Pavar\u00ebsisht problematikave t\u00eb v\u00ebrejtura n\u00eb funksionimin e deritanish\u00ebm t\u00eb k\u00ebtij mekanizmi, ai mbetet nj\u00eb hallk\u00eb e procesit q\u00eb duhet t\u00eb forcohet m\u00eb tej n\u00ebp\u00ebrmjet amendimeve ligjore.<\/p>\n\n\n\n<p>N\u00eb kushtet aktuale, paraqitet nevoja q\u00eb ky mekaniz\u00ebm t\u00eb mund t\u00eb p\u00ebrmir\u00ebsohet n\u00ebn kuadrin ligjor ekzistues, p\u00ebr t\u00eb maksimizuar p\u00ebrfitimet nga puna n\u00eb terren e monitoruesve n\u00ebp\u00ebrmjet zbatimit dhe p\u00ebrmbushjes sa m\u00eb t\u00eb plot\u00eb t\u00eb detyrimeve ligjore t\u00eb parashikuara, t\u00eb cilat t\u00eb mund t\u00eb sh\u00ebrbejn\u00eb edhe si hallka e par\u00eb monitoruese, pas s\u00eb cil\u00ebs ngrihet m\u00eb pas e gjith\u00eb piramida e kontrollit prej KQZ-s\u00eb.<\/p>\n\n\n\n<p>Ky mekaniz\u00ebm kontrolli, sikurse \u00ebsht\u00eb parashikuar aktualisht n\u00eb ligj, gjykohet prej KRIIK si tejet i r\u00ebnd\u00ebsish\u00ebm, jo vet\u00ebm gjat\u00eb periudh\u00ebs parazgjedhore, me q\u00ebllim rritjen e transparenc\u00ebs p\u00ebr zgjedh\u00ebsit, por edhe pas saj, duke qen\u00eb q\u00eb gjetjet e monitoruesve mund t\u00eb sh\u00ebrbejn\u00eb edhe si informacion shtes\u00eb p\u00ebr KQZ-n\u00eb p\u00ebr evidentimin e sakt\u00ebsis\u00eb s\u00eb raportimit financiar t\u00eb fushat\u00ebs nga vet\u00eb subjektet zgjedhore.<\/p>\n\n\n\n<p>Duke vler\u00ebsuar s\u00ebrish praktik\u00ebn e KQZ-s\u00eb lidhur me konsultimin paraprak t\u00eb akteve n\u00ebnligjore me aktor\u00eb t\u00eb interesuar, lutemi gjeni m\u00eb posht\u00eb disa rekomandime t\u00eb KRIIK lidhur me Projekt-udh\u00ebzimin \u201c<em>P\u00ebr p\u00ebrcaktimin e kritereve p\u00ebr p\u00ebrzgjedhjen e monitoruesve n\u00eb zgjedhje dhe procedur\u00ebn e em\u00ebrimit t\u00eb tyre<\/em>.\u201d<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li><em>Lidhur me procedur\u00ebn e em\u00ebrimit t\u00eb monitoruesve<\/em>:<\/li><\/ol>\n\n\n\n<p>1.1. KRIIK vler\u00ebson se <strong>mekanizmi i testimit me shkrim t\u00eb monitoruesve, n\u00eb funksion t\u00eb garancis\u00eb p\u00ebr cil\u00ebsin\u00eb e gjetjeve t\u00eb tyre \u00ebsht\u00eb i nevojsh\u00ebm<\/strong> (sikurse ka qen\u00eb parashikuar n\u00eb Udh\u00ebzimin nr. 1 dat\u00eb 02.02.2021 t\u00eb Komisionerit Shtet\u00ebror t\u00eb Zgjedhjeve).<\/p>\n\n\n\n<p>KRIIK sjell n\u00eb v\u00ebmendje se gjetjet e monitoruesve mund t\u00eb p\u00ebrb\u00ebjn\u00eb indikacionin fillestar p\u00ebr shkelje t\u00eb mundshme, \u00e7ka mund t\u00eb shpjer\u00eb n\u00eb sanksionim t\u00eb nj\u00eb subjekti zgjedhor. P\u00ebr rrjedhoj\u00eb KQZ duhet t\u00eb ket\u00eb garancit\u00eb m\u00eb t\u00eb larta t\u00eb mundshme q\u00eb njohurit\u00eb e tyre t\u00eb jen\u00eb t\u00eb nivelit t\u00eb k\u00ebrkuar.<\/p>\n\n\n\n<p>P\u00ebr m\u00eb tep\u00ebr, monitoruesit certifikohen nga KQZ, ndaj p\u00ebr nj\u00eb certifikim sa m\u00eb solid procesi duhet t\u00eb ket\u00eb n\u00eb vetvete p\u00ebrve\u00e7 trajnimit dhe eksperienc\u00ebs, edhe testimin e njohurive dhe t\u00eb zot\u00ebrimit t\u00eb p\u00ebrmbajtjes s\u00eb formateve t\u00eb raportimit.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><em>Lidhur me objektin e pun\u00ebs dhe modalitetet e monitorimit nga monitoruesit<\/em>:<\/li><\/ul>\n\n\n\n<p>2.1. Baza ligjore e p\u00ebrcaktuar p\u00ebr pun\u00ebn e monitoruesve \u00ebsht\u00eb pjesa VII, Kreu I i Kodit Zgjedhor, i cili p\u00ebrmban p\u00ebrcaktime lidhur me Financimin e Zgjedhjeve, si dhe aktet e tjera n\u00ebnligjore.<\/p>\n\n\n\n<p>Pavar\u00ebsisht se p\u00ebrfshirja e fraz\u00ebs \u201caktet e tjera n\u00ebnligjore\u201d prezumohet t\u00eb jet\u00eb gjith\u00ebp\u00ebrfshir\u00ebse, n\u00eb gjykimin e KRIIK <strong>duhet t\u00eb specifikohen se cilat jan\u00eb aktet e tjera n\u00ebnligjore ku do t\u00eb bazohet puna e monitoruesve<\/strong>, ose t\u00eb pakt\u00ebn e akteve kryesore mbi t\u00eb cilat do t\u00eb zhvillohet nj\u00eb pjes\u00eb e mir\u00eb e p\u00ebrmbushjes s\u00eb misionit t\u00eb monitoruesve, sikurse \u00ebsht\u00eb vendimi nr. 9 dat\u00eb 24.12.2020 i Komisionit Rregullator t\u00eb KQZ-s\u00eb, apo edhe akte t\u00eb tjera<\/p>\n\n\n\n<p>2.2. N\u00eb udh\u00ebzim dhe format e raportimit t\u00eb nd\u00ebrmjet\u00ebm dhe final t\u00eb monitoruesve duhet t\u00eb <strong>parashikohet detyrimi p\u00ebr nj\u00eb raportim t\u00eb p\u00ebrmbledhur t\u00eb pun\u00ebs ditore t\u00eb secilit monitorues n\u00eb terren, p\u00ebrpos gjetjeve nga procesi i monitorimit.<\/strong><\/p>\n\n\n\n<p>Pavar\u00ebsisht se me nj\u00eb k\u00ebqyrje t\u00eb raportit p\u00ebrkat\u00ebs KQZ-ja mund t\u00eb marr\u00eb nj\u00eb informacion t\u00eb p\u00ebrgjithsh\u00ebm lidhur me aktivitetin e monitoruesve, kjo duhet t\u00eb b\u00ebhet detyrim p\u00ebr monitoruesit, duke vendosur, por pa e kufizuar, pikat ku duhet t\u00eb bazohet puna e p\u00ebrditshme e tyre n\u00eb terren.<\/p>\n\n\n\n<p>N\u00ebp\u00ebrmjet k\u00ebtij mekanizmi gjykojm\u00eb se jo vet\u00ebm do t\u00eb rritet p\u00ebrgjegjshm\u00ebria e monitoruesve p\u00ebr t\u00eb p\u00ebrmbushur sa m\u00eb mir\u00eb detyr\u00ebn e tyre, por edhe KQZ-ja do t\u00eb ket\u00eb mund\u00ebsi t\u00eb kontrolloj\u00eb pun\u00ebn dhe p\u00ebrpjekjet e b\u00ebra prej tyre.<\/p>\n\n\n\n<p>Kjo do t\u00eb mund\u00ebsoj\u00eb q\u00eb puna e monitoruesve t\u00eb mos limitohet thjesht dhe vet\u00ebm me plot\u00ebsimin e raporteve, pa patur mund\u00ebsi t\u00eb gjykohet n\u00ebse p\u00ebrmbajtja e raportuar \u00ebsht\u00eb gjendja faktike e monitoruar apo vullnet i monitoruesit p\u00ebr t\u00eb raportuar apo jo mbi nj\u00eb aspekt t\u00eb caktuar t\u00eb monitorimit. Sjellim n\u00eb v\u00ebmendje gjithashtu se evaziviteti n\u00eb raportim ishte nj\u00eb nd\u00ebr t\u00eb metat e p\u00ebrmbajtjes s\u00eb raportimeve t\u00eb kryera nga monitoruesit n\u00eb zgjedhjet e shkuara.<\/p>\n\n\n\n<p>P\u00ebrpos sa m\u00eb sip\u00ebr, gjykohet se ky element nxit monitoruesit p\u00ebr nj\u00eb qasje m\u00eb proaktive n\u00eb monitorimin q\u00eb duhet t\u00eb kryejn\u00eb, e ve\u00e7an\u00ebrisht n\u00eb k\u00ebrkesat p\u00ebr transparenc\u00eb e llogaridh\u00ebnie kundrejt subjekteve zgjedhore, duke nd\u00ebrgjegj\u00ebsuar edhe k\u00ebto t\u00eb fundit lidhur me detyrimin p\u00ebr respektimin e zbatimin e ligjit.<\/p>\n\n\n\n<p>2.3. Duke patur n\u00eb konsiderat\u00eb zhvendosjen dhe kryerjen gjithmon\u00eb e m\u00eb shum\u00eb t\u00eb fushat\u00ebs elektorale n\u00eb media, gjykohet se <strong>monitorimi i mediave, mediave sociale dhe shtypit lokal, jan\u00eb element\u00eb q\u00eb duhet t\u00eb parashikohen n\u00eb m\u00ebnyr\u00eb m\u00eb t\u00eb plot\u00eb n\u00eb modalitetet e monitorimit t\u00eb monitoruesve<\/strong>. Sa m\u00eb sip\u00ebr n\u00ebnkupton q\u00eb t\u00eb detajohet se cilat jan\u00eb mediat q\u00eb kan\u00eb detyrim t\u00eb monitorojn\u00eb monitoruesit, duke theksuar n\u00eb m\u00ebnyr\u00eb t\u00eb ve\u00e7ant\u00eb mediat sociale, t\u00eb cilat jan\u00eb nj\u00eb nga kanalet kryesore t\u00eb komunikimit.&nbsp;&nbsp; Nga ana tjet\u00ebr duke patur n\u00eb konsiderat\u00eb kufizimet e AMA-s p\u00ebr monitorimin e pand\u00ebrprer\u00eb t\u00eb mediave lokale, ky mekaniz\u00ebm do t\u00eb ndihmoj\u00eb p\u00ebr disiplinimin sadopak dhe sjelljen e k\u00ebtyre t\u00eb fundit konform kuadrit rregullator ligjor.<\/p>\n\n\n\n<p>P\u00ebrve\u00e7 k\u00ebsaj, udh\u00ebzimi do t\u00eb duhet t\u00eb p\u00ebrcaktoj\u00eb se monitorimi i mediave p\u00ebrdoret si p\u00ebr aktivitetet institucionale ashtu edhe p\u00ebr aktivitetet elektorale t\u00eb subjekteve zgjedhore.
