Mosrespektimin e afatit ligjor 5 ditor p\u00ebrpara zhvillimit t\u00eb aktivitetit;<\/strong><\/p>\n\n\n\n<p><strong>2. Kryerjen e veprimtarive publike, pavar\u00ebsisht se nuk jan\u00eb raportuar n\u00eb nd\u00ebrfaqen e raportimeve n\u00eb KQZ;<\/strong><\/p>\n\n\n\n<p><strong>3. Raportimin pa detaje nga institucionet;<\/strong><\/p>\n\n\n\n<p><strong>4. Pjes\u00ebmarrjen e drejtuesve politik\u00eb t\u00eb qarqeve, n\u00eb aktivitete t\u00eb bashkive pavar\u00ebsisht se nuk jan\u00eb deputet\u00eb t\u00eb zon\u00ebs.<\/strong><\/p>\n\n\n\n<p>Konkretisht:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li><strong>Raportimi i aktiviteteve me vones\u00eb<\/strong><\/li><\/ol>\n\n\n\n<p>Praktika e raportimit t\u00eb aktiviteteve me vones\u00eb (m\u00eb pak se pes\u00eb dit\u00eb p\u00ebrpara dit\u00ebs s\u00eb aktivitetit) vijon edhe n\u00eb k\u00ebt\u00eb jav\u00eb t\u00eb dyt\u00eb, madje konstatohet se situata \u00ebsht\u00eb akoma m\u00eb problematike n\u00eb krahasim me jav\u00ebn e par\u00eb.<\/p>\n\n\n\n<p>Nga monitorimi i KRIIK rezulton se&nbsp;<strong>rreth 59% e raportimeve n\u00eb j<\/strong><strong>av\u00ebn e dyt\u00eb (20-26 janar) jan\u00eb me vones\u00eb, p\u00ebrkund\u00ebr 30% t\u00eb evidentuara n\u00eb jav\u00ebn e par\u00eb.&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<p>Specifikisht, nga 152 aktivitete t\u00eb raportuara nga data 20 n\u00eb dat\u00ebn 26 janar 2023, 90 jan\u00eb raportuar me vones\u00eb&nbsp;<em>(p\u00ebr m\u00eb shum\u00eb shih&nbsp;<strong>Lidhjen 1<\/strong>, e cila p\u00ebrmbledh t\u00eb dh\u00ebnat p\u00ebr raportimet me vones\u00eb<\/em><em>, si dhe&nbsp;<strong>Lidhjen 2<\/strong>&nbsp;me list\u00ebn e detajuar t\u00eb k\u00ebtyre aktiviteteve, s\u00eb bashku me t\u00eb dh\u00ebnat p\u00ebrkat\u00ebse referuar nd\u00ebrfaqes s\u00eb aktiviteteve n\u00eb faqen e internetit t\u00eb KQZ-s\u00eb)<\/em>.<\/p>\n\n\n\n<p>Lidhur me k\u00ebto konstatime, KRIIK ju p\u00ebrcjell rekomandimet e tij si m\u00eb posht\u00eb:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>N\u00eb linj\u00eb me rekomandimin n\u00eb Raportin e jav\u00ebs s\u00eb shkuar (13-19 janar), d\u00ebrguar me email m\u00eb dat\u00eb 21.01.2023, KRIIK gjykon&nbsp;<strong>se nevojitet nj\u00eb vendimmarrje e menj\u00ebhershme e KQZ-s\u00eb lidhur me k\u00ebt\u00eb detyrim ligjor<\/strong>, duke qen\u00eb se praktika e ndodhur n\u00eb dy proceset e m\u00ebparshme zgjedhore nga institucionet po vijon dhe respektimi i kuadrit ligjor \u00ebsht\u00eb n\u00eb p\u00ebrkeq\u00ebsim.<\/li><\/ol>\n\n\n\n<p>KRIIK&nbsp;<strong>vler\u00ebson marrjen n\u00eb shqyrtim t\u00eb ecuris\u00eb s\u00eb raportimit prej Komisionerit<\/strong>&nbsp;n\u00eb seanc\u00ebn publike t\u00eb dat\u00ebs 25 janar 2023, si&nbsp;<strong>dhe zotimin se KQZ-ja do t\u00eb kryej\u00eb procedurat e hetimit administrativ<\/strong>&nbsp;p\u00ebr sa \u00ebsht\u00eb konstatuar nga Struktura P\u00ebrgjegj\u00ebse.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Gjithashtu, risillet&nbsp;n\u00eb v\u00ebmendjen tuaj&nbsp;<strong>rekomandimin nr. 3&nbsp;<\/strong><strong>i<\/strong><strong>&nbsp;<\/strong><strong>Dokumentit<\/strong>&nbsp;me&nbsp;Rekomandime t\u00eb p\u00ebrcjell\u00eb tek ju me email-in e dat\u00ebs 25 janar 2023,&nbsp;<strong>lidhur me afatet e parashikuara&nbsp;<\/strong>p\u00ebr raportimin e veprimtarive t\u00eb institucioneve publike.<\/li><\/ol>\n\n\n\n<p>KRIIK, ashtu sikurse administrata e KQZ-s\u00eb, i ka p\u00ebrllogaritur afatet e raportimit prej institucioneve&nbsp;<strong>si dit\u00eb kalendarike<\/strong>,&nbsp;nd\u00ebrkoh\u00eb q\u00eb n\u00eb pjes\u00ebn e kontrollit dhe ndalimit k\u00ebto afate&nbsp;<strong>nevojiten t\u00eb konsiderohen me dit\u00eb pune<\/strong>, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb b\u00ebhet i mundur shqyrtimi administrativ&nbsp;i menj\u00ebhersh\u00ebm&nbsp;prej administrat\u00ebs s\u00eb KQZ-s\u00eb&nbsp;dhe&nbsp;<strong>vendimmarrja&nbsp;<\/strong><strong>n\u00eb koh\u00eb e&nbsp;<\/strong><strong>Komisionerit<\/strong><strong>, pra dy dit\u00eb p\u00ebrpara zhvillimit t\u00eb veprimtaris\u00eb<\/strong>.<\/p>\n\n\n\n<p>Ndaj, konsiderohet se&nbsp;<strong>n<\/strong><strong>evojitet&nbsp;<\/strong><strong>domosdoshm\u00ebrisht&nbsp;<\/strong><strong>q\u00eb KQZ t\u00eb sakt\u00ebsoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb detajuar p\u00ebrllogaritjen e afateve<\/strong>&nbsp;dhe unfikimin n\u00eb parashikim t\u00eb tyre.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Gjithashtu,&nbsp;<strong>KRIIK&nbsp;<\/strong><strong>ju rikujton dhe ju nxit t\u00eb merrni n\u00eb shqyrtim rekomandimin e dyt\u00eb<\/strong>&nbsp;t\u00eb Raportit&nbsp;I&nbsp;t\u00eb jav\u00ebs 13-19 janar, edhe p\u00ebr t\u00eb leht\u00ebsuar pun\u00ebn e KQZ-s\u00eb dhe t\u00eb institucioneve raportuese p\u00ebr ndalimin e aktiviteteve q\u00eb raportohen me vones\u00eb.<\/li><\/ol>\n\n\n\n<p>Sipas tij, gjykohet se&nbsp;<strong>do t\u00eb ishte me vler\u00eb dhe m\u00eb funksionale<\/strong>&nbsp;<strong>q\u00eb n\u00eb sistemin e raportimit t\u00eb integrohej nj\u00eb mekaniz\u00ebm sigurie automatik<\/strong>, i cili n\u00eb momentin q\u00eb nj\u00eb veprimtari raportohet p\u00ebrtej afatit t\u00eb p\u00ebrcaktuar (pra, kur numri i dit\u00ebve mes dat\u00ebs s\u00eb aktivitetit dhe dat\u00ebs s\u00eb raportimit \u00ebsht\u00eb m\u00eb i vog\u00ebl se 5), p\u00ebrdoruesit t\u00eb institucionit p\u00ebrkat\u00ebs t\u2019i shfaqet automatikisht nj\u00eb mesazh se ky aktivitet nuk mund t\u00eb kryhet pasi \u00ebsht\u00eb raportuar jasht\u00eb afatit.<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb konfigurim, sikurse&nbsp;\u00ebsht\u00eb&nbsp;theksuar, duhen t\u00eb parashikohen p\u00ebrjashtimisht rastet kur mund t\u00eb ket\u00eb arsye t\u00eb forta p\u00ebr zhvillimin e aktiviteteve q\u00eb e justifikojn\u00eb kryerjen e tij (p.sh. rastet e emergjencave, apo t\u00eb tjera).<\/p>\n\n\n\n<p>Risjellim n\u00eb v\u00ebmendje se&nbsp;<strong>ndalimi<\/strong><strong>&nbsp;n\u00eb m\u00ebnyr\u00eb automatike i \u00e7do veprimtarie t\u00eb raportuar me vones\u00eb \u00ebsht\u00eb n\u00eb p\u00ebrmbushje t\u00eb sa Komisioneri u ka komunikuar institucioneve n\u00eb dat\u00ebn 12 janar<\/strong>&nbsp;me&nbsp;<a href=\"https:\/\/kqz.gov.al\/2023\/01\/12\/kujtese-mbi-veprimtarine-e-institucioneve-publike-kater-muaj-perpara-dates-se-zgjedhjeve\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cKUJTES\u00cbN \u2013 Mbi veprimtarin\u00eb e institucioneve publike kat\u00ebr muaj p\u00ebrpara dat\u00ebs s\u00eb zgjedhjeve<\/a>\u201d, pika 3.<\/p>\n\n\n\n<p>N\u00eb opinionin e tij, KRIIK gjykon se vonesat, relativizimi dhe moszbatimi i q\u00ebndrimit t\u00eb Komisionerit&nbsp;t\u00eb&nbsp;shprehur qartazi p\u00ebr t\u00eb zbatuar pa ekuivok ligjin, vendos pik\u00ebpyetje p\u00ebr sigurin\u00eb e zbatimit t\u00eb ligjit dhe l\u00eb udh\u00eb p\u00ebr precedent\u00eb t\u00eb tjer\u00eb t\u00eb relativizimit apo moszbatimit t\u00eb ligjit n\u00eb&nbsp;procese t\u00eb tjera mbikqyr\u00ebse n\u00eb&nbsp;vijim.<\/p>\n\n\n\n<p>Zvarritja n\u00eb terma praktik\u00eb, nga nj\u00ebra an\u00eb,&nbsp;n\u00ebp\u00ebrmjet&nbsp;formave&nbsp;t\u00eb ndryshme p\u00ebr ta konsideruar procesin e raportimit si nj\u00eb proces t\u00eb v\u00ebshtir\u00eb&nbsp;e t\u00eb komplikuar, si&nbsp;dhe masiviteti i fenomenit t\u00eb shkeljeve, nga ana tjet\u00ebr,&nbsp;<strong>me q\u00ebllim&nbsp;<\/strong><strong>p\u00ebr ta relativizuar dhe b\u00ebr\u00eb&nbsp;<\/strong><strong><em>de facto&nbsp;<\/em><\/strong><strong>ligjin&nbsp;<\/strong><strong>t\u00eb pazbatuesh\u00ebm<\/strong>, nuk \u00ebsht\u00eb nj\u00eb qasje risi,&nbsp; ndaj&nbsp;n\u00eb gjykimin e KRIIK,&nbsp;ky&nbsp;<strong>fenomen&nbsp;<\/strong><strong>duhet t\u00eb ndalohet prerazi nga KQZ<\/strong>-ja.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>N\u00ebse punonj\u00ebsit e ngarkuar me raportimin jan\u00eb t\u00eb paaft\u00eb n\u00eb menaxhimin e procesit dhe p\u00ebrdorimin e teknologjis\u00eb, KQZ-ja p\u00ebrpos marrjes s\u00eb masave t\u00eb k\u00ebrkuara nga ligji,&nbsp;<strong>duhet t\u00eb k\u00ebrkoj\u00eb menj\u00ebher\u00eb z\u00ebvend\u00ebsimin e tyre m\u00eb n\u00ebpun\u00ebs q\u00eb plot\u00ebsojn\u00eb kriteret e nevojshme dhe kan\u00eb kapacitetin<\/strong>&nbsp;p\u00ebr t\u00eb kryer nj\u00eb proces raportimi n\u00eb nd\u00ebrfaqen e KQZ-s\u00eb.<\/li><\/ol>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Nga ana tjet\u00ebr, p\u00ebr t\u00eb&nbsp;<strong>evituar \u00e7do lloj paqart\u00ebsie<\/strong>&nbsp;q\u00eb mund t\u00eb pretendohet si dhe p\u00ebr&nbsp;unifikuar praktikisht m\u00ebnyr\u00ebn e&nbsp;detajuar t\u00eb&nbsp;raportimit,&nbsp;<strong>nxitet&nbsp;<\/strong><strong>KQZ-ja&nbsp;<\/strong><strong>q\u00eb t\u00eb organizoj\u00eb nj\u00eb trajnim online dhe n\u00eb terma praktik\u00eb me t\u00eb gjith\u00eb n\u00ebpun\u00ebsit e ngarku<\/strong><strong>a<\/strong><strong>r<\/strong>&nbsp;p\u00ebr t\u00eb kryer raportimin,&nbsp;p\u00ebrfshir\u00eb n\u00ebpun\u00ebsit e parashikuar si z\u00ebvend\u00ebsues t\u00eb k\u00ebtyre t\u00eb fundit n\u00eb rast nevoje, nga t\u00eb gjith\u00eb institucionet objekt t\u00eb ligjit.<\/li><\/ol>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>Madje, nisur nga praktika e&nbsp;krijuar p\u00ebr&nbsp;gjoja&nbsp;\u201cpazbatueshm\u00ebrin\u00eb&nbsp;e&nbsp;mekanizmit\u201d dhe&nbsp;situata n\u00eb t\u00ebr\u00ebsi e ligjzbatimit prej institucioneve e titullar\u00ebve t\u00eb tyre n\u00eb vend,&nbsp;KRIIK rekomandon&nbsp;se \u00ebsht\u00eb&nbsp;<strong>e nevojshme t\u00eb organizohet e zhvillohet&nbsp;<\/strong><strong>edhe nj\u00eb sesion informimi p\u00ebr titullar\u00ebt&nbsp;<\/strong><strong>e institucioneve&nbsp;<\/strong>si p\u00ebrgjegj\u00ebs direkt p\u00ebr procesin e raportimit prej institucioneve p\u00ebrkat\u00ebse,<strong>apo&nbsp;<\/strong><strong>p\u00ebr&nbsp;<\/strong><strong>stafet e ngushta t\u00eb tyre<\/strong><strong>&nbsp;\/ k\u00ebshilltar\u00ebt \/ asistent\u00ebt e tyre<\/strong>.<\/li><\/ol>\n\n\n\n<p>Ky trajnim duhet t\u00eb informoj\u00eb e siguroj\u00eb, s\u00eb pari, titullar\u00ebt mbi vullnetin e plot\u00eb t\u00eb KQZ-s\u00eb p\u00ebr zbatimin e ligjit n\u00eb funksionimin e mekanizmit t\u00eb raportimit dhe mbikqyrjes s\u00eb aktiviteteve, vullnet i cili duhet t\u00eb nxitet p\u00ebr tu transmetuar prej tyre n\u00eb administratat p\u00ebrkat\u00ebse n\u00eb var\u00ebsi.<\/p>\n\n\n\n<p>S\u00eb dyti, paraqitet e nevojshme t\u00eb b\u00ebhet nj\u00eb informim i zgjeruar mbi tipologjin\u00eb e rasteve \/ aktiviteteve q\u00eb duhen raportuar, atyre q\u00eb ndalohen, si dhe t\u00eb mund t\u00eb orientohen p\u00ebr unifikimin e m\u00ebnyrave t\u00eb raportimit.<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\" start=\"2\"><li><strong>Veprimtari publike t\u00eb zhvilluara, por t\u00eb paraportuara<\/strong><\/li><\/ol>\n\n\n\n<p>Bazuar n\u00eb nj\u00eb monitorim jo sistematik t\u00eb faqeve t\u00eb disa institucioneve n\u00eb mediat sociale dhe t\u00eb mediave, KRIIK ka evidentuar se, gjat\u00eb periudh\u00ebs 20 \u2013 26 janar 2023, s\u00eb paku 21 veprimtari publike t\u00eb nd\u00ebrlidhura me 24 institucione q\u00eb bartin detyrimin e raportimit, rezultojn\u00eb se nuk jan\u00eb raportuar n\u00eb nd\u00ebrfaqen e KQZ-s\u00eb<em>.&nbsp;<\/em>Numri i institucioneve \u00ebsht\u00eb m\u00eb i lart\u00eb se ai i aktiviteteve p\u00ebr shkak se n\u00eb tre aktivitete ka m\u00eb shum\u00eb se nj\u00eb institucion&nbsp;t\u00eb p\u00ebrfshir\u00eb, por aktiviteti \u00ebsht\u00eb i nj\u00ebjti.<\/p>\n\n\n\n<p><em>(p\u00ebr m\u00eb tep\u00ebr gjeni bashk\u00eblidhur&nbsp;<strong>Lidhjen nr. 3<\/strong>&nbsp;me list\u00ebn e k\u00ebtyre aktiviteteve s\u00eb bashku me informacione shtes\u00eb t\u00eb pasqyrimeve mediatike q\u00eb provojn\u00eb realizimin e tyre).<\/em><\/p>\n\n\n\n<p>Lidhur me k\u00ebt\u00eb konstatim, KRIIK risjell n\u00eb v\u00ebmendjen tuaj se:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Konstatimi bazohet n\u00eb gjykimin se k\u00ebto aktivitete nuk jan\u00eb raportuar pasi nuk pasqyrohen n\u00eb informacionin e b\u00ebr\u00eb publik n\u00eb faqen e KQZ-s\u00eb.<\/li><\/ul>\n\n\n\n<p>N\u00eb prezantimin e raportit t\u00eb b\u00ebr\u00eb nga Struktura p\u00ebrgjegj\u00ebse e KQZ-s\u00eb n\u00eb seanc\u00ebn e mbledhjes s\u00eb 25.01.2023, u deklarua se pas dat\u00ebs 19 janar, pjesa d\u00ebrmuese e institucioneve e kan\u00eb adresuar leht\u00ebsisht nd\u00ebrfaqen.<\/p>\n\n\n\n<p><strong>Nd\u00ebrkoh\u00eb, e<\/strong><strong>dhe n\u00ebse institucionet&nbsp;<\/strong><strong>mund t\u00eb&nbsp;<\/strong><strong>k<\/strong><strong>e<\/strong><strong>n\u00eb ndeshur<\/strong><strong>&nbsp;s\u00ebrish<\/strong><strong>&nbsp;probleme me aksesin n\u00eb sistemin e raportimit, gjykohet se mosraportimi i veprimtarive nuk mund t\u00eb justifikohet n\u00eb asnj\u00eb rrethan\u00eb,&nbsp;<\/strong>pasi institucionet mund t\u00eb kishin raportuar me e-mail, sikurse parashikohet qart\u00eb n\u00eb udh\u00ebzimet e KQZ-s\u00eb.<\/p>\n\n\n\n<p>Nga ana tjet\u00ebr, n\u00ebse njoftimi \u00ebsht\u00eb kryer prej institucionit, postimi duhet t\u00eb ishte hedhur n\u00eb m\u00ebnyr\u00eb t\u00eb menj\u00ebhershme dhe t\u00eb pasqyrohej nga administrata e KQZ-s\u00eb n\u00eb faqen e internetit.<\/p>\n\n\n\n<p>Raportimi mbi veprimtarit\u00eb dhe gjykimi mbi to, nuk mund t\u00eb limitohet vet\u00ebm n\u00eb njoftimin e KQZ-s\u00eb, pasi jo m\u00eb kot&nbsp;<strong>ligji parashikon publikimin e menj\u00ebhersh\u00ebm n\u00eb faqen e internetit p\u00ebr opinionin publik<\/strong>, nd\u00ebrkoh\u00eb q\u00eb ky moment p\u00ebrb\u00ebn edhe faktin publik t\u00eb nisjes s\u00eb afateve p\u00ebr proceset monitoruese t\u00eb parashikuara n\u00eb vijim.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Me shum\u00eb gjas\u00eb numri i aktiviteteve t\u00eb pa raportuara duhet t\u00eb jet\u00eb m\u00eb i lart\u00eb, pasi si\u00e7 u citua m\u00eb sip\u00ebr, aktivitetet e gjetura bazohen n\u00eb nj\u00eb monitorim t\u00eb kryer n\u00eb m\u00ebnyr\u00eb jo sistematike.<\/li><\/ul>\n\n\n\n<p>Bazuar n\u00eb sa m\u00eb sip\u00ebr, duke qen\u00eb se situata mbetet e nj\u00ebjt\u00eb, KRIIK risjell rekomandimin e paraqitur tanim\u00eb n\u00eb Raportin e par\u00eb se \u201cnevojitet q\u00eb&nbsp;<strong>KQZ-ja n\u00ebp\u00ebrmjet vendimmarjeve institucionale t\u00eb siguroj\u00eb dhe propogandoj\u00eb zbatimin pa ekuivok t\u00eb ligjit<\/strong>, nd\u00ebrkoh\u00eb q\u00eb duhet t\u00eb rris\u00eb m\u00ebnyrat e nd\u00ebrgjegj\u00ebsimit paraprakisht p\u00ebr zbatimin e detyrimeve ligjore t\u00eb parashikuara p\u00ebr tu
