u00ebr krijimin e kushteve t\u00eb pamund\u00ebsis\u00eb objektive t\u00eb kryq\u00ebzimit dhe kontrollit t\u00eb t\u00eb dh\u00ebnave t\u00eb deklaruara.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>N\u00eb kushtet kur vet\u00ebraportimi financiar i subjekteve zgjedhore do t\u00eb duhet t\u00eb kryhet deri n\u00eb 60 dit\u00eb pas shpalljes s\u00eb rezultatit p\u00ebrfundimtar t\u00eb zgjedhjeve<\/em><a href=\"#_ftn15\" id=\"_ftnref15\"><em><strong>[15]<\/strong><\/em><\/a><em>, KRIIK i b\u00ebn s\u00ebrish thirrje KQZ-s\u00eb dhe Komisionit Rregullator, t\u00eb konsiderojn\u00eb me seriozitet dhe marr\u00eb n\u00eb shqyrtim sa m\u00eb shpejt t\u00eb jet\u00eb e mundur k\u00ebto rekomandime.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a id=\"_Toc141704601\">II.2. Vet\u00ebraportimi financiar prej subjekteve zgjedhore<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Numri i subjekteve zgjedhore t\u00eb cil\u00ebt duhet t\u00eb raportojn\u00eb n\u00eb k\u00ebto zgjedhje \u00ebsht\u00eb tejet i lart\u00eb, 23,907<a href=\"#_ftn16\" id=\"_ftnref16\">[16]<\/a> kandidat\u00eb, dhe 44 parti politike.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">T\u00eb gjith\u00eb bartin detyrimin ligjor p\u00ebr raportim t\u00eb t\u00eb ardhurave dhe shpenzimeve t\u00eb kryera n\u00eb funksion t\u00eb fushat\u00ebs elektorale, pavar\u00ebsisht numrit t\u00eb votave q\u00eb kan\u00eb marr\u00eb<a href=\"#_ftn17\" id=\"_ftnref17\">[17]<\/a> apo sasis\u00eb s\u00eb parave t\u00eb p\u00ebrfituar e shpenzuar.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00c7do kandidat apo parti politike pjes\u00ebmarr\u00ebse n\u00eb zgjedhje, duhet t\u00eb deklaroj\u00eb me p\u00ebrgjegjshm\u00ebri t\u00eb lart\u00eb \u00e7do aktivitet financiar t\u00eb kryer n\u00eb funksion t\u00eb fushat\u00ebs, duke patur n\u00eb konsiderat\u00eb \u00e7do detyrim ligjor, si dhe precedentin e vendosur<a href=\"#_ftn18\" id=\"_ftnref18\">[18]<\/a> nga Komisioni i Ankimimeve dhe Sanksioneve me vendimmarrjen e tij t\u00eb janarit 2023, sipas t\u00eb cilit fushat\u00eb elektorale me kosto zero nuk mund t\u00eb ket\u00eb<a href=\"#_ftn19\" id=\"_ftnref19\">[19]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ekzistenca e kandidat\u00ebve q\u00eb nuk b\u00ebjn\u00eb n\u00eb asnj\u00eb moment fushat\u00eb aktive, duke rezultuar n\u00eb zero t\u00eb ardhura apo shpenzime gjat\u00eb saj \u00ebsht\u00eb tregues i faktit se partit\u00eb politike p\u00ebrfshijn\u00eb n\u00eb listat e veta t\u00eb kandidat\u00ebve nj\u00eb num\u00ebr individ\u00ebsh n\u00eb m\u00ebnyr\u00eb fiktive. K\u00ebta kandidat\u00eb nuk kan\u00eb pritshm\u00ebri t\u00eb marrin mandat dhe p\u00ebrfshihen n\u00eb list\u00eb nga ana e partive vet\u00ebm p\u00ebr t\u00eb plot\u00ebsuar detyrimin ligjor t\u00eb numrit t\u00eb emrave n\u00eb list\u00eb<a href=\"#_ftn20\" id=\"_ftnref20\">[20]<\/a>, nd\u00ebrkoh\u00eb q\u00eb vet\u00eb partit\u00eb kan\u00eb pritshm\u00ebri t\u00eb marrin shum\u00eb m\u00eb pak vende n\u00eb k\u00ebshillin bashkiak p\u00ebrkat\u00ebs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ky fiktivitet n\u00eb listat e kandidat\u00ebve n\u00eb thelb p\u00ebrb\u00ebn mashtrim me ofert\u00ebn elektorale nga ana e partive politike dhe munges\u00eb p\u00ebrgjegjshm\u00ebrie ndaj procesit zgjedhor dhe ndaj qytetar\u00ebve t\u00eb cil\u00ebve u k\u00ebrkohet vota.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a id=\"_Toc141704602\">II.3. Monitorimi i fushat\u00ebs nga Monitoruesit e kontraktuar prej KQZ-s\u00eb<\/a><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Nj\u00eb risi e Zgjedhjeve Vendore 2023 \u00ebsht\u00eb rritja e numrit t\u00eb monitoruesve t\u00eb kontraktuar nga KQZ-ja p\u00ebr t\u00eb monitoruar p\u00ebrputhshm\u00ebrin\u00eb me ligjin t\u00eb fushat\u00ebs zgjedhore t\u00eb zhvilluar prej subjekteve zgjedhore, si dhe mosp\u00ebrdorimin e burimeve shtet\u00ebrore<a href=\"#_ftn21\" id=\"_ftnref21\">[21]<\/a> prej tyre. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nga rreth 60 monitorues q\u00eb u angazhuan p\u00ebr Zgjedhjet p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb vitit 2021, p\u00ebr Zgjedhjet Lokale 2023 u angazhuan dyfishi i tyre, mbi 120 monitorues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KRIIK ka shprehur rezerva n\u00eb lidhje me k\u00ebt\u00eb mekaniz\u00ebm monitorimi prej adoptimit t\u00eb tij n\u00eb vitin 2020, p\u00ebr munges\u00ebn e efektivitetit pasi monitoruesit jan\u00eb shum\u00eb vulnerab\u00ebl ndaj pushteteve, pa asnj\u00eb status e t\u00eb pambrojtur, e rrjedhimisht cedojn\u00eb n\u00eb objektivitet dhe paanshm\u00ebrin\u00eb q\u00eb duhet t\u00eb manifestojn\u00eb. Nd\u00ebrkoh\u00eb nga ana tjet\u00ebr ata tashm\u00eb nuk ngarkohen m\u00eb t\u00eb kryejn\u00eb asnj\u00eb lloj kostimi t\u00eb aktiviteteve t\u00eb fushat\u00ebs, por vet\u00ebm i monitorojn\u00eb ato<a href=\"#_ftn22\" id=\"_ftnref22\">[22]<\/a>. Ky ndryshim i mekanizmit u konsiderua nj\u00eb hap pas krahasuar me mekanizmin e suksessh\u00ebm, megjith\u00eb problematikat minore t\u00eb v\u00ebrejtuara, t\u00eb aplikuar n\u00eb zgjedhjet e vitit 2017 dhe 2019 kur monitorimi kryhej nga Ekspert\u00eb Financiar\u00eb, t\u00eb cil\u00ebt p\u00ebrpos integritetit dhe mbrojtjes q\u00eb g\u00ebzonin n\u00eb kryerjen e detyr\u00ebs s\u00eb tyre, kryenin edhe kostim t\u00eb aktiviteteve, p\u00ebrve\u00e7se i monitoronin<a href=\"#_ftn23\" id=\"_ftnref23\">[23]<\/a> ato.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebt\u00eb m\u00ebnyr\u00eb ngrihen dyshime t\u00eb forta mbi dobin\u00eb e gjetjeve t\u00eb k\u00ebtyre monitoruesve, pasi ato mund t\u00eb p\u00ebrdoren n\u00eb m\u00ebnyr\u00eb shum\u00eb t\u00eb kufizuar p\u00ebr kryq\u00ebzimin e t\u00eb dh\u00ebnave financiare t\u00eb raportuara nga partit\u00eb politike, duke ndikuar k\u00ebshtu n\u00eb t\u00eb kund\u00ebrt n\u00eb t\u00ebr\u00ebsi n\u00eb funksionalitetin e mekanizmit t\u00eb kontrollit t\u00eb financave t\u00eb tyre nga KQZ dhe audit\u00ebt ligjor\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nga ndjekja e procesit t\u00eb hartimit<a href=\"#_ftn24\" id=\"_ftnref24\">[24]<\/a> dhe miratimit t\u00eb akteve n\u00ebnligjore p\u00ebrkat\u00ebse<a href=\"#_ftn25\" id=\"_ftnref25\">[25]<\/a>, em\u00ebrimit dhe trajnimit<a href=\"#_ftn26\" id=\"_ftnref26\">[26]<\/a> t\u00eb monitoruesve dhe k\u00ebqyrja e raporteve t\u00eb tyre, KRIIK konkludon se edhe n\u00eb k\u00ebto zgjedhje monitorimi ka qen\u00eb shum\u00eb i kufizuar nga pik\u00ebpamja e efi\u00e7enc\u00ebs dhe se gjetjet e monitoruesve nuk justifikojn\u00eb burimet e vendosura n\u00eb dispozicion t\u00eb tyre nga KQZ-ja, nga pik\u00ebpamja e burimeve financiare, logjistike e njer\u00ebzore<a href=\"#_ftn27\" id=\"_ftnref27\">[27]<\/a>, apo nga pik\u00ebpamja e efektivitetit dhe rezultateve q\u00eb mund t\u00eb sjellin si rrjedhoj\u00eb e fuqis\u00eb dhe kompetenc\u00ebs q\u00eb legjislacioni u njeh<a href=\"#_ftn28\" id=\"_ftnref28\">[28]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jo vet\u00ebm kaq, por pik\u00ebpyetje mund t\u00eb vendosen edhe mbi paan\u00ebsin\u00eb e monitoruesve t\u00eb angazhuar n\u00eb p\u00ebrmbushjen e detyrave t\u00eb veta, duke qen\u00eb se KQZ-ja nuk ka b\u00ebr\u00eb asnj\u00eb verifikim t\u00eb konfliktit potencial t\u00eb interesit nga ana e tyre, por \u00ebsht\u00eb mjaftuar vet\u00ebm me vet\u00ebdeklarimin e monitoruesve se ata nuk jan\u00eb n\u00eb konflikt interesi<a href=\"#_ftn29\" id=\"_ftnref29\">[29]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Shqet\u00ebsimi madhor n\u00eb lidhje me sa m\u00eb sip\u00ebr \u00ebsht\u00eb se, p\u00ebr t\u00eb tret\u00ebn her\u00eb q\u00eb aplikohet, s\u00ebrish mekanizmi i monitorimit po rezulton t\u00eb jet\u00eb jo efektiv, duke theksuar precedentin e mosfunksionimit t\u00eb mekanizmave n\u00eb dispozicion t\u00eb institucioneve p\u00ebr t\u00eb verifikuar n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur vet\u00ebdeklarimin e subjekteve zgjedhore dhe, si rrjedhim, bazuar t\u00eb gjith\u00eb procesin e kontrollit mbi k\u00ebt\u00eb vet\u00ebdeklarim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebrgjegj\u00ebsia p\u00ebr k\u00ebt\u00eb performanc\u00eb t\u00eb munguar bie mbi administrat\u00ebn e KQZ-s\u00eb q\u00eb nuk ka gjetur m\u00ebnyrat p\u00ebr t\u00eb maksimalizuar p\u00ebrdorimin e tij.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb \u00e7do rast, pavar\u00ebsisht kufizimeve ligjore dhe efektivitetit shum\u00eb t\u00eb limituar<a href=\"#_ftn30\" id=\"_ftnref30\">[30]<\/a> t\u00eb implementimit t\u00eb mekanizmit t\u00eb monitorimit, si n\u00eb procese t\u00eb m\u00ebparshme zgjedhore ashtu edhe n\u00eb k\u00ebto zgjedhje, KRIIK gjykon <em>se ai mund t\u00eb p\u00ebrdoret me shum\u00eb m\u00eb tep\u00ebr efektivitet nga \u00e7far\u00eb \u00ebsht\u00eb p\u00ebrdorur deri n\u00eb k\u00ebt\u00eb moment, dhe i rekomandon KQZ-s\u00eb q\u00eb t\u00eb p\u00ebrdor\u00eb ato gjetje q\u00eb monitoruesit kan\u00eb, sado t\u00eb limituara, p\u00ebr verifikimin e shpenzimeve t\u00eb raportuara nga subjektet zgjedhore.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gjithashtu, KQZ \u00ebsht\u00eb institucioni p\u00ebrgjegj\u00ebs, <em>i cili duhet t\u00eb analizoj\u00eb dhe t\u00eb gjej\u00eb arsyet se pse mekanizmi i monitorimit n\u00ebp\u00ebrmjet monitoruesve nuk funksionoi si\u00e7 duhet, si dhe t\u00eb eksploroj\u00eb dhe implementoj\u00eb t\u00eb gjitha mund\u00ebsit\u00eb q\u00eb ky mekaniz\u00ebm i integruar n\u00eb Kodin Zgjedhor, t\u00eb jet\u00eb funksional.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><a id=\"_Toc141704603\">II.4. N\u00ebse k\u00ebto media kan\u00eb transmetuar t\u00eb till\u00eb materiale me pages\u00eb, me shum\u00eb gjas\u00eb ato nuk jan\u00eb evidentuar si reklam\u00eb politike nga AMA, pasi jan\u00eb reportazhe apo lajme.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">KRIIK inkurajon <em>Komisionin Qendror t\u00eb Zgjedhjeve q\u00eb n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb mund t\u00eb evidentohen t\u00eb gjitha shpenzimet e kryera nga subjektet zgjedhore p\u00ebr mbulim mediatik, qoft\u00eb n\u00eb form\u00ebn e reklamave klasike qoft\u00eb n\u00eb forma t\u00eb tjera, t\u00eb k\u00ebrkojn\u00eb informacion nga monitoruesit e angazhuar gjat\u00eb fushat\u00ebs zgjedhore n\u00eb lidhje me reklama n\u00eb mediat sociale apo t\u00eb tjera informacione q\u00eb ata mund t\u00eb ken\u00eb n\u00eb lidhje me praktikat e mediave p\u00ebr t\u00eb ofruar mbulim p\u00ebr fushat\u00ebn zgjedhore p\u00ebrkundrejt pages\u00ebs, si dhe indicie nga KZAZ-t\u00eb apo subjektet zgjedhore<\/em>. Pavar\u00ebsisht nga motivet, pretendimi p\u00ebr kandidat\u00eb \u201cpa shpenzime\u201d nuk mund t\u00eb pranohet nga KAS-i, sepse nj\u00eb pretendim i till\u00eb \u00ebsht\u00eb de-facto i pav\u00ebrtet\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref20\" id=\"_ftn20\">[20]<\/a> Neni 67, pika 4 e Kodit Zgjedhor \u201cEmrat n\u00eb list\u00ebn shumem\u00ebrore t\u00eb subjektit zgjedhor paraqiten t\u00eb renditura sipas rendit shifror, duke filluar nga numri nj\u00eb. Numri i kandidat\u00ebve n\u00eb list\u00ebn shumem\u00ebrore nuk mund t\u00eb jet\u00eb m\u00eb i vog\u00ebl se numri i mandateve q\u00eb do t\u00eb zgjidhen n\u00eb zon\u00ebn zgjedhore p\u00ebrkat\u00ebse, shtuar dy&#8230;\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref21\" id=\"_ftn21\">[21]<\/a> Neni 3, pika 3 e <a href=\"https:\/\/kqz.gov.al\/wp-content\/uploads\/2022\/11\/Udhezim_nr.3_date_3.11.2022_Per-percaktimin-e-kritereve-per-perzgjedhjen-e-monitoruesve-ne-zgjedhje-dhe-rregullat-per-monitorimin-1.pdf\">Udh\u00ebzimit nr. 3<\/a>, dat\u00eb 3.11. 2022, t\u00eb Komisionerit Shtet\u00ebror t\u00eb Zgjedhjeve, \u201cP\u00ebr p\u00ebrcaktimin e kritereve p\u00ebr p\u00ebrzgjedhjen e monitoruesve n\u00eb zgjedhje dhe procedur\u00ebn e em\u00ebrimit t\u00eb tyre\u201d: \u201cMonitorimi kufizohet n\u00eb v\u00ebzhgimin leht\u00ebsisht t\u00eb verifikuesh\u00ebm t\u00eb respektimit t\u00eb p\u00ebrmbushjes s\u00eb detyrimeve nga ana e partive politike, subjekteve zgjedhore dhe kandidat\u00ebve p\u00ebr periudh\u00ebn e monitorimit, si m\u00eb posht\u00eb vijon: a) Organizimi i takimeve, veprimtarive e tubimeve elektorale,&nbsp; b) P\u00ebrdorimi i materialeve propagandistike, ngritja dhe veprimtaria n\u00eb zyrat zgjedhore, referuar udh\u00ebzimeve t\u00eb Komisionerit Shtet\u00ebror t\u00eb Zgjedhjeve p\u00ebr p\u00ebrdorimin e materialeve propagandistike,&nbsp; c) Respektimi i ndalimeve dhe kufizimeve p\u00ebr veprimtari t\u00eb caktuara para dat\u00ebs s\u00eb zgjedhjeve si dhe p\u00ebrdorimi\/shp\u00ebrdorimi i burimeve shtet\u00ebrore gjat\u00eb periudh\u00ebs s\u00eb monitorimit. Organizimin e takimeve, veprimtarive e tubimeve elektorale, b) P\u00ebrdorimin e materialeve propagandistike, ngritjen dhe veprimtarin\u00eb n\u00eb zyrat zgjedhore, c) Respektimin e ndalimeve dhe kufizimeve p\u00ebr veprimtari t\u00eb caktuara para dat\u00ebs s\u00eb zgjedhjeve si dhe p\u00ebrdorimin\/shp\u00ebrdorimin e burimeve shtet\u00ebrore gjat\u00eb periudh\u00ebs s\u00eb monitorimit, \u00e7) Monitorimin e mediave online si dhe t\u00eb rrjeteve sociale t\u00eb tilla por jo vet\u00ebm, Facebook, Instagram, lidhur me aktivitetet institucionale, aktivitetet elektorale t\u00eb subjekteve zgjedhore, si dhe faqet e sponsorizuara nga partia dhe\/ose kandidat\u00ebt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref22\" id=\"_ftn22\">[22]<\/a> Kodi Zgjedhor p\u00ebrcakton qart\u00eb se monitoruesit nuk kryejn\u00eb kostim t\u00eb shpenzimeve totale p\u00ebr fushat\u00eb (neni 94\/2, pika 3), megjithat\u00eb n\u00eb asnj\u00eb pik\u00eb nuk ndalon q\u00eb ata t\u00eb b\u00ebjn\u00eb kostim t\u00eb pjessh\u00ebm t\u00eb atyre aktiviteteve q\u00eb kan\u00eb v\u00ebzhguar, \u00e7ka do t\u00eb ndihmonte Komisionin Qendror t\u00eb Zgjedhjeve n\u00eb kontrollin e v\u00ebrtet\u00ebsis\u00eb s\u00eb shpenzimeve t\u00eb fushat\u00ebs nga ana e subjekteve zgjedhore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref23\" id=\"_ftn23\">[23]<\/a> Me ndryshimet n\u00eb Ligjin p\u00ebr Partit\u00eb Politiken t\u00eb vitit 2017 (<a href=\"http:\/\/qbz.gov.al\/eli\/ligj\/2017\/05\/22\/90-2017\">Ligji nr. 90\/2017<\/a>, dat\u00eb 22.05.2017) u p\u00ebrdor\u00ebn p\u00ebr her\u00eb t\u00eb par\u00eb monitorues t\u00eb fushat\u00ebs zgjedhore t\u00eb kontraktuar nga KQZ-ja. KRIIK e ka vler\u00ebsuar k\u00ebt\u00eb mekaniz\u00ebm si pozitiv n\u00eb frym\u00eb dhe me potencial p\u00ebr rritjen e transparenc\u00ebs t\u00eb financave t\u00eb fushat\u00ebs zgjedhore, pavar\u00ebsisht kritikave q\u00eb ka shprehur p\u00ebr m\u00ebnyr\u00ebn se si mekanizmi u aplikua n\u00eb praktik\u00eb, ve\u00e7an\u00ebrisht n\u00eb zgjedhjet e vitit 2019. Por me ndryshimet n\u00eb Kodin Zgjedhor t\u00eb korrikut 2020 (<a href=\"http:\/\/qbz.gov.al\/eli\/ligj\/2020\/07\/23\/101\">Ligji nr. 101\/2020<\/a>, dat\u00eb 23.07.2020), detyrimi p\u00ebr t\u00eb angazhuar ekspert\u00eb financiar\u00eb si monitorues u eliminua, nd\u00ebrkoh\u00eb q\u00eb Kodi Zgjedhor p\u00ebrcaktoi se monitoruesit nuk kryejn\u00eb m\u00eb asnj\u00eb kostim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref24\" id=\"_ftn24\">[24]<\/a> Para miratimit t\u00eb projekt udh\u00ebzimit p\u00ebrkat\u00ebs KRIIK i d\u00ebrgoi KQZ-s\u00eb dokumentin &nbsp;<a href=\"https:\/\/kriik.al\/home\/2022\/10\/10\/rekomandime-lidhur-me-projekt-udhezimin-per-percaktimin-e-kritereve-per-perzgjedhjen-e-monitoruesve-ne-zgjedhje-dhe-proceduren-e-emerimit-te-tyre\/\">REKOMANDIME<\/a> lidhur me Projekt-udh\u00ebzimin \u201cP\u00ebr p\u00ebrcaktimin e kritereve p\u00ebr p\u00ebrzgjedhjen e monitoruesve n\u00eb zgjedhje dhe procedur\u00ebn e em\u00ebrimit t\u00eb tyre.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref25\" id=\"_ftn25\">[25]<\/a> N\u00eb <a href=\"https:\/\/kqz.gov.al\/wp-content\/uploads\/2022\/11\/Udhezim_nr.3_date_3.11.2022_Per-percaktimin-e-kritereve-per-perzgjedhjen-e-monitoruesve-ne-zgjedhje-dhe-rregullat-per-monitorimin-1.pdf\">udh\u00ebzimin e miratuar<\/a> KQZ vendosi t\u00eb integronte dy prej rekomandimeve t\u00eb KRIIK q\u00eb konsistonin n\u00eb aplikimin e testimit me shkrim para em\u00ebrimit p\u00ebr monitoruesit si dhe futjen e rrjeteve sociale si hallk\u00eb p\u00ebr monitorim nga monitoruesit. P\u00ebr pjes\u00ebn tjet\u00ebr t\u00eb rekomandimeve u ra dakord publikisht se ato do t\u00eb shpjegoheshin n\u00eb trajnime dhe implementoheshin p\u00ebrgjat\u00eb pun\u00ebs s\u00eb KQZ dhe monitoruesve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref26\" id=\"_ftn26\">[26]<\/a> N\u00eb procesin e rekrutimit, i filluar nga KQZ me shum\u00eb vones\u00eb, KQZ ndeshi n\u00eb problematik\u00ebn e numrit shum\u00eb t\u00eb ul\u00ebt aplikimeve. N\u00eb kushtet e nj\u00eb numri sa p\u00ebr t\u00eb plot\u00ebsuar nevoj\u00ebn e numrit dhe tejkalimit t\u00eb afateve ligjore, KQZ zhvilloi trajnime shum\u00eb t\u00eb shkurtra, dhe thuajse nuk implementoi hallk\u00ebn e testimit me shkrim p\u00ebr monitoruesit p\u00ebrpara em\u00ebrimit t\u00eb tyre, si dhe nuk kreu asnj\u00eb kontroll p\u00ebr p\u00ebrputhshm\u00ebrin\u00eb e aplikant\u00ebve m\u00eb kriteret ligjore, pavar\u00ebsisht se kjo \u00ebsht\u00eb edhe n\u00eb angazhimin personal t\u00eb aplikant\u00ebve p\u00ebr monitorues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref27\" id=\"_ftn27\">[27]<\/a> Komunikimi i KQZ me monitoruesit qoft\u00eb p\u00ebr nevoja verifikimi t\u00eb evidentuara nga KQZ gjat\u00eb periudh\u00ebs zgjedhore t\u00eb angazhimit t\u00eb tyre, qoft\u00eb p\u00ebr p\u00ebrgjigje ta ardhura jo n\u00ebp\u00ebrmjet raporteve t\u00eb hedhura nga monitoruesit n\u00eb PERF ka qen\u00eb t\u00ebr\u00ebsisht jo publik.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref28\" id=\"_ftn28\">[28]<\/a> P\u00ebr aq sa KRIIK monitori trajnimet e monitoruesve n\u00eb qytetet e Shqip\u00ebris\u00eb, si dhe nga k\u00ebqyrja e raporteve t\u00eb tyre nuk ka asnj\u00eb t\u00eb dh\u00ebn\u00eb t\u00eb informimit dhe shfryt\u00ebzimit prej monitoruesve t\u00eb mekanizmit t\u00eb investimit me k\u00ebrkes\u00eb zyrtare subjekteve apo institucioneve p\u00ebr \u00e7do informacion t\u00eb nevojsh\u00ebm p\u00ebr ta n\u00eb funksion t\u00eb monitorimit, sikurse ligji iu jep atyre t\u00eb drejt\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref29\" id=\"_ftn29\">[29]<\/a> KRIIK v\u00ebrejti nj\u00eb monitoruese t\u00eb em\u00ebruar e cila ishte an\u00ebtare e K\u00ebshillit Bashkiak, si dhe dy monitorues t\u00eb cil\u00ebt kan\u00eb em\u00ebr t\u00eb nj\u00ebjt\u00eb me po aq kandidat\u00eb p\u00ebr k\u00ebshilla bashkiak\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn bashki ku monitoruesit kan\u00eb ushtruar detyr\u00ebn e vet.
