Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>T\u00eb nderuar koleg\u00eb t\u00eb administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p>N\u00eb kuad\u00ebr t\u00eb gjith\u00eb bashk\u00ebpunimit me ju lidhur me konsultimin paraprak t\u00eb projektakteve t\u00eb ndryshme, p\u00ebr t\u00eb cilin gj\u00ebjm\u00eb rastin t\u2019ju falenderojm\u00eb s\u00ebrish, KRIIK ka sjell\u00eb pran\u00eb Komisionit Qendror t\u00eb Zgjedhjeve, n\u00eb dat\u00ebn 10 janar 2023, nj\u00eb dokument p\u00ebrmbledh\u00ebs me disa rekomandime t\u00eb cilat i konsideron t\u00eb r\u00ebnd\u00ebsishme p\u00ebr t\u2019u patur n\u00eb konsiderat\u00eb nga administrata e KQZ, n\u00eb p\u00ebrmir\u00ebsimin e akteve t\u00eb ndryshme n\u00ebnligjore. Bazuar kjo, n\u00eb frym\u00ebn e asaj \u00e7far\u00eb Kodi Zgjedhor parashikon si dhe referuar problematikave t\u00eb v\u00ebzhguara n\u00eb praktik\u00eb n\u00eb zgjedhjet pararend\u00ebse.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Gjejm\u00eb rastin, q\u00eb t\u00eb k\u00ebrkojm\u00eb mir\u00ebkuptimin dhe bashk\u00ebpunimin tuaj, p\u00ebr pasjen n\u00eb konsiderat\u00eb t\u00eb rekomandimeve t\u00eb p\u00ebrfshira n\u00eb dokumentin n\u00eb fjal\u00eb.<\/p>\n\n\n\n<p>Ne kemi marr\u00eb njoftimin n\u00eb dat\u00ebn 16.01.2023 n\u00eb mbr\u00ebmje, p\u00ebr shqyrtimin dhe miratimin n\u00eb seanc\u00eb publike nga Komisioneri n\u00eb dat\u00ebn 18.01.2023 t\u00eb projektudh\u00ebzimit \u201c<em>P\u00ebr caktimin e rregullave p\u00ebr depozitimin e verifikimin e dokumentacionit t\u00eb kandidimit, afatet p\u00ebr publikimin e listave t\u00eb kandidat\u00ebve dhe miratimin e modeleve t\u00eb kandidimit p\u00ebr zgjedhjet e qeverisjes vendore<\/em>\u201d.<\/p>\n\n\n\n<p>Lidhur me k\u00ebt\u00eb projektakt, nuk kemi informacion n\u00ebse propozimet e pik\u00ebs&nbsp; 2 \u201cRegjistrimi i subjekteve zgjedhore dhe kandidat\u00ebve\u201d n\u00eb Dokumentin e Rekomandimeve, t\u00eb protokolluar pran\u00eb institucionit tuaj m\u00eb dat\u00eb 11.10.2023, jan\u00eb shqyrtuar apo jo nga administrata e KQZ-s\u00eb p\u00ebrpara finalizimit t\u00eb projektaktit q\u00eb propozohet sot p\u00ebr tu miratuar.<\/p>\n\n\n\n<p>Nga shqyrtimi i b\u00ebr\u00eb projektaktit, konsiderojm\u00eb se jo vet\u00ebm nuk jan\u00eb marr\u00eb n\u00eb konsiderat\u00eb, por heqja e detyrimit t\u00eb kandidat\u00ebve p\u00ebr t\u00eb depozituar jet\u00ebshkrimin e tyre, konsiderohet si nj\u00eb hap pas, lidhur me standardin e arritur dhe praktik\u00ebn e krijuar.<\/p>\n\n\n\n<p>Nga rekomandimet e p\u00ebrcjella , KRIIK ju risjell n\u00eb v\u00ebmendje, dhe gjykon se \u00ebsht\u00eb e r\u00ebnd\u00ebsishme t\u00eb p\u00ebrfshihen s\u00eb paku dy element\u00eb teknik\u00eb.<\/p>\n\n\n\n<p><strong>Konkretisht:<\/strong><\/p>\n\n\n\n<p>1. Udh\u00ebzimi parashikon, nd\u00ebr t\u00eb tjera, detyrimin p\u00ebr hapjen prej subjekteve zgjedhore t\u00eb numrit t\u00eb llogaris\u00eb s\u00eb posa\u00e7me bankare dhe dor\u00ebzimin e saj n\u00eb KQZ.<\/p>\n\n\n\n<p>N\u00eb zgjedhjet e vitit 2021, KQZ ka b\u00ebr\u00eb nj\u00eb hap pozitiv n\u00eb aplikimin e kthimit t\u00eb dokumentacionit n\u00eb rast mungese t\u00eb k\u00ebsaj pike.<\/p>\n\n\n\n<p>Megjithat\u00eb, m\u00eb pas u konstatua nga audit\u00ebt se, n\u00eb disa raste llogaria nuk ishte llogari e posa\u00e7me p\u00ebr fushat\u00ebn, por nj\u00eb llogari q\u00eb partia apo edhe kandidati p\u00ebrdorte n\u00eb aktivitetin e saj normal.<\/p>\n\n\n\n<p>Sugjerohet q\u00eb n\u00eb modelet e hartuara n\u00eb p\u00ebrmbajtje t\u00eb udh\u00ebzimit, duhet t\u00eb shkruhet p\u00ebrpos baz\u00ebs ligjore q\u00eb detyron hapjen e llogaris\u00eb s\u00eb posa\u00e7me edhe specifikimin konkret q\u00eb llogaria n\u00eb fjal\u00eb duhet t\u00eb jet\u00eb e posa\u00e7me p\u00ebr fushat\u00ebn dhe jo llogaria e aktivitetit normal t\u00eb partis\u00eb apo kandidatit.<\/p>\n\n\n\n<p>Gjithashtu, sugjerohet q\u00eb KQZ t\u00eb gjej\u00eb e&nbsp;<strong>aplikoj\u00eb paraprakisht mekanizma kontrolli&nbsp; p\u00ebr t\u00eb verifikuar n\u00ebse numri i llogaris\u00eb s\u00eb dor\u00ebzuar \u00ebsht\u00eb ai i nj\u00eb llogarie bankare t\u00eb hapur posa\u00e7\u00ebrisht p\u00ebr fushat\u00ebn elektorale<\/strong>.<\/p>\n\n\n\n<p>I nj\u00ebjti mekaniz\u00ebm duhet t\u00eb aplikohet edhe p\u00ebr kandidat\u00ebt.<\/p>\n\n\n\n<p>Theksojm\u00eb se ky detaj p\u00ebrpos k\u00ebrkes\u00ebs p\u00ebr t\u00eb zbatuar ligjin, p\u00ebrb\u00ebn nj\u00eb element t\u00eb r\u00ebnd\u00ebsish\u00ebm n\u00eb procesin e kontrollit q\u00eb b\u00ebh\u00ebt m\u00eb pas prej KQZ-s\u00eb lidhur me financat e fushat\u00ebs zgjedhore. Ajo l\u00eb shteg p\u00ebr deklarime t\u00eb paplota e pasinqerta nga ana e subjekteve zgjedhore dhe kandidat\u00ebve t\u00eb tyre, p\u00ebrpos se limiton funksionin verifikues t\u00eb audit\u00ebve ligjor\u00eb.<\/p>\n\n\n\n<p>2. Aplikimi i procesit t\u00eb plot\u00ebsimit dhe publikimit t\u00eb jet\u00ebshkrimit t\u00eb kandidat\u00ebve, pavar\u00ebsisht se nuk ka qen\u00eb nj\u00eb detyrim ligjor i p\u00ebrcaktuar dhe shprehur eksplicisht n\u00eb Kodin Zgjedhor, si dhe ka&nbsp;treguar mang\u00ebsi n\u00eb aplikimin n\u00eb praktik\u00eb, ka qen\u00eb tejet pozitiv.<\/p>\n\n\n\n<p>Ky akt ndihmon&nbsp;thelb\u00ebsisht&nbsp;dhe rrit standardin e procesit elektoral n\u00eb funksion t\u00eb transparenc\u00ebs dhe informimit t\u00eb qytetar\u00ebve mbi pjes\u00ebn m\u00eb t\u00eb r\u00ebnd\u00ebsishme t\u00eb ofert\u00ebs elektorale q\u00eb iu paraqitet&nbsp;p\u00ebr t\u00eb&nbsp;votuar, informacion sa m\u00eb i plot\u00eb mbi&nbsp;jet\u00ebshkrimin&nbsp;e kandidat\u00ebv\u00eb&nbsp;q\u00eb propozohen p\u00ebr t\u00eb&nbsp;marr\u00eb&nbsp;dhe ushtruar sovranitetin e deleguar nga populli,&nbsp;n\u00eb&nbsp;organet e zgjedhura.<\/p>\n\n\n\n<p>Informacioni mbi&nbsp;jet\u00ebshkrimin&nbsp;mbetet&nbsp;shum\u00eb&nbsp;i&nbsp;r\u00ebnd\u00ebsish\u00ebm&nbsp;pasi&nbsp;p\u00ebrpiqet q\u00eb t\u00eb b\u00ebj\u00eb transparenc\u00eb&nbsp;dhe&nbsp;jap\u00eb&nbsp;informacion&nbsp;qytetar\u00ebve&nbsp;mbi integritetin&nbsp;q\u00eb kan\u00eb kandidat\u00ebt, n\u00eb pik\u00ebpamje t\u00eb&nbsp;shkollimit, edukimit,&nbsp;pun\u00ebsimit, dhe \u00e7do&nbsp;p\u00ebrvoje tjet\u00ebr t\u00eb&nbsp;kryer&nbsp;p\u00ebrpara&nbsp;kandidimit. Kjo sigurisht&nbsp;q\u00eb&nbsp;ndihmon&nbsp;thelb\u00ebssisht n\u00eb&nbsp;krijimin e&nbsp;nj\u00eb&nbsp;gjykimi dhe opinioni&nbsp;m\u00eb t\u00eb plot\u00eb t\u00eb qytetar\u00ebve&nbsp;mbi individin&nbsp;q\u00eb&nbsp;i&nbsp;k\u00ebrkohet t\u00eb&nbsp;votohet. Rritja e&nbsp;transparenc\u00ebs&nbsp;dhe informimit&nbsp;t\u00eb&nbsp;votuesit mbi&nbsp;kandidat\u00ebt \u00ebsht\u00eb nj\u00eb&nbsp;rekomandim i&nbsp;vazhduesh\u00ebm&nbsp;prej organizmave vendase dhe&nbsp;nd\u00ebrkomb\u00ebtar\u00eb.<\/p>\n\n\n\n<p>Nga ana&nbsp;tjet\u00ebr, n\u00ebse&nbsp;do&nbsp;t\u00eb&nbsp;sillet&nbsp;n\u00eb v\u00ebmendje&nbsp;konteksti i&nbsp;Shqip\u00ebris\u00eb, nj\u00eb&nbsp;vend i cili u detyrua&nbsp;t\u00eb&nbsp;miratoje dhe&nbsp;t\u00eb&nbsp;ashtuquajturin \u201cligj&nbsp;t\u00eb&nbsp;dekriminalizimit\u201d&nbsp;p\u00ebr t\u00eb&nbsp;siguruar integritetin e&nbsp;individ\u00ebve kandidat\u00eb, ky hap i heqjes&nbsp;s\u00eb jet\u00ebshkrimeve&nbsp;si detyrim&nbsp;p\u00ebr&nbsp;kandidim,&nbsp;p\u00ebrve\u00e7se \u00ebsht\u00eb nj\u00eb&nbsp;hap pas, merr edhe&nbsp;nj\u00eb&nbsp;konotacion politik jopozitiv,&nbsp;t\u00eb&nbsp;cilin KQZ-ja e re nuk duhet ta&nbsp;manifestoj\u00eb&nbsp;pasi&nbsp;\u00ebsht\u00eb n\u00eb q\u00ebndrim&nbsp;diametralisht&nbsp;t\u00eb kund\u00ebrt&nbsp;me&nbsp;at\u00eb t\u00eb Marr\u00ebveshjes&nbsp;Politike&nbsp;t\u00eb&nbsp;5 qershorit 2020 si dhe&nbsp;t\u00eb&nbsp;vullnetit&nbsp;t\u00eb ligjv\u00ebn\u00ebsit.<\/p>\n\n\n\n<p>Ky detyrim ka qen\u00eb i parashikuar n\u00eb udh\u00ebzimin Udh\u00ebzimi nr.1, dat\u00eb 23.12. 2020, i Komisionit Qendror t\u00eb Zgjedhjeve, \u201cP\u00ebr caktimin e rregullave p\u00ebr depozitimin dhe verifikimin e dokumentacionit t\u00eb kandidimit dhe afatet p\u00ebr publikimin e listave t\u00eb kandidat\u00ebve\u201d, por figuron t\u00eb jet\u00eb hequr n\u00eb projektudh\u00ebzimit \u201cP\u00ebr caktimin e rregullave p\u00ebr depozitimin e verifikimin e dokumentacionit t\u00eb kandidimit, afatet p\u00ebr publikimin e listave t\u00eb kandidat\u00ebve dhe miratimin e modeleve t\u00eb kandidimit p\u00ebr zgjedhjet e qeverisjes vendore\u201d.<\/p>\n\n\n\n<p>KRIIK gjykon se qytetar\u00ebt, aq m\u00eb shum\u00eb n\u00eb zgjedhje t\u00eb karakterit lokal ku drejtuesi i bashkis\u00eb zgjidhet me votim t\u00eb drejtp\u00ebrdrejt\u00eb, duhet t\u00eb jen\u00eb sa m\u00eb mir\u00eb t\u00eb informuar lidhur m\u00eb \u00e7far\u00eb p\u00ebrfaq\u00ebsojn\u00eb kandidaturat e propozuara nga subjektet zgjedhore, aq m\u00eb tep\u00ebr n\u00eb rastin e zgjedhjeve p\u00ebr k\u00ebshillat bashkiak\u00eb ku tipikisht, nj\u00eb pjes\u00eb e konsiderueshme e kandidat\u00ebve b\u00ebjn\u00eb pak fushat\u00eb t\u00eb drejtp\u00ebrdrejt\u00eb.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb kontekst, KRIIK gjykon se dor\u00ebzimi dhe publikimi i jet\u00ebshkrimit t\u00eb kandidat\u00ebve duhet t\u00eb futet si detyrim n\u00eb udh\u00ebzim, si dhe duhet t\u00eb&nbsp;<strong>krijohet nj\u00eb format jet\u00ebshkrimi sa m\u00eb i detajuar&nbsp; p\u00ebr kandidat\u00ebt,&nbsp;<\/strong><strong>\u00e7ka do t\u2019i sh\u00ebrbente informimit m\u00eb t\u00eb mir\u00eb t\u00eb publikut mbi integritetin dhe angazhimet e tjera q\u00eb secili kandidat ka patur ose ka.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>I Nderuar Z.
