Komisioner!<\/strong><\/p>\n\n\n\n<p><strong>&nbsp;&nbsp; T\u00eb nderuar Koleg\u00eb t\u00eb Administrat\u00ebs s\u00eb KQZ-s\u00eb!<\/strong><\/p>\n\n\n\n<p>N\u00eb kuad\u00ebr t\u00eb gjith\u00eb bashk\u00ebpunimit t\u00eb deritanish\u00ebm me Institucionin e KQZ-s\u00eb, p\u00ebr t\u00eb cilin gjejm\u00eb rastin t\u2019ju fal\u00ebnderojm\u00eb s\u00ebrish, <strong>KRIIK ju p\u00ebrg\u00ebzon p\u00ebr k\u00ebt\u00eb hap t\u00eb d\u00ebrgimit t\u00eb nj\u00eb KUJTESE tjet\u00ebr ndaj t\u00eb gjith\u00eb institucioneve publike<\/strong>.<\/p>\n\n\n\n<p>Na lejoni q\u00eb n\u00eb parantez\u00eb <strong>t\u2019ju ftojm\u00eb q\u00eb k\u00ebt\u00eb praktik\u00eb ta ndiqni edhe me element\u00eb t\u00eb tjer\u00eb q\u00eb lidhen m\u00eb zbatimin e ligjit nga aktor\u00ebt t\u00eb tjer\u00eb t\u00eb ngarkuar me detyra<\/strong>, sidomos tani p\u00ebrpara apo n\u00eb prag t\u00eb fushat\u00ebs zgjedhore.<\/p>\n\n\n\n<p>Gjykohet se kjo do t\u00eb ndihmonte n\u00eb nj\u00eb kuptim m\u00eb t\u00eb mir\u00eb t\u00eb ligjit, si dhe n\u00eb unifikimin e kuptimit dhe interpretimit t\u00eb tij prej t\u00eb gjith\u00eb aktor\u00ebve t\u00eb p\u00ebrfshir\u00eb.<\/p>\n\n\n\n<p>Konkretisht, gjykohet se do t\u00eb ishte me vler\u00eb q\u00eb Komisioneri t\u00eb p\u00ebrgatiste dhe niste nj\u00eb Kujtes\u00eb t\u00eb posa\u00e7me edhe p\u00ebr:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Institucionet shtet\u00ebrore, p\u00ebrfshir\u00eb rolin e Ministrave, Deputet\u00ebve dhe Kryebashkiak\u00ebve q\u00eb rikandidojn\u00eb p\u00ebr sjelljen e tyre <strong>p\u00ebrgjat\u00eb fushat\u00ebs zgjedhore<\/strong>;<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>OSHMA-t\u00eb<\/strong> lidhur me t\u00ebr\u00eb rolin e p\u00ebrgjegj\u00ebsit\u00eb e tyre p\u00ebrgjat\u00eb fushat\u00ebs zgjedhore, ve\u00e7an\u00ebrisht lidhur me koh\u00ebn e reklamave politike, element\u00ebt financiar\u00eb, transmetimin e materialeve t\u00eb p\u00ebrcjella nga subjektet zgjedhore, etj., duke patur parasysh n\u00eb ve\u00e7anti problematikat e v\u00ebrejtura p\u00ebrgjat\u00eb zgjedhjeve parlamentare 2021;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Bashkit\u00eb<\/strong> lidhur me kompetencat e tyre p\u00ebr caktimin e vendeve t\u00eb afishimit t\u00eb materialeve zgjedhore, lejimin e zyrave zgjedhore, si dhe kontrollin e territorit n\u00eb m\u00ebnyr\u00eb periodike p\u00ebr heqjen e t\u00ebr\u00eb materialeve propagandistike t\u00eb cilat nuk jan\u00eb printuar dhe shpallur sipas parashikimeve ligjore;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Partit\u00eb politike<\/strong> p\u00ebr detyrimet e tyre n\u00eb raport me Bashkit\u00eb, OSHMA-t\u00eb, Institucionet Publike, si dhe, ve\u00e7an\u00ebrisht, lidhur me detyrimet e tyre dhe kandidat\u00ebve t\u00eb tyre p\u00ebr m\u00ebnyrat e raportimit t\u00eb t\u00eb ardhurave dhe shpenzimeve;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Policis\u00eb s\u00eb shtetit<\/strong> lidhur me gatishm\u00ebrin\u00eb dhe kompetencat q\u00eb duhet t\u00eb realizoj\u00eb sipas parashikimeve t\u00eb Kodit Zgjedhor.<\/li><\/ul>\n\n\n\n<p>P\u00ebrsa i p\u00ebrket KUJTES\u00cbS s\u00eb p\u00ebrgatitur t\u00eb d\u00ebrguar p\u00ebr konsultim paraprak, KRIIK e vler\u00ebson maksimalisht k\u00ebt\u00eb angazhim t\u00eb KQZ-s\u00eb p\u00ebr sakt\u00ebsimin e disa elementeve, t\u00eb cilat p\u00ebrb\u00ebjn\u00eb domosdoshm\u00ebri p\u00ebr informimin dhe kuptimin n\u00eb m\u00ebnyr\u00eb t\u00eb drejt\u00eb prej institucioneve publike, n\u00eb raport me veprimtarit\u00eb e tyre publike dhe detyrimet q\u00eb iu rrjedhin nga Kodi Zgjedhor, n\u00eb periudh\u00ebn kat\u00ebr muaj para dit\u00ebs s\u00eb zgjedhjeve e deri n\u00eb dit\u00ebn e zgjedhjeve.<\/p>\n\n\n\n<p>Nisur nga gjith\u00eb \u00e7far\u00eb ka ndodhur dhe \u00ebsht\u00eb arritur deri m\u00eb tani, si dhe nisur nga q\u00ebllimi <strong>p\u00ebr p\u00ebrmir\u00ebsimin e m\u00ebtejsh\u00ebm t\u00eb efikasitetit t\u00eb mekanizmit<\/strong>, sidomos p\u00ebr periudh\u00ebn m\u00eb t\u00eb ndezur t\u00eb periudh\u00ebs kat\u00ebr mujore, <strong>n\u00eb vijim, sillet n\u00eb v\u00ebmendje t\u00eb KQZ-s\u00eb nj\u00eb adresim m\u00eb i plot\u00eb i rrethanave dhe k\u00ebrkesave <\/strong>q\u00eb k\u00ebnaqin maksimalisht, n\u00eb gjykimin e KRIIK, pyetjet e ngritura prej KQZ-s\u00eb n\u00eb KUJTES\u00cb, n\u00eb drejtim t\u00eb informimit, kuptimit dhe zbatimit n\u00eb praktik\u00eb t\u00eb tyre.<\/p>\n\n\n\n<p><strong>1. Dokumenti gjykohet se duhet t\u00eb jet\u00eb sa m\u00eb i plot\u00eb<\/strong> n\u00eb g\u00ebrm\u00eb, por ve\u00e7an\u00ebrisht n\u00eb kuptimin e rregullave dhe zbatimin e tyre duke p\u00ebrfshir\u00eb sakt\u00ebsimet e nevojshme referuar kuadrit ligjor, <strong>por edhe t\u00eb gjith\u00eb praktik\u00ebn e vendosur<\/strong> tashm\u00eb nga KQZ-ja n\u00ebp\u00ebrmjet vendimmarrjes prej saj lidhur me denoncimet e marra, p\u00ebrgjat\u00eb t\u00eb tre proceseve zgjedhore.<\/p>\n\n\n\n<p><strong>2. Konsiderohet ende e nevojshme dhe me efektivitet<\/strong> marrja n\u00eb konsiderat\u00eb e rekomandimeve t\u00eb p\u00ebrcjella q\u00eb n\u00eb nisje t\u00eb procesit n\u00ebp\u00ebrmjet <a href=\"https:\/\/kriik.al\/home\/2023\/01\/14\/rekomandime-lidhur-me-nderfaqen-e-raportimeve-te-veprimtarive-me-karakter-publik-te-institucioneve-publike-agjencive-dhe-ose-ndermarrjeve-shteterore-te-ngritur-prej-kqz-se\/\">Dokumentit \u201cREKOMANDIME<\/a> lidhur me <strong>plot\u00ebsimin e detajimin e m\u00ebtejsh\u00ebm t\u00eb nd\u00ebrfaqes<\/strong> s\u00eb raportimeve pran\u00eb KQZ-s\u00eb.<\/p>\n\n\n\n<p>Megjith\u00ebse jemi n\u00eb gjysm\u00ebn e dyt\u00eb t\u00eb periudh\u00ebs s\u00eb raportimit, gjykohet se faza m\u00eb e r\u00ebnd\u00ebsishme, n\u00eb t\u00eb cil\u00ebn do t\u00eb k\u00ebrkohet maksimalisht efi\u00e7enc\u00eb prej KQZ-s\u00eb dhe ku do t\u00eb evidentohet impakti real i mekanizmit, \u00ebsht\u00eb periudha nj\u00eb mujore e fushat\u00ebs zgjedhore p\u00ebrpara dit\u00ebs s\u00eb zgjedhjeve.<\/p>\n\n\n\n<p>Lejimi i t\u00eb b\u00ebrit fushat\u00eb gjat\u00eb k\u00ebsaj periudhe, si dhe fakti q\u00eb pjesa m\u00eb e madhe e KryeBashkiak\u00ebve n\u00eb detyr\u00eb do t\u00eb rikandidojn\u00eb <strong>do t\u00eb komplikoj\u00eb edhe m\u00eb tej, t\u00ebr\u00eb m\u00ebdyshjet e deritanishme t\u00eb t\u00eb gjith\u00eb aktor\u00ebve<\/strong>, madje edhe t\u00eb vet\u00eb administrat\u00ebs s\u00eb KQZ-s\u00eb, midis asaj se \u00e7far\u00eb Ligji e lejon, dhe \u00e7far\u00eb jo.<\/p>\n\n\n\n<p><strong>Shqyrtimi me kujdes i k\u00ebrkes\u00ebs s\u00eb drejtp\u00ebrdrejt\u00eb <\/strong>t\u00eb nenit 92 pika 3 t\u00eb Kodit Zgjedhor, evidenton se <strong>p\u00ebr \u00e7do veprimtari k\u00ebrkohet t\u00eb jepet informacion i mjaftuesh\u00ebm<\/strong> p\u00ebr t\u00eb leht\u00ebsuar gjykimin paraprakisht t\u00eb KQZ-s\u00eb mbi aktivitetin, duke ushtruar p\u00ebrgjegj\u00ebsin\u00eb e saj p\u00ebr ta ndalur paraprakisht at\u00eb <strong>n\u00eb rast se krijon bindjen apo dyshimin se ajo mund t\u00eb ndjek\u00eb q\u00ebllime politike apo elektorale<\/strong>, duke shp\u00ebrdoruar k\u00ebshtu asetet \/ burimet shtet\u00ebrore t\u00eb institucionit organizator.<\/p>\n\n\n\n<p><em>Konkretisht<\/em>, k\u00ebrkohen t\u00eb dh\u00ebna p\u00ebr:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>dat\u00ebn dhe or\u00ebn e veprimtaris\u00eb &#8211;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Mbetet domosdoshm\u00ebri sakt\u00ebsimi dhe qart\u00ebsimi se n\u00ebse veprimtaria ka n\u00eb agjend\u00eb informimin e publikut rreth ndodhis\u00eb s\u00eb saj<\/strong> (Neni 92, pika 1 e Kodit Zgjedhor), pavar\u00ebsisht se kur ndodh ky informim (live gjat\u00eb koh\u00ebs q\u00eb ndodh veprimtaria, apo m\u00eb pas), <strong>ajo duhet t\u00eb raportohet.<\/strong><\/p>\n\n\n\n<p><strong>\u00c7do diskutim tjet\u00ebr q\u00eb heq k\u00ebt\u00eb kuptim t\u00eb drejtp\u00ebrdrejt\u00eb<\/strong> t\u00eb k\u00ebrkes\u00ebs s\u00eb ligjit, n\u00eb gjykimin e KRIIK, <strong>\u00ebsht\u00eb i pavend<\/strong>.<\/p>\n\n\n\n<p>Pra institucioni organizator, sikurse planifikon \u00e7do detaj t\u00eb aktivitetit, planifikon paraprakisht edhe n\u00ebse do t\u00eb b\u00ebj\u00eb ose jo, ndonj\u00eb publikim rreth zhvillimit t\u00eb tij, pavar\u00ebsisht p\u00ebrmbajtjes dhe se kush jan\u00eb pjes\u00ebmarr\u00ebsit.<\/p>\n\n\n\n<p>Pra legjislatori \u00ebsht\u00eb i kujdessh\u00ebm q\u00eb <strong>p\u00ebr \u00e7do publikim q\u00eb do t\u00eb b\u00ebj\u00eb institucioni n\u00eb em\u00ebr t\u00eb tij, t\u00eb ket\u00eb nj\u00eb mekaniz\u00ebm filtrues t\u00eb kujdessh\u00ebm, q\u00eb \u00ebsht\u00eb KQZ-ja<\/strong>, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb mos <strong>cenohet integriteti dhe b\u00ebrja pis n\u00eb asnj\u00eb rrethan\u00eb e emrit\/autoritetit t\u00eb institucionit<\/strong>. &nbsp;As me politik\u00eb, as me fushat\u00eb elektorale, as me p\u00ebrmendje t\u00eb individ\u00ebve apo fabulave politike e partiake, dhe as me prezenc\u00eb t\u00eb personave q\u00eb kan\u00eb post e kostum politik e njihen prej publikut si t\u00eb till\u00eb, pavar\u00ebsisht n\u00ebse flasin apo jo.<\/p>\n\n\n\n<p>Pra \u00ebsht\u00eb e qart\u00eb se vet\u00ebm kaq mjafton, q\u00eb sipas ligjit, <strong>veprimtaria t\u00eb konsiderohet publike dhe duhet t\u00eb raportohet nga institucioni organizator<\/strong>.<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, <strong>p\u00ebrmbajtja, pjes\u00ebmarr\u00ebsit dhe detajet e tjera, ndihmojn\u00eb KQZ<\/strong>-n\u00eb n\u00eb ushtrimin e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb saj p\u00ebr gjykimin paraprakisht n\u00ebse aktiviteti mund t\u00eb ndjek\u00eb q\u00ebllime politike apo elektorale.<\/p>\n\n\n\n<p>Nisur nga praktika e vendimmarrjes prej vet\u00eb KQZ-s\u00eb, Kujtes\u00ebs se b\u00ebr\u00eb m\u00eb par\u00eb nga Komisioneri, interpretimeve t\u00eb gjera t\u00eb b\u00ebra nga aktor\u00eb dhe institucione nd\u00ebrkomb\u00ebtare, por edhe nga argumentimi q\u00eb mund t\u00eb b\u00ebj\u00eb secili prej an\u00ebtar\u00ebve t\u00eb organeve drejtuese t\u00eb KQZ-s\u00eb dhe t\u00eb administrat\u00ebs, mbi at\u00eb se \u00e7far\u00eb kuptohet me mediatizim sipas ligjit, kur sot m\u00ebnyra m\u00eb e p\u00ebrhapur e publikimit jan\u00eb rrjetet sociale dhe platformat online t\u00eb mediave, pranohet gjer\u00ebsisht tashm\u00eb se publikimi n\u00eb rrjetet dhe mediat sociale p\u00ebrb\u00ebn mediatizim t\u00eb veprimtaris\u00eb n\u00eb kuptim t\u00eb nj\u00eb informimi m\u00eb t\u00eb gjer\u00eb t\u00eb mundsh\u00ebm t\u00eb publikut t\u00eb gjer\u00eb.<\/p>\n\n\n\n<p>Shtojm\u00eb k\u00ebtu, Udh\u00ebzimin e Komisionerit p\u00ebr Mbik\u00ebqyrjen e Sh\u00ebrbimit Civil, i cili thekson se: <em>\u201c\u2026N\u00eb vijim t\u00eb k\u00ebsaj analize, nisur nga nj\u00eb p\u00ebrcaktim i p\u00ebrgjithsh\u00ebm q\u00eb mund t\u2019i b\u00ebjm\u00eb rrjeteve sociale, mediave on line, apo platformave sociale si, &#8220;Facebook&#8221;, &#8220;Twitter&#8221;, &#8220;Instagram&#8221;, &#8220;WhatsApp&#8221;, etj., <strong>ato mund t\u00eb konsiderohen si \u201csheshe virtuale\u201d, t\u00eb shprehjes s\u00eb bindjeve apo preferencave politike<\/strong>. K\u00ebto mjete komunikimi t\u00eb japin mund\u00ebsi reale, q\u00eb duke p\u00ebrdorur teknologjin\u00eb e internetit, n\u00ebp\u00ebrmjet llogarive personale, t\u00eb vendos\u00ebsh, apo t\u00eb ndash me t\u00eb tjer\u00ebt fotografi, filmime, mendime, lajme, reklama, propagand\u00eb politike etj., e n\u00eb k\u00ebt\u00eb k\u00ebndv\u00ebshtrim, ato mund t\u00eb sh\u00ebrbejn\u00eb si instrumente efektive p\u00ebr t\u00eb shprehur dhe mb\u00ebshtetur nj\u00eb preferenc\u00eb politike, e cila \u00ebsht\u00eb e ndaluar p\u00ebr n\u00ebpun\u00ebsin civil\u201d.<\/em><\/p>\n\n\n\n<p>Argumentuar sa m\u00eb sip\u00ebr, t\u00eb gjith\u00eb <strong>institucionet dhe titullar\u00ebt e tyre kan\u00eb sot n\u00eb zot\u00ebrim faqe zyrtare n\u00eb rrjetet sociale<\/strong> t\u00eb cilat i p\u00ebrdorin p\u00ebr mediatizim t\u00eb veprimtaris\u00eb s\u00eb p\u00ebrditshme t\u00eb tyre.<\/p>\n\n\n\n<p>Rrjedhimisht, <strong>planifikimi (paraprakisht) dhe publikimi<\/strong> (live apo pas realizimit) i nj\u00eb veprimtarie n\u00eb faqet zyrtare t\u00eb institucioneve dhe t\u00eb drejtuesve t\u00eb tyre, \u00ebsht\u00eb m\u00ebse i mjaftuesh\u00ebm <strong>p\u00ebr ta kategorizuar aktivitetin si \u201cveprimtari publike e cila duhet raportuar\u201d.<\/strong><\/p>\n\n\n\n<p>Madje n\u00eb gjykimin e KRIIK, duhet t\u00eb merret n\u00eb konsiderat\u00eb edhe <strong>publikimi n\u00eb faqet e rrjeteve sociale t\u00eb drejtuesve t\u00eb tjer\u00eb t\u00eb niveleve t\u00eb ndryshme t\u00eb institucionit apo t\u00eb&nbsp; n\u00ebpun\u00ebsve t\u00eb tij<\/strong>, p\u00ebrsa koh\u00eb ato jan\u00eb faqe publike, dhe jo profile t\u00eb mbyllura private.<\/p>\n\n\n\n<p><strong>4. Sakt\u00ebsimi i ndalimit t\u00eb pjes\u00ebmarrjes s\u00eb deputet\u00ebve apo funksionar\u00ebve politik\u00eb n\u00eb aktivitetet institucionale t\u00eb institucioneve,<\/strong> <strong>ve\u00e7an\u00ebrisht Bashkive.<\/strong><\/p>\n\n\n\n<p>Lidhur me prezenc\u00ebn e Deputet\u00ebve n\u00eb veprimtarit\u00eb publike t\u00eb Bashkive\/Institucioneve, KRIIK ka servirur nj\u00eb s\u00ebr\u00eb argumentesh pran\u00eb KQZ-s\u00eb, duke konkluduar se e konsideron <strong>ftes\u00ebn e b\u00ebr\u00eb ndaj Deputet\u00ebve nga Bashkia\/Institucioni jo konform parashikimeve ligjore.<\/strong><\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb q\u00eb nga ana tjet\u00ebr, edhe pjes\u00ebmarrjen e Deputet\u00ebve n\u00eb aktivitetet rutin\u00eb t\u00eb Bashkis\u00eb\/Institucionit, e konsideron <strong>jasht\u00eb detyrave t\u00eb tyre funksionale parlamentare dhe n\u00eb kund\u00ebrshtim me Kodin e Sjelljes, Rregulloren e Kuvendit dhe t\u00eb Ligjit p\u00ebr Statusin e Deputet\u00ebve.<\/strong><\/p>\n\n\n\n<p>KRIIK sjell n\u00eb v\u00ebmendje, <strong>se n\u00eb aktivitetet rutin\u00eb t\u00eb Bashkive\/Institucioneve duhet t\u00eb ndalohet edhe pjes\u00ebmarrja e Ministrave<\/strong>. S\u00eb pari dhe s\u00eb paku, e atyre Ministrave fusha e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb t\u00eb cil\u00ebve nuk lidhet me karakterin apo tematik\u00ebn e veprimtaris\u00eb s\u00eb p\u00ebrditshme t\u00eb institucionit organizator.<\/p>\n\n\n\n<p>Theksohet se <strong>Ministri \u00ebsht\u00eb Person Politik, p\u00ebrfaq\u00ebsues i Qeveris\u00eb, dhe prezenca e tij i jep rrjedhimisht konotacion politik aktivitetit<\/strong> ku ai merr pjes\u00eb, duke u perceptuar edhe si mb\u00ebshtetje e tij apo Qeveris\u00eb ndaj veprimtaris\u00eb s\u00eb institucionit, dhe vet\u00eb institucionit n\u00eb fjal\u00eb.<\/p>\n\n\n\n<p>Madje, edhe n\u00eb rastin kur tematika e veprimtaris\u00eb hyn n\u00eb fush\u00ebn e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb Ministrit, s\u00ebrish gjykohet se \u00ebsht\u00eb <strong>e nevojshme t\u00eb provohet edhe angazhimi konkret apo lidhja direkte e veprimtaris\u00eb specifike, pra e bashk\u00ebpunimit apo nd\u00ebrveprimit institucional, me Institucionin e Ministris\u00eb<\/strong>, q\u00eb t\u00eb mund t\u00eb p\u00ebrligjet edhe pjes\u00ebmarrja e Ministrit, si titullar i Institucionit.<\/p>\n\n\n\n<p>Ve\u00e7an\u00ebrisht n\u00eb rastin e Zgjedhjeve Vendore, fusha e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb nj\u00eb Ministrie lidhet domosdoshm\u00ebrisht me s\u00eb paku nj\u00eb tematik\u00eb t\u00eb nj\u00eb aktiviteti t\u00eb zhvilluar nga secila prej 61 bashkive.<\/p>\n\n\n\n<p>Sigurisht q\u00eb n\u00eb terma praktik\u00eb, Ministri nuk ka mund\u00ebsi fizike edhe n\u00ebse do t\u00eb d\u00ebshironte q\u00eb t\u00eb merrte pjes\u00eb n\u00eb t\u00eb 61 aktivitetet, p\u00ebrgjat\u00eb fushat\u00ebs zgjedhore.<\/p>\n\n\n\n<p>Kjo do t\u00eb thot\u00eb q\u00eb <strong>pjes\u00ebmarrja e tij, i jep v\u00ebmendje t\u00eb ve\u00e7ant\u00eb dhe kredite t\u00eb shtuara<\/strong> aktivitetit ku Ministri merr pjes\u00eb, rrjedhimisht edhe institucionit organizator, e titullarit t\u00eb tij, duke krijuar <strong>nj\u00eb perceptim publik ku favorizohet nj\u00eb Kryebashkiak, n\u00eb raport me Kryebashkiak\u00ebt e tjer\u00eb,<\/strong> pavar\u00ebsisht se t\u00eb gjitha Bashkit\u00eb\/Kryebashkiak\u00ebt mund t\u00eb ken\u00eb organizuar aktivitete q\u00eb hyjn\u00eb n\u00eb sfer\u00ebn e p\u00ebrgjegj\u00ebsis\u00eb s\u00eb Ministrit.<\/p>\n\n\n\n<p>N\u00eb rastin dhe kontekstin konkret, jemi n\u00eb rrethanat kur pjesa m\u00eb e madhe e Kryebashkiak\u00ebve <strong>rikandidojn\u00eb, pra jan\u00eb subjekte zgjedhore<\/strong>.<\/p>\n\n\n\n<p><strong>Pjes\u00ebmarrja e Ministrit n\u00eb nj\u00eb aktivitet publik t\u00eb zhvilluar prej Institucionit t\u00eb Bashkis\u00eb<\/strong>, ku merr pjes\u00eb Titullari i Institucionit, pra Kryebashkiaku i cili \u00ebsht\u00eb nj\u00ebkoh\u00ebsisht edhe Kandidat,&nbsp; n\u00eb perceptimin publik t\u00eb pjes\u00ebmarr\u00ebsve dhe atyre q\u00eb shohin publikimin mbi aktivitetin, <strong>krijohet p\u00ebrshtypja se Kandidati ka mb\u00ebshtetjen e Ministrit, madje edhe t\u00eb Qeveris\u00eb, duke prishur k\u00ebshtu parimin e barazis\u00eb s\u00eb gar\u00ebs elektorale<\/strong>.<\/p>\n\n\n\n<p>T\u00ebr\u00eb kjo situat\u00eb, vet\u00ebm n\u00eb rastin kur Ministri thjesht \u00ebsht\u00eb prezent me kostumin e tij zyrtar\/politik t\u00eb Qeveris\u00eb, pra ve\u00e7 merr pjes\u00eb fizikisht, pa manifestuar asnj\u00eb rol kryesor n\u00eb veprimtari dhe pa patur rolin e fol\u00ebsit.<\/p>\n\n\n\n<p><strong>Situata b\u00ebhet akoma m\u00eb e r\u00ebnd\u00eb n\u00eb realitet<\/strong>, sikurse ndodh praktikisht n\u00eb t\u00ebr\u00eb aktivitetet ku marrin pjes\u00eb Ministrat e Qeveris\u00eb, n\u00eb t\u00eb cilat <strong>k\u00ebta t\u00eb fundit jan\u00eb n\u00eb qend\u00ebr t\u00eb v\u00ebmendjes, duke patur rol kryesor edhe si fol\u00ebs<\/strong>, duke b\u00ebr\u00eb artikulime politike, partiake apo edhe elektorale.<\/p>\n\n\n\n<p><strong>5. Shtrirja e ndalimit t\u00eb p\u00ebrdorimit t\u00eb simboleve e logove, edhe tek hashtag-et me slogane elektorale<\/strong> q\u00eb publikohen si pjes\u00eb e aktiviteteve institucionale, qoft\u00eb n\u00eb faqet e institucioneve, qoft\u00eb n\u00eb ato t\u00eb drejtuesve apo p\u00ebrfaq\u00ebsuesve t\u00eb tyre.<\/p>\n\n\n\n<p>K\u00ebtu b\u00ebhet fjal\u00eb jo vet\u00ebm p\u00ebr hashtag-et e njohura gjer\u00ebsisht tashm\u00eb q\u00eb identifikojn\u00eb Partin\u00eb Socialiste si slogane t\u00eb krijuara n\u00eb Zgjedhjet Parlamentare 2021, por edhe p\u00ebr hashtag-e t\u00eb tjera t\u00eb cilat kan\u00eb nisur apo do t\u00eb p\u00ebrdoren zyrtarisht nga Subjektet Elektorale p\u00ebr k\u00ebto zgjedhje.<\/p>\n\n\n\n<p><strong>6. Sakt\u00ebsimi i rolit t\u00eb n\u00ebpun\u00ebsit publik, n\u00eb raport me aktivitetet publike si dhe ato me karakter elektoral<\/strong>.<\/p>\n\n\n\n<p>N\u00ebpun\u00ebsit civil i ndalohet pjes\u00ebmarrja n\u00eb aktivitete elektorale jo vet\u00ebm gjat\u00eb orarit zyrtar. Pas orarit zyrtar ai mund t\u00eb marr\u00eb pjes\u00eb n\u00eb aktivitete elektorale <strong>vet\u00ebm si pjes\u00ebmarr\u00ebs i thjesht\u00eb n\u00eb ushtrim t\u00eb t\u00eb drejtave t\u00eb tij politike<\/strong>. Por atij i ndalohet t\u00eb manifestoj\u00eb publikisht bindjet apo preferencat e veta, pra t\u00eb mbaj\u00eb veshje me slogane elektorale, parulla, apo t\u00eb marr\u00eb rol organizator apo drejtues, etj.<\/p>\n\n\n\n<p>Sipas vendimit nr. 9 t\u00eb Komisionit Rregullator, neni 6 pika 5 \u201c<em>Gjat\u00eb pjes\u00ebmarrjes n\u00eb veprimtari politike apo zgjedhore, <strong>n\u00ebpun\u00ebsit civil, i ndalohet t\u00eb shpreh\u00eb publikisht bindjet apo preferencat e tij politike dhe t\u00eb b\u00ebj\u00eb fushat\u00eb p\u00ebr nj\u00eb subjekt zgjedhore apo kandidat<\/strong><\/em>\u201d.<\/p>\n\n\n\n<p>Po ashtu edhe Udh\u00ebzimi i Komisionerit p\u00ebr Mbik\u00ebqyrjen e Sh\u00ebrbimit Civil, qart\u00ebson se n\u00ebpun\u00ebsit civil\u00eb e kan\u00eb t\u00eb ndaluar t\u00eb shprehin publikisht preferencat e tyre politike.&nbsp; Konkretisht sipas KMSHC \u201c<em>Duke vler\u00ebsuar faktin se nuk ka nj\u00eb rregullim t\u00eb posa\u00e7\u00ebm ligjor, n\u00eb lidhje me m\u00ebnyr\u00ebn e sjelljes s\u00eb n\u00ebpun\u00ebsve civil\u00eb n\u00eb mediat on line dhe n\u00eb rrjetet e platformat sociale q\u00eb shfaqen p\u00ebr publikun n\u00ebp\u00ebrmjet internetit, Komisioneri vler\u00ebson se kjo \u00e7\u00ebshtje duhet t\u00eb trajtohet sipas <strong>parashikimeve t\u00eb nenit 37 pika 1, t\u00eb ligjit nr. 152\/2013, \u201cP\u00ebr n\u00ebpun\u00ebsin civil\u201d, i ndryshuar, e po k\u00ebshtu edhe sipas praktik\u00ebs m\u00eb t\u00eb mir\u00eb ligjore t\u00eb Bashkimit Evropian<\/strong>. &nbsp;N\u00eb k\u00ebt\u00eb dispozit\u00eb, p\u00ebrcaktohet se: \u201cN\u00ebpun\u00ebsi civil nuk mund t\u00eb shpreh\u00eb publikisht bindjet apo preferencat e tij politike\u201d, e p\u00ebr k\u00ebt\u00eb arsye, me q\u00ebllim q\u00eb t\u00eb kuptohet drejt p\u00ebrmbajtja e saj, Komisioneri ka hartuar dhe d\u00ebrguar pran\u00eb institucioneve q\u00eb pun\u00ebsojn\u00eb n\u00ebpun\u00ebs civil, nj\u00eb udh\u00ebzues ku jan\u00eb dh\u00ebn\u00eb sqarime t\u00eb holl\u00ebsishme q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me t\u00eb drejtat dhe detyrimet e n\u00ebpun\u00ebsit civil\u00eb gjat\u00eb periudh\u00ebs zgjedhore\u201d.<\/em><\/p>\n\n\n\n<p><strong>7. Gjithashtu<\/strong>, duke mbajtur n\u00eb konsiderat\u00eb p\u00ebrdorimin masiv dhe t\u00eb koordinuar t\u00eb rrjeteve sociale prej <strong>punonj\u00ebsve t\u00eb administrat\u00ebs shtet\u00ebrore<\/strong> p\u00ebr q\u00ebllime fushate, KRIIK sugjeron q\u00eb ata t\u00eb informohen specifikisht n\u00eb Kujtes\u00eb p\u00ebr <strong>ndalimin e postimeve me natyr\u00eb elektorale, ndarje<\/strong><strong>n e postimeve t\u00eb t\u00eb tjer\u00ebve apo kryerjen e reagimeve ndaj tyre, n\u00eb kanalet personale t<\/strong><strong>\u00eb<\/strong><strong> tyre n\u00eb mediat sociale<\/strong><strong>, n\u00eb p\u00ebrforcim edhe t\u00eb udh\u00ebzuesit t\u00eb d\u00ebrguar nga Komisioneri i Mbik\u00ebqyrjes s\u00eb Sh\u00ebrbimit Civil. <\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>8. Lidhur me termin Stigmatizim<\/strong> t\u00eb p\u00ebrdorur n\u00eb Kujtes\u00eb, n\u00eb gjykimin e KRIIK, <strong>duhet t\u00eb ket\u00eb sqarim m\u00eb shterues<\/strong>.<\/p>\n\n\n\n<p>P\u00ebr t\u2019u patur n\u00eb konsiderat\u00eb nga institucionet, <strong>duhet t\u00eb sakt\u00ebsohet m\u00eb mir\u00eb ndalimi qoft\u00eb edhe i p\u00ebrmendjes s\u00eb subjekteve politike apo zgjedhore, n\u00eb nj\u00eb aktivitet institucional<\/strong>.<\/p>\n\n\n\n<p>Nuk ka asnj\u00eb arsye q\u00eb subjektet politike t\u00eb p\u00ebrmenden n\u00eb aktivitete institucionale. Shteti dhe detyrat q\u00eb rrjedhin si funksionar i tij jan\u00eb t\u00eb ndara nga ato t\u00eb partis\u00eb t\u00eb cil\u00ebn simpatizon apo p\u00ebrfaq\u00ebson.<\/p>\n\n\n\n<p><strong>9. Duhet t\u00eb citohet qart\u00eb se cilat jan\u00eb asetet publike n\u00eb t\u00eb cilat mund t\u00eb lejohet zhvillimi i veprimtarive politike\/elektorale<\/strong>, e konkretisht lidhur me p\u00ebrdorimin e nd\u00ebrtesave t\u00eb institucioneve publike.<\/p>\n\n\n\n<p>Ligji nuk e ndalon q\u00eb n\u00ebp\u00ebrmjet aplikimit t\u00eb nj\u00eb procedure t\u00eb caktuar, t\u00eb p\u00ebrdoren disa asete publike, si\u00e7 jan\u00eb p\u00ebr shembull sht\u00ebpit\u00eb e kultur\u00ebs, etj.<\/p>\n\n\n\n<p>Por gjithmon\u00eb duke u kujdesur q\u00eb p\u00ebr k\u00ebt\u00eb t\u00eb ket\u00eb nj\u00eb vendimmarrje zyrtare prej institucionit q\u00eb i ka n\u00eb pron\u00ebsi. Nga ana tjet\u00ebr duhet t\u00eb sigurohet edhe b\u00ebrja e ditur prej institucionit pronar se k\u00ebto ambiente jan\u00eb t\u00eb lira dhe t\u00eb hapura p\u00ebr p\u00ebrdorim nga t\u00eb t\u00ebr\u00eb subjektet e interesuar.<\/p>\n\n\n\n<p><strong>10. Gjithashtu, duhet sakt\u00ebsuar q\u00eb automjetet <\/strong>dhe karburanti i titullarit t\u00eb institucionit, si dhe \u00e7do burim material i institucionit apo financiar (dieta, etj.), nuk duhet t\u00eb p\u00ebrdoren p\u00ebr veprimtari t\u00eb fushat\u00ebs zgjedhore apo p\u00ebr takime t\u00eb titullarit e veprimtari t\u00eb tjera t\u00eb tij, kur k\u00ebto t\u00eb fundit <strong>nuk jan\u00eb t\u00eb karakterit institucional<\/strong> q\u00eb lidhen drejtp\u00ebrdrejt\u00eb me funksionet e titullarit si drejtues i institucionit shtet\u00ebror.<\/p>\n\n\n\n<p>K\u00ebto automjete, sipas nj\u00eb urdhri q\u00eb duhet t\u00eb jet\u00eb miratuar nga titullari i institucionit p\u00ebrkat\u00ebs, duhet t\u00eb parkohen n\u00eb ambientet e institucioneve respektive n\u00eb p\u00ebrfundim t\u00eb orarit zyrtar.<\/p>\n\n\n\n<p><strong>11.
