Komisioner!<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;&nbsp; T\u00eb nderuar an\u00ebtar\u00eb t\u00eb Komisionit Rregullator! <\/strong><strong><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&nbsp;&nbsp; T\u00eb nderuar koleg\u00eb t\u00eb administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb kuad\u00ebr t\u00eb gjith\u00eb bashk\u00ebpunimit t\u00eb deritanish\u00ebm me Institucionin e KQZ-s\u00eb, p\u00ebr t\u00eb cilin gjejm\u00eb rastin t\u2019ju fal\u00ebnderojm\u00eb s\u00ebrish, <strong>KRIIK ju nis k\u00ebt\u00eb rekomandim p\u00ebr veprime q\u00eb mund t\u00eb nd\u00ebrmarr\u00eb Komisioni Qendror i Zgjedhjeve p\u00ebr t\u00eb garantuar nj\u00eb mjedis t\u00eb lir\u00eb nga intimidimi, t\u00eb qet\u00eb dhe t\u00eb sigurt p\u00ebr zgjedh\u00ebsit gjat\u00eb dit\u00ebs s\u00eb zgjedhjeve, si dhe mund\u00ebsin\u00eb q\u00eb zgjedh\u00ebsit t\u00eb votojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb fsheht\u00eb.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Si raporti i KRIIK p\u00ebr Zgjedhjet p\u00ebr Kuvendin e 25 prillit 2021, ashtu edhe ai i OSBE\/ODIHR kan\u00eb evidentuar si problematike prezenc\u00ebn e personave t\u00eb paautorizuar, me shum\u00eb gjas\u00eb aktivist\u00eb apo militant\u00eb t\u00eb subjekteve zgjedhore, n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit, qofshin k\u00ebto mjediset e p\u00ebrbashk\u00ebta mes qendrave t\u00eb votimit n\u00eb strukturat publike (oborr apo korridore), apo menj\u00ebher\u00eb n\u00eb af\u00ebrsi t\u00eb tyre &nbsp;(pran\u00eb hyrjes) gjat\u00eb dit\u00ebs s\u00eb zgjedhjeve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prania e aktivist\u00ebve partiak\u00eb rreth qendrave t\u00eb votimit mund t\u00eb p\u00ebrb\u00ebj\u00eb nj\u00eb k\u00ebrc\u00ebnim madhor potencial p\u00ebr fsheht\u00ebsin\u00eb e vot\u00ebs. Kjo p\u00ebr shkak se ata mund t\u00eb p\u00ebrpiqen t\u00eb ndikojn\u00eb ose t\u00eb frik\u00ebsojn\u00eb votuesit, gj\u00eb q\u00eb mund t&#8217;i b\u00ebj\u00eb votuesit t\u00eb ndihen t\u00eb detyruar t\u00eb votojn\u00eb p\u00ebr nj\u00eb kandidat ose parti t\u00eb caktuar. K\u00ebto praktika mund t\u00eb krijojn\u00eb nj\u00eb mjedis armiq\u00ebsor ose frik\u00ebsues p\u00ebr votuesit, gj\u00eb q\u00eb mund t&#8217;i b\u00ebj\u00eb ata t\u00eb ndihen jo komod\u00eb apo edhe t\u00eb frik\u00ebsuar p\u00ebr t\u00eb votuar lirisht dhe n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Praktika e militant\u00ebve partiak\u00eb t\u00eb grumbulluar n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit \u00ebsht\u00eb ve\u00e7an\u00ebrisht problematike n\u00ebse shihet n\u00eb kontekstin m\u00eb t\u00eb gjer\u00eb t\u00eb strukturave t\u00eb organizuara p\u00ebr drejtimin e vot\u00ebs n\u00eb periudh\u00ebn parazgjedhore, n\u00ebp\u00ebrmjet sistemit t\u00eb patronazhimit politik dhe kontrollit kapilar t\u00eb votuesve; p\u00ebrfshi por pa u kufizuar n\u00eb blerjen e vot\u00ebs apo intimidimin e zgjedh\u00ebsve. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nj\u00eb sistem i till\u00eb i kontrollit dhe drejtimit t\u00eb vot\u00ebs, i cili n\u00eb gjykimin e KRIIK p\u00ebrb\u00ebn nj\u00eb shkelje t\u00eb pik\u00ebs b t\u00eb nenit 25 Konvent\u00ebs Nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb Drejtat dhe Lirit\u00eb Civile dhe Politike t\u00eb Kombeve t\u00eb Bashkuara<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a>, ratifikuar prej Shqip\u00ebris\u00eb q\u00eb prej vitit 1991, p\u00ebrmbyllet dit\u00ebn e zgjedhjeve me prezenc\u00ebn e personave t\u00eb paautorizuar n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebr sa m\u00eb sip\u00ebr, t\u00eb nderuar koleg\u00eb t\u00eb KQZ-s\u00eb, na lejoni t\u2019ju rikthejm\u00eb n\u00eb v\u00ebmendje se rekomandimi i dyt\u00eb par\u00ebsor i OSBE\/ODIHR n\u00eb Raportin Final p\u00ebr Zgjedhjet p\u00ebr Kuvendin t\u00eb 25 prillit 2021 ka qen\u00eb se \u201c[s]hteti duhet t\u00eb garantoj\u00eb t\u00eb drejt\u00ebn p\u00ebr nj\u00eb zgjedhje t\u00eb lir\u00eb dhe t\u00eb fsheht\u00eb. \u00c7do form\u00eb presioni p\u00ebr t\u00eb zbuluar n\u00ebse dikush ka votuar apo jo dhe si ka votuar duhet t\u00eb parandalohet.<a href=\"#_ftn2\" id=\"_ftnref2\">[2]<\/a>\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">P\u00ebr m\u00eb tep\u00ebr, prezenca e grupeve t\u00eb aktivist\u00ebve apo militant\u00ebve partiak\u00eb n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit mund t\u00eb kthehet edhe n\u00eb nj\u00eb rrezik potencial p\u00ebr konflikte dit\u00ebn e zgjedhjeve, duke krijuar nj\u00eb situat\u00eb pasigurie akoma m\u00eb t\u00eb theksuar dhe dekurajuar pjes\u00ebmarrjen n\u00eb zgjedhje t\u00eb qytetar\u00ebve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bazuar n\u00eb problematik\u00ebn e parashtruar m\u00eb sip\u00ebr, KRIIK gjykon se kjo \u00e7\u00ebshtje do t\u00eb duhet t\u00eb adresohet n\u00eb m\u00ebnyr\u00eb t\u00eb menj\u00ebhershme dhe sa m\u00eb shteruese nga ana e Komisionit Qendror t\u00eb Zgjedhjeve dhe nxit trupat drejtuese t\u00eb KQZ-se, konkretisht Komisionerin Shtet\u00ebror t\u00eb Zgjedhjeve dhe Komisionin Rregullator, q\u00eb t\u00eb nd\u00ebrveprojn\u00eb p\u00ebr ta adresuar at\u00eb dhe garantuar nj\u00eb situat\u00eb ku zgjedh\u00ebsit mund t\u00eb ndjejn\u00eb se votojn\u00eb t\u00eb lir\u00eb dhe n\u00eb m\u00ebnyr\u00eb t\u00eb fsheht\u00eb; jo vet\u00ebm brenda qendrave t\u00eb votimit, por edhe n\u00eb mjediset rrethuese t\u00eb tyre, sipas parashikimeve t\u00eb Kodit Zgjedhor<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ky rekomandim nxitet edhe nga nj\u00eb komunikimi verbal q\u00eb KRIIK ka patur si me Komisionerin Shtet\u00ebror t\u00eb Zgjedhjeve, ashtu edhe me p\u00ebrfaq\u00ebsues t\u00eb lart\u00eb t\u00eb Policis\u00eb s\u00eb Shtetit.&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>N\u00eb gjykimin e KRIIK, nj\u00eb nga m\u00ebnyrat p\u00ebr t\u00eb minimizuar efektin e k\u00ebtij fenomeni, p\u00ebrsa i p\u00ebrket manifestimit t\u00eb tij n\u00eb Dit\u00ebn e Zgjedhjeve, do t\u00eb ishte q\u00eb <strong>Komisioni Qendror i Zgjedhjeve t\u00eb p\u00ebrgatit\u00eb dhe nxjerr\u00eb nj\u00eb apo disa akte n\u00ebnligjore, <\/strong>n\u00eb form\u00ebn q\u00eb KQZ-ja e gjykon m\u00eb t\u00eb p\u00ebrshtatshme,<strong> p\u00ebr t\u00eb rikthyer n\u00eb v\u00ebmendjen e administrat\u00ebs zgjedhore n\u00eb nivelin e dyt\u00eb dhe t\u00eb tret\u00eb se detyrimi i tyre p\u00ebr t\u00eb garantuar nj\u00eb mjedis t\u00eb lir\u00eb nga ndikimi dhe intimidimi p\u00ebr zgjedh\u00ebsit nuk p\u00ebrfundon tek hyrja e qendr\u00ebs s\u00eb votimit, por shtrihet edhe n\u00eb mjedisin rrethues t\u00eb saj.<\/strong><\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Nj\u00eb form\u00eb p\u00ebr t\u00eb garantuar k\u00ebt\u00eb mund t\u00eb ishte q\u00eb t\u00eb ngarkohen komisionet e qendrave t\u00eb votimit me detyrimin eksplicit q\u00eb, n\u00eb m\u00ebnyr\u00eb periodike, t\u00eb kontrollojn\u00eb n\u00ebse mjedisi rrethues i qendr\u00ebs s\u00eb votimit \u00ebsht\u00eb i qet\u00eb apo ka prezenc\u00eb t\u00eb personave t\u00eb paautorizuar n\u00eb af\u00ebrsi t\u00eb tyre. N\u00eb rast se evidentohet prezenca e t\u00eb till\u00eb personave, <strong>t\u00eb nd\u00ebrmerren hapat p\u00ebrkat\u00ebs, n\u00eb p\u00ebrmbushje t\u00eb pik\u00ebs 7 t\u00eb nenit 109 t\u00eb Kodit Zgjedhor, t\u00eb till\u00eb si njoftimi i Policis\u00eb s\u00eb Shtetit, apo edhe nd\u00ebrprerja e votimit, n\u00eb rast se \u00ebsht\u00eb e nevojshme.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb m\u00ebnyr\u00eb q\u00eb ky detyrim t\u00eb zbatohet me p\u00ebrpikm\u00ebri nga ana e komisioner\u00ebve t\u00eb nivelit t\u00eb dyt\u00eb e t\u00eb tret\u00eb t\u00eb administrat\u00ebs zgjedhore, mund q\u00eb t\u00eb konsiderohet edhe vendosja e <strong>detyrimit p\u00ebr KQV-t\u00eb p\u00ebr t\u00eb raportuar n\u00eb m\u00ebnyr\u00eb periodike n\u00eb KZAZ edhe p\u00ebr situat\u00ebn rrethuese t\u00eb qendrave t\u00eb votimit<\/strong>. Nga ana e vet, <strong>KZAZ-t\u00eb t\u00eb ken\u00eb detyrimin q\u00eb k\u00ebt\u00eb informacion t\u2019ia p\u00ebrcjellin KQZ-s\u00eb<\/strong> dhe, n\u00eb raportimet e veta p\u00ebr median dhe publikun n\u00eb dit\u00ebn e zgjedhjeve, <strong>KQZ-ja t\u00eb komunikoj\u00eb edhe p\u00ebr situat\u00ebn rreth qendrave t\u00eb votimit, raste t\u00eb prezenc\u00ebs s\u00eb personave t\u00eb paautorizuar t\u00eb evidentuara dhe hapat e nd\u00ebrmarr\u00eb p\u00ebr normalizimin e situat\u00ebs<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb gjykimin e KRIIK detyrimi <strong>eksplicit <\/strong>p\u00ebr t\u00eb nd\u00ebrmarr\u00eb hapat sa m\u00eb sip\u00ebr do t\u00eb ndihmoj\u00eb qoft\u00eb n\u00eb kufizimin e partive politike dhe militant\u00ebve t\u00eb tyre p\u00ebr t\u00eb ndikuar zgjedh\u00ebsit, ashtu edhe n\u00eb informimin dhe rritjen e garancive p\u00ebr qytetar\u00ebt se mund t\u00eb votojn\u00eb t\u00eb lir\u00eb e t\u00eb pandikuar.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Gjithashtu, <strong>KZAZ-t\u00eb t\u00eb jen\u00eb t\u00eb v\u00ebmendshme gjat\u00eb dit\u00ebs s\u00eb zgjedhjeve p\u00ebr raportime nga mediat apo indicie nga v\u00ebzhguesit<\/strong>, qofshin ata t\u00eb partive politike apo v\u00ebzhgues qytetar\u00eb. N\u00eb rast se KZAZ-ja merr indicie p\u00ebr prezenc\u00eb t\u00eb personave t\u00eb paautorizuar n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit, <strong>t\u00eb ket\u00eb detyrimin eksplicit q\u00eb t\u00eb d\u00ebrgoj\u00eb nj\u00eb p\u00ebrfaq\u00ebsues t\u00eb saj n\u00eb qendr\u00ebn apo qendrat e votimit ku \u00ebsht\u00eb v\u00ebrejtur fenomeni dhe t\u00eb marr\u00eb masat e nevojshme p\u00ebr normalizimin e situat\u00ebs<\/strong>.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Sigurisht q\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb mekanizmi t\u00eb funksionoj\u00eb, do t\u00eb duhet q\u00eb Policia e Shtetit t\u00eb jet\u00eb m\u00eb e v\u00ebmendshme dhe t\u00eb ket\u00eb nj\u00eb qasje m\u00eb proaktive ndaj k\u00ebtij fenomeni. KRIIK gjykon se kjo mund t\u00eb arrihet n\u00ebp\u00ebrmjet nj\u00eb <strong>koordinimi m\u00eb t\u00eb mir\u00eb mes administrat\u00ebs zgjedhore dhe Policis\u00eb s\u00eb Shtetit, n\u00eb t\u00eb gjith\u00eb nivelet<\/strong>, nga KQZ n\u00eb KQV.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebt\u00eb kuptim, KRIIK rekomandon q\u00eb, si hap i par\u00eb, KQZ-ja t\u2019i d\u00ebrgoj\u00eb Drejtoris\u00eb s\u00eb P\u00ebrgjithshme t\u00eb Policis\u00eb s\u00eb Shtetit nj\u00eb kujtes\u00eb p\u00ebr detyrat e saj gjat\u00eb dit\u00ebs s\u00eb zgjedhjeve, duke <strong>p\u00ebrfshir\u00eb dhe theksuar nevoj\u00ebn p\u00ebr t\u00eb garantuar nj\u00eb mjedis t\u00eb lir\u00eb n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cbsht\u00eb e r\u00ebnd\u00ebsishme gjithashtu q\u00eb gjat\u00eb kryerjes s\u00eb k\u00ebsaj detyre, efektiv\u00ebt e Policis\u00eb s\u00eb Shtetit t\u00eb jen\u00eb t\u00eb kujdessh\u00ebm q\u00eb prezenca e tyre n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit t\u00eb mos ket\u00eb efektin e kund\u00ebrt, duke krijuar nj\u00eb situat\u00eb pasigurie si pasoj\u00eb e forcave t\u00eb shtuara t\u00eb policis\u00eb dhe t\u00eb dekurajoj\u00eb pjes\u00ebmarrjen n\u00eb zgjedhje.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>S\u00eb fundmi, KRIIK rekomandon q\u00eb KQZ-ja t\u2019i drejtohet edhe <strong>partive politike me nj\u00eb dokument zyrtar ku t\u2019u t\u00ebrheq\u00eb v\u00ebmendjen p\u00ebr precedent\u00ebt e shkuar me prezenc\u00ebn e aktivist\u00ebve dhe militant\u00ebve t\u00eb vet n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit gjat\u00eb dit\u00ebs s\u00eb zgjedhjeve, dhe t\u2019u k\u00ebrkoj\u00eb q\u00eb t\u00eb garantojn\u00eb se do t\u00eb evitojn\u00eb prezenc\u00ebn e k\u00ebtyre personave n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit n\u00eb dit\u00ebn e zgjedhjeve<\/strong>.<\/li><\/ul>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref1\" id=\"_ftn1\">[1]<\/a> Konventa Nd\u00ebrkomb\u00ebtare p\u00ebr t\u00eb Drejtat dhe Lirit\u00eb Civile dhe Politike, Neni 25<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c\u00c7do qytetar ka t\u00eb drejt\u00ebn dhe mund\u00ebsin\u00eb, pa asnj\u00eb nga dallimet e p\u00ebrmendura n\u00eb nenin 2 dhe pa kufizime t\u00eb paarsyeshme:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">[\u2026]\n\n\n\n<p class=\"wp-block-paragraph\">(b) T\u00eb votoj\u00eb dhe t\u00eb zgjidhet n\u00eb zgjedhje t\u00eb v\u00ebrteta periodike, t\u00eb cilat do t\u00eb jen\u00eb me votim t\u00eb p\u00ebrgjithsh\u00ebm dhe t\u00eb barabart\u00eb dhe do t\u00eb mbahen me votim t\u00eb fsheht\u00eb, duke garantuar shprehjen e lir\u00eb t\u00eb vullnetit t\u00eb zgjedh\u00ebsve;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2026\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref2\" id=\"_ftn2\">[2]<\/a> Raporti P\u00ebrfundimtar i OSBE\/ODIHR p\u00ebr Zgjedhjet p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb 25 prillit 2021, faqe 30.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref3\" id=\"_ftn3\">[3]<\/a> Neni 109, pikat 6 dhe 7 t\u00eb Kodit Zgjedhor:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c\u2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">6. N\u00eb mjediset jasht\u00eb qendr\u00ebs s\u00eb votimit, n\u00eb oborrin e nd\u00ebrtes\u00ebs, n\u00eb hyrje t\u00eb saj dhe n\u00eb korridoret e brendshme t\u00eb nd\u00ebrtes\u00ebs nuk lejohet prania apo grumbullimi i personave, p\u00ebrve\u00e7 zgjedh\u00ebsve q\u00eb presin n\u00eb radh\u00eb p\u00ebr t\u00eb votuar. P\u00ebrjashtimisht nga ky rregull, lejohet prania e v\u00ebzhguesve dhe p\u00ebrfaq\u00ebsuesve t\u00eb medias s\u00eb autorizuar, si dhe e personave t\u00eb ngarkuar me kryerjen e sondazheve p\u00ebr votimin, kur organizata q\u00eb ata p\u00ebrfaq\u00ebsojn\u00eb \u00ebsht\u00eb autorizuar p\u00ebr k\u00ebt\u00eb q\u00ebllim nga KQZ-ja.
