{"id":1693,"date":"2023-01-25T22:51:00","date_gmt":"2023-01-25T21:51:00","guid":{"rendered":"https:\/\/kriik.al\/home\/?p=1693"},"modified":"2023-09-01T15:59:01","modified_gmt":"2023-09-01T13:59:01","slug":"rekomandime-lidhur-me-projekt-aktet-per-kamerat-regjistruese-ne-vnv-dhe-akreditimin-e-vezhguesve-jopolitike","status":"publish","type":"post","link":"https:\/\/kriik.al\/home\/2023\/01\/25\/rekomandime-lidhur-me-projekt-aktet-per-kamerat-regjistruese-ne-vnv-dhe-akreditimin-e-vezhguesve-jopolitike\/","title":{"rendered":"REKOMANDIME &#8211; lidhur me projekt aktet p\u00ebr kamerat regjistruese n\u00eb VNV dhe akreditimin e v\u00ebzhguesve jopolitik\u00eb"},"content":{"rendered":"\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p class=\"has-text-align-center\"><strong>Shkarko <a href=\"https:\/\/kriik.al\/home\/wp-content\/uploads\/2023\/01\/KRIIK-REKOMANDIME-Lidhur-me-projekt-aktet-e-KQZ-per-kamerat-regjistruese-ne-VNV-dhe-akreditimin-e-vezhguesve-jopolitike-20230125.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">dokumentin<\/a> e derguar KQZ-se<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p>Koalicioni p\u00ebr Reforma, Integrim dhe Institucione t\u00eb Konsoliduara (KRIIK) ka ndjekur n\u00eb vijim\u00ebsi gjith\u00eb procesin e vendimmarrjes administrative n\u00eb KQZ, duke u p\u00ebrpjekur t\u00eb jap\u00eb kontributin e vet n\u00ebp\u00ebrmjet rekomandimeve apo sugjerimeve konkrete p\u00ebrgjat\u00eb procesit t\u00eb konsultimit paraprak t\u00eb projekt-akteve t\u00eb d\u00ebrguara nga KQZ, apo edhe p\u00ebr projektakte t\u00eb tjera p\u00ebr t\u00eb cilat vler\u00ebsohet se nevojiten t\u2019iu b\u00ebhen p\u00ebrmir\u00ebsime t\u00eb m\u00ebtejshme.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Duke vler\u00ebsuar maksimalisht gatishm\u00ebrin\u00eb dhe fleksibilitetin e treguar nga KQZ n\u00eb k\u00ebt\u00eb proces, KRIIK gjen rastin te shprehe edhe nj\u00ebher\u00eb fal\u00ebnderimet e tij p\u00ebr t\u00ebr\u00eb k\u00ebt\u00eb bashk\u00ebpunim t\u00eb frytsh\u00ebm t\u00eb arritur deri m\u00eb tani.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb kuad\u00ebr t\u00eb k\u00ebtij procesi, sjellim n\u00eb kujtes\u00eb te KQZ-se se m\u00eb dat\u00eb 10 janar 2023, KRIIK ka d\u00ebrguar nj\u00eb <a href=\"https:\/\/kriik.al\/home\/wp-content\/uploads\/2023\/01\/KRIIK-Propozime-per-reflektime-te-kuadrit-ligjor-nga-KQZ.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Dokument me Rekomandime p\u00ebr p\u00ebrmir\u00ebsimin e kuadrit rregullator ligjor p\u00ebr zgjedhet vendore 2023<\/a> lidhur me disa \u00e7\u00ebshtje si:&nbsp;&nbsp;<\/p>\n\n\n\n<p>1) Listat e zgjedh\u00ebsve; 2) Regjistrimi i subjekteve zgjedhore dhe kandidat\u00ebve; 3) Monitorimi i medias; 4) Komisionet Zonale t\u00eb Administrimit Zgjedhor; 5) V\u00ebzhguesit; 6) Parandalimi i abuzimit me burimet shtet\u00ebrore; 7) Financimi i subjekteve zgjedhore dhe 8) Auditimi pas zgjedhor.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Theksohet se rekomandimet e paraqitura n\u00eb Dokument jan\u00eb nd\u00ebr konsideratat m\u00eb kryesore t\u00eb KRIIK n\u00eb raport me k\u00ebto \u00e7\u00ebshtje, nd\u00ebrkoh\u00eb q\u00eb m\u00eb t\u00eb plota apo edhe t\u00eb tjera rreth tyre do t\u00eb paraqiten n\u00eb momentin q\u00eb KQZ-ja do t\u00eb konsideroj\u00eb dhe nd\u00ebrmarr\u00eb rishikimin e akteve rregullatore p\u00ebrkat\u00ebse.&nbsp;<\/p>\n\n\n\n<p>Duke konsideruar rendin e dit\u00ebs t\u00eb njoftuar p\u00ebr seancat publike q\u00eb do t\u00eb mbahen n\u00eb dat\u00ebn 25.01.2023 nga Komisioneri Shtet\u00ebror i Zgjedhjeve dhe Komisioni Rregullator, si dhe duke shmangur rekomandimet lidhur me v\u00ebzhguesit politik\u00eb (disa prej tyre pasqyrohen n\u00eb Dokumentin e lartp\u00ebrmendur), p\u00ebr t\u00eb cil\u00ebt parashikohet t\u00eb ket\u00eb nj\u00eb akt tjet\u00ebr n\u00ebnligjor,&nbsp;&nbsp;<\/p>\n\n\n\n<p>KRIIK konsideron me vend p\u00ebrcjelljen e rekomandimeve t\u00eb m\u00ebposhtme, t\u00eb cilat gjykohen se jan\u00eb me shum\u00eb r\u00ebnd\u00ebsi t\u00eb merren n\u00eb konsiderat\u00eb dhe t\u00eb shqyrtohen prej jush.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong><em>Konkretisht:\u202f&nbsp;<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p><strong>1. Lidhur me projekt-aktin<\/strong><strong><em> \u201cRregullat procedurale p\u00ebr p\u00ebrdorimin e kamerave regjistruese e monitor\u00ebve (ekraneve) n\u00eb vendet e num\u00ebrimit t\u00eb votave dhe transmetimin n\u00eb koh\u00eb reale nga vendet e num\u00ebrimit t\u00eb votave n\u00eb ambientet e Komisionit Qendror t\u00eb Zgjedhjeve\u201d.<\/em><\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb pik\u00ebn 3 t\u00eb vendimit parashikohet se \u201c<em>Administrata e KQZ-s\u00eb, ose kur \u00ebsht\u00eb e mundur edhe Komisioni i Zon\u00ebs s\u00eb Administrimit Zgjedhor, riprodhon dhe v\u00eb n\u00eb dispozicion t\u00eb subjekteve zgjedhore, me k\u00ebrkes\u00eb t\u00eb tyre, kopje t\u00eb materialit t\u00eb regjistruar nga kamerat e tavolinave kundrejt pages\u00ebs s\u00eb nj\u00eb tarife q\u00eb mbulon koston e riprodhimit<\/em>&#8230;\u201d .&nbsp;<\/p>\n\n\n\n<p>Nd\u00ebrkoh\u00eb, n\u00eb pik\u00ebn 6 t\u00eb tij parashikohet se \u201c<em>Regjistrimi filmik (video) i procesit t\u00eb num\u00ebrimit t\u00eb votave nga kamerat e vrojtimit n\u00eb VNV, t\u00eb cilat p\u00ebrmbajn\u00eb t\u00eb dh\u00ebna personale i vihen n\u00eb dispozicion vet\u00ebm organeve ligjzbatuese me k\u00ebrkes\u00eb t\u00eb tyre<\/em>\u201d.&nbsp;<\/p>\n\n\n\n<p>N\u00eb referenc\u00eb t\u00eb Ligjit Nr. 9887, dat\u00eb 10.3.2008 \u201cP\u00ebr mbrojtjen e t\u00eb dh\u00ebnave personale\u201d, neni 2 pika 1 \u201c <em>\u2018T\u00eb dh\u00ebna personale\u2019 \u00ebsht\u00eb \u00e7do informacion n\u00eb lidhje me nj\u00eb person fizik, t\u00eb identifikuar ose t\u00eb identifikuesh\u00ebm, direkt ose indirekt, n\u00eb ve\u00e7anti duke iu referuar nj\u00eb numri identifikimi ose nj\u00eb a m\u00eb shum\u00eb faktor\u00ebve t\u00eb ve\u00e7ant\u00eb p\u00ebr identitetin e tij fizik, fiziologjik, mendor, ekonomik, kulturor apo social<\/em>\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Duke patur n\u00eb konsiderat\u00eb baz\u00ebn ligjore mbi t\u00eb dh\u00ebnat personale dhe <a href=\"https:\/\/www.idp.al\/wp-content\/uploads\/2016\/11\/udherrefyes_per_subjektet_e_te_dhenave_85_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Udh\u00ebzuesin e Komisionerit p\u00ebr t\u00eb Drejt\u00ebn e Informimit dhe Mbrojtjen e t\u00eb Dh\u00ebnave Personale<\/a>, i cili p\u00ebrkufizon \u00e7far\u00eb jan\u00eb t\u00eb dh\u00ebna personale n\u00eb m\u00ebnyr\u00eb shteruese, e dh\u00ebn\u00eb personale, nd\u00ebr t\u00eb tjera,\u202f mund t\u00eb konsiderohet edhe fotografia e personit, emri, mbiemri, gjeometria e fytyr\u00ebs ose duarve, etj. (faqe 4 e Udh\u00ebzuesit).&nbsp;&nbsp;<\/p>\n\n\n\n<p>Disa nga k\u00ebto t\u00eb dh\u00ebna mundet gabimisht apo q\u00ebllimisht t\u00eb filmohen dhe regjistrohen prej kamerave n\u00eb tavolinat e num\u00ebrimit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nj\u00eb rast i till\u00eb do ta b\u00ebnte t\u00eb pazbatuesh\u00ebm t\u00eb drejt\u00ebn e subjekteve zgjedhor\u00eb t\u00eb sanksionuar edhe n\u00eb pik\u00ebn 3 t\u00eb aktit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Nj\u00eb situat\u00eb e till\u00eb, c\u00ebnon n\u00eb m\u00ebnyr\u00eb t\u00eb padiskutueshme, jo vet\u00ebm transparenc\u00ebn e procesit, por edhe t\u00eb drejt\u00ebn e subjekteve zgjedhore p\u00ebr ta patur k\u00ebt\u00eb informacion dhe p\u00ebrdorur at\u00eb sipas nevojave, duke filluar s\u00eb pari n\u00eb procesin ankimues t\u00eb asaj q\u00eb konsiderohet drejt\u00ebsia zgjedhore.&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, regjistrimet video nga kamerat 360\u00ba t\u00eb vendosura n\u00eb VNV p\u00ebrmbajn\u00eb automatikisht t\u00eb dh\u00ebna personale t\u00eb t\u00eb gjith\u00eb personave q\u00eb jan\u00eb prezent\u00eb n\u00eb VNV (pamje t\u00eb tyre) e ndofta mund t\u00eb p\u00ebrmbajn\u00eb edhe element\u00eb t\u00eb tjer\u00eb.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Neni 6 i aktit e b\u00ebn k\u00ebt\u00eb proces filmimi dhe regjistrimi t\u00eb dobish\u00ebm vet\u00ebm n\u00eb funksion t\u00eb rastit kur ato do t\u00eb k\u00ebrkohen nga organet ligjzbatuese<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Madje, sipas Lidhjes 1 q\u00eb i bashkangjitet aktit, edhe vet\u00eb KQZ-ja, megjith\u00ebse do t\u00eb krijoj\u00eb n\u00eb ambientet e saj mund\u00ebsi monitorimi t\u00eb nj\u00ebkohsh\u00ebm t\u00eb procesit t\u00eb num\u00ebrimit n\u00eb 8 tavolina dhe n\u00eb ambientet e 8 VNV-ve, <strong>do t\u00eb ket\u00eb mund\u00ebsi t\u00eb shikoj\u00eb imazhet e filmuara vet\u00ebm n\u00eb rastet kur paraqitet ndonj\u00eb problematik\u00eb ose kur kjo do t\u00eb k\u00ebrkohet nga KQZ-ja <\/strong>me akt t\u00eb Komisionerit Shtet\u00ebror.&nbsp;<\/p>\n\n\n\n<p>Nga gjith\u00eb sa m\u00eb sip\u00ebr, duket se t\u00ebr\u00eb investimi i kushtuesh\u00ebm i dakord\u00ebsuar politikisht p\u00ebr tu shpenzuar n\u00eb teknologji p\u00ebr t\u00eb rritur transparenc\u00ebn e procesit n\u00eb koh\u00eb reale, b\u00ebhet totalisht i padobish\u00ebm n\u00eb raport me at\u00eb q\u00eb kjo transparenc\u00eb n\u00eb koh\u00eb reale, nd\u00ebrlidhur me procese t\u00eb tjera q\u00eb mund t\u00eb nxis\u00eb dhe mb\u00ebshtes\u00eb, ofron p\u00ebr t\u00eb p\u00ebrmir\u00ebsuar integritetit e procesit zgjedhor, dhe konkretisht, p\u00ebr t\u00eb siguruar q\u00eb procesi i num\u00ebrimit nuk do t\u00eb c\u00ebnoj\u00eb n\u00eb asnj\u00eb rast vullnetin e shprehur tashm\u00eb t\u00eb sovranit e t\u00eb depozituar n\u00eb kutit\u00eb e votimit.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kufizimi i t\u00eb mirave madhore t\u00eb transparenc\u00ebs, p\u00ebrfshir\u00eb indiciet\/provat e mundshme t\u00eb ofruara nga teknologjia e investuar,\u202f vet\u00ebm si nj\u00eb proces post-factum, \u00ebsht\u00eb s\u00eb pari n\u00eb kund\u00ebrshtim me t\u00ebr\u00eb aspiratat e shprehura dhe dakord\u00ebsuar gjat\u00eb procesit reformues t\u00eb kuadrit ligjor mbi standardet e procesit zgjedhor e t\u00eb shprehura si frym\u00eb e g\u00ebrm\u00eb n\u00eb Kodin Zgjedhor.&nbsp;<\/p>\n\n\n\n<p>Nga ana tjet\u00ebr, ky proces shqyrtimi post-factum n\u00eb t\u00ebr\u00ebsin\u00eb e p\u00ebrvojave t\u00eb procesit t\u00eb ankimim\/apelimeve p\u00ebrgjat\u00eb procesit t\u00eb drejt\u00ebsis\u00eb zgjedhore, ka treguar se \u00ebsht\u00eb totalisht joefi\u00e7ent dhe ka vuajtur nga shkelja e ligjit, dhe anshm\u00ebria poltike, diskrecionet e tepruara shpesh ekstraligjore apo tendenca p\u00ebr t\u00eb mbyllur \u00e7do proces ankimues i cili mund t\u00eb b\u00ebj\u00eb pis rezultatin apo edhe vet\u00eb procesin zgjedhor, tashm\u00eb t\u00eb \u00e7ertifikuar.&nbsp;<\/p>\n\n\n\n<p>P\u00ebr gjith\u00eb sa m\u00eb sip\u00ebr parashtrohet dhe nisur nga fakti se KQZ-ja parashikon se <em>ky projektvendim \u00ebsht\u00eb i natyr\u00ebs normative dhe p\u00ebr k\u00ebt\u00eb arsye propozohet q\u00eb procedurat t\u00eb jen\u00eb t\u00eb aplikueshme p\u00ebr t\u00eb gjith\u00eb proceset zgjedhore<\/em>.<\/p>\n\n\n\n<p><strong>Koalicioni p\u00ebr Reforma, Integrim dhe Institucione t\u00eb Konsoliduara<\/strong><strong> (KRIIK) <\/strong><strong>:&nbsp;<\/strong>&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebm\u00ebndje se kufizimi i parashikuar n\u00eb \u00f6pik\u00ebn 6 t\u00eb projektaktit nuk gjendet i shprehur shprehimisht n\u00eb Kodin Zgjedhor;&nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebmendje parashikimin e b\u00ebr\u00eb n\u00eb nenin 22, pika 2 t\u00eb Kodit Zgjedhor ku autorizohet KQZ-ja p\u00ebr t\u00eb instaluar dhe p\u00ebrdorur sistemet e videomonitorimit n\u00eb VNV-t\u00eb p\u00ebr t\u00eb monitoruar dhe provuar rregullshm\u00ebrin\u00eb e procesit n\u00eb mjediset e brendshme t\u00eb tyre. Pra KQZ-ja p\u00ebrdor filmimin p\u00ebr t\u00eb monitoruar ecurin\u00eb dhe provuar se kjo ecuri \u00ebsht\u00eb n\u00eb \u00e7do hap e rregullt dhe n\u00eb p\u00ebrputhje me ligjshm\u00ebrin\u00eb, \u00e7ka do t\u00eb thot\u00eb se monitorimi duhet t\u00eb jet\u00eb i pand\u00ebrprer\u00eb dhe n\u00eb koh\u00eb reale prej KQZ-s\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb parandaloj\u00eb apo ndaloj\u00eb n\u00eb koh\u00eb \u00e7do shkelje t\u00eb mundshme q\u00eb mund t\u00eb v\u00ebrehet, e cila mund t\u00eb c\u00ebnoj\u00eb integritetin e procesit.&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p>Kjo <strong>e drejt\u00eb dhe detyrim i KQZ-s\u00eb nuk mund t\u00eb limitohet<\/strong> vet\u00ebm at\u00ebher\u00eb kur ka problematika, kur nd\u00ebrkoh\u00eb k\u00ebto t\u00eb fundit evidentohen dhe nxiten vet\u00ebm at\u00ebher\u00eb kur pal\u00ebt politike kryesore t\u00eb p\u00ebrfaq\u00ebsuara n\u00eb komisionet zgjedhore, n\u00ebp\u00ebrmjet komisioner\u00ebve t\u00eb tyre, nuk gjejn\u00eb dakord\u00ebsi dhe krijojn\u00eb p\u00ebrplasje p\u00ebr \u00e7\u00ebshtje nga nga m\u00eb t\u00eb ndryshmet, qoft\u00eb p\u00ebrmbajt\u00ebsisht qoft\u00eb artificialisht.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Monitorimi dhe aksesi i KQZ-s\u00eb duhet t\u00eb jet\u00eb i pand\u00ebrprer\u00eb, edhe n\u00eb rastet kur nuk raportohen problematika,<\/strong> por pal\u00ebt kan\u00eb gjetur gjuh\u00ebn e p\u00ebrbashk\u00ebt dhe i kan\u00eb mbyllur problemet midis tyre. Pasi shpesh kjo dakord\u00ebsi , sikurse \u00ebsht\u00eb b\u00ebr\u00eb e ditur nga v\u00ebzhguesit \u00ebsht\u00eb n\u00eb c\u00ebnim t\u00eb integritetit t\u00eb procesit n\u00eb vetvete dhe t\u00eb paprekshm\u00ebris\u00eb s\u00eb vullnetit t\u00eb votuesit, si dhe n\u00eb c\u00ebnim t\u00eb t\u00eb drejtave t\u00eb subjekteve t\u00eb tjera zgjedhore apo kandidat\u00ebve.&nbsp;<\/p>\n\n\n\n<p><strong>Kjo e drejt\u00eb, detyrim dhe m\u00ebnyr\u00eb kontrolli e KQZ-s\u00eb, automatikisht b\u00ebhet e detyrueshme p\u00ebr tu monitoruar dhe ndar\u00eb edhe me aktor\u00ebt v\u00ebzhgues t\u00eb procesit si dhe me subjektet elektorale pjes\u00ebmarr\u00ebse n\u00eb proces.<\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb fjalin\u00eb pasardh\u00ebse t\u00eb pik\u00ebs 2 t\u00eb nenit 22, <strong>ligji parashikon t\u00eb vetmin kufizim n\u00eb k\u00ebt\u00eb proces t\u00eb ngarkuar ndaj KQZ-s\u00eb<\/strong>, pra q\u00eb \u201csistemi i videomonitorimit nuk mund t\u00eb instalohet n\u00eb qendrat e votimit n\u00eb m\u00ebnyr\u00eb t\u00eb till\u00eb q\u00eb t\u00eb cenoj\u00eb ose t\u00eb rrezikoj\u00eb kryerjen n\u00eb fsheht\u00ebsi t\u00eb votimit\u201d.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebmendje se ky kufizim nuk ka qen\u00eb i parashikuar n\u00eb aktet e m\u00ebparshme t\u00eb rregullimit t\u00eb k\u00ebtij procesi prej Komisionit Rregullator dhe p\u00ebrkat\u00ebsisht n\u00eb Vendimin nr. 8, dat\u00eb 14.12.2020 <em>\u201cP\u00ebr p\u00ebrdorimin e kamerave regjistruese dhe t\u00eb monitor\u00ebve p\u00ebr shfaqjen e flet\u00ebve t\u00eb votimit \u00eb Vendet e Num\u00ebrimit t\u00eb Votave n\u00eb zgjedhjet p\u00ebr Kuvend, t\u00eb dat\u00ebs 25 prill 2021\u201d<\/em> dhe n\u00eb Vendimin nr. 01, dat\u00eb 22.01.2021 <em>\u201cP\u00ebr rregullat proceduriale p\u00ebr p\u00ebrdorimin e kamerave regjistruese e monitor\u00ebve (ekraneve) n\u00eb Vendet e Num\u00ebrimit t\u00eb Votave\u201d.<\/em>&nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebmendje se mbetet detyr\u00eb e KQZ-s\u00eb q\u00eb t\u00eb b\u00ebj\u00eb p\u00ebrpjekje maksimale e t\u00eb ket\u00eb qasje proaktive, brenda kuadrit ligjor ekzistues, p\u00ebr t\u00eb parashikuar t\u00eb gjitha situatat e mundshme q\u00eb mund t\u00eb \u00e7ojn\u00eb n\u00eb c\u00ebnimin e integritetit t\u00eb procesit, nisur nga p\u00ebrvojat e m\u00ebparshme negative dhe raportet e v\u00ebzhgimit nd\u00ebrkomb\u00ebtare e vendase, dhe b\u00ebr\u00eb adresimet e duhura n\u00eb kuadrin rregullator.&nbsp;<\/li><\/ul>\n\n\n\n<p>Gjithashtu, n\u00eb veprimtarin\u00eb e tyre, <strong>t\u00eb tre organet drejtuese t\u00eb KQZ-s\u00eb dhe administrata e saj nevojitet t\u00eb ken\u00eb si objektiv madhor e prioritar t\u00eb drejtat dhe lirit\u00eb kushtetuese t\u00eb shtetasve<\/strong>, mbrojtjen e vot\u00ebs dhe mosc\u00ebnimin e vullnetit t\u00eb shprehur, si zgjedhore, qoft\u00eb kandidat\u00eb apo edhe t\u00eb tret\u00eb, p\u00ebrgjat\u00eb ecuris\u00eb s\u00eb procesit zgjedhor, p\u00ebrfshir\u00eb procesin e drejt\u00ebsis\u00eb zgjedhore.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>KQZ-ja duhet t\u00eb shmang\u00eb dhe mosndjek<\/strong><strong>\u00eb<\/strong><strong> n\u00eb asnj\u00eb rast praktik\u00ebn e ndjekur nga KQZ-t\u00eb e m\u00ebparshme p\u00ebr t\u00eb kryer nj\u00eb proces fiktiv shqyrtimi ankesash e problematikash<\/strong> t\u00eb paraqitura, duke u dakord\u00ebsuar n\u00eb nivel politik p\u00ebr mbylljen me procedur\u00eb t\u00eb tyre, me vet\u00ebm nj\u00eb q\u00ebllim, konkludimin sa m\u00eb shpejt\u00eb t\u00eb procesit zgjedhor dhe mosb\u00ebrjen pis t\u00eb tij;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebmendje se aplikimi i teknologjis\u00eb prezumohet t\u00eb siguroj\u00eb transparenc\u00eb n\u00eb shkall\u00eb t\u00eb lart\u00eb, mund\u00ebsi kontrolli nga t\u00eb gjith\u00eb subjektet garuese e aktor\u00ebt v\u00ebzhgues, e rrjedhimisht t\u00eb nxis\u00eb dhe rris\u00eb besimin e qytetar\u00ebve n\u00eb rradh\u00eb t\u00eb par\u00eb, por edhe t\u00eb t\u00eb gjith\u00eb aktor\u00ebve pjes\u00ebmarr\u00ebs n\u00eb zgjedhje, si:\u202f parti politike, ve\u00e7an\u00ebrisht ato t\u00eb cilat nuk kan\u00eb an\u00ebtar\u00eb n\u00eb Grupet e Num\u00ebrimit t\u00eb Votave, ato q\u00eb nuk kan\u00eb v\u00ebzhgues apo mund\u00ebsi p\u00ebr t\u00eb mbuluar t\u00ebr\u00eb VNV-t\u00eb me t\u00eb till\u00eb;\u202f kandidat\u00ebt e t\u00eb gjith\u00eb subjekteve ve\u00e7an\u00ebrisht n\u00eb rastin e zgjedhjeve parlamentare, p\u00ebrsa i p\u00ebrket leximit t\u00eb drejt\u00eb t\u00eb votimit preferencial, t\u00eb v\u00ebzhguesve, etj;&nbsp;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebmendje se dh\u00ebnia e s\u00eb drejt\u00ebs p\u00ebr t\u00eb patur regjistrimet vet\u00ebm t\u00eb tavolinave t\u00eb num\u00ebrimit, pa u shoq\u00ebruar edhe me ato t\u00eb vrojtimit t\u00eb ambientit p\u00ebrreth, t\u00eb cilat duhet t\u00eb sigurojn\u00eb se kutit\u00eb e votimit dhe flet\u00ebt e votimit nuk jan\u00eb prekur deri n\u00eb momentin e shfaqjes s\u00eb tyre n\u00eb tavolinat e num\u00ebrimit, \u00ebsht\u00eb nj\u00eb process i paplot\u00eb, i p\u00ebrgjysmuar dhe fiktiv.&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p>Kamerat duhet t\u00eb filmojn\u00eb dhe transmetojn\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb pand\u00ebrprer\u00eb, 24 or\u00eb rresht, t\u00eb gjith\u00eb ambientin e VNV-s\u00eb, duke siguruar mosc\u00ebnimin n\u00eb asnj\u00eb form\u00eb t\u00eb materialeve zgjedhore.&nbsp;<\/p>\n\n\n\n<p>P\u00ebrvojat e m\u00ebparshme t\u00eb zgjedhjeve jan\u00eb alarmante n\u00eb k\u00ebt\u00eb drejtim. P\u00ebrmendim rastet kur v\u00ebzhgues t\u00eb partive politike q\u00ebndronin n\u00eb m\u00ebnyr\u00eb t\u00eb pand\u00ebrprer\u00eb me dit\u00eb t\u00eb t\u00ebra n\u00eb VNV, pavar\u00ebsisht se GNV-t\u00eb mund t\u00eb ishin n\u00eb pushim, apo rastet e zgjedhjeve 2021, ku komisioner\u00ebt n\u00eb ambientet e VNV-ve n\u00eb prezenc\u00eb edhe t\u00eb komisioner\u00ebve t\u00eb tjer\u00eb nd\u00ebrhynin e b\u00ebnin sh\u00ebnime n\u00eb flet\u00ebt e votimit. K\u00ebto t\u00eb fundit u zbuluan e b\u00ebn\u00eb publike nga kamerat vrojtuese dhe jo ato t\u00eb tavolinave t\u00eb num\u00ebrimit;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>duke sjell\u00eb n\u00eb v\u00ebmendje se subjektet e autorizuara si v\u00ebzhgues n\u00eb proces, nuk ndalohen t\u00eb b\u00ebjn\u00eb filmime ambientale brenda VNV-ve, n\u00eb raport me ato q\u00eb mund t\u00eb konsiderohen shkelje t\u00eb t\u00eb dh\u00ebnave personale t\u00eb individ\u00ebve t\u00eb pranish\u00ebm.&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p>Madje k\u00ebto filmime mund t\u00eb b\u00ebhen n\u00eb t\u00ebr\u00eb VNV-t\u00eb, prej tyre e t\u00eb p\u00ebrdoren prej tyre sipas nevojave, sikurse ka ndodhur.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kjo <em>de facto<\/em> e zhb\u00ebn totalisht q\u00ebllimin e aktit p\u00ebr t\u00eb siguruar t\u00eb dh\u00ebnat personale.&nbsp;&nbsp;<\/p>\n\n\n\n<p>P\u00ebr m\u00eb tep\u00ebr q\u00eb n\u00eb \u00e7do rast, sipas gjykimit t\u00eb KRIIK, <strong>ky detyrim \u00ebsht\u00eb minor p\u00ebrpara detyrimeve t\u00eb tjera primare q\u00eb vendos kushtetuta e q\u00eb lidhen me themelin e sistemit juridik e t\u00eb sigurimit t\u00eb vullnetit t\u00eb sovranit n\u00eb procesin shtetformues<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>gjykon se kufizimi i parashikuar n\u00eb pik\u00ebn 6 t\u00eb aktit duhet t\u00eb hiqet.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Gjith\u00ebsesi, KRIIK,<strong> mb\u00ebshtet qasjen se kjo problematik\u00eb duhet t\u00eb rregullohet p\u00ebr t\u00eb siguruar jo vet\u00ebm respektimin e legjislacionit p\u00ebr t\u00eb dh\u00ebnat personale , por edhe p\u00ebr t\u00eb siguruar q\u00eb t\u00eb mos keqp\u00ebrdoren k\u00ebto t\u00eb drejta p\u00ebr t\u00eb krijuar ng\u00ebr\u00e7<\/strong><strong>e<\/strong><strong> institucionale <\/strong><strong>t\u00eb paq\u00ebna <\/strong><strong>apo c\u00ebnuar transparenc\u00ebn q\u00eb duhet t\u00eb sigurohet p\u00ebrgjat\u00eb t\u00eb gjith\u00eb procesit zgjedhor.<\/strong>&nbsp;<\/p>\n\n\n\n<p>Ndaj p\u00ebr t\u00eb evituar \u00e7do pretendim t\u00eb individ\u00ebve prezent\u00eb n\u00eb VNV, lidhur me keqp\u00ebrdorimin e mundsh\u00ebm t\u00eb t\u00eb dh\u00ebnave t\u00eb tyre personale, do t\u00eb ishte me vend q\u00eb <strong>t\u00eb parashikohet n\u00eb akt njoftimi i tyre n\u00ebp\u00ebrmjet vendosjes s\u00eb tabelave informuese n\u00eb VNV<\/strong>, se ambienti \u00ebsht\u00eb i monitoruar nga kamerat, si dhe filmimet jan\u00eb me rezolucion t\u00eb lart\u00eb, ruhen e shp\u00ebrndahen me pal\u00eb t\u00eb treta ose\/edhe me institucione ligjzbatuese, n\u00eb rast k\u00ebrkese prej tyre.&nbsp;&nbsp;<\/p>\n\n\n\n<p>N\u00eb funksion t\u00eb sa m\u00eb sip\u00ebr, duke mbajtur n\u00eb v\u00ebmendje se, sipas p\u00ebrcaktimeve ligjore, personat prezent\u00eb n\u00eb VNV gjat\u00eb num\u00ebrimit t\u00eb votave duhet t\u00eb jen\u00eb t\u00eb akredituar, do t\u00eb ishte e udh\u00ebs dhe q\u00eb, <strong>n\u00eb momentin e akreditimit ata t\u00eb <\/strong><strong>informohen dhe japin <\/strong><strong>p\u00eblqimin p\u00ebr shp\u00ebrndarjen e mundshme t\u00eb t\u00eb dh\u00ebnave t\u00eb tyre personale, t\u00eb cilat mund t\u00eb jen\u00eb t\u00eb identifikueshme n\u00eb video-regjistrimet e VNV-ve<\/strong> me subjektet q\u00eb mund t\u00eb k\u00ebrkojn\u00eb k\u00ebto regjistrime.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kjo hallk\u00eb duhet t\u00eb parashikohet edhe n\u00eb vendimmarrjen e Komisionerit lidhur me projektvendimet p\u00ebr akreditimin e v\u00ebzhguesve. (<em>shih <\/em><em>pik\u00ebn 2 <\/em><em>m\u00eb posht\u00eb<\/em>).&nbsp;<\/p>\n\n\n\n<p>Gjithashtu , vlen t\u00eb theksohet se <strong>n\u00eb autorizimin e dh\u00ebn\u00eb subjekteve<\/strong> q\u00eb shprehin interesin e tyre p\u00ebr t\u2019i patur regjistrimet, <strong>t\u00eb p\u00ebrcaktohen detyrimet dhe p\u00ebrgjegj\u00ebsit\u00eb ligjore p\u00ebrkat\u00ebse<\/strong>, se k\u00ebto regjistrime do t\u00eb p\u00ebrdoren vet\u00ebm p\u00ebr informim dhe interes t\u00eb ligjsh\u00ebm t\u00eb tyre, dhe, si materiale q\u00eb mund t\u00eb p\u00ebrmbajn\u00eb t\u00eb dh\u00ebna personale, ata nuk duhet t\u00eb b\u00ebjn\u00eb n\u00eb asnj\u00eb rast t\u00eb b\u00ebjn\u00eb publikimin e tyre apo shp\u00ebrndarjen e tyre tek t\u00eb tret\u00eb.&nbsp;<\/p>\n\n\n\n<p><strong>2. Lidhur me projekt vendimin \u201c<\/strong><strong><em>P\u00ebr procedurat e akreditimit dhe rregullat e v\u00ebzhgimit t\u00eb zgjedhjeve nga organizatat joqeveritare shqiptare dhe t\u00eb huaja, organizatat nd\u00ebrkomb\u00ebtare, p\u00ebrfaq\u00ebsues t\u00eb shteteve t\u00eb huaja dhe mediave<\/em><\/strong><strong>\u201d<\/strong>&nbsp;<\/p>\n\n\n\n<p>N\u00eb vijim t\u00eb argumentimit t\u00eb b\u00ebr\u00eb m\u00eb sip\u00ebr, t\u00eb sigurimit t\u00eb parimit t\u00eb ligjshm\u00ebris\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e rregullimit t\u00eb s\u00eb drejt\u00ebs p\u00ebr t\u00eb v\u00ebzhguar pa penges\u00eb t\u00eb gjitha aspektet e p\u00ebrgatitjes dhe zhvillimit t\u00eb zgjedhjeve, si dhe t\u00eb shmangies s\u00eb situatave q\u00eb mund t\u00eb krijohen apo nxiten p\u00ebr t\u00eb krijuar ng\u00ebr\u00e7e n\u00eb procesin e sigurimit t\u00eb transparenc\u00ebs dhe besimit ndaj ecuris\u00eb s\u00eb t\u00ebr\u00eb procesit zgjedhor,&nbsp;&nbsp;<\/p>\n\n\n\n<p>KRIIK gjykon se \u00ebsht\u00eb e nevojshme q\u00eb v\u00ebzhguesit:&nbsp;<\/p>\n\n\n\n<p>a) <strong>s\u00eb pari, t\u00eb vihen n\u00eb dijeni se ambientet, ku ata do t\u00eb ushtrojn\u00eb misionin e tyre (QV, VNV), jan\u00eb t\u00eb survejuara me kamera 360\u00ba t\u00eb cilat regjistrojn\u00eb<\/strong> n\u00eb m\u00ebnyr\u00eb t\u00eb pand\u00ebrprer\u00eb dhe gjat\u00eb t\u00eb cilit mund t\u00eb regjistrohen element\u00eb q\u00eb mund t\u00eb p\u00ebrb\u00ebjn\u00eb t\u00eb dh\u00ebna t\u00eb tyre personale. Regjistrime k\u00ebto t\u00eb cilat do t\u00eb ruhen p\u00ebr nj\u00eb afat 10 vje\u00e7ar dhe mund t\u00eb p\u00ebrdoren p\u00ebr efekt t\u00eb verifikimeve q\u00eb mund t\u00eb b\u00ebjn\u00eb subjektet zgjedhore dhe kandidat\u00ebt, v\u00ebzhguesit dhe organet ligjzbatuese, apo q\u00eb edhe mund t\u00eb publikohen eventualisht n\u00eb rast t\u00eb ngjarjeve problematike;&nbsp;<\/p>\n\n\n\n<p>b) <strong>s\u00eb dyti, t\u00eb shprehin dakord\u00ebsin\u00eb e tyre dhe japin p\u00eblqimin paraprakisht, edhe n\u00eb rast t\u00eb filmimit t\u00eb mundsh\u00ebm t\u00eb t\u00eb dh\u00ebnave t\u00eb tyre personale<\/strong>, p\u00ebr p\u00ebrdorimin e regjistrimeve n\u00eb funksion t\u00eb verifikimeve q\u00eb mund t\u00eb b\u00ebjn\u00eb subjektet zgjedhore dhe kandidat\u00ebt, v\u00ebzhguesit dhe organet ligjzbatuese, apo edhe p\u00ebr publikimin eventualisht t\u00eb tyre n\u00eb rast t\u00eb ngjarjeve problematike.&nbsp;<\/p>\n\n\n\n<p>P\u00ebr k\u00ebt\u00eb propozohet q\u00eb <strong>KQZ-ja t\u00eb hartoj\u00eb dhe miratoj\u00eb nj\u00eb deklarat\u00eb shtes\u00eb me p\u00ebrmbajtje informimin dhe dh\u00ebnien e dakord\u00ebsis\u00eb paraprake prej v\u00ebzhguesit, e cila duhet t\u00eb firmoset prej tij<\/strong>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Kjo deklarat\u00eb e vezhguesit duhet t\u00eb jet\u00eb pjes\u00eb e dokumentacionit t\u00eb nevojsh\u00ebm q\u00eb paraqitet p\u00ebr tu akredituar nga ana e subjekteve t\u00eb parashikuara nga ligji.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>3. Lidhur me afatet e parashikuara n\u00eb Vendimin nr. 9 dat\u00eb 24.12.2020 t\u00eb Komisionit Rregullator, lidhur me raportimin e veprimtarive t\u00eb institucioneve publike.<\/strong>&nbsp;<\/p>\n\n\n\n<p>KRIIK ka filluar tashm\u00eb procesin e monitorimit t\u00eb sjelljes s\u00eb institucioneve publike, si dhe p\u00ebrdorimin e burimeve shtet\u00ebrore n\u00eb fushat\u00eb elektorale, procese p\u00ebr t\u00eb cilat \u00ebsht\u00eb mbajtur nj\u00eb komunikim i vazhduesh\u00ebm me KQZ-n\u00eb.\u202f&nbsp;&nbsp;<\/p>\n\n\n\n<p>P\u00ebrpos element\u00ebve q\u00eb KRIIK i konsideron me shum\u00eb r\u00ebnd\u00ebsi p\u00ebr t\u2019u adresuar dhe p\u00ebrfshir\u00eb n\u00eb Vendimin nr. 9 t\u00eb Komisionit Rregullator, t\u00eb p\u00ebrcjella n\u00eb KQZ n\u00ebp\u00ebrmjet <a href=\"https:\/\/kriik.al\/home\/wp-content\/uploads\/2023\/01\/KRIIK-Propozime-per-reflektime-te-kuadrit-ligjor-nga-KQZ.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Dokumentit me Rekomandime p\u00ebr p\u00ebrmir\u00ebsimin e kuadrit rregullator ligjor p\u00ebr zgjedhet vendore 2023<\/a> , nj\u00eb element tjet\u00ebr i parashikuar n\u00eb k\u00ebt\u00eb Vendim dhe q\u00eb ka nevoj\u00eb p\u00ebr qart\u00ebsim jan\u00eb afatet lidhur me raportimin e institucioneve dhe ndalimin q\u00eb mund t\u00eb b\u00ebj\u00eb KQZ-ja.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Konkretisht, neni 4 pika 4 e vendimit nr. 9 parashikon se \u201c<em>raportimi n\u00eb nd\u00ebrfaqe duhet t\u00eb kryhet jo m\u00eb von\u00eb se <\/em><em>5 dit\u00eb p\u00ebrpara afatit t\u00eb planifikuar<\/em><em> p\u00ebr zhvillimin e veprimtaris\u00eb ose aktivitetit publik<\/em>\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Edhe n\u00eb pik\u00ebn 2 t\u00eb nenit 9 caktohen afatet e kontrollit, paraqitjes s\u00eb k\u00ebrkesave nga t\u00eb tret\u00eb dhe ndalimit t\u00eb zhvillimit t\u00eb aktivitetit: \u201c<em>Personat e tret\u00eb q\u00eb paraqesin k\u00ebrkes\u00eb tek Komisioneri Shtet\u00ebror i Zgjedhjeve p\u00ebr t\u00eb k\u00ebrkuar ndalimin e nj\u00eb veprimtarie publike, duhet ta paraqesin <\/em><em>jo m\u00eb von\u00eb se tre dit\u00eb nga data e planifikuar<\/em><em> e mbajtjes s\u00eb saj.&nbsp;<\/em>&nbsp;<\/p>\n\n\n\n<p><em>[&#8230;] Komisioneri b\u00ebn shqyrtimin administrativ t\u00eb k\u00ebrkes\u00ebs dhe vendos n\u00eb lidhje m\u00eb t\u00eb jo m\u00eb von\u00eb se dy dit\u00eb para zhvillimit t\u00eb veprimtaris\u00eb<\/em>\u201d.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Pra n\u00ebse i referohemi afateteve t\u00eb raportimit ato llogariten me dit\u00eb kalendarike, nd\u00ebrkoh\u00eb q\u00eb n\u00eb pjes\u00ebn e kontrollit dhe ndalimit k\u00ebto afate nevojiten t\u00eb konsiderohen me dit\u00eb pune, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb b\u00ebhet i mundur shqyrtimi administrativ dhe vendimmarrja e Komisionerit.&nbsp;<\/p>\n\n\n\n<p>Duke qen\u00eb afate shum\u00eb t\u00eb ngushta, koha n\u00eb dispozicion t\u00eb KQZ-s\u00eb p\u00ebr t\u00eb shqyrtuar e verifikuar rastin \u00ebsht\u00eb mjaft e limituar, madje potencialisht edhe e pamundur t\u00eb nd\u00ebrmerret.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Konkretisht, n\u00eb rastin e dit\u00ebve t\u00eb pushimit apo t\u00eb festave zyrtare, b\u00ebhet gati e pamundur vendimmarrja e KQZ-s\u00eb p\u00ebr shkak se dita e pun\u00ebs, n\u00eb t\u00eb cil\u00ebn duhet b\u00ebr\u00eb shqyrtimi administrativ dhe duhet marr\u00eb vendim p\u00ebr ndalimin e mundsh\u00ebm t\u00eb nj\u00eb veprimtarie, mund t\u00eb bjer\u00eb n\u00eb dit\u00ebn kur veprimtaria zhvillohet apo pasi ajo \u00ebsht\u00eb zhvilluar, duke b\u00ebr\u00eb k\u00ebshtu nul mekanizmin parandalues.&nbsp;<\/p>\n\n\n\n<p>N\u00eb <a p\u00ebrllogaritur afatet e raportimit prej institucioneve si dit\u00eb kalendarike.&nbsp;<\/p>\n\n\n\n<p>Nevojitet q\u00eb KQZ <strong>t\u00eb sakt\u00ebsoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb detajuar p\u00ebrllogaritjen e afateve dhe unfikimin n\u00eb parashikim t\u00eb tyre<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Lidhur me gjith\u00eb sa m\u00eb sip\u00ebr, p\u00ebr t\u00eb siguruar nj\u00eb tablo sa m\u00eb t\u00eb qart\u00eb dhe b\u00ebr\u00eb funksional mekanizmin parandalues t\u00eb parashikuara nga ligji, KRIIK sugjeron se:&nbsp;<\/p>\n\n\n\n<p>a) <strong>nevojitet q\u00eb t\u00ebr\u00eb afatet t\u00eb llogariten me dit\u00eb pune<\/strong>, pasi qoft\u00eb institucionet qoft\u00eb KQZ-ja ushtrojn\u00eb veprimtarin\u00eb e tyre n\u00eb dit\u00ebt zyrtare t\u00eb pun\u00ebs.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Gjithashtu, p\u00ebr efekt t\u00eb pasjes s\u00eb koh\u00ebs s\u00eb nevojshme n\u00eb dispozicion, p\u00ebr t\u00eb b\u00ebr\u00eb shqyrtimin administrativ t\u00eb \u00e7\u00ebshtjes apo edhe verifikimet e nevojshme, afati 5 ditor i dit\u00ebve t\u00eb pun\u00ebs p\u00ebr deklarimin e veprimtaris\u00eb nevojitet t\u00eb jet\u00eb i plot\u00eb,
