lidhur me projekt-vendimin p\u00ebr miratimin e procedurave dhe kritereve t\u00eb akreditimit t\u00eb v\u00ebzhguesve t\u00eb subjekteve zgjedhore"},"content":{"rendered":"\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p class=\"has-text-align-center\"><strong>Shkarko <a href=\"https:\/\/kriik.al\/home\/wp-content\/uploads\/2023\/02\/KRIIK-REKOMANDIME-MbiProjektVendimin_PerAkreditiminEVezhguesveTeSubjekteveZgjedhore-20230131.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dokumentin<\/a> e derguar KQZ-se<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>Koalicioni p\u00ebr Reforma, Integrim dhe Institucione t\u00eb Konsoliduara (KRIIK) ka ndjekur n\u00eb vijim\u00ebsi gjith\u00eb procesin e vendimmarrjes administrative n\u00eb KQZ, duke u p\u00ebrpjekur t\u00eb jap\u00eb kontributin e vet n\u00ebp\u00ebrmjet rekomandimeve apo sugjerimeve konkrete p\u00ebrgjat\u00eb procesit t\u00eb konsultimit paraprak t\u00eb projekt-akteve t\u00eb d\u00ebrguara nga ju, apo edhe p\u00ebr projekt akte t\u00eb tjera p\u00ebr t\u00eb cilat vler\u00ebsohet se nevojiten t\u2019iu b\u00ebhen p\u00ebrmir\u00ebsime t\u00eb m\u00ebtejshme.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Duke vler\u00ebsuar maksimalisht gatishm\u00ebrin\u00eb dhe fleksibilitetin e treguar nga ju n\u00eb k\u00ebt\u00eb proces, KRIIK gjen rastin t\u2019ju shpreh edhe nj\u00ebher\u00eb fal\u00ebnderimet e tij p\u00ebr t\u00ebr\u00eb k\u00ebt\u00eb bashk\u00ebpunim t\u00eb frytsh\u00ebm t\u00eb arritur deri m\u00eb tani.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Me email-in e dat\u00ebs 31 janar jemi njohur me agjend\u00ebn e mbledhjes s\u00eb dat\u00ebs 1 shkurt 2023 nga ana e Komisionerit Shtet\u00ebror p\u00ebr Zgjedhjet, ku parashikohet t\u00eb shqyrtohet e miratohet edhe projektvendimi \u201cP\u00ebr miratimin e procedurave dhe kritereve t\u00eb akreditimit t\u00eb v\u00ebzhguesve t\u00eb subjekteve zgjedhore n\u00eb komisionet e zonave t\u00eb administrimit zgjedhor, komisionet e qendrave t\u00eb votimit dhe vendet e num\u00ebrimit t\u00eb votave, nga komisioni i zon\u00ebs s\u00eb administrimit zgjedhor p\u00ebr zgjedhjet\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Paraprakisht <strong>ju shprehim vler\u00ebsimin e KRIIK p\u00ebr p\u00ebrmir\u00ebsimin e aktit<\/strong>, si dhe marrjen n\u00eb konsiderat\u00eb t\u00eb shqet\u00ebsimeve\/rekomandimeve p\u00ebr t\u00eb b\u00ebr\u00eb publike \/ p\u00ebrcjell\u00eb n\u00eb KQZ vendimmarrjet e KZAZ-ve lidhur me akreditimin e v\u00ebzhguesve, duke b\u00ebr\u00eb transparenc\u00eb e v\u00ebn\u00eb n\u00eb kontroll t\u00eb KQZ-s\u00eb e publikut k\u00ebt\u00eb proces autorizimi t\u00eb v\u00ebzhguesve t\u00eb subjekteve zgjedhore, p\u00ebrfshir\u00eb mund\u00ebsin\u00eb e revokimit t\u00eb akreditimit t\u00eb tyre.&nbsp;<\/p>\n\n\n\n<p>Na lejoni t\u2019ju risjellim n\u00eb v\u00ebmendjen tuaj, se ky akt rreket t\u00eb adresoj\u00eb p\u00ebrballimin m\u00eb nj\u00eb s\u00ebr\u00eb problematikash jo t\u00eb vogla, t\u00eb cilat jan\u00eb shkaktuar nga kjo kategori e v\u00ebzhguesve n\u00eb ecurin\u00eb e procesit t\u00eb votimit e t\u00eb num\u00ebrimit, n\u00eb procese t\u00eb m\u00ebparshme zgjedhore, duke filluar nga:&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; orientimi i votuesve n\u00eb QV;&nbsp;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; drejtimi i pun\u00ebs s\u00eb komisioner\u00ebve t\u00eb QV-s\u00eb n\u00eb disa raste;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; marrja sh\u00ebnim n\u00eb QV, identifikimi dhe njoftimi haptazi tek t\u00eb tret\u00eb mbi identitetin e shtetasit\/ve q\u00eb po votojn\u00eb apo edhe p\u00ebr ata q\u00eb nuk kan\u00eb ardhur ende p\u00ebr t\u00eb votuar, duke p\u00ebrb\u00ebr\u00eb k\u00ebshtu pik\u00ebnisjen e nj\u00eb mekanizmi t\u00eb t\u00ebr\u00eb organizimi, kontrolli dhe orientimi\/drejtimi\/intimidimi t\u00eb qytetar\u00ebve\/vot\u00ebs;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; intimidimi i votuesve\/komisioner\u00ebve\/v\u00ebzhguesve me akte konkrete apo edhe thjesht me prezenc\u00ebn e tyre brenda ambienteve t\u00eb v\u00ebzhgimit nga persona me t\u00eb shkuar kriminale t\u00eb akredituar si v\u00ebzhgues;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; mungesa e konsiderueshme e kontrollit mbi hyrje\/daljet e personave t\u00eb paakredituar, kryesisht atyre me pozit\u00eb zyrtare\/politike, apo t\u00eb tjer\u00eb individ\u00eb me influenc\u00eb lokale, ve\u00e7an\u00ebrisht n\u00eb vendet e num\u00ebrimit t\u00eb votave;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; akreditimi i v\u00ebzhguesve jasht\u00eb afateve t\u00eb p\u00ebrcaktuara, prej komisioner\u00ebve t\u00eb KZAZ-ve;&nbsp;<\/p>\n\n\n\n<p>&nbsp;&#8211; nxitja e ng\u00ebr\u00e7eve n\u00eb ecurin\u00eb e procesit, apo e konflikteve t\u00eb ndryshme, deri n\u00eb konflikte fizike brenda ambienteve t\u00eb v\u00ebzhgimit, e t\u00eb tjera problematika.&nbsp;<\/p>\n\n\n\n<p>Duke patur n\u00eb konsiderat\u00eb gjith\u00eb sa m\u00eb sip\u00ebr, si dhe projektvendimin e p\u00ebrgatitur, <strong>KRIIK ju paraqet n\u00eb vijim disa rekomandime shtes\u00eb<\/strong>, t\u00eb cilat n\u00eb gjykimin e tij, do ta b\u00ebjn\u00eb aktin m\u00eb t\u00eb plot\u00eb dhe efi\u00e7ent.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>Konkretisht:<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>1. N\u00eb lidhje me verifikimin e gjendjes gjyq\u00ebsore t\u00eb v\u00ebzhguesve<\/strong>&nbsp;<\/p>\n\n\n\n<p>Neni 5, pika 1.d. e projekt-vendimit p\u00ebrcakton se subjekti zgjedhor dor\u00ebzon n\u00eb KQZ \u201cvet\u00ebdeklarimin e v\u00ebzhguesit p\u00ebr gjendjen gjyq\u00ebsore\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nga formulimi i pik\u00ebs n\u00eb fjal\u00eb nuk \u00ebsht\u00eb e qart\u00eb se me \u00e7far\u00eb dokumenti specifikisht do t\u00eb duhet t\u00eb v\u00ebrtetohet gjendja gjyq\u00ebsore e v\u00ebzhguesve, por duket se i referohet<a href=\"https:\/\/www.drejtesia.gov.al\/wp-content\/uploads\/2018\/10\/formulari-i-vetdeklarimit_gjendja-gjyqesore.pdf\"> Vet\u00ebdeklarimit t\u00eb Gjendjes Gjyq\u00ebsore<\/a>, me an\u00eb t\u00eb t\u00eb cilit shtetasit i japin nj\u00ebkoh\u00ebsisht t\u00eb drejt\u00ebn subjektit ku dor\u00ebzohet vet\u00ebdeklarimi p\u00ebr t\u00eb verifikuar t\u00eb dh\u00ebnat.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, duke qen\u00eb se<a href=\"https:\/\/e-albania.al\/eAlbaniaServices\/UseService.aspx?service_code=13259\"> procedura p\u00ebr marrjen e certifikat\u00ebs t\u00eb gjendjes gjyq\u00ebsore<\/a> \u00ebsht\u00eb shum\u00eb e leht\u00eb, kryhet online n\u00ebp\u00ebrmjet e-Albania, falas, dhe p\u00ebr nj\u00eb periudh\u00eb relativisht t\u00eb shkurt\u00ebr kohore, KRIIK <strong>sugjeron q\u00eb v\u00ebzhguesve potencial\u00eb t\u2019iu k\u00ebrkohet nj\u00eb \u00c7ertifikat\u00eb e Gjendjes Gjyq\u00ebsore dhe jo Vet\u00ebdeklarim<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kjo do t\u00eb leht\u00ebsonte administrat\u00ebn e KQZ-s\u00eb apo subjektet zgjedhore nga nevoja p\u00ebr t\u00eb verifikuar gjendjen gjyq\u00ebsore t\u00eb nj\u00eb numri shum\u00eb t\u00eb lart\u00eb v\u00ebzhguesish.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>2. N\u00eb lidhje me ruajtjen e fsheht\u00ebsis\u00eb s\u00eb vot\u00ebs n\u00eb Qendrat e Votimit<\/strong>&nbsp;<\/p>\n\n\n\n<p>Raportet e v\u00ebzhguesve vendas dhe nd\u00ebrkomb\u00ebtar\u00eb p\u00ebr Zgjedhjet p\u00ebr Kuvendin e Shqip\u00ebris\u00eb t\u00eb vitit 2021 kan\u00eb evidentuar si problematik <strong>ndikimin e paduhur nga v\u00ebzhguesit partiak\u00eb apo t\u00eb t\u00eb tjer\u00eb personave mbi zgjedh\u00ebsit, qoft\u00eb n\u00eb af\u00ebrsi t\u00eb qendrave t\u00eb votimit, qoft\u00eb brenda tyre<\/strong>. Kjo b\u00ebhet akoma m\u00eb problematike n\u00ebse konsiderohet n\u00eb kontestin e p\u00ebrgjithsh\u00ebm t\u00eb strukturave t\u00eb patronazhimit politik t\u00eb ngritur dhe t\u00eb drejtimit t\u00eb vot\u00ebs.&nbsp;&nbsp;Specifikisht, p\u00ebrpos Raportit P\u00ebrfundimtar t\u00eb KRIIK,<a href=\"https:\/\/www.osce.org\/files\/f\/documents\/4\/c\/495052.pdf\"> Raporti Final i ODIHR<\/a>, p\u00ebrve\u00e7 personave t\u00eb vendosur jasht\u00eb qendrave t\u00eb votimit, n\u00eb faqen 29 p\u00ebrmend specifikisht faktin se \u201cMNVZ-ja vuri n\u00eb dukje shum\u00eb raste kur v\u00ebzhguesit e partive mbanin sh\u00ebnim ata q\u00eb votonin, duke regjistruar numrat e tyre rendor\u00eb si\u00e7 ishin caktuar n\u00eb listat e zgjedh\u00ebsve.\u201d&nbsp;<\/p>\n\n\n\n<p>Madje, kjo gjetje \u00ebsht\u00eb nj\u00eb nga argumentet p\u00ebr Rekomandimin e dyt\u00eb Prioritar t\u00eb Raportit t\u00eb ODIHR (faqe 30) se \u201c<strong>Shteti duhet t\u00eb garantoj\u00eb t\u00eb drejt\u00ebn p\u00ebr nj\u00eb zgjedhje t\u00eb lir\u00eb dhe t\u00eb fsheht\u00eb. \u00c7do form\u00eb presioni p\u00ebr t\u00eb zbuluar n\u00ebse dikush ka votuar apo jo<\/strong> dhe si ka votuar duhet t\u00eb parandalohet.\u201d&nbsp;<\/p>\n\n\n\n<p>Risillet n\u00eb v\u00ebmendje k\u00ebtu se Shteti shqiptar, n\u00eb Samitin e Stambollit t\u00eb vitit 1999, \u00ebsht\u00eb angazhuar p\u00ebr t\u00eb \u201czbatuar n\u00eb m\u00ebnyr\u00eb t\u00eb menj\u00ebhershme vler\u00ebsimet dhe rekomandimet e ODIHR-it p\u00ebr zgjedhjet\u201d.&nbsp;<\/p>\n\n\n\n<p>Bazuar n\u00eb sa m\u00eb sip\u00ebr, KRIIK gjykon se projektvendimi \u201cP\u00ebr procedurat dhe kriteret e akreditimit t\u00eb v\u00ebzhguesve t\u00eb subjekteve zgjedhore n\u00eb komisionet e zonave t\u00eb administrimit zgjedhor, komisionet e qendrave t\u00eb votimit dhe vendet e num\u00ebrimit t\u00eb votave, n\u00eb zgjedhje\u201d mund t\u00eb <strong>parashikoj\u00eb n\u00eb p\u00ebrmbajtje t\u00eb tij, element\u00eb q\u00eb t\u00eb mund t\u00eb minimizojn\u00eb dhe parandalojn\u00eb k\u00ebt\u00eb fenomen<\/strong>, t\u00eb pranish\u00ebm prej vitesh n\u00eb proceset zgjedhore. Kjo edhe n\u00eb sinkron me frym\u00ebn dhe qasjen e re q\u00eb duhet manifestuar prej KQZ-s\u00eb n\u00eb vijim t\u00eb aspiratave t\u00eb marr\u00ebveshjes politike t\u00eb 5 qershorit 2020.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Specifikisht, <strong>n\u00eb p\u00ebrmbushje t\u00eb parashikimit t\u00eb b\u00ebr\u00eb n\u00eb nenin 7, pika 2.d. t\u00eb Kodit Zgjedhor<\/strong> (detyrimi i v\u00ebzhguesve p\u00ebr t\u00eb mos dhunuar t\u00eb drejt\u00ebn e votuesit p\u00ebr t\u00eb votuar n\u00eb fsheht\u00ebsi), projektvendimi nuk sjell asgj\u00eb shtes\u00eb, duke u mjaftuar me p\u00ebrs\u00ebritjen e k\u00ebsaj norme t\u00eb Kodit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb m\u00ebnyr\u00eb q\u00eb akti n\u00ebnligjor t\u00eb jet\u00eb m\u00eb efektiv, KRIIK sugjeron q\u00eb kjo pik\u00eb e ligjit t\u00eb zb\u00ebrthehet n\u00eb element\u00eb specifik\u00eb t\u00eb ndaluar (m\u00ebnyra se si mund t\u00eb dhunohet e drejta e zgjedh\u00ebsve p\u00ebr t\u00eb votuar n\u00eb fsheht\u00ebsi), duke p\u00ebrfshir\u00eb por pa u kufizuar n\u00eb:&nbsp;<\/p>\n\n\n\n<p>2.1. <strong>Ndalimin e v\u00ebzhguesve politik\u00eb<\/strong> <strong>p\u00ebr t\u00eb q\u00ebndruar pran\u00eb dhom\u00ebs s\u00eb fsheht\u00eb<\/strong> apo n\u00eb nj\u00eb pozicion t\u00eb till\u00eb q\u00eb t\u00eb mund t\u00eb shoh\u00eb apo kuptoj\u00eb se p\u00ebr k\u00eb po voton votuesi;&nbsp;<\/p>\n\n\n\n<p>2.2.&nbsp; <strong>Ndalimin p\u00ebr t\u00eb marr\u00eb informacion<\/strong>, sh\u00ebnuar apo dokumentuar me \u00e7far\u00ebdo m\u00ebnyre e mjeti, brenda ambient\u00ebve t\u00eb qendr\u00ebs s\u00eb votimit dhe\/ose nga an\u00ebtar\u00ebt e komisionit t\u00eb qendr\u00ebs s\u00eb votimit, <strong>t\u00eb dh\u00ebna q\u00eb mund t\u00eb \u00e7ojn\u00eb n\u00eb identifikimin e zgjedh\u00ebsve q\u00eb po votojn\u00eb, kan\u00eb votuar apo nuk kan\u00eb votuar ende<\/strong>.&nbsp;<\/p>\n\n\n\n<p>2.3. N\u00eb plot\u00ebsim t\u00eb k\u00ebtij parashikimi, n\u00eb rastet kur evidentohet se nj\u00eb v\u00ebzhgues i nj\u00eb subjekti zgjedhor kryen shkeljet e m\u00ebsip\u00ebrme, duhet q\u00eb ai <strong>t\u00eb p\u00ebrjashtohet menj\u00ebher\u00eb nga Qendra e Votimit, me vendim t\u00eb Kryetarit<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kryetari vendos pas denoncimit q\u00eb mund t\u00eb b\u00ebj\u00eb nj\u00eb an\u00ebtar i komisionit t\u00eb QV-s\u00eb, v\u00ebzhgues apo qytetar. Vendimi mund t\u00eb parashikoj\u00eb edhe n\u00ebnshkrimin jo t\u00eb detyruar t\u00eb v\u00ebzhguesve prezent\u00eb n\u00eb momentin e shkeljes.&nbsp;<\/p>\n\n\n\n<p>Pas marrjes s\u00eb vendimit, Kryetari i QV-s\u00eb ia p\u00ebrcjell\u00eb menj\u00ebher\u00eb KZAZ-s\u00eb emrin e v\u00ebzhguesit p\u00ebr revokim t\u00eb akreditimit t\u00eb tij. KZAZ-ja vendos vet\u00eb p\u00ebr revokim t\u00eb akreditimit t\u00eb v\u00ebzhguesit, ose ia p\u00ebrcjell emrin e tij KQZ-s\u00eb, sipas rastit.&nbsp;<\/p>\n\n\n\n<p><strong>3. Lidhur me transparenc\u00ebn dhe kontrollin ndaj respektimit t\u00eb kritereve dhe afateve t\u00eb akreditimit t\u00eb v\u00ebzhguesve prej KZAZ-ve<\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb nenin 11 \u201cAutorizimi dhe mandati i v\u00ebzhguesve\u201d t\u00eb projektvendimit, n\u00eb pik\u00ebn 5 e 6 t\u00eb tij parashikohet:&nbsp;<\/p>\n\n\n\n<p>\u201c5. Sekretari i KZAZ-s\u00eb jo m\u00eb von\u00eb se 5 dit\u00eb pas miratimit t\u00eb autorizimit p\u00ebr akreditimin e v\u00ebzhguesve dor\u00ebzon n\u00eb KQZ n\u00eb form\u00eb elektronike list\u00ebn e v\u00ebzhguesve t\u00eb akredituar si dhe kopje t\u00eb vendimmarrjeve t\u00eb KZAZ-s\u00eb p\u00ebr akreditimin e tyre.&nbsp;<\/p>\n\n\n\n<p>6.
